FARGO, N.D. (AP) – The director of a former youth chemical dependency center in Jamestown agreed to pay $1.5 million in a civil suit over accusations of misconduct among staff members, one of whom allegedly had sex with residents and encouraged them to use drugs and alcohol
Recently unsealed court documents show that the complaint was filed six years ago on behalf of 11 minors against Fargo-based Drake Counseling Center Inc. and Charles Drake. The suit says the center “absolutely failed in its duty to the children involved.”
No criminal charges were filed in the case and the Drake Counseling Center license is in good standing with the state. Drake now runs a similar adolescent treatment center near Detroit Lakes.
Drake and his lawyer in the case did not respond to requests for comment.
Valley City (CSi) On Saturday the North Dakota Winter Show Event Center was evacuated for about a half hour as the Valley City Fire Department call, of a smoke odor from a fluorescent light fixture ballast in the office.
Valley City Fire Chief Gary Retterath says fixture was quickly repaired.
At the time of the call, people and animals were inside the North Dakota Winter Show Event Center during the Barnes County 4-H Achievement Days.
Jamestown (CSi) A fundraising effort is underway in Jamestown as local veterans’ groups are looking to send a vet to a reunion with his former unit,
All Vets Club Board of Directors, Chairman, LeRoy Wegenast says, plans are to send 98 year old Ernest Hubacker, to the reunion of Merrill’s Marauders and the Mars Task Force in Milwaukee at the end of August.
Wegenast says so far about $400 has been raised toward the $1,700 needed to cover expenses for Ernie and a family member to attend the reunion.
Ernie will turn 99 about six weeks after he returns from the reunion.
Hubacker’s duty with the Mars Task Force included time in the hills above the Burma Road. He and other members of the unit would call in artillery if Japanese vehicles attempted to use the road. They were also the targets of Japanese artillery.
BISMARCK, N.D. (AP) – Gov. Jack Dalrymple has appointed his staff attorney to a judgeship in the Southeast Judicial District.
Jerod Tufte has been Dalrymple’s legal counsel the past four years. He’ll succeed John Paulson, who retired after serving more than 30 years on the bench.
Six people applied for the job, and Tufte was among three finalists named by a nominating committee. The others were Cass County prosecutor Cherie Clark and Stutsman County prosecutor Troy LeFevre.
Tufte holds a law degree from Arizona State University. He has served as a federal appeals court clerk, as an attorney with a Phoenix law firm, and as a state’s attorney in Kidder and Sheridan counties. He also is a member of the National Guard and has served as legal counsel to military commanders.
Valley City (CSi) A man charged in the October 21, 2013 arson fire and burglary at Faith Lutheran Church in Valley City, will stand trial, August 19-22, 2014 in Barnes County.
26 year old Andrew Miklas is facing charges of felony arson, endangering by fire, and theft of property.
Meanwhile, Barnes County State’s Attorney, Carl Martineck says, 19-year-old Nicole Lindermann will plead guilty to felony conspiracy to commit arson for her alleged part in the Faith Lutheran Church arson fire, along with charges of felony criminal conspiracy to commit burglary and theft of property charges.
Martineck says at her scheduled August 5, 2014 hearing Lindermann may agree to be sentenced or request a pre-sentence investigation.
Jamestown (CSi ) The James Valley Humane Society has outlined upcoming events and fundraisers.
On Friday’s Wayne Byers Show on CSi Cable 2, President, Matt Opsahl said on July 26, 2014 from 10am – 2pm there will be a grill out at Coborn’s.
He said the Humane Society is planning stage for what’s being tentatively called, “Paws in the Park.”
He added that the event will display some of the animals available for adoption and people can learn more about the shelter. There may also be a 5K Run/Walk that day. Plans are still be finalized.
Currently there are 24 cats and 15 dogs available for adoption.
He also pointed out that there is an opening for a weekend paid staff person at the shelter with the hours 7-a.m., to noon. The job involves cleaning and feeding and giving medications to those animals in need.

