UPDATE…

The North Dakota Department of Transportation (NDDOT) along with the North Dakota Highway Patrol have CLOSED I-94 from Bismarck to Jamestown due to high winds causing areas of zero visibility and hazardous travel conditions.  Motorists who drive past a road closure device may be fined up to $250.

 

A No Travel Advisory remains in effect for areas in central and northeastern regions of North Dakota due to snow and blowing snow creating near zero visibility. Cities included in the  No Travel Advisory are Bismarck, Devils Lake, Grand Forks, and the surrounding area. Conditions are such that motorists in these areas should not travel.

 

The Travel Alert has been extended to include the cities of Center and Underwood in central North Dakota. Other areas included in a Travel Alert are New Salem, Linton, Napoleon, Jamestown, Valley City, Fargo, Wahpeton, and surrounding areas due to snow and blowing snow creating reduced visibility. 

 

All travelers are encouraged to monitor road conditions as weather conditions occur and use caution while traveling. For road information, call 511 from any type of phone or go to the website: www.dot.nd.gov.  NDDOT releases information to inform the public about travel conditions throughout the state. The three categories are as follows:

 

1.    TRAVEL ALERT – Motorists can still travel but may encounter areas of challenging winter weather driving conditions on roadways. Motorists should allow extra time to reach their destination and be alert to conditions that may make travel difficult, change rapidly, or cause travel delays. A TRAVEL ALERT has the potential to change to a NO TRAVEL ADVISED if conditions deteriorate.

 

2.    NO TRAVEL ADVISED – Motorists should not travel due to hazardous conditions which may make it unsafe to travel. Snowplows may be pulled from the roads during severe conditions. Motorists should take NO TRAVEL ADVISED seriously as those motorists who choose to travel at their own risk may become stranded and emergency responders may not be able to reach them safely. A NO TRAVEL ADVISED has the potential to change to a ROAD CLOSED OR BLOCKED if conditions deteriorate.

 

3.    ROAD CLOSED OR BLOCKED – Motorists are not allowed to travel on a closed road due to life threatening conditions. The road may be impassible or blocked. Motorists who drive past a road closure device may be fined up to $250.

The road report is based upon the information available to the NDDOT at the time of preparation and is provided solely as a public service. Conditions may vary from those reported.

 

If you become stranded, motorists should stay with their vehicle and call 911 for emergency assistance.

The National Weather Service has posted blizzard warnings in eastern North Dakota and northeastern South Dakota. The impacted area includes the James River and Red River valleys.
 
     The cold front sweeping in from Canada is expected to bring only about an inch of snow. But winds gusting to 70 mph are creating whiteout conditions.
 
     A wind gust of 72 mph was reported at Forbes on the North Dakota-South Dakota border. As a comparison – sustained winds of 74 mph are considered hurricane force.
 
     North Dakota’s two largest universities – the University of North Dakota in Grand Forks and North Dakota State University in Fargo – are closed.

 

New York J.C. Penney Company announced Wednesday that it was closing 33 J.C. Penney stores nationwide. The Jamestown Penney’s is not on the list for closure.

No North Dakota stores are on the present closure list. One store will be closed in Minnesota in Worthington.

Stores closing include five in Wisconsin, where archrival Kohl’s Corp is dominant, three inPennsylvania, and two in Florida. No stores in Penney’s home state of Texas are slated to close.

Two of the 33 stores were locations owned by the company, with the remainder being leased stores. Penney leases its stores at over half of its mall locations, according to an analysis last year by Green Street Advisors.

The company said the stores being closed were underperforming, and the closings were expected to provide an annual cost savings of about $65 million.

Penney, operates about 1,100 mid-market department stores in the United States, is trying to stanch enormous losses and win back shoppers after suffering a 25 percent drop in sales in fiscal 2012 during a failed attempt to go upmarket.

It has returned to the discounts that were long its hallmark and brought back popular in-house brands.

 

Jamestown (CSi) A former University of Jamestown student, will stand trial in April.

19 year old Robert Joe Flores, is charged with terrorizing in a incident in November of 2013, at the University, campus.

The trial dates are scheduled for April 21-22 in Southeast District Court in Jamestown, with Judge Thomas Merrick presiding over the trial.

William Mackenzie has been court appointed to defend Flores

Flores is accused of threatening to commit a crime of violence or act of violence dangerous to human life in an incident that occurred November 6, 2013.

