Nov 20 Jamestown (CSi) – Interstate Engineering advises residents and motorists that a section of 3rd Street SE, near the railroad tracks, will close on Wednesday, November 20, 2013. 3rd Street SE will be closed from 11th Ave SE to Railroad Drive E. A detour will be in place on Railroad Drive E and 7th Ave SE.
This closure and detour are anticipated to be in place for up to two days. Updates will be posted online at jamestownsewerproject.com.
A reminder, the intersection of 1st Street SW and 3rd Avenue SW, near Renaissance Recycling, is closed for construction. A detour is in place and access will be provided for area businesses during this time.
To enter CSi, customers are reminded to go west on 2nd St SW to 4th Ave SW, go north 1/2 block and enter the CSi parking lot from the west.
With the closing of the 1st Street intersection, the detour to access west of the river is via 2nd Street to 4th Ave, up to 1st Street to use the 1st Street bridge. 2nd St SW bridge will remain closed for 3 more weeks or longer while lift station work is being done.

Jamestown, ND (CSi) — The Jamestown City Council met Tuesday afternoon at City Hall, at 3-p.m. Council Member Gumke was not present.
The City Council considered two items.
First Council Members reviewed the City of Jamestown and Stutsman Rural Water District agreement to provide water to the Great River Energy plant, at Spiritwood.
City Attorney Ken Dalsted said, the city has concerns of meter access by the city for readings and maintenance.
GRE’s Al Christianson said both the City and Rural Water would have equal access.
Other items such as water tower maintenance and other issues were brought up.
Christianson said GRE will be able resolve issues of concern.
Following additional concerns of Dalsted and City Council Member Dan Buchanan,
that were addressed the City Council voted to approve the contract.
Next the City Council voted to table authorizing entering into an agreement with Interstate Engineering, for miscellaneous improvements to the water distribution system, pending specific fee structure numbers instead of just percentages.
The item will then come before the December 2, 2013 City Council meeting for final approval.

Jamestown (CSi) — The Jamestown City Council’s committees met in combined session on Tuesday (Nov 19, 2013) at City Hall.
With Finance and Legal Committee business:
The committee recommended approving the request from the North Dakota Trade Office for $25,000 in Economic Development Funds to match dues from local companies with the City Share to be $20,000 and paid from the City Sales Tax Fund.
Recommended approving the offer from Koste (Coast) Materials, LLC, to purchase Lots 1, 2 & 3 in the JSDC Ag Food Processing Industrial Park, in the amount of $262,500.
Recommended for disapproval, the offer from Ambassador Steel Corporation to purchase Lot 4 in the JSDC Ag Food Processing Industrial Park, in the amount of $81,375…$7,500 per acre..approved Tuesday by the Stutsman County Commission. A grant of $175,000 may also be applied for.
The committee recommended for approval the offer from Kevin Thoele, Buffalo City Diesel, to purchase Lot 6, Block 4 in the I-94 Business Park, in the amount of $69,260.
Recommended approval of the offer from Shaw Development Group to purchase Lot 8, Block 1 in the I-94 Business Park, at $1 per acre, in the amount of $68,171.
(proposed motel). Former Mayor Clarice Liechty appeared and opposed the approval, based on the sale below market value, and a competing business, and not a primary sector business. (The JSDC Board of Directors, and Stutsman County Commission has approved the offer).
The committee recommended approving the sale of the JSDC Condos # 2 & #3 on the second floor of Buffalo City Grille, in the amounts of $150,000 and $145,000.
Recommends approval of an SRF Consulting Change Order, in the amount of $13,839, for performing out of scope services and to authorize the use of Economic Development Funds with the City Share to be $11,071.20 and paid from the City Sales Tax Fund.
Considered the request from Metro Plains for the City Council to consider the inclusion of Block 42, Original Addition, to the City of Jamestown into the Renaissance Zone. Representative Erin Anderson says Metro Plains is seeking state, funding from the North Dakota Housing Finance Agency to construct 24 units of affordable senior housing, at the former Essentia Clinic location in downtown Jamestown, and parking lot. She said an agreement has been reached with Essentia officials for the purchase. The James River Library System has been looking at the site for a new library.
The committee recommends to approve the request for inclusion to the Renaissance Zone.
Considered the request of Ray Hammer to purchase (subject to North Dakota Historical Society Approval) the East 95’ of the South 50’ of Lot 12, Block 1, Homestead III Addition, in the amount of $3,000. The committee voted to recommend approval contingent upon approval of the State Historical Society.
The committee recommends approval of Water, Sewer, Sanitation and Solid Waste rates effective January 1, 2014, per the 2014 Budget.
Considered the extension of the agreement to Jointly Operate the Stutsman County
Communications Center. The agreement would cover an additional dispatcher while two new dispatchers are trained, under the changes in the dispatch center, expected until July 2014. The extension until July of 2014, was recommended for approval.
Norm Aldinger appeared concerning the erection of an Otter Tail Power Company electrical pole and structure on 12th Avenue NE, and its removal. Mayor Andersen says the city has limited authority to provide a solution, based on the franchise agreement with Otter Tail Power Company.
The committee move the item to the December City Council meeting without recommendations.
Monthly departmental reports were presented.
The committee noted, the First Reading of an Ordinance to amend and reenact Chapter 26 of the City Code pertaining to taxicab licenses and taxicab driver’s licenses.

