Jamestown (CSi) The Jamestown City Engineer’s office informs residents that due to the recent light snow events, City crews have begun snow removal in the RESIDENTIAL areas today, Tuesday, January 7, 2014 during normal working hours.
City crews will begin snow removal in the DOWNTOWN area beginning approximately at 11:00 p.m. Wednesday, January 8, 2014 and continue during the night.

BISMARCK, N.D. (AP) – Schools in the Dakotas are getting back to normal after many called off classes during a day of extremely cold weather.
Schools were reopening today, though some were starting classes later in the morning. Many closed for the day Monday when temperatures dropped as low as the minus 20s, and wind chills plummeted to the minus 30s, 40s and 50s.
Temperatures early Tuesday were beginning to moderate. National Weather Service forecasts called for daytime highs in North Dakota ranging from the single digits below zero in the east to the teens above zero in the southwest.
Jamestown (CSi) The Jamestown City Council met in Special Session Monday (Jan 6, 2014 at 4-p.m., at City Hall to hold a Public Hearing concerning an Alcohol Compliance check violation of serving alcohol to a minor, that occurred in October of 2013. All members were present, along with City Attorney, Ken Dalsted.
The request was made by NPC International Inc., doing business as Jamestown’s Pizza Hut.
Dalsted outlined the notification of the hearing, and the Notice of First Offense against Pizza Hut. He said at the time of the first violation, the server had certified alcohol server training in checking IDs and was not counted as a first violation.
The second violation, with in 24 months, was made by a server who did not have a certification, and so it was considered a first violation.
A Jamestown Police officer testified that an individual was sent to the establishment, along with a plain clothed officer, and if a violation has occurred the server is so told.
On the date in question, the police officer was brought in and the server stated that she served the minors, and she did not complete the server training after which a report was filed. The server said she misread the date of birth on the ID a North Dakota drivers license that was presented.
The Manager testified that he was not aware of the server compliance certification, and the server was recently hired. He has since been made aware, and server training is being complied with. He said the server who is 19 years old is from another state where the IDs are different. The server was not charged by police for serving a minor. Dalsted said the certification is of benefit to the establishment and that the business is diligent in the training.
The fine for the violation is a mandatory $500 fine for a first violation.
After the Public Hearing Council Member Gumke moved to adhere to the City Ordinance regarding serving liquor to minors, and impose the fine. The City Council voted unanimously that a violation had occurred, which was passed unanimously.
Jamestown (CSi) The Jamestown City Council met in Regular Session Monday at CityHall. All members were present.
Consent Agenda Items discussed separately included:
Council Member Kourajian requested that item “A” be discussed separeatly, a Resolution to re-affirm pledges of deposit as follows: Unison Bank – $13,131,805.22; Wells Fargo Bank – $17,620,677.06. He asked why fewer financial institutions were being used by the city. Deputy Auditor Jay Sveum was unable to specially answer the question.
Item“D” was asked to be discussed by Council Member Buchanan, a Resolution to approve the request from Metro Plains, LLC, for the City of Jamestown to provide
a Letter/Resolution of Support for Jamestown Court Row homes which is intended to provide affordable senior housing that contributes to community revitalization in the Renaissance Zone. He said the item should be considered after a similar item on the agenda, later, which was agreed to by the Council.

