ROBINSON, N.D. (AP) – A pickup truck rollover crash north of Robinson has killed one teenager and injured two others.
The Highway Patrol says a 15-year-old Steele boy who was a passenger died in the Tuesday night crash. The 15-year-old driver and a 13-year-old passenger were hurt. They were not immediately identified.
The patrol says the crash happened shortly after 9 p.m. on a gravel road. The teens were returning from an area lake when the driver lost control. All three occupants were thrown from the vehicle.
Valley City (CSi) The Valley City Commission met in Regular Session Tuesday evening at City Hall. Commissioner Pedersen was present via telephone conference call.
Approval of Consent Agenda items included:
Monthly Reports from the Fire Chief, Building Inspector, Auditor, Municipal Judge and Public Works Accountant.
Monthly Bills for the City and Public Works in the Amount of $3,010,300.49.

Ordinances:
Following an explanation of amendments by City Attorney Russell Myhre, the City Commission approved the second and final reading of an Ordinance recodifying the Criminal Ordinance.
New Business:
Approved awarding an asbestos removal bid for $$28,250 for phase two buyouts.
The City Commission approved two Conditional Use Permits for a structure for BEK Communications (Valley View, Granger Hill).
Approved awarding the bid to Freightliner for a Public Works dump truck chassis (2) in the amount of $85,465.66 each. City Administrator Schelkoph, the expenditure is under budget from the Public Works Department, Capital Improvement budget.
Awarded the bid to Northern Truck for a Public Works dump truck body (2) in the amount of $49,580 each.
Awarded the bid for Phase II house demolition buyouts, with landscaping to Six D Construction in the amount of $250,000.
The City Commissioners discussed the mill & overlay project on 5th Avenue NE, 12th St N to city limits and a $5,000 verbal commitment from Paul Diegel. City Administrator Schelkoph said Mayor Werkhoven suggested the Mill and Overlay, and Diegel has agreed to outlay the $5,000.
The Commissioners approved the project.
Approved a Special Alcohol Beverage Event Permit for the Eagles Club at Winter Show Event Center on June 14, 2014, a truck mud run event.
Informational:
Commissioners discussed local funding in conjunction with the State Water Commission to pay toward permanent flood protection in Valley City.
Commissioner Nielson said a half percent sales tax would fund the project, at 80 percent state and 20 percent local, at $450,000 annually over 40 years.
She pointed out that in 2017 the half percent city sales tax now in effect for the HAC expires. Any additional sales tax percentage will have to be approved by voters.
She said there will be public meetings in the future to further discuss the progress of the project and funding options.
No action was taken by the City Commission.
City Administrator David Schelkoph’s Report:
He said an Ordinance is being developed concerning disposal into the sanitary sewer system.
He pointed out that residents should keep all types of cooking oil, and grease out of the system, and, large items such as diapers are not appropriate for flushing.
City Attorney Myhre is working on language in the Ordinance.

City Attorney Myhre noted that two more flood buyouts are being worked on.
City Auditor Richter said the buyouts are still under budget.
Fire Chief Retterath passed along a complaint he’s received about the language being used by city employees, and asked the Commission to take note of the complaint.
With fire statistics he pointed out that residents need to be cautions about starting garage fires, noting electrical problems.
Police Chief Thompson said a new radar unit has arrived.
He added a federal grant will be used for amenities, saying the dollars need to be used within a certain period of time.
Mayor Werkhoven said the city continues to work on mitigating Special Assessment costs.