Building, Planning & Zoning Committee:
The committee recommends sending to the City Council without recommendation approving the recommendation from the Planning Commission to fund formal planning and development services for calendar year 2014 either by contract or position for at least what was budgeted for this year which was $35,000.
Forestry
Discussion was held about the Partners In Planting Program.
City Forester Doug Wiles talked about a program to plant trees on city boulevards, through donations, without cost to the city. A funding program for the property owners will be developed, based on a formula. Wiles will inspect the plantings to make sure the trees are located in the proper spot.
The committee recommends implementing the program.
Public Works Committee:
Discussion was held about conflicts with existing private utilities relating to the Wastewater & Lift Station Replacement & Force main Improvements Project Phase II – Force Main and Gravity Sewer project. David Swofford with Sellin Brothers contractors gave an update on problems encountered including utilities that had to be moved, unknown at the start of the project. Sellin says an additional $65,000 is being asked from the city for the extra work.
City Attorney Ken Dalsted recommends that topic be tabled, until he does more research on legal recourse on behalf of the city.
The balance of the committees agenda items were delayed until a meeting later this week or early next week, when the committees will reconvene.

Jamestown (CSi) Fairgoers should mark their 2014 calendars with an earlier date for the Stutsman County Fair…it will be held one week earlier for at least the next five years. The Stutsman County Fair is scheduled July 2-5 this summer.
The Fair Board has now contracted with a different carnival for more rides.
Stutsman County Fair Board President Mike Williams says the fair has entered a five-year contract with Murphy Bros. Exposition, which will move the fair to the first week of July, guaranteeing 25 rides.
Murphy Bros. provided rides to the Stutsman County Fair from the 1960s through the ’80s or ’90s,
The Mighty Thomas Carnival, which has served the Stutsman County Fair for about 10 years, provided about 15 to 17 rides.
The fair board switched to the Mighty Thomas Carnival about 10 years ago when Murphy Bros. couldn’t come to the Stutsman County Fair because of a scheduling conflict with the Red River Valley Fair in Fargo.
Williams pointed out that having the Stutsman County Fair during Fourth of July week will also put it around the same time as White Cloud’s Birthday/Tatanka Festival.
Buffalo City Tourism Director, Searle Swedlund, says having the Stutsman County Fair, Tatanka Festival and Fourth of July events all in the same week will provide “a bigger experience for visitors to Jamestown.”
The Stutsman County Fair is scheduled July 1-4 in 2015, June 29-July 2 in 2016, June 28-July 1 in 2017 and July 4-7 in 2018.
MINOT, N.D. (AP) – North Dakota homeowners who were flooded two years ago are seeking about $3.6 million in loans from a state program that began taking applications Oct. 1.
The Bank of North Dakota reports it has received 182 applications in the Supplemental Rebuilders Loan Program, which offers low-interest loans of up to $20,000 to homeowners who previously received loans from the original Rebuilders Loan Fund. The original loan limit was $30,000.
Homeowners who received the original loans have until Dec. 31 to apply for a supplemental loan. To be eligible, homeowners must be living in their residences that were damaged by Souris River and Missouri River flooding in 2011 in Barnes, Benson, Burleigh, McHenry, Morton, Ramsey, Renville, Richland or Ward counties.
Carrington (CSi) —The Foster County Commission has accepted the resignation of the county auditor on a split vote.
Foster County Commission Chariman, James Carr, was the lone dissenting vote on the motion to accept Schlotman’s resignation.
Roger Schlotman submitted his resignation on November 6, 2013 when he was charged with three counts of misapplication of entrusted property, two counts of conspiracy to commit misapplication of entrusted property and two counts of tampering with public records. The charges are Class C felonies.
Schlotman did not attend the meeting.
James Carr, faces two counts of conspiracy to commit misapplication of entrusted property, Class B and Class C felonies, and two counts of tampering with public records, Class A misdemeanors. Carr is accused of conspiring with Schlotman to transfer property in a manner not authorized by the county.
Charges against both, relate to an alleged shortfall of at least $13,000 in an account used to reimburse Federal Emergency Management Agency projects in Foster County, irregularities in the County Commission meeting minutes and a tax sale of a Carrington property that was not approved by the full commission.
The commission authorized Deputy Auditor Sarah Aberle to act as auditor until a temporary auditor can be named, to hold the position until the general election in 2014.
The County Commission authorized Paul Straley, vice chairman of the County Commission to begin exploring possible firms to conduct a forensic audit of the county’s financial records.
Straley will present information on firms willing to do a forensic audit during the December 3, 2013, Foster County Commission meeting.