During the time of the incident, that morning, the University of Jamestown campus was locked down as law enforcement officers searched the town for Flores.

He was arrested in downtown Jamestown later that morning.

Flores, lives in Southgate, California, and remains free on a $10,000 surety bond.

 

Jamestown, (CSi) The Jamestown Regional Airport Authority will advertise for bids on building a nine-bay T-shaped hangar.

The estimated cost of $917,000 is without having determined how to pay for the building.

The Airport Authority approved seeking bids on a 6-1, with Mayor Katie Andersen opposed.

Steve Aldinger, project engineer with Interstate Engineering,  says he should be able to get the bid notice in the local newspaper in time for it to run this Saturday.

Bids will be open on Februrary 17th and a recommendation will be brought to the Airport Authority for its February 19th meeting.

Jamestown (CSi) The Jamestown Arts Center will host a wine and cheese tasting event on Saturday January 25, 2014, from 7-p.m., to 9-p.m. All proceeds to benefit the Arts Center.

Tickets are $30 per person, and are available at The Arts Center and Cork & Barrel. Must be at least 21 years of age to attend this event.

Information from Arts Center Board, President, John Fugleberg, and board member Karn Crane says, this is the Arts Center’s 4th year hosting a wine and cheese tasting.

It’s coordinated by Arts Center Board members and staff with assistance from Scott Anderson of Cork & Barrel.

As in past years, it will have an international theme with wines from around the world. There will also be premium wines available which will be sold by the glass. In addition, there will be several varieties of cheeses, too!

The mission of the Arts Center is to enrich the Jamestown area community through the arts. The motto is “Culture Builds Community.”

 

 BISMARCK, N.D. (AP) – A North Dakota company has recalled more than a ton of beef franks due to misbranding.
 
     The United States Department of Agriculture’s Food Safety and Inspection Service says Cloverdale Foods Co. in Mandan recalled 2,664 pounds of beef franks.
 
     The agency says the hot dogs were made with milk, which was not declared on the product label. Milk is a known allergen.
 
     There have no reports of illness from the recalled products.
 
     The items identified in the recall were “Seattle Mariners Beef Franks.” The products were produced on Nov. 23 and Dec. 13, 2013. 
 
     The franks can be identified by the establishment number “Est. 7603” inside the USDA mark of inspection.  
 
     The products were sold to retailers in Montana, North Dakota and Washington.

 

 CARSON, N.D. (AP) – A judge in Carson says two white supremacists accused of using guns to terrorize residents of the small town of Leith (leeth) must stand trial.
 
     Lawyers for Craig Cobb and Kynan Dutton argued Wednesday that the guns were legal and the men didn’t say or do anything violent, so the charges should be reduced or dismissed.
 
     The Bismarck Tribune reports South Central District Judge Donald Jorgenson instead bound them over for trial, which would likely take two or three days.
 
     He says he’ll consider motions next week to reduce bond that’s now set at $1 million cash for Cobb and $50,000 cash for Dutton.
 
     The two are charged with seven felony terrorizing counts.
 
     They maintain they were patrolling the town because of violence and harassment directed at them.

 

BISMARCK, N.D. (AP) – Fire has caused an estimated $10,000 in damage to a business in a Bismarck mall. Fire officials say an overheated electric motor is the apparent cause of the blaze around 5 a.m. yesterday at BC Bagels in the Gateway Fashion Mall.

 

BISMARCK, N.D. (AP) – Preliminary numbers released by the North Dakota Highway Patrol show that 148 people died on roadways in 2013, compared with 170 killed the year before.
 
     The patrol says 46 percent of the fatal crashes involved alcohol, and 59 percent of the victims were not wearing seat belts. Troopers made 1,936 DUI arrests and issued 8,787 seat belt citations in 2013.
 
     The patrol says troopers worked more than 14,000 overtime hours, including a special enforcement effort on Nov. 27 when all available officers were on duty.
 
     Col. Jim Prochniak (PRAWK’-nee-ack) says troopers held 386 safety presentations around the state in 2013. He says lives can be saved “by driving defensively, sober and with seat belts fastened.”

 

 FARGO, N.D. (AP) – Two North Dakota residents are named as plaintiffs in a federal lawsuit against Target for the massive pre-holiday data breach.
 
