FARGO, N.D. (AP) – A prisoner transport company says it should
not have to pay costs to farmers who helped flush an escaped
convict from a North Dakota cornfield.
A federal lawsuit against Extradition Transport of America asks
a judge to order restitution for several law enforcement agencies
and the farmers who formed a posse for the October 2011 search.

Authorities say about $95,000 was spent recapturing Joseph
Megna, who was being transported from Florida to Washington state.

The feds say the action is possible under a 2000 federal law
passed following the escape in New Mexico of an inmate convicted of
murdering an 11-year-old Fargo girl, Jeanna North.
The company says in a response filed Wednesday that the federal
court does not have jurisdiction in the case and it should be
thrown out.

FARGO, N.D. (AP) – A 22-year-old Grand Forks man accused of
distributing synthetic drugs that led to the deaths of two teens
has been indicted.

Andrew Spofford pleaded not guilty yesterday to five counts.

Police say 18-year-old Christian Bjerk and 17-year-old
Elijah Stai died of apparent overdoses from the synthetic drugs.

STANLEY, N.D. (AP) – A Utah man working in the North Dakota oil fields is being treated at a Minnesota burn center after an oil rig explosion.

Mountrail County Sheriff Ken Halvorson says 29-year-old Jeffery Kinkaid, of Nephi, Utah, apparently became wedged beneath a burning tank and suffered burns on about 90 percent of his body in the incident Tuesday at a Hess Corp. site southwest of Stanley.

The cause of the blast was not immediately determined.

BISMARCK, N.D. (AP) – The U.S. Department of Agriculture has
declared an agricultural disaster for some parts of North Dakota
due to the drought.

Gov. Jack Dalrymple and North Dakota’s congressional delegation announced that Agriculture Secretary Tom Vilsack notified them of the declaration on Wednesday.

The declaration makes farmers and ranchers in 16 counties in the state
eligible for federal assistance because of damaged crops.

Stutsman and Barnes Counties are included in the declaration.

BISMARCK, N.D. (AP) – Some Upper Midwest farmers who thought
they caught a break when the federal government eased crop
insurance rules for land hit by prolonged flooding are finding it
isn’t as easy to cash in as they first thought.
The “prevented planting” provision pays farmers if they can’t
plant due to extreme weather like flooding.

A new rule for the “prairie pothole” region of the Dakotas, Montana, Minnesota and Iowa addresses multiple-year disasters – essentially letting
farmers collect as long as they had planted a crop on the land at
least once in the past four years.
But there also are other provisions.

The Risk Management Agency recently published memorandums clarifying rules, and some farmers aren’t meeting them.
Members of North Dakota’s congressional delegation are urging
the RMA to address the issue.

FORT YATES, N.D. (AP) – A Florida real estate tycoon who owns a
controversial bison ranch in the Dakotas is selling a separate
cattle ranch.

Maurice Wilder’s 12,000-acre Wilder Cattle Ranch is to be sold at
auction on Sept. 14. Auctioneer Adam Karrels says he is not aware
of any plans to sell the 35,000-acre bison ranch that straddles the
North Dakota-South Dakota border.
Relations between Wilder and ranchers in the Dakotas have been
strained for years.

The bison ranch has sparked complaints and
lawsuits over animals allegedly running loose and causing problems
for neighbors.

Last year, authorities impounded more than 3,000 of Wilder’s bison after reports of starving animals.

Wilder paid $57,000 for feed and expenses after the impoundment ended and took about 850 bison to auction.

BISMARCK, N.D. (AP) – Democratic governor candidate Ryan Taylor
believes incumbent Republican Jack Dalrymple hasn’t done a good job
managing the effects of North Dakota’s oil boom.
Dalrymple says there’s some catching up to do.

But he says his administration has done well at trying to build new roads, housing, classrooms and public works to deal with the influx of people.
Taylor and Dalrymple met in Bismarck on Wednesday for their
first debate. The North Dakota Broadcasters Association hosted
debates for governor, U.S. Senate and U.S. House.

BISMARCK, N.D. (AP) – North Dakota’s candidates for the U.S.
House sparred over the issue of tax breaks for the wind energy
industry.

Democrat Pam Gulleson said during a debate in Bismarck
that tax credits due to expire at the end of the year should be
extended. But Republican Kevin Cramer says he’s against keeping the
credits in place when the nation’s debt is soaring.

BISMARCK, N.D. (AP) – In North Dakota’s U.S. Senate campaign,
Republican Rick Berg and Democrat Heidi Heitkamp agree on many
things.
At a debate Wednesday in Bismarck, Berg and Heitkamp said they
support developing all of the nation’s energy sources, including
coal and oil.
Heitkamp says President Barack Obama has “walked away from coal
and been hostile to oil.”
Heitkamp says she agrees with former Alaska Republican Gov.
Sarah Palin’s “drill, baby, drill” strategy.
Berg and Heitkamp say the best way to bolster Social Security is
to get jobs growing again.

And they both say they wouldn’t rule out
military action against Iran to prevent the country from getting
nuclear weapons.
Heitkamp says she would insist on permission from Congress
before going to war. Berg says consultations with Congress are
needed.