LaMoure (CSi) – The North Dakota Department of Transportation has announced the beginning of utility work on Highway 13 near 7th Street in Southeast LaMoure.
During the project, motorists can expect temporary barricades placed across portions of the North Dakota Highway 13 Westbound lane. Traffic will still be able to travel, but speeds will be reduced.

GRAND FORKS, N.D. (AP) – Three sons of a northeastern North Dakota farmer convicted of terrorizing law officers two years ago are scheduled to stand trial beginning Jan. 21 in Grand Forks on similar charges.
Alex, Jacob and Thomas Brossart each would face up to five years in prison if convicted. Their father, Rodney, also could face five years when he’s sentenced Jan. 14. A jury convicted him earlier this month.
The Brossarts were arrested after a summer-long standoff in 2011 that began as a case of missing cattle. Authorities say family members refused to allow deputies on their farmstead and didn’t show up for court hearings. The case drew widespread attention because police used a military-style unmanned drone to conduct surveillance on the Brossart farm.
Prosecutors earlier dropped charges against Brossart’s wife and daughter.
GRAND FORKS, N.D. (AP) – Four people are awaiting extradition from Minnesota to North Dakota on charges connected with a burglary and fatal stabbing west of Grand Forks.
Grand Forks County Sheriff Robert Rost says 33-year-old Ruben Cisneros, of Grand Forks, was found early Sunday stabbed to death at a farm house.
Rost says the four suspects were later arrested in East Grand Forks, Minn., where they’ve been living in a motel.
Twenty-one-year-old Joe Ramon Saucedo is charged with felony murder and conspiracy to commit burglary.
The other three are charged with conspiracy to commit burglary: 23-year-old Thomas Begg, 24-year-old Vincent Gladue and 23-year-old Jennifer Blue.
Rost says Blue’s a former girlfriend of Cisneros.
FARGO, N.D. (AP) – A North Dakota man faces life in prison on child sex abuse charges.
Erick McKay, of Devils Lake, pleaded guilty Tuesday to two counts of abusive sexual contact.
The incidents occurred between April 2011 and June 2012 on the Spirit Lake Indian Reservation.
Authorities say the victim was a girl who was under 12 years old.
Sentencing for McKay is scheduled for Feb. 12.
FARGO, N.D. (AP) – A Gardner woman has been sentenced to 28 days in jail after pleading guilty to charges she stole money from her son’s developmentally disabled girlfriend. Tamera Porter pleaded guilty to two counts of felony exploitation of a vulnerable adult. Court documents say the son’s 18-year-old girlfriend has the intellectual capacity of a third-grader.
BISMARCK, N.D. (AP) – One of the nation’s most prominent white separatists is distancing himself from another white supremacist who faces terrorizing charges for allegedly threatening residents of the North Dakota town he’s trying to turn into an Aryan enclave.
Tom Metzger tells The Associated Press he is returning property in Leith that Craig Cobb deeded to him.
Metzger is a former grand wizard of the Ku Klux Klan and founder of the White Aryan Resistance. He says he likes Cobb but disagrees with his methods. He says Cobb is too controversial.
The 62-year-old Cobb and another man are accused of terrorizing people with guns over the weekend.
They said they were patrolling Leith because of violence and harassment directed at them. The two are being held in Stanton without bond.
BISMARCK, N.D. (AP) – The North Dakota Department of Mineral Resources, Oil & Gas Division says about 350 barrels of oil was released in McKenzie County but was contained.
Preliminary information from Zenergy Inc. indicates most of it has been recovered.
TRENTON, N.D. (AP) – The North Dakota Health Department says nearly all of a 500-barrel crude oil spill near Trenton has been recovered.
The agency says it happened at a rail transfer facility and 477 barrels were contained. About 20 barrels did reach the surface of the ground just outside a secondary containment structure.
Hiland Partners LP, which owns Hiland Crude LLC, reported the spill.
The Health Department says it has an inspector on the site to monitor the response and cleanup activities.
It says all of the released oil was contained within the company’s site and no water was contaminated.
EDMOND, Okla. (AP) – A North Dakota woman is preparing to be reunited with her dog that somehow wandered away – to Oklahoma.
Tina Bohn’s 8-year-old boxer Jasmine went missing two months ago from her Minot, N.D., home and Bohn says she thought the pooch was lost forever.
But Willy Fields with Free to Live Animal Sanctuary found the dog along a road in Logan County in central Oklahoma earlier this month and took her to a vet. A microchip listing Bohn’s information was discovered on Jasmine. Now, the dog is flying home to be reunited with Bohn.
Bohn thinks Jasmine was stolen and that’s how she ended up in Oklahoma.
BISMARCK, N.D. (AP) – Energy company ONEOK Partners says it will build its sixth and largest natural gas processing plant in western North Dakota.
The governor’s office says the Lonesome Creek plant will be built in McKenzie County and will be able to process 200 million cubic feet of natural gas daily.
The project will cost an estimated $550 million to $680 million. It’s expected to go online by the end of 2015.
Gov. Jack Dalrymple and ONEOK executives say the Oklahoma-based company also plans to invest another $100 million to increase the capacity of its 600-mile Bakken NGL Pipeline.
It transports unfractionated natural gas liquids from the Williston Basin to an interconnection in Colorado.
Including the new projects, ONEOK Partners will invest more than $3 billion in the Williston Basin through 2016.