Jamestown (CSi) The North Dakota Highway Patrol is looking into who owns a boat that was resting on the side of the I-94 roadway, near mile marker 267, about five miles east of Jamestown.
Motorist on Interstate 94 eastbound notified authorities seeing the boat lying on the side of the highway.
Authorities are investigating if the owner lost the boat or if it was abandoned.
LINCOLN, N.D. (AP) – The Burleigh County Sheriff’s Department says a fire has destroyed a home north of Lincoln.
Lt. Dan Lembieux says firefighters and emergency officials were called to the scene at Sunday night.
Lembieuz says the home was engulfed in flames when firefighters arrived.
He says family members safely evacuated the home but a pet died in the blaze.
The cause of the fire is under investigation.
(CSi) The North Dakota Highway Patrol reports, two teenagers were injured Saturday in a rollover 5 miles southwest of Lisbon at about 3:30 – p.m.
A 17-year-old male from Sheldon, was driving a 1996 Chevrolet Cavalier eastbound on a gravel road on 71st Street Southeast.
The driver lost control of the vehicle, entered the south ditch, went through a fence and overturned the car in a ravine.
A 16-year-old female passenger was ejected from the vehicle and was not wearing a seatbelt. The driver was wearing a seatbelt.
Both occupants were transported by First Medic Ambulance of Lisbon to Lisbon Area Health Services. The passenger was later airlifted to a Fargo hospital.
The Ransom County Sheriff’s Office, Lisbon Police Department and Lisbon Fire Department also assisted with the crash.
The crash remains under investigation.
FARGO, N.D. (AP) – A federal appeals court has upheld the life sentence of a man convicted in a North Dakota drug case.
Raul Tovar was found guilty last year of conspiracy to possess methamphetamine with intent to distribute, and aiding and abetting. Authorities say he was dealing drugs in the Fargo and Moorhead, Minnesota, area.
Tovar argued to the 8th U.S. Circuit Court of Appeals that a judge made a mistake when he gave instructions to the jury on the aiding and abetting charge after his lawyer’s closing arguments.
The appeals court says the judge did not prejudice the case because the instructions were given before jury deliberations.
MINOT, N.D. (AP) – Gov. Jack Dalrymple is asking the Federal Emergency Management Agency to assist state and local officials in assessing the damage caused by overland flooding in several areas of the state.
State emergency management officials say initial assessments show total flood damages are exceeding FEMA’s threshold of $1 million for federal cost-share assistance.
Torrential rains in some areas of the state led to flooding that damaged roadways and other public infrastructure. Counties in the northern and northwestern parts of the state have been hit particularly hard.
Dalrymple says he will continue working with local officials and FEMA to move forward on repairs and other flood-recovery assistance.
BISMARCK, N.D. (AP) – The state’s Department of Mineral Resources is slated to release updated production numbers in North Dakota’s oil patch.
North Dakota was producing more than 1 million barrels of oil per day in April.
The numbers for May are slated to be released today.
Oil production numbers typically lag about two months.
WILLISTON, N.D. (AP) – The Williston City Commission has rejected a plan to develop 73 townhouses in the oil boom town.
The council voted to deny the project last week.
Mayor Howard says the project was denied because it was “too dense” for the area.
Code Estates LLC is the project’s developer and provided the city commission with signatures from neighbors who supported the project.
But officials say some neighbors worried about the townhouses turning into crew camps for oil workers and increased traffic.
WILLISTON, N.D. (AP) – A Democratic candidate for North Dakota Senate is asking city and state officials to meet in Williston to discuss high rent increases in the city. Barb Vondell plans to host the meeting Wednesday at the Williston Community Library. Vondell has been fighting against high rent increases at two Williston mobile home courts.
BISMARCK, N.D. (AP) – Sen. John Hoeven says the U.S. Department of Veterans Affairs has awarded a more than $375,000 grant to improve access to health care for veterans living in rural North Dakota.
Hoeven says the grant will fund transportation services for veterans to travel to VA medical centers and other facilities providing VA care.
Hoeven says the grant will benefit approximately 5,477 veterans living in 36 counties in North Dakota.
MANDAN, N.D. (AP) – The Northern Great Plains Research Laboratory at Mandan is holding its annual public open house on Thursday.
The Friends & Neighbors Day event will include research tours, exhibits, speakers, entertainment and free food. Hundreds of people are expected.
The lab is part of the federal Agricultural Research Service. It’s located just south of the Heart River on state Highway 6, on the southwest edge of Mandan.
MINOT, N.D. (AP) – The North Dakota State Fair begins its nine-day run in Minot on Friday.
The annual fair includes everything from agricultural exhibits to carnival rides. This year’s entertainment lineup includes big-name acts Lady Antebellum, Florida Georgia Line, Brad Paisley, John Mellencamp, the Charlie Daniels Band and rockers Three Days Grace.
Retired North Dakota High School Activities Association Executive Secretary Sherm Sylling will serve as grand marshal of the State Fair Parade on Saturday.
The fair runs through July 26. Last year’s fair drew a record 320,485 people.