Jamestown (CSi) the North Dakota Highway Patrol reports, an SUV and Semi collision Monday evening about 5:11, on Highway 281 and Highway 13 at Edgely, injured a Wishek woman.
The Freightliner operated by 40 year old Claude Forbes of Ontario was southbound on Highway 281. A Jeep driven by 68 year old Nancy Brandner of Wishek was westbound on Highway 13. Brandner failed to yield after stopping at the intersection and struck the left side of the semi trailer. The Jeep came to rest on the northbound lane. The Forbes vehicle slowed and attempted to avoid the crash by driving onto the west shoulder and came to rest on the southbound lane. Brandner was extricated and airlifted to a Bismarck hospital. Forbes was not injured. Traffic was diverted onto a nearby frontage road until the vehicles were towed from Highway 281.
The crash remains under investigation.
Assisting the NDHP at the scene was Edgeley Ambulance, and then Brandner was airlifted to a Bismarck Hospital.
Also at the scene were: the Lamoure County Sheriff’s Office and Edgely Fire and Rescue.
Jamestown (CSi) To go along with the new branding, “Jamestown Tourism,” is the slightly changed name of Buffalo City Tourism.
On Tuesday’s Wayne Byers Show, on CSi Cable 2, Jamestown Tourism Director, Searle Swedlund said the new name along with the new branding “Discover Jamestown, North Dakota,” better reflects the offerings available in the area.
He said tourism still promotes such attractions as The World’s Largest Buffalo, the buffalo herd, Frontier Village, the National Buffalo Museum and other traditional attracts, plus the historical nature of the area.
In addition tourism is extending its efforts to promote the Jamestown area as an outdoor attraction for campers and others, highlighting the Jamestown Reservoir, and outdoor availability’s.
Swedlund also pointed out the Jamestown Area Source Guide is available at the tourism office, outside Frontier Village, and is widely distributed through locations in Jamestown, and being sent to locations in the area.