BISMARCK, N.D. (AP) – North Dakota’s Republican chairman says
Democratic U.S. Senate candidate Heidi Heitkamp and House hopeful
Pam Gulleson should join the GOP.
Stan Stein was reacting to statements Heitkamp and Gulleson made
during debates with Republican opponents Rick Berg and Kevin Cramer
on Wednesday.
Heitkamp and Gulleson both supported developing North Dakota’s
oil and coal resources, and Heitkamp was critical of Democratic
President Barack Obama’s energy policies.

Heitkamp backed reducing the national corporate income tax rate.
Stein says the two candidates are trying to hide from their
support for Obama.
Spokespeople for Heitkamp and Gulleson say the two Democrats
won’t be turning Republican.

A spokesman for Heitkamp says she doesn’t support cutting Medicare and reducing crop insurance for farmers.
A spokeswoman for Gulleson says neither party has a monopoly on
good ideas.

EAST RUTHERFORD, N.J. (AP) – The Dallas Cowboys have opened the NFL season with a 24-17 upset of the Super Bowl champion New York Giants.

Tony Romo threw for 307 yards and three touchdowns, two to Kevin Ogletree, who had no career touchdown receptions before last night.

EAST RUTHERFORD, N.J. (AP) – The NFL kicked off the season with
replacement referees and, for the most part, nothing seemed
different.

They were largely a non-factor in the Cowboys’ 24-17 win
over the Giants.
Jim Core’s seven-man crew seemingly didn’t make any blunders,
although there were a couple of calls that both teams questioned.

BALTIMORE (AP) – Former Baltimore Ravens owner Art Modell has
died. He was 87.
The team said Modell died early Thursday at Johns Hopkins
Hospital, where he had been admitted Wednesday. A cause of death
was not given.
Modell was among the most important figures in the NFL as owner
of the Cleveland Browns, which became the Ravens after he took the
team to Baltimore in 1996 in a move that tarnished his reputation
as one of the league’s most innovative and influential owners.
During his four decades as an NFL owner, Modell helped negotiate
the league’s lucrative contracts with television networks, served
as president of the NFL from 1967 to 1969, and chaired the
negotiations for the first the collective bargaining agreement with
the players in 1968.
He also was the driving force behind the 1970 contract between
the NFL and ABC to televise games on Monday night.

MINNEAPOLIS (AP) – The Minnesota Vikings’ value has jumped 22 percent to $975 million on Forbes magazine’s ranking of NFL franchises.

The publication released its 2012 team valuations yesterday. Forbes executive editor Mike Ozanian says the increase is directly due to Minnesota’s planned new stadium.

TENNIS…

NEW YORK (AP) -There’s been a big upset at the U.S. Open.

Men’s top seed and five-time champion Roger Federer was ousted before the semifinals at the Open for the first time since 2003, losing to sixth-seeded Tomas Berdych (TOH’-mahs bur-DEEK’) 7-6, 6-4, 3-6, 6-3 last night.

NEW YORK (AP) – Andy Roddick’s tennis career ended yesterday at age 30. Roddick, who announced last week he was retiring at the end of his run at the U.S. Open, lost a four-set match to 2009 U.S.

Open champion Juan Martin del Potro (wahn mar-TEEN’ dehl POHT’-roh)  in a match spread over two days because of rain.

On the women’s side, third-seeded Serena Williams served 12 aces
in a 6-1, 6-3 victory over Ana Ivanovic (ee-VAH’-noh-vich) to
advance to the semifinals.
Maria Sharapova (shah-rah-POH’-vah) and Sara Errani
(ehr-RAH’-nee) also advanced to the semifinals.

Sharapova eliminated 11th-seed Marion Bartoli, 3-6, 6-3, 6-4, while Errani
beat her doubles partner and good friend Roberta Vinci (VIN’-chee)
6-2, 6-4. Errani plays Williams next.

In world and national  news…

CHARLOTTE, N.C. (AP) – President Barack Obama speaks to the
Democratic National Convention and the American people tonight, one
night after delegates nominated him for a second term.

Last night, former President Bill Clinton made the case for another four years
for Obama.

Clinton said no president could have repaired all the
economic damage in four years that Obama inherited.

CHARLOTTE, N.C. (AP) – Before President Barack Obama takes to
the stage at the Democratic convention tonight, delegates will hear
from Vice President Joe Biden.

Ted Kaufman, a longtime Biden confidant who took his seat in the Senate, says look for Biden to use words such as “conviction,” “character” and “values,” and to talk about what he’s regularly mentioned in his campaign
appearances, that “Osama bin Laden is dead and General Motors is
alive.”

ISTANBUL (AP) – Officials expect the death toll to rise after a
boat carrying illegal immigrants sank off the coast of Turkey.
Officials say they’ve recovered 20 bodies, but they put the death
toll at 39.

They say the fishing boat was carrying about 100
people, mostly from Iraq and Syria.

CHEVALINE, France (AP) – French authorities say a 4-year-old
British girl appears unharmed after she was found in the back of a
car filled with the dead bodies of her mother and three other
adults on a remote Alpine road.

Investigators say the girl sat huddled in fear for eight hours as French investigators stood nearby, unaware that she was there. The mysterious shooting rampage also left a 7-year-old girl hospitalized with bullet wounds and skull fractures.
