Jamestown (CSi) The Jamestown City Council met in Regular Session Monday at City Hall. All members were present.
No Consent Agenda items were discussed separately.
REGULAR AGENDA…
Resolutions:
A Public Hearing was held concerning the request from the James River Valley Library System for a letter of support from the City to apply for a grant, in the amount of $74,000.00, from the USDA to partially fund the replacement of the bookmobile. Library Director, Joe Rector said the present vehicle is nearly 20 years old with 100,000 miles on it. He said a new smaller vehicle would cost about 130,000 to 150,000.
Following the Public Hearing the City Council approved providing a “Certification of Significant Community Support” for the James River Valley Library System to apply for a grant from the USDA to replace the bookmobile.
Council Members discussed additional considerations relative to the paint scheme for the new southwest water tower. Mayor Andersen said the proposed logo from Tourism is not a good fit, and would be cost prohibitiive.
Council Member Buchanan moved to approve the basic bid of $25,000 for a white paint scheme with “Jamestown” in black lettering, which Mayor Andersen would not be “value added.” She prefers a solid blue color, with no logo at this time.
Buchanan amended his motion to “one color,” with no logo or lettering.
The council members voted unanimously in favor of the amendment, with the change order.
A second vote on the color of Midwest Sky Blue was approved unanimously.
Committee Reports:
Awarded the bid for the sale of an impounded/abandoned vehicle a 2005 Chevy Silverado to Budget Auto Sales in the amount of $8,651.00
Awarded the bid for the purchase of a New Roll-Off Truck (Cab, Chassis & Hoist) for the Solid Waste Department, to Sanitary Products, in the amount of $142,867.
Awarded the bid for the “AS-IS” Direct Sale of a 2000 Sterling, LT8513, Roll-Off Truck (Cab, Chassis & Hoist) in the Solid Waste Department, to Northland in the amount of $11,110.00.
The Council declared that the Fusion Automation, Inc., bid for the City of Jamestown Pump Stations Improvement Project to be an irregular bid due to the bidder not having a current contractor’s license as required by NDCC 43-07-12.
Following that the Council awarded the bid for the City of Jamestown Pump Stations Improvements Project to Swanberg Construction, Inc., in the amount of $1,282,400.00.
Ordinances:
A FIRST READING: Concerning an ordinance to amend Ordinance No. 329 by amending the District Map to change the zoning of a tract of land located in the NW Quarter of Section 2, Township 139 North, Range 64 West (Menards Site) from P-O-C (Public Open Development & Conservation District) to C-2 (General Commercial District).
A FIRST READING: Concerning an ordinance to amend Appendix C, Section 5.8, of the City Code pertaining to uses permitted, M-1 Districts.
A SECOND READING: of an Ordinance to enact Chapter 6.5 pertaining to beekeeping within the city. A permit for beekeeping is established with approval of 75% of neighbors with a 150 foot radius of the hives. City Attorney Dalsted said the Ordinance was based on state regulations which has changed.
The Council tabled a vote on the issue.
A SECOND READING: of an Ordinance was approved to amend and re-enact Section 2-19.1 of the City Code pertaining to administration.
A Public Hearing was held concerning an ordinance to change the zoning of Lot 8, Block 3, Buchholtz Fourth Addition, from R-1 (One-Family Residential District) to P-O-C (Public, Open Development & Conservation District).
Following the Public Hearing a SECOND READING: of an Ordinance to
amend and re-enact the Ordinance was approved.
A Public Hearing concerned an ordinance to change the zoning of Plat C in the SW
Quarter of Section 36, Township 140N, Range 64W, in the City of Jamestown, from R-1 (One- Family Residential District) to P-O-C (Public, Open Development & Conservation District).
Following the Public Hearing a SECOND READING of an Ordinance to
amend and re-enact the Ordinance was approved.
A Public Hearing concerned an ordinance to change the zoning of a four (4) acre tract of land in the NE Quarter of the SW Quarter of Section 2, Township 139N, Range 64W, from A-G (Agricultural District) to C-1 (Local Commercial District).
Following the Public Hearing the SECOND READING of an Ordinance amending the District Map to change the zoning was approved.
A Public Hearing was held concerned an ordinance to annex a tract located in the NE Quarter of the SW Quarter of Section 2, Township 139N, Range 64 W, containing 3.99 acres, more or less.