     The case filed Wednesday by Alissa Farol and Frances Lundblad seeks class-action status. They say total claims among class members total more than $5 million.
 
     The complaint says Farol and Lundblad used credit or debit cards to pay for purchases at the Fargo Target store between Nov. 27 and Dec. 15. The class would include all shoppers whose financial information was compromised in that time period.
 
     Target Corp. initially disclosed that about 40 million credit and debit cards may have been affected by the security lapse. The company later said hackers stole personal information from as many as 70 million customers.
 
     The breach has resulted in several lawsuits.

 

 GRAND FORKS, N.D. (AP) – A Grand Forks man is accused of victimizing teenage girls through a social media website.
 
     Police allege that 29-year-old Eric Sansburn created multiple accounts that he used to meet and interact with girls between the ages of 13 and 17.
 
     Sansburn faces a total of 18 counts of luring minors by computer, possession of child pornography, gross sexual imposition and sexual assault. All of the charges are felonies. The most serious carry a maximum punishment of life in prison without parole.
 
     Sansburn’s attorney, Tyler Morrow, was out of the office on Wednesday and did not immediately respond to an email request for comment.

 

 WASHINGTON (AP) – North Dakota Senator Heidi Heitkamp (HYT’-kamp) says the Obama administration should make a decision soon on the Keystone XL oil pipeline. And she says that decision should be to go ahead with the project.
 
     Heitkamp met Wednesday with Canadian Foreign Minister John Baird and Canadian Ambassador to the U.S. Gary Doer.
 
     The Canadian officials and Heitkamp agree that the Keystone pipeline would be of great benefit to the U.S. and Canada. Heitkamp, a Democrat, says the process has taken too long.
 
     Heitkamp says the project would provide jobs and allow the United States to get oil from a country that shares its interests.
 
     Environmental groups oppose the Canada-to-Texas pipeline as a major contributor to global warming. Backers say it would create jobs and boost North American energy independence.
 

 
     WASHINGTON (AP) – Senator John Hoeven says the Department of Transportation needs to speed up its timeline for finalizing new rules on the construction of rail tanker cars.
 
     Hoeven’s comments came after the DOT published an item in the federal register indicating that rules might not be finalized until sometime after January 2015. The timeline was first reported by The Wall Street Journal.
 
     Hoeven says he is concerned that if the DOT doesn’t provide guidance sooner it will be hard for the oil industry to get newer, safer tankers up and running. He says the industry needs certainty.
 
     New regulations for oil tankers have come into focus after a string of tanker derailments in Canada and one in North Dakota in Casselton.
 

 

 BISMARCK, N.D. (AP) – A Fargo lawmaker says federal court decisions to overturn bans on same-sex marriage in two conservative states may prompt challenges to North Dakota’s constitutional ban on gay marriage.
 
     Democratic Rep. Joshua Boschee (boh-SHAY’) is the first openly gay person elected to the North Dakota Legislature. He says a federal court decision in Oklahoma and one in Utah, resulting in those states’ bans being struck down, may spur lawsuits in North Dakota.
 
     North Dakota voters overwhelmingly approved a constitutional amendment in 2004 that bans same-sex marriages and defines marriage as the union of a man and a woman.
 
     Boschee says he does not know of any pending lawsuits but he knows people who have expressed interest in challenging North Dakota law.
 

 

 WILLISTON, N.D. (AP) – The Williams County Commission has reduced by 99 percent a $2.6 million fine levied against a Texas company operating in the western North Dakota oil patch.
 
     The agreement calls for Houston-based Stallion Oilfield Services to pay just $26,000, and to have employees vacate what the county says is illegal temporary housing by the end of April.
 
     The  dispute was over how many housing units were at the site. The two parties agreed that the county did not adequately define the term “unit” when granting a permit for the site.
 
     Commission Chairman Dan Kalil says the county was trying to get the company’s attention with the large fine, and it worked. He says, “They made changes. We’ll make changes.”

Valley City (CSi & VCSU) – Valley City State University announces the resignation of head volleyball coach Susan Kolbow, effective January 29, 2014.

Kolbow, who coached the Vikings for four seasons, is stepping down for personal and family reasons.

Kolbow says, “I am thankful for the opportunities that VCSU has offered me and have truly enjoyed my time here. The faculty, staff, and administration have been so supportive and helpful along the way. I have learned a lot about myself and had the chance to work with hardworking, dedicated student-athletes who will go on and shine in their respective paths.”