A Public Hearing was held concerning the request to amend the Jamestown Renaissance Zone District Boundary to include Block 42, Original Addition to the City of Jamestown. A member of the audience asked the benefits of the request, which was explained by the mayor, in part to re-purpose the property, along with a five year tax exemption.
The City Council approved the request from Metro Plains, LLC, to amend the Jamestown Renaissance Zone District Boundary to include Block 42, Original Addition to the City of Jamestown. Mayor Andersen said, no benefits have yet to be applied for.
Council Member Buchanan voted in opposition, saying Renaissance Zone benefits are not needed by Metro Plains, and the action of a property tax exemption is putting a drag on other property owners relative to property taxes. He said Metro Plains would also receive income tax credits, in addition to other types of breaks.
Mayor Andersen point out that Post House, and the James House are successful Metro Plains developments, and that additional housing of that type is needed in Jamestown.
Item “D” from the Consent Agenda was addressed, a Resolution to approve the request from Metro Plains, LLC, for the City of Jamestown to provide
a Letter/Resolution of Support for Jamestown Court Row homes which is intended to provide affordable senior housing that contributes to community revitalization in the Renaissance Zone. The City Council approved sending the letter of support, Council Member Buchanan voted in opposition.
The request of Norm Aldinger for the City to direct Otter Tail Power Company to remove the structure at 113 12th Avenue NE based on language in the city franchise ordinance, was tabled to a future meeting , at the request of legal council.
Ordinances:
The Second Reading of an Ordinance to amend and re-enact a Section of the City Code pertaining to taxicab licenses and taxicab driver’s licenses, was discussed.
The Ordinance was approved as amended.
Hearing From The Audience:
Jamestown Regional Airport Authority Chairman Jim Boyd explained that the Authority has sent a letter to the Federal Department of Transportation in support of SkyWest as the Essential Air Service Carrier, the next two years, starting in March this year. (see separate story from Regional Airport Manager Matt Leitner).
Boyd added that the City of Devils Lake is also supporting SkyWest air service.
Boyd also said his private business is to formulate a strategic plan for his clients.
He said he is working with the Downtown Association, and President Nancy Miller said the organization is looking at rebranding along with forming a sub committee on other issues.
Appointments:
The City Council approved the appointment Rodney Johnson & Scott Roemmich to serve as members of the Fire Code Board of appeals for three (3) year terms to expire November 2016.
Approved for appointment was Neil Barkus to serve as a member of the Board of Adjustments for a three (3) year term to expire January 2017.

The City Council approved a Change Order to Sellin Brothers, Inc., on Jamestown WTP Backwash Pond Lift Station, for an increase in the contract price of $7,225.50.
Approved was an application from Lucas Dockter d/b/a Middles for an On/Off Sale alcoholic beverage license at 113 1st Avenue South, for the period ending June 30, 2014.
Approved a Public Works software purchase from Tracker Software Corporation for approximately $28,000 with a yearly Maintenance Fee of approximately $4200 beginning 6 months after purchase (2013 Budget–$31,000).
Approved a Traffic Counter/Classifier purchase from Counting Cars in the amount of $2,279.
Approved four unit heater replacements at the Solid Waste Baler Facility.
The City Council approved a Letter of Support for a request from G.A. Haan Development LLC to build approximately 40 units of affordable senior housing, in Jamestown. Council Member Buchanan requested information in writing on the specifics of the project. Mayor Andersen said she has reviewed the information from G.A. Haan. Over the phone Director of Development, Ben Ibes from Michigan outlined credit to be applied for with the State Housing Agency.
He said the town homes or individual apartment units would be constructed in the area northwest of Wal-Mart in Jamestown. Tenants will need to be income eligible.
He is planning to ask the city for a reduction in permits fees. He is working with Stutsman Rural Water District on a water source.