Following the Public Hearing, a SECOND READING of an Ordinance was approved.
A SECOND READING of an Ordinance to amend and re-enact a Chapter of the City Code pertaining to provisions regulating crew camps in the city was approved, including an amendment inserting of lighting provisions, along with sign requirements outside crew camp fence, along with other changes in provisions, including a site plan.
The Ordinance is a regulatory tool, and is based on the Crew Camp regulations approved by the Stutsman County Commission.
Hearing from the audience: Jim Boyd commended the City on implementing a strategic plan. He pointed out however that the plan needs to be updated soon.
Joan Morris spoke and asked about the progress on a Jamestown Recycling study, to which the Mayor said progress is being made, on the scope of work on the plan, which will determine the time line.
Appointments:
The City Council approved the appointment of Delores Rath to serve as a member on the Planning Commission for a term to expire August 2018.
Mayor and Council Member Reports:
Council Member Buchanan congratulated the street and engineering department on the timely removal of the recent blizzard snowfall amounts.
He pointed out complaints about 10th street Northeast between 5th and 6th Avenues Northeast, concerning a rough pavement and access of those avenues to 10th Street.
Mayor Andersen said the area will be discussed at a committee meeting, concerning adding 10th Street Northeast to the Snow Emergency Routes.
Other Business:
The City Council considered recognizing the Jamestown Regional Medical Center Relay for Life Team as an other public spirited organization and to authorize the issuance of a Raffle Permit with the drawing to be held June 22, 2014.
The Council approved authorizing conveying by Quit Claim Deed to the Jamestown/Stutsman Development Corporation Lot 2, Block 1, Redmond 2nd Addition, in exchange for the South 200 feet of the East 235 feet of Lot 1, Block l, Bloom Industrial Addition, A Replat of Auditor’s Lot 27-1, Bloom
Township, within the East Half of Section 27, Township 140, Range 63, to the City of Jamestown, Stutsman County, North Dakota.
The City Council approved the amendment to the Developer’s Fee Agreement between R. H. Johnson Company, Woodsonia Real Estate Group, Inc., and the City of Jamestown. (Menard’s project). Council Member Buchanan voted in opposition.
Authorized submitting an application to the North Dakota Health Department and Public Finance Authority for a SRF (Drinking Water) loan to finance the City of Jamestown Pump Stations Improvements Project, DWSRF No. 4700498-05, in the amount of $910,000.00.

Jamestown (CSi) The deadline to file to run in the June 10, 2014 elections was Monday at 4-p.m.
The Jamestown City Auditor’s Office reports that Mayor petitions filed for a four year term, is Mayor Katie Andersen, for re-election.
Pam Phillips has filed her petitions to run for mayor.
Filing to run for the city council seat, up for election, a four year term are:
The incumbent Ramone Gumke, and Dwaine Heinrich.
For City Park board, three seats to be elected, for four year terms are Mike Landscoot who has filed for re-election as has Larry Knoblich. Also filing are Kevin Miller, and Richard Ryan.
Joyce Heinrich is not seeking re-election.
For Municipal Judge, Timothy Ottmar has file his petitions for re-election.
The filed petitions will then be reviewed to make sure they contain the proper number of valid signatures.
The elections will be held on June 10, 2014.
In Valley City City Auditor Avis Richter says those filing to run in the April 10, 2014 city elections are:
For Mayor: The incumbent Robert Werkhoven, and Jeff Edwards
For City Council two seats: Matt Pedersen and Duane Magnuson-incumbants, and Gary Schlegel.
For City Park Board the three incumbents have filed: Mike Lentz, Buff Murray, and Susan Kringlie.
The filed petitions will then be reviewed to make sure they contain the proper number of valid signatures.
The elections will be held on June 10, 2014.

Jamestown (CSi) The Jamestown City Fire Department was called to an apartment building Sunday about 6:24 to help an individual be removed from his unit, due to a medical emergency.
The apartment was located at 1514 6th Avenue, Southwest.
The person, who weighs 500 pounds, was taken from the balcony of the unit, after being placed in a stokes basket and then onto a platform on the ladder truck, and then lowered to the ground, where he was placed on a gurney.
The logistics of the apartment hallway with tight corners to the stairway, did not allow for the a conventional exit.
He was transported to Jamestown Regional Medical Center for treatment.
Four city fire units were on the scene with 14 fire fighters assisting.