Jamestown (CSi) To mark United Airlines and SkyWest start up for Jamestown, there will be a water cannon salute for their first arrival in Jamestown on Thursday, June 5, 2014, with the scheduled landing at 12:46 p.m.
The Jamestown Fire Department has agreed to provide the water cannon salute, with public is invited to attend and greet the first flight.
Jamestown Regional Airport Manager Matt Leitner says access to the field will be limited due to safety and security.
Viewing opportunities will be available from the terminal and at west fence adjacent to the terminal.
He adds, a water cannon salute is tradition in welcoming a new service or saying goodbye to retiring crews and aircraft.
An open house will also be held on June 20,2014 at 11:00 AM. This event will be attended by representatives of federal, state and local governments and United Airlines and SkyWest officials.
BISMARCK, N.D. (AP) – A North Dakota postmaster is accused of collecting emergency salary advances he had authorized for his employees.
Edmond Sharp IV is charged in federal court with misappropriation of postal funds and false statements. He is scheduled to make his first appearance on Friday.
Prosecutors say the scheme took place between June 2013 and February 2014 while Sharp was the postmaster at Beulah. It’s not clear how much money was involved.
Court documents do not list a lawyer for Sharp.
FARGO, N.D. (AP) – The trial for a North Dakota woman accused of killing her husband by means of drugs and asphyxiation has been moved to Fargo.
Sixty-one-year-old Sherry Midstokke, of Finley, is charged with Class AA felony murder in the death of 66-year-old Lyle Midstokke.
The defense team for Midstokke filed a change of venue request, and Judge Steven Marquart has approved it. Midstokke was originally to be tried in Steele County.
MINOT, N.D. (AP) – Minot police say officers arrested two Minot men during a burglary in process at a downtown pawn shop.
Police say officers responded to the burglary at about 11 p.m. Monday. Police arrested 18-year-old James Skinner and 19-year-old Clayton Shubert at the scene.
The teens were charged with felony burglary and are being held in the Ward County Jail pending an initial court appearance.
BISMARCK, N.D. (AP) – Supporters of changing North Dakota’s pharmacy ownership law can begin circulating petitions to try to bring the issue to voters.
Secretary of State Al Jaeger has approved the format of the petition. Supporters need to gather and submit at least 13,452 valid signatures by Aug. 6 to get a proposed measure on November’s general election ballot.
It would change a requirement in North Dakota law that says majority ownership in pharmacies in the state must be held by a registered pharmacist. That could open the door for big-box retailers such as Wal-Mart to operate pharmacies in the state.
A similar petition drive failed in 2010, a year after the 2009 Legislature defeated a bill that would have repealed the pharmacy ownership requirement.
BISMARCK, N.D. (AP) – A Bismarck man’s appeal in a drunken driving case is taking on North Dakota’s strengthened implied consent law.
The state Legislature last year strengthened driving under the influence laws, and made a suspect’s refusal to submit to chemical testing a crime on par with DUI. Under the implied consent law, drivers imply their consent to testing as a condition of having a driver’s license.
The North Dakota Supreme Court heard arguments Tuesday in the case of Jason Brenny, who was arrested last September. Defense attorney Chad McCabe maintains that the implied consent law constitutes an unreasonable search – a violation of the Fourth Amendment. Prosecutor Christine Hummert McAllister disputes that, and says such statutes have been upheld in other states.
Justices will rule later.
BISMARCK, N.D. (AP) – Several state agriculture leaders say the Environmental Protection Agency’s proposed rule for the Clean Water Act is an overreach of federal authority and should be reconsidered.
State Agriculture Commissioner Doug Goehring and agriculture officials spoke on the proposed rule Tuesday morning in Bismarck.
Under the rule proposed by the EPA and the Army Corps of Engineers, seasonal and rain-dependent streams – and wetlands near rivers and streams – would be covered by the Clean Water Act. Others would be considered on a case-by-case basis to determine if they play a significant role in the quality of downstream waters.
Goehring says the rule could hurt agriculture in the state and eventually lead to permits being required for basic farming practices, including weed control and pesticide application.
GRAND FORKS, N.D. (AP) – The Grand Forks City Council has voted to ban selling electronic cigarettes to minors after concerns of underage use have grown.
The Council approved the ordinance Monday night.
City Attorney Howard Swanson says the new ordinance treats electronic cigarettes the same as tobacco products in terms of licensing and sales to minors.
Several other cities in the state have passed or are considering similar ordinances. Swanson says state law already bans using the “e-cigs” in public places.
The new ordinance will take effect July 1.
LEITH, N.D. (AP) – The town of Leith (leeth) has invited Gov. Jack Dalrymple and members of North Dakota’s congressional delegation to help the community celebrate its birthday and the end of a months-long clash with a white supremacist who unsuccessfully tried to take over.
It wasn’t immediately clear if Dalrymple, Sens. John Hoeven and Heidi Heitkamp and Rep. Kevin Cramer planned to attend.
Leith is holding is 105th birthday bash the weekend of July 19-20. Town spokesman Greg Bruce says the event “will be a celebration of freedom from the last nine months of terror.”
Craig Cobb is serving four years of probation for menacing and terrorizing residents. He no longer owns property in the town and has been ordered to stay away from his victims there. He’s seeking to move to Missouri.
BISMARCK, N.D. (AP) – Public Service Commission Chairman Brian Kalk has been appointed to the National Coal Council.
Kalk says he was appointed to the position last week by U.S. Energy Secretary Ernest Moniz. The National Coal Council’s purpose is to inform and make recommendations to the Energy Secretary on all matters relating to coal and the coal industry.
Kalk is a Bottineau native who served for 20 years in the Marine Corps before retiring as a major in 2006. Kalk taught at North Dakota State University before he was elected to the PSC in 2008.
The PSC is a three-member panel that regulates coal mining, land reclamation, pipelines, electric and gas utilities, grain elevators, telecommunications and auctioneers.
BISMARCK, N.D. (AP) – U.S. Attorney General Eric Holder is coming to North Dakota. U.S. Attorney Timothy Purdon it’s the first time a sitting attorney general has visited Bismarck since Robert F. Kennedy addressed the National Congress of American Indians in September of 1963. Holder is scheduled to speak tomorrow afternoon the James Henry Community Center.

MILWAUKEE (AP) – Josh Willingham hit a three-run homer as the Minnesota Twins beat Milwaukee 6-4 last night in a game delayed when a fan fell into the Brewers’ bullpen. The game was held up at the start of the eighth inning after the man fell. He was carried on a stretcher out of the bullpen in left-center field.
MILWAUKEE (AP) – A man has been carried off on a stretcher during the Minnesota Twins’ game at the Milwaukee Brewers after falling into the home bullpen. The man had a brace around his neck as he was wheeled off. The Brewers say the fan was conscious and alert and was being taken to Froedtert Hospital.