Kolbow joined the Vikings in 2010 after starting her coaching career at MSU-Moorhead. Her 2013 team posted a 13-25 record.

VCSU Athletic Director, Jack Denholm, says, “We appreciate the time and effort Susan put into the Viking volleyball program over the past four seasons. Her leadership helped produce several all conference players and NAIA Scholar-Athletes. We wish her the best in the future.”

BISMARCK, N.D. (AP) – Maryland’s governor has settled a football wager and had a box of crabcakes delivered to the North Dakota governor’s office. Governor Jack Dalrymple (DAHL’-rimp-ul) received the special delivery Wednesday from Maryland Governor Martin O’Malley. The two governors had a friendly bet on the outcome of the NCAA Division One Football Championship Subdivision title game in which NSDU defeated Towson earlier this month.

 MINNEAPOLIS (AP) – The Minnesota Vikings say Mike Zimmer is their new coach. The Vikings announced the news on Twitter on Wednesday night. Zimmer becomes the team’s ninth head coach in the franchise’s 54-year history. He replaces Leslie Frazier, who was fired after the team went 5-10-1 and missed the playoffs. Zimmer was the defensive coordinator in Cincinnati. The 57-year-old is getting his first chance to be a head coach.

UNDATED (AP) – A person familiar with the deal says pitcher Clayton Kershaw has agreed to a $215 million, seven-year contract with the Dodgers. That makes the two-time Cy Young Award winner baseball’s first player with a $30 million average salary.
 
     The person spoke on condition of anonymity because the agreement had not yet been announced.
 
     Kershaw receives the most lucrative deal for a pitcher, breaking the mark of $180 million set by Justin Verlander last March for his seven-year contract with Detroit.
 
     The average salary of $30.7 million tops the previous high of $27.5 million, set by the New York Yankees’ Alex Rodriguez as part of a 10-year agreement December 2007.

 

 PHILADELPHIA (AP) – A person familiar with the decision says Charlie Manuel has agreed to return to the Philadelphia Phillies, accepting a position offered to him the day he was fired as manager. The 70-year-old Manuel will be a senior adviser to Phils GM Ruben Amaro Jr.

     MELBOURNE, Australia (AP) –  Maria Sharapova (shah-rah-POH’-vah) survived the searing heat and intense challenge from Karin Knapp to advance to the third round of the Australian Open with a grueling 6-3, 4-6, 10-8 win in 3 hours, 28 minutes on Thursday.
 
     Some matches were suspended Thursday at the Australian Open, with organizers implementing the Extreme Heat Policy when the temperature reached 108 degrees.

WASHINGTON (AP) – Congress is on the brink of approving a $1.1 trillion bipartisan spending bill that keeps the government afloat through the end of the fiscal year in October — just before the elections. It’s the Senate’s turn to act, possibly as early as today, after the bill got overwhelming approval in the House yesterday. The measure contains compromises on almost every one of its 1,582 pages.
 
     WASHINGTON (AP) – President Barack Obama highlights his effort today to expand access to higher education. He and first lady Michelle Obama plan to welcome university presidents to the White House and request commitments from each to help more low-income students attend college. Leaders from more than 100 colleges and universities, plus 40 nonprofit and other groups, are expected to attend.
 
     LUCASVILLE, Ohio (AP) – A never-tried lethal injection method is about to be used in Ohio, where a convicted killer is scheduled for execution today. The state will use a two-drug combination because supplies of the state’s previous drug have dried up. Dennis McGuire’s lawyers say the combination carries substantial risk of air hunger, which would cause him to experience terror as he strains to catch his breath.
 
     NEW DELHI (AP) – Indian police say two suspects are in custody and they’re closing in on six homeless men in the gang rape of a 51-year-old Danish tourist in New Delhi. It’s seen as another case highlighting the plague of sexual violence in India, which threatens to tarnish its tourism industry.

 
     CAIRO (AP) – Egypt is about to get a revamped constitution prompted by the military’s ouster of Islamist President Mohammed Morsi. Officials say unofficial results, after most of ballots have been counted, indicate that more than 90 percent of the voters have said “yes” to the new document. The draft is a key piece of a political roadmap toward new elections for a president.