Jamestown (CSi) The Mrs. North Dakota ~ America Pageant Weekend is planned for April 10th – 12th, 2014.
Mary Schwartzkopf, Mrs. North Dakota-America 2011 who is the state pageant director will be leading the festivities with her staff and Sister Queens (called the Queen Team) during the pageant weekend. The final pageant show is scheduled for Saturday at 7:00 pm, April 12th at the Jamestown Civic Center in Jamestown, ND.
This year’s venue theme is “The Past is in the Past….Let It Go” to the pageant show featuring the movie, “Frozen” as well as musical vocal dynamics from the current Mrs. ND-America 2013, Aly Downs. Last year at Mrs. America, Aly was asked to entertain and sang “God Bless America” at the Prelims and Finals events. A few of the state titleholders entertained as well to make it an evening of musical delight. This year, The Mrs. Nd-America State Pageant Entertainment Headliner is our very own Mrs. ND-America 2013, Aly Downs sharing her vocal talents as she sings the theme song, “LET IT GO” from the 2014 Oscar Winner Best Animated Feature Film, Disney’s FROZEN! Miss James River Valley, Annika Vernon will also entertain with vocal selections during the pageant that evening as well.
Local titleholders from across the state of North Dakota will be competing for the state crown and arriving in Jamestown on Thursday, April 10th, 2014. During the pageant weekend, the ladies will be on location, participating in a photo-shoot in the city of Jamestown, visiting local attractions and meeting with pageant sponsors. This year, there will be an “In-House” Fashion show planned that Friday afternoon at Leanne’s Bridal in Jamestown with the local titleholders and Mrs. NDA 2014 modeling formal gowns and bridal wear that the store features at 1:30pm at Leanne’s Bridal.

The Mrs. North Dakota ~ America Pageant is the official state preliminary to the national event. The state pageant will be held on April 12th at 7:00pm in the Jamestown Civic Center.
The 2014 Mrs. America Pageant will be held in Tucson, AZ in August. This year the National directors will include an online page with the “First Runner-up Delegates” from every state that will have their photo to be voted on. The First Runner-up who wins with the most online votes will be an additional delegate at the Mrs. America 2014 as the

Jamestown (CSi) Stutsman County Auditor/COO Casey Bradley reminds North Dakota voters that they will need to update their address if they have moved since they last voted.
Voters Must Update Address by May 10, 2014, Or Earlier for Absentee or Early Voting.
New residents of the state are also to obtain their North Dakota ID by this same date. State law requires that voters must live in a precinct 30 days prior to voting in any election. This law applies whether voting by mail or in person.
To update a Driver’s License or Non-driver’s ID, voters can:
- Visit their nearest Driver’s License site or
- Use the online tool at vote.nd.gov, or
- Call (701) 328-2600 or 1-855-637-6237
- The TTY Number 711 or 1-800-366-6888.
Mr. Bradley says, “Many voters have asked if it’s OK that their ID still has their old address printed on it, even though they have updated their record with the Department of Transportation, and the short answer is, ‘yes’ it’s OK.” He says the ND Department of Transportation can issue a new ID card for a minimal fee, however the free option to update the address with DOT will cause the correct address to appear in the poll book, which the poll worker will use to confirm that the voter is eligible to vote in that precinct. Again, this needs to be done by May 10th, 30 days prior to the June Primary Election.
The five forms of identification valid for voting are:
- North Dakota Driver’s License
- North Dakota Non-driver’s ID
- Tribal Issued ID
- Student ID Certificate
- Long Term Care ID Certificate
In all cases, the ID must include the voter’s name, residential address (no PO Boxes) and date of birth. Not all tribal-issued IDs include all the required information, so it is important to check them ahead of time.
Vote.nd.gov not only has a link for updating addresses online, but also has tools for finding your voting precinct, previewing your ballot and other information.
“It is vitally important to get the word out about this,” says Mr. Bradley. “Everyone who wants to vote and is eligible to vote will have that opportunity if they take simple, but important action now to be sure their identification record is in order.”
Jamestown (CSi) At the April 10, 2014 Jamestown Downtown Association Board of Directors meeting, the board will discuss moving the office to a new location, and the possibility of combining the location with a Jamestown Bus Depot.
Ambassador Charlie Kourajian, will ask the board’s permission to move the JDA Office to 112 8th Street Southeast, across the street South of Papa Murphey’s.