FARGO, N.D. (AP) – Police are investigating the death of a former University of North Dakota hockey player and junior hockey league coach who was struck and killed in an industrial area of Fargo.
A train crew spotted the body of 43-year-old Chad Lewis Johnson, of Fargo. Police say they are waiting for a report from a medical examiner, but did not suspect foul play.
Johnson played in 95 games for UND from 1990 to 1993.
He was head coach of the Lincoln Stars of the United States Hockey League from 2010 to 2012. He resigned in September after telling team officials he wanted to return to Fargo to be closer to his family and address health issues.
Johnson was previously an assistant coach with the Fargo Force of the USHL.

MINNEAPOLIS (AP) – Andre Hollins helped Minnesota overcome a sluggish performance by scoring 19 points for the Gophers in an 82-72 victory over Coastal Carolina yesterday. Hollins shot 6 for 14 from the floor and chipped in five rebounds and four assists for Minnesota. The junior is averaging 21.8 points per game.

NEW YORK (AP) – The NBA has suspended Grizzlies guard Tony Allen one game without pay for kicking Los Angeles Clippers guard Chris Paul in the face.
Allen was given a flagrant 2 foul and ejected after his left leg caught Paul’s face with 1:51 left in the first quarter of Memphis’ 106-102 win over the Clippers on Monday. He will sit out the Grizzlies’ next game Wednesday night when Memphis visits Golden State.

MINNEAPOLIS (AP) – The Minnesota Twins have acquired left-hander Kris Johnson from the Pittsburgh Pirates for right-hander Duke Welker. Johnson went 0-2 with a 6.10 ERA in four appearances with the Pirates last season. Welker went 3-4 with a 3.57 ERA and nine saves in 48 appearances for Indianapolis last season.
DENVER – A person with knowledge of the situation says reliever LaTroy Hawkins has agreed to a one-year, $2.5 million deal with the Colorado Rockies.

UNDATED (AP) – The U.S. Golf Association and Royal & Ancient have announced a new decision that would not penalize a player whose ball moves at rest if the movement is only detected by enhanced pictures. It was the second time in the last two years that the USGA and Royal & Ancient have established new guidelines involving video. The new decision did not stem from Tiger Woods being penalized two shots in the BMW Championship in September.

BONNE TERRE, Mo. (AP) – It didn’t take long for the execution of a white supremacist serial killer in Missouri today after the Supreme Court denied a petition early today requesting a stay of execution. Joseph Paul Franklin targeted blacks and Jews in a cross-country killing spree from 1977 to 1980. He had two Missouri convictions and admitted wounding civil rights leader Vernon Jordan and Hustler magazine publisher Larry Flynt.
BAGHDAD (AP) – Iraqi officials say nearly 30 people have been killed today in the latest attacks targeting Shiite Muslims and busy commercial areas in and outside Baghdad. Another 104 people were wounded as insurgents kept up a campaign to thwart the Shiite-led government’s efforts to stabilize the country.
TEHRAN, Iran (AP) – Iran’s supreme leader says economic pressure won’t result in unwelcome nuclear concessions, but at the same time, Ayatollah Ali Khamenei says Iran has “no animosity”‘ toward the American people. Meanwhile, the French government spokeswoman says President Francois Hollande (frahn-SWAH’ oh-LAWND’) believes comments by Khamenei referring to Israel as “the rabid dog of the region” complicate nuclear talks.
ALBUQUERQUE, N.M. (AP) – A proposed local ban on late-term abortions in Albuquerque has been banished by voters in a closely watched, first-of-its kind municipal election.