Jamestown (CSi) With the January 6, 2014 deadline having arrived on Monday the Jamestown Regional Airport Authority has notified the Federal Department of Transportation that it recommends SkyWest Airlines become the Essential Air Service Carrier for Jamestown, starting in March.
On Monday’s Wayne Byers Show, on CSi Cable 2, Jamestown Airport Manager Matt Leitner said the recommendation is based on comments and input from the community.
He said those included support for SkyWest from the Jamestown City Council Stutsman County Commission, travel agents, the public and the Jamestown Regional Airport Authority.
Leitner pointed out that the Department of Transportation has 30 days, or February 6, 2014, to make a decision on either of the two airlines making bids on the Jamestown EAS package, the present carrier, Great Lakes Airlines, or SkyWest.
Leitner added the the Airport Authority favors SkyWest with anticipated competitive through fares, along with a Code Share with United Express
plus connections to other airlines in connections to destinations.
He noted that if SkyWest is selected for the next two years, the airline has 60-days to transition to Jamestown service, including a set schedule, and signage changes at Jamestown Regional Airport.
SkyWest proposes, one daily jet flight (50 passenger) to and from the Denver Hub. The service includes a restroom, flight attendant and a galley.
Valley City (CSi) Assistant Barnes County State’s Attorney Carl Martineck will fill the unexpired term of Barnes County State’s Attorny, Lee Grossman.
The appointment becomes effective February 14, 2014.
Grossman has accepted a position with the Myhre Law Firm, in Valley City.
Martineck, his wife and daughter live in Valley City.
He will have to run for a full term during the November 2014 election.
The deadline to submit applications to fill the post of Assistant Barnes County States Attorney is January 17, 2014.
WISHEK, N.D. (AP) – Fire has destroyed a welding business in the southeastern North Dakota town of Wishek.
State Highway 13 into town was shut down and traffic rerouted for several hours Sunday afternoon while firefighters fought the blaze at Central Iron. The cause of the fire was not immediately determined.
There were no major injuries, though Fire Chief Dave Just tells The Bismarck Tribune that one firefighter was taken to a hospital to be treated for breathing problems.
Firefighters were able to save surrounding buildings.
FARGO, N.D. (AP) – A North Dakota man avoided jail time for neglecting about 170 dogs at an apparent puppy mill at his rural Wheatland home.
Darcy Smith was sentenced Monday in Fargo and was ordered to pay fines and fees of just over $2,300. He’ll also be on probation for two years and can’t go back into the dog breeding business during that time.
Authorities seized the animals from Smith’s home in July. He later waived his rights to the animals and they were put up for adoption. None died.
His lawyer says Smith cares about animals but became overwhelmed when he had more dogs than he could care for.
BISMARCK, N.D. (AP) – A second deer killed during the 2013 hunting season in western Grant County has tested positive for chronic wasting disease.
It’s the fifth deer killed in the 3F2 hunting unit to test positive for CWD in five years. Infected deer also were killed in 2009, 2010 and 2011. The Game and Fish Department earlier implemented hunter restrictions in 3F2 to try to prevent the spread of CWD to deer in other parts of the state.
CWD affects the nervous system of members of the deer family and is always fatal. Game and Fish has been monitoring for it since 2002 through samples taken from hunter-harvested deer.
The test on the latest deer was done at Michigan State University. The results are being confirmed by a national lab in Ames, Iowa.
BISMARCK, N.D. (AP) – A North Dakota man has pleaded guilty to two separate assaults against women on the Fort Berthold Indian Reservation.
Waylon Gardner pleaded guilty Monday to assault of a spouse or intimate partner resulting in substantial bodily injury, and assault resulting in serious bodily injury.
Authorities say the incidents happened April 3 in Mandaree and May 20 in Parshall. One of his victims was knocked unconscious and another was stabbed.
Gardner faces a maximum penalty of 15 years in prison on the two charges.
Sentencing is scheduled for April 21 in Bismarck.
BISMARCK, N.D. (AP) – North Dakota tourism officials, along with Gov. Jack Dalrymple, are slated unveil the state’s new marketing campaign to lure visitors.
Dalrymple and Tourism Division Director Sara Otte Coleman are slated to launch the new campaign on Tuesday in downtown Bismarck.
Officials say the new campaign will feature new television and print ads as well as new travel and hunting guides.
The new tourism campaign comes as life-threatening cold hangs over the state.
North Dakota tourism officials historically have geared campaigns toward audiences in the neighboring states of Minnesota, Wisconsin, South Dakota, Montana as well as the Canadian provinces of Manitoba and Saskatchewan.
BISMARCK, N.D. (AP) – South Central District Judge Donald Jorgensen is retiring at the end of his term, after three decades behind the bench.
The state Supreme Court says Jorgensen won’t seek re-election in November. He was first elected a district judge in 1984.
Jorgensen was born in Kenmare in 1944 and is a graduate of the University of North Dakota law school. He served in the Southwest Judicial District before transferring to the South Central district in 1995. His chambers are in Linton.
MINOT, N.D. (AP) – Rescuers in Minot thought they had saved a wild cat that fell into a heated fish pond and then froze to a rock, but it had to be put down.
Kim Fundingsland says he found the animal in his yard early Monday morning and initially thought it was a chunk of ice because the black cat was all white.
He called the animal control officer who used warm water to free it.
A police captain says a veterinarian examined the feral cat but it had been out in the cold too long and its injuries were too bad.
He says it shows how cold it was — a cat that normally wouldn’t have trouble jumping out of a pond gets stuck to a rock.

PASADENA, Calif. (AP) – Florida State has won the BCS championship game by storming back from a 21-3, first-half deficit to beat Auburn 34-31 in the Rose Bowl. Jameis (JAYM’-ihs) Winston threw a two-yard touchdown pass to Kelvin Benjamin to put the Seminoles ahead with 13 seconds remaining, 66 seconds after Tre Mason’s 37-yard touchdown run gave the Tigers a 31-27 lead. Winston was the game’s offensive MVP, throwing for 237 yards and a pair of fourth-quarter touchdowns to lead the Seminoles to their third national championship and first since the 1999 season.
NEW YORK (AP) – Florida State is the No. 1 team in the final Associated Press football poll. The Seminoles just completed a 14-0 season and ended the Southeastern Conference’s string of seven straight years with the top team in the season-ending poll. Auburn is second, followed by Michigan State, South Carolina, Missouri, Oklahoma, Alabama, Clemson, Oregon and UCF. The SEC winds up with four teams in the top seven.