State, business and sports leaders appeared yesterday with Governor Mark Dayton to describe their push for college basketball’s biggest weekend. They think the gleaming new $1 billion stadium being built for the Minnesota Vikings is the perfect setting for the Final Four.

NEW YORK (AP) – NHL Commissioner Gary Bettman has cut Daniel Carcillo’s (KAR’-sihl-ohz) suspension from 10 games to six, meaning the New York Rangers enforcer could play in the Stanley Cup finals. Carcillo was suspended on May 23 after he appeared to twice elbow linesman Scott Driscoll, who was trying to keep Carcillo away from a fight during Game 3 of the Eastern Conference finals. The original ban would have kept him completely out of the Cup finals.
LOS ANGELES (AP) – The first game of the Stanley Cup final is tonight in Los Angeles. The Kings and Rangers are squaring off for the NHL championship this year with the first two games in L.A. and Game 3 set for Monday in Madison Square Garden.

UNDATED (AP) – Los Angeles Angels outfielder Josh Hamilton has been activated after spending almost two months on the disabled list. The former AL MVP has been out since tearing a ligament in his left thumb sliding headfirst into first base on April 8. Hamilton hit .444 with two homers and six RBIs in eight games for the Angels this season before getting hurt.
The Brewers are set to activate Aramis Ramirez from the disabled list on Wednesday after the third baseman was sidelined more than three weeks with a strained left hamstring. Ramirez was hitting .252 with five homers and 21 RBIs when he got hurt May 11.

SAN ANTONIO (AP) – The NBA Finals get going tomorrow night with the Spurs hosting the Heat. Parker is averaging a team-leading 17.2 points and 4.9 assists this postseason but has been bothered by injuries the past two rounds.

MONTGOMERY, Ala. (AP) – Winning certainly plays off. The Alabama system trustees’ compensation committee has approved a new deal for football coach Nick Saban. He will make nearly $7 million a year through 2022. The 62-year-old will make $6.5 million in base pay and “talent fee” plus a $400,000 completion fee for each year. Saban has led the Crimson Tide to three national championships in seven seasons.

BERLIN (AP) – Germany’s chief federal prosecutor says he’s opened an investigation into the alleged monitoring of Chancellor Angela Merkel’s (AHN’-geh-lah MEHR’-kuhlz) cell phone by the U.S. National Security Agency. The prosecutor has been mulling for months whether to open a formal probe of the allegations, which cooled relations between Berlin and Washington.
BRUSSELS (AP) – The top NATO commander says the Russian threat in the Ukraine region means the alliance needs to consider a long-term troop deployment. U.S. Air Force Gen. Philip Breedlove says the remaining Russian troops on the Ukraine border look like they intend to stay there, while rebel forces inside Ukraine continue to destabilize the Kiev government.
BRUSSELS (AP) – Russian President Vladimir Putin is gone but not forgotten as the G-7 leaders meet over dinner today. Russia’s actions in Ukraine got him disinvited and the meeting was switched out of Russia, but Putin is still expected to dominate the agenda. Before Putin’s annexation of the Crimea, Russia had been a member of the group then known as the G-8. The G-7 members have differing positions on Russia.
KABUL, Afghanistan (AP) – A Defense Department spokesman says there’s no reason to think a Taliban video of the transfer of Sgt. Bowe Bergdahl to U.S. forces in eastern Afghanistan is anything but genuine, though the recording is being reviewed. A statement accompanying the video characterizes the swap for five Taliban officials as a significant achievement. The Taliban officials held at Guantanamo were flown to Qatar (GUH’-tur).
MILFORD, Conn. (AP) – A court appearance is scheduled today for a 17-year-old in Connecticut charged in the fatal stabbing of a fellow student on prom day. The hearing will determine if there’s enough evidence to prosecute Christopher Plaskon. He’s charged with murder in the death of Maren Sanchez and police are investigating whether it was related to Sanchez’s refusal to be Plaskon’s date.