Other items on the agenda include Bob Martin and Michelle Neumiller from the Chamber City Beautification Committee to discuss this year’s flower basket program. The meeting will be on April 10th at 11 AM at the KC Hall.
WILLISTON, N.D. (AP) – Road repairs in the north unit of the Theodore Roosevelt National Park are expected to begin this week ahead of the heavy tourist season.
The rainfall of the past few years has severely damaged the roads in the area.
Valerie Naylor is the park’s superintendent. She says maintaining the north unit’s scenic drive is always a challenge because of the unstable badlands soils.
Naylor says the levels of soil moisture of the last five years combined with the local geology have made road maintenance a constant issue.
The scenic drive will be closed at the Caprock Coulee parking area during the repairs, which are expected to be finished by May 15.
BISMARCK, N.D. (AP) – A Bismarck eighth-grader will represent North Dakota at the National Geographic Bee next month.
Home-schooled Erik Johnson won the state bee last week at the University of Mary in Bismarck. He beat out 100 other students. He won $100, a National Geographic Atlas and a trip to Washington, D.C., for the national competition May 19-21.
Will Rice of Devils Lake placed second at the state bee and Keshava Katti of Fargo took third.
BISMARCK, N.D. (AP) – Job fairs are being held in eight North Dakota cities and four South Dakota cities to woo workers to the western North Dakota oil fields.
The events are part of an initiative launched by Dakota Construction Careers. The coalition of six labor unions has launched a campaign to recruit construction workers and people wanting to learn building trades.
Brian Aske with the International Union of Operating Engineers Local 49 says companies are “running out of people for jobs.”
Rapid City, S.D., construction company owner Andy Scull says there’s a growing need for schools, hospitals, recreation centers and government buildings in western North Dakota. He opened an office in Dickinson two years ago that employs 50 workers, and says he could easily hire another 50.

BISMARCK, N.D. (AP) – U.S. senators from North Dakota and Minnesota are making a friendly wager on the outcome of the NCAA Frozen Four semifinal hockey matchup involving the University of North Dakota and the University of Minnesota.
Republican Sen. John Hoeven of North Dakota is putting up a box of chocolate-covered potato chips, and Democratic Sen. Amy Klobuchar of Minnesota is wagering a homemade frozen hot dish.
UND plays Minnesota on Thursday for the right to advance to the national championship game, against either Boston College or Union. This year’s Frozen Four is in Philadelphia.
In world and national news…
PERTH, Australia (AP) – It could still take days to confirm that the signals that have been picked up by an Australian navy ship are coming from the black boxes from Malaysia Airlines Flight 370. But the head of the search effort says it’s a “promising” development. He says the signal sounds “just like an emergency locator beacon.” If the signal can be picked up again, Navy specialists might be able to pinpoint a location where an unmanned miniature sub can be sent down.
WASHINGTON (AP) – Secretary of State John Kerry is going to meet with top diplomats from Russia, Ukraine and the European Union — part of a new effort to calm tensions in eastern Ukraine. Pro-Russian activists who have barricaded themselves inside a government building in eastern Ukraine are proclaiming the region to be independent. And they are calling for a referendum on seceding from Ukraine. The White House is warning Moscow there will be further sanctions if it intervenes.
NEW YORK (AP) – Stocks are extending their slump, putting the S&P 500 on track for its first three-day losing streak since January. Leading the declines are companies selling non-essential goods and services. Investors this week will start focusing on the outlook for corporate earnings, as companies begin to report first-quarter results.
SAN DIEGO (AP) – A U.S. Navy warship carrying a sick baby and her family is expected to arrive in San Diego at mid-week. The one-year-old girl, her three-year-old sister and their parents were rescued from a disabled sailboat hundreds of miles from Mexico’s Baja peninsula after the family called the Coast Guard for help last week. They’d been sailing around the world in the 36-foot boat. The parents say the girl is doing better now that she’s on board the USS Vandegrift.
PHOENIX (AP) – A Phoenix woman who left her two young children in her vehicle during a job interview has pleaded not guilty at her arraignment. The case of Shanesha Taylor has attracted attention with her tearful police mugshot, and people rallying to her defense online to raise money for her. She’s facing two counts of child abuse. Court documents say Scottsdale firefighters found both children sweating profusely in the car.
