Jamestown (CSi) With the January 6, 2014 deadline having arrived on Monday the Jamestown Regional Airport Authority has notified the Federal Department of Transportation that it recommends SkyWest Airlines become the Essential Air Service Carrier for Jamestown, starting in March.
On Monday’s Wayne Byers Show, on CSi Cable 2, Jamestown Airport Manager Matt Leitner said the recommendation is based on comments and input from the community.
He said those included support for SkyWest from the Jamestown City Council Stutsman County Commission, travel agents, the public and the Jamestown Regional Airport Authority.
Leitner pointed out that the Department of Transportation has 30 days, or February 6, 2014, to make a decision on either of the two airlines making bids on the Jamestown EAS package, the present carrier, Great Lakes Airlines, or SkyWest.
Leitner added the the Airport Authority favors SkyWest with anticipated competitive through fares, along with a Code Share with United Express
plus connections to other airlines in connections to destinations.
He noted that if SkyWest is selected for the next two years, the airline has 60-days to transition to Jamestown service, including a set schedule, and signage changes at Jamestown Regional Airport.
SkyWest proposes, one daily jet flight (50 passenger) to and from the Denver Hub. The service includes a restroom, flight attendant and a galley.
Jamestown (CSi) The Jamestown City Council met in Special Session Monday (Jan 6, 2014 at 4-p.m., at City Hall to hold a Public Hearing concerning an Alcohol Compliance check violation that occurred in October of 2013. All members were present, along with City Attorney, Ken Dalsted.
The request was made by NPC International Inc., doing business as Jamestown’s Pizza Hut.
Jamestown (CSi) The Jamestown City Council met in Special Session Monday (Jan 6, 2014 at 4-p.m., at City Hall to hold a Public Hearing concerning an Alcohol Compliance check violation of serving alcohol to a minor, that occurred in October of 2013. All members were present, along with City Attorney, Ken Dalsted.
The request was made by NPC International Inc., doing business as Jamestown’s Pizza Hut.
Dalsted outlined the notification of the hearing, and the Notice of First Offense against Pizza Hut. He said at the time of the first violation, the server had certified alcohol server training in checking IDs and was not counted as a first violation.
The second violation, with in 24 months, was made by a server who did not have a certification, and so it was considered a first violation.
A Jamestown Police officer testified that an individual was sent to the establishment, along with a plain clothed officer, and if a violation has occurred the server is so told.
On the date in question, the police officer was brought in and the server stated that she served the minors, and she did not complete the server training after which a report was filed. The server said she misread the date of birth on the ID a North Dakota drivers license that was presented.
The Manager testified that he was not aware of the server compliance certification, and the server was recently hired. He has since been made aware, and server training is being complied with. He said the server who is 19 years old is from another state where the IDs are different. The server was not charged by police for serving a minor. Dalsted said the certification is of benefit to the establishment and that the business is diligent in the training.
The fine for the violation is a mandatory $500 fine for a first violation.
After the Public Hearing Council Member Gumke moved to adhere to the City Ordinance regarding serving liquor to minors, and impose the fine. The City Council voted unanimously that a violation had occurred, which was passed unanimously.

Consent Agenda Items discussed separately included: Council Member Kourajian requested that item “A” be discussed separeatly, a Resolution to re-affirm pledges of deposit as follows: Unison Bank – $13,131,805.22; Wells Fargo Bank – $17,620,677.06. He asked why fewer financial institutions were being used by the city. Deputy Auditor Jay Sveum was unable to specially answer the question.
Item”D” was asked to be discussed by Council Member Buchanan, a Resolution to approve the request from Metro Plains, LLC, for the City of Jamestown to provide a Letter/Resolution of Support for Jamestown Court Row homes which is intended to provide affordable senior housing that contributes to community revitalization in the Renaissance Zone. He said the item should be considered after a similar item on the agenda, later, which was agreed to by the Council.