PLANCHER-LES-MINES, France (AP) – Two-time champion Alberto Contador has dropped out of the Tour de France after crashing during Stage 10 in the Vosges mountains.
The 31-year-old Spaniard with Tinkoff-Saxo Bank becomes the second big favorite to drop out this year after defending champion Chris Froome of Britain crashed out in Stage 5.
Contador began the stage in 4:08 back of race leader Tony Gallopin of France, in ninth place overall.
MULHOUSE, France (AP) – Frenchman Tony Gallopin defends the yellow jersey on the 10th stage of the Tour de France with a testing day of climbing ahead on Bastille Day – France’s national day.
The 161.5-kilometer (100-mile) trek from Mulhouse to La Planche des Belles Filles features four steep Category 1 climbs and is the toughest stage so far.
Gallopin will be hard pushed to keep the jersey and faces still competition from Italian Vincenzo Nibali – who starts the stage 1 minute, 34 seconds behind in second – and from two-time champion Alberto Contador, who is 4:08 back in ninth.
The last section of the final ascent up to Belles Filles features a punishing 20 percent gradient that could shake up the pack and give a clearer indication of this year’s genuine contenders.

ABERDEEN, Scotland (AP) – Justin Rose finished in front of the field to win the Scottish Open. Rose shot a final round 6-under-65 to finish 16-under par, two shots in front of Kristoffer Broberg.
Phil Mickelson had a good round of golf, shooting a 6-under 65 to finish play at 8-under.
This was the final tune-up tournament before this week’s upcoming British Open. Mickelson won both the Scottish and British Opens last year.

SOUTHPORT, England (AP) – Mo Martin of the U.S. has won the Women’s British Open. The 31-year-old shot a final-round even-par 72 to finish 1-under, one shot in front of Shanshan Feng (fung) and Suzann Pettersen. Inbee Park, the leader after three rounds, skied to a 5-over 77 to finish two shots back of Martin, who played golf at UCLA.
The 5-foot-2 Martin started play on the LPGA Tour as a pro two years ago and clinched the Open championship with an eagle on the 18th hole.

UNDATED (AP) – Carmelo Anthony is remaining with the Knicks. He posted the news on his website by saying, “in the end, I am a New York Knick at heart.” It’s believed the Knicks can pay the All-Star forward they acquired in February 2011 nearly $130 million over five years.
Anthony met with Chicago, Houston, Dallas and the Lakers after terminating the final year of his contract and becoming a free agent July 1.

– One of the agents for free agent forward Luol Deng (LOO’-ul dehng) says his client has agreed to a $20 million, two-year deal with the Miami Heat. Deng has averaged 16.0 points per game in his career, almost entirely with the Chicago Bulls.
– Jeremy Lin has joined the Lakers in a trade with the Houston Rockets, who also gave up first- and second-round draft picks in 2015 for the rights to European center Sergei Lishchuk. Lin will make about $15 million this season in the last year of a deal that counts only $8 million against the salary cap. The Lakers have the cap room to absorb Lin’s contract.

It’s the first time one of the world’s most deadly diseases has been seen in the part of West Africa including Guinea, Liberia and Sierra Leone. The key to halting Ebola is isolating the sick, but fear and panic have sent some patients into hiding.
WASHINGTON (AP) – Another big bank is agreeing to a settlement over risky mortgages. Citigroup will pay roughly $7 billion to settle an investigation into subprime mortgages, the type that helped fuel the financial crisis. The Justice Department had previously warned that it would sue one of the nation’s biggest banks. J.P. Morgan is the only other major U.S. bank to settle so far.
LONDON (AP) – Civil liberties groups and the British government are gearing up for a battle over electronic surveillance. Groups including Amnesty International, Liberty and the American Civil Liberties Union are taking Britain’s spy agencies to court in a bid to set limits, even as the government tries to pass legislation to extend its snooping powers. A special court begins hearing the case today.
WASHINGTON (AP) – President Barack Obama will focus on transportation issues this week as he presses Congress to keep highway and transit aid flowing to states. The White House says Obama will discuss the issue tomorrow at a facility in Virginia that tests new technologies for highway transportation. He’ll promote infrastructure funding Thursday during a trip to Delaware.
SKIPPACK TOWNSHIP, Pa. (AP) – Authorities in Pennsylvania say the big stink in a suburban Philadelphia township is coming from residents’ sump pumps. The odor prompted a voluntary evacuation of about 100 homes. The Montgomery County Department of Public Safety says authorities are working to identify the compound producing the smell in Skippack Township.