The Wild have placed Koivu on injured reserve, when their first-line center and leading scorer with 35 points in 44 games underwent surgery to repair a broken ankle. Koivu was hit by a puck Saturday against Washington.

CHICAGO (AP) – The Cleveland Cavaliers have traded Andrew Bynum and three future draft picks to the Chicago Bulls for All-Star forward Luol Deng (LOO’-ul dehng). The trade comes just days after Bynum was suspended by the Cavaliers and allows Cleveland to unload the center before having to guarantee his contract. Deng is a two-time All-Star who is averaging 19 points, seven rebounds and 3.7 assists per game this season.
MINNEAPOLIS (AP) – The game between the San Antonio Spurs and Minnesota Timberwolves that was originally scheduled to be played in Mexico City on Dec. 4 will now be played in Minnesota on April 8. The game was part of the NBA’s ongoing efforts to increase the league’s international reach. But logistics and scheduling prevented the league from replaying the game in Mexico City. Season ticket holders will be given priority to purchase tickets for the game.

MINNEAPOLIS (AP) – A person with knowledge of the process tells The Associated Press that the Minnesota Vikings have asked to interview Cincinnati offensive coordinator Jay Gruden for their head coach vacancy. The person spoke yesterday on condition of anonymity because the team has not made information about the search public. The Vikings fired Leslie Frazier last week and will be making their third head coach hire in eight years.
Miami Dolphins offensive coordinator Mike Sherman has been fired, the first change by the team since missing the playoffs because of a late-season collapse. Sherman’s unit ranked 27th this season in the NFL in yards, allowed a franchise-record 58 sacks and scored once in its final 24 possessions.

KAPALUA, Hawaii (AP) – Zach Johnson birdied three straight holes on the back nine and closed with a 7-under 66 to win the Tournament of Champions in Hawaii. He won by one shot over Jordan Spieth (speeth), who birdied the last two holes for a 69. It was Johnson’s third win in his last six starts, and his 11th career win on the PGA Tour.

Lindsey Vonn is going to skip the Sochi Olympics because of a right knee injury.
Her personal publicist, Lewis Kay, says in a statement Tuesday that Vonn “will have surgery shortly.”
The 29-year-old American won two medals at the 2010 Vancouver Olympics, including a gold in the downhill. She is also a four-time overall World Cup champion and the biggest name in Alpine skiing.
But Vonn tore two ligaments in her right knee during a high-speed crash at the world championships last February, sidelining her for about 10 months. She re-tore her surgically repaired ACL in a training crash in November, then sprained her MCL during a race at Val d’Isere, France, last month

INDIANAPOLIS (AP) – Utility officials are concerned about a spike in demand for power as residents from the Midwest to the East and South cope with the deep freeze ushered in by the “polar vortex” that usually stays north of the Canadian border. They’re asking people to conserve power, especially during peak hours. More than 30,000 customers in Indiana are without power.
WASHINGTON (AP) – The Senate hopes to hold a key test vote today on extending jobless benefits for the long-term unemployed. Supporters among the Democrats say the economy benefits from the money spent by recipients. Skeptical Republicans want offsetting spending cuts in other areas.
HARRISBURG, Pa. (AP) – Jerry Sandusky will make a video appearance from prison today as a court considers his effort to have his Penn State pension restored. At issue is whether Sandusky’s ties to the university after his 1999 retirement made him a “de facto” Penn State employee when he committed child sexual abuse.
LONDON (AP) – Figures out today that show underlying inflation in the eurozone at a record low have raised deflation concerns and increased the pressure on the European Central Bank to ease monetary policy further. Most economists think the ECB will keep its monetary policy unchanged at its meeting Thursday.
NEW ORLEANS (AP) – The deep freeze gripping much of the nation has left New Orleans below freezing, but not below zero as the city officially kicks off the Carnival season. The Phunny Phorty Phellows club, which first took to the streets in 1878, was one of two groups that paraded last night, known as Twelfth Night. In New Orleans, that’s when street parades begin and king cakes pop up in grocery stores and bakeries. In all, more than 100 parades will be held along the Gulf Coast, leading up to Mardi Gras on March 4.