A Public Hearing was held concerning the request to amend the Jamestown Renaissance Zone District Boundary to include Block 42, Original Addition to the City of Jamestown. A member of the audience asked the benefits of the request, which was explained by the mayor, in part is to re-purpose the property, along with a five year tax exemption.
The City Council approved the request from Metro Plains, LLC, to amend the Jamestown Renaissance Zone District Boundary to include Block 42, Original Addition to the City of Jamestown. Mayor Andersen said, no benefits have yet to be applied for.
Council Member Buchanan voted in opposition, saying Renaissance Zone benefits are not needed by Metro Plains, and the action of a property tax exemption is putting a drag on other property owners relative to property taxes. He said Metro Plains would also receive income tax credits, in addition to other types of breaks.
Mayor Andersen point out that Post House, and the James House are successful Metro Plains developments, and that additional housing of that type is needed in Jamestown.
Item “D” from the Consent Agenda was addressed, a Resolution to approve the request from Metro Plains, LLC, for the City of Jamestown to provide a Letter/Resolution of Support for Jamestown Court Row homes which is intended to provide affordable senior housing that contributes to community revitalization in the Renaissance Zone. The City Council approved sending the letter of support, Council Member Buchanan voted in opposition.
The request of Norm Aldinger for the City to direct Otter Tail Power Company to remove the structure at 113 12th Avenue NE based on language in the city franchise ordinance, was tabled to a future meeting , at the request of legal council.
Ordinances:
The Second Reading of an Ordinance to amend and re-enact a Section of the City Code pertaining to taxicab licenses and taxicab driver’s licenses was discussed. The Ordinance was approved as amended.
Hearing From The Audience:
Jamestown Regional Airport Authority Chairman Jim Boyd explained that the Authority has sent a letter to the Federal Department of Transportation in support of SkyWest as the Essential Air Service Carrier, the next two years, starting in March this year. (see separate story from Regional Airport Manager Matt Leitner). Boyd added that the City of Devils Lake is also supporting SkyWest air service.
Boyd also said his private business is to formulate a strategic plan for his clients. He said he is working with the Downtown Association, and President Nancy Miller said the organization is looking at rebranding along with forming a sub committee on other issues.
Appointments:
The City Council approved the appointment Rodney Johnson & Scott Roemmich to serve as members of the Fire Code Board of appeals for three (3) year terms to expire November 2016.
Approved for appointment was Neil Barkus to serve as a member of the Board of Adjustments for a three (3) year term to expire January 2017.

The City Council approved a Change Order to Sellin Brothers, Inc., on Jamestown WTP Backwash Pond Lift Station, for an increase in the contract price of $7,225.50.
Approved was an application from Lucas Dockter d/b/a Middles for an On/Off Sale alcoholic beverage license at 113 1st Avenue South, for the period ending June 30, 2014.
Approved a Public Works software purchase from Tracker Software Corporation for approximately $28,000 with a yearly Maintenance Fee of approximately $4200 beginning 6 months after purchase (2013 Budget–$31,000).
Approved a Traffic Counter/Classifier purchase from Counting Cars in the amount of $2,279.
Approved four unit heater replacements at the Solid Waste Baler Facility.
The City Council approved a Letter of Support for a request from G.A. Haan Development LLC to build approximately 40 units of affordable senior housing, in Jamestown. Council Member Buchanan requested information in writing on the specifics of the project. Mayor Andersen said she has reviewed the information from G.A. Haan. Over the phone Director of Development, Ben Ibes from Michigan outlined credit to be applied for with the State Housing Agency. He said the town homes or individual apartment units would be constructed in the area northwest of Wal-Mart in Jamestown. Tenants will need to be income eligible. He is planning to ask the city for a reduction in permits fees. He is working with Stutsman Rural Water District on a water source.

Valley City (CSi) Assistant Barnes County State’s Attorney Carl Martineck will fill the unexpired term of Barnes County State’s Attorny, Lee Grossman.
The appointment becomes effective February 14, 2014.
Grossman has accepted a position with the Myhre Law Firm, in Valley City.
Martineck, his wife and daughter live in Valley City.
He will have to run for a full term during the November 2014 election.
The deadline to submit applications to fill the post of Assistant Barnes County States Attorney is January 17, 2014.
WISHEK, N.D. (AP) – Fire has destroyed a welding business in the southeastern North Dakota town of Wishek.
State Highway 13 into town was shut down and traffic rerouted for several hours Sunday afternoon while firefighters fought the blaze at Central Iron. The cause of the fire was not immediately determined.
There were no major injuries, though Fire Chief Dave Just tells The Bismarck Tribune that one firefighter was taken to a hospital to be treated for breathing problems.
Firefighters were able to save surrounding buildings.
WAHPETON, N.D. (AP) – Authorities are investigating what caused a liquid propane tank to catch fire near the Bobcat manufacturing plant in Wahpeton.
Fire Chief Derek Miller says gas leaked from a pump on one of two 1,000-gallon tanks and somehow ignited early Monday. That created a fireball about 8 feet high and 12 feet wide. No one was hurt.
Firefighters who responded to the scene had to battle not only the flames but also frigid weather. The temperature at the time was about 24 degrees below zero, and the wind child was about twice as cold.
DEVILS LAKE, N.D. (AP) – Two Devils Lake firefighters were taken to a hospital to be treated for frostbite after battling a fire at a grain elevator.
Fire Chief Jim Moe says crews were called to the scene just after 8 p.m. Sunday. He says firefighters had to fight the blaze in wind chills that reached about 50 degrees below zero.
Moe says the state fire marshal is on the scene to investigate the cause.
FARGO, N.D. (AP) – A North Dakota man avoided jail time for neglecting about 170 dogs at an apparent puppy mill at his rural Wheatland home.
Darcy Smith was sentenced Monday in Fargo and was ordered to pay fines and fees of just over $2,300. He’ll also be on probation for two years and can’t go back into the dog breeding business during that time.
Authorities seized the animals from Smith’s home in July. He later waived his rights to the animals and they were put up for adoption. None died.
His lawyer says Smith cares about animals but became overwhelmed when he had more dogs than he could care for.
FARGO, N.D. (AP) – A lot of school children had the day off, but most people in the Dakotas went about business as usual Monday, despite subzero wind chills.
Brandon Schmidt of Jim’s Towing in West Fargo had icicles in his mustache and beard as hooked up a delivery truck that wouldn’t start. His company began towing vehicles at 3 a.m. Monday and there was no end in sight.
In Sioux Falls, S.D., courier Mike Jesse needed gas before driving his route, but the north-facing pumps wouldn’t work, so he moved around to the south side.
Also, in southeast South Dakota, the Turner County Courthouse in Parker, S.D., had to close because of a natural gas problem.
And in Minot, a stray cat that was frozen to a rock was rescued but ultimately died.
BISMARCK, N.D. (AP) – Officials say contributions have exceeded a $20 million state income tax credit cap to subsidize construction of low-income dwellings in North Dakota, primarily in the state’s booming oil patch.
The North Dakota Housing Finance Agency’s low-income housing development program gives individual and business donors a dollar-for-dollar tax credit.
Agency Director Jolene Kline says several million dollars in contributions came in during the last two weeks of the year and about $400,000 in tax credits had to be turned away.
During the previous two-year budget cycle, the program was capped at $15 million and consisted entirely of tax credits. The Legislature last year expanded the program to include $20 million in tax credits and $15.4 million from the state general fund, which is supported by taxpayers.
BISMARCK, N.D. (AP) – South Central District Judge Donald Jorgensen is retiring at the end of his term, after three decades behind the bench.
The state Supreme Court says Jorgensen won’t seek re-election in November. He was first elected a district judge in 1984.
Jorgensen was born in Kenmare in 1944 and is a graduate of the University of North Dakota law school. He served in the Southwest Judicial District before transferring to the South Central district in 1995. His chambers are in Linton.

WASHINGTON (AP) – The Supreme Court has put same-sex marriages on hold in Utah. An order issued Monday grants an emergency appeal by the state of a judge’s ruling that Utah’s ban on gay marriage is unconstitutional. The high court order will remain in effect until the Denver-based 10th U.S. Circuit Court of Appeals decides whether to uphold the judge’s ruling.
SAN FRANCISCO (AP) – A lawyer for the family of a 13-year-old California girl declared brain dead after surgery says she has arrived safely at a new location, but that she is in “bad shape.” Jahi (juh-HY’) McMath was moved to an undisclosed location from Children’s Hospital Oakland, where she had surgery for sleep apnea. The hospital had wanted to remove the ventilator that is keeping her heart pumping, arguing in court that she is legally dead.
CHICAGO (AP) – Authorities are investigating two similar accidents involving commuter trains Monday in Chicago. Fourteen passengers were injured when one train hit a “bumping post” at a downtown Chicago station. The same thing happened earlier in the morning, but no one was hurt. Officials are looking to see if weather played a role. Temperatures in Chicago were around 15 below zero, with wind chills as low as minus 40.
SAN FRANCISCO (AP) – The FBI says it has made an arrest in a fire set at the Chinese Consulate in San Francisco. An FBI spokesman says one suspect has been taken into custody. No one was hurt in the New Year’s Day blaze that charred a doorway and damaged the lobby of the building.
ELIZABETH, N.J. (AP) – A man who gained Internet fame as “Kai the Hatchet-Wielding Hitchhiker” has pleaded not guilty to murder charges in the beating death of an elderly New Jersey man last year. The Star-Ledger reports that 24-year-old Caleb McGillivary remained silent while his public defender entered the plea in court today. The Canadian became known for his description of using a hatchet to intervene in a 2012 assault on a California utility worker.
