Spiritwood (CSi) A 56 year old member of a cleaning crew working at Cargill Malt in Spiritwood was purportedly lacerated with a knife by a co-worker of the crew late Tuesday morning.
Stutsman County Sheriff, Chad Kaiser says the victim had gotten into an argument with a 39 year old male, which led to the altercation, and alleged knifing by the 39 year old.
Kaiser says a Cargill employee called authorities.
When the Sheriff’s Office arrived, the suspect was in a construction trailer, and offered no resistance.
He says the cleaning crew is contracted out of Fargo, which sub-contracts workers.
At this time no information was available as to their names or home towns.
Kaiser says the victim received superficial lacerations and was taken by Jamestown Area Ambulance Service to Jamestown Regional Medical Center, for treatment, and released.
He says the knife used was taken for evidence.
Kaiser says the suspect was not taken into custody, and any charges are pending with the Stutsman County State’s Attorney’s Office.
He says the North Dakota Bureau of Criminal Investigation conducted an interview with the victim at the hospital.

Jamestown (CSi) The Jamestown Police Department is warning residents regarding a convicted sex offender, who has changed his Jamestown address.
Roger Patrick McAvoy as of August 5, 2014 resides at 402 1st Avenue, North, Apt #7, Jamestown, ND
His prior residence was Starlite Motel Unit #1, Jamestown, ND
Mc Avoy is a 53 year old white male, five feet seven inches tall, weighing 172 pounds with brown eyes and brown hair.
McAvoy has been assigned a high risk assessment by the North Dakota Risk Level Committee of the North Dakota Attorney General’s Office.
He was convicted in May of 1995 in Arapahoe County, Colorado, District Court of sexual assault of two girls, age 13 and 14, involving an incident at a skating rink.
Disposition: 90 days, 8-years probation
He was convicted in December 1989 in Burleigh County District Court of Gross Sexual Imposition involving a relationship with a 12 year old girl, that led to fondling and another sexual act.
Disposition: Four years.
McAvoy is currently on probation with North Dakota Parole and Probation.
McAvoy is not wanted by police at this time and is currently serving his sentence. This notification was issued for public safety and not to increase fear in the community. Anyone harassing, intimidating or threatening the offenders their families employers or landlords are subject to prosecution.

Valley City (CSi) The Valley City Commission met in Regular Session on Tuesday evening at City Hall. All members were present.

PUBLIC FORUM
Gary Schlagel spoke about dust in his neighborhood.
City Administrator Schelkoph said the area is swept regularly and the soil will be hydro-seeded.
RESOLUTIONS
Approved a Resolution increasing the sewer rates. City Administrator Schelkoph said the last time the rate were adjusted was in 2009. The proposed increase annually is $5.03 per month, up to $10.88 per month. He said the increase was enough to cover the cost of operation. The rate will be reviewed annually.
ORDINANCES
Approved the first reading of an Ordinance designating the Legacy West Townhome PUD zoned as recommended by the Planning & Zoning Committee. The developer will install the infrastructure at his cost, and turn it over to the city.
NEW BUSINESS
A Public Hearing was held regarding Special Assessments confirmed by the Special Assessment Commission for Storm Sewer District No. 48.
No one spoke at the hearing. Following the Public Hearing, the City Commission approved Special Assessments as Recommended by the Special Assessment Commission for Storm Sewer District No. 48. City Auditor, Avis Richter said the Special Assessment on some parcels on the river side of the dike was reduced due to the reduction in square footage.
The City Commission approved a rezoning request for Tim Logan on Lot 4 Block 3 Fairhill Properties from I-1 to B-2. Commissioner Pedersen abstained from voting.
The City Commission approved a Special Alcohol Beverage Event permit for Tavern 94 for a Hip Hop performance at Dacotah Pavilion. Police Chief Fred Thompson said police will be on hand to make sure the crowd in under control. An organizer said the event will be family friendly.
The City Commission approved updating the Street Excavation (street cutting) Permit in regard to a city Ordinance. Before permits are issued the City Engineer needs to give permission based on such areas as traffic control.
The contractor will also need to supply their state license number, before approval is given.
Economic Development Director Jennifer Feist spoke regarding a possible Sales Tax special election to support permanent flood control and a wellness center.
The Valley City Health, Wellness and Recreation Center concept has been approved by the Valley City Parks and Recreation Board. The total estimated cost is $16 million dollars, as grants and other pledges, fundraisers and donations have been noted toward the total. $4-million dollars would come from a public fund drive, and dollars have been earmarked from the college foundation fund. Also, the State of North Dakota has offered a matching grant. Once the total package has been put together more information will come before the public. The project has been endorsed by Mercy Hospital, with the facility offering prevention and therapy services, under the direction of professionals.
A full presentation will be made before the City Commission, on August 19th along with public meetings this month.
Feist said healthcare education and housing are the main areas of concern being offered while attracting new businesses.
VCSU was represented at the City Commission meeting by Larry Robinson, who said the University supports the concept, adding that it will play a major role in recruiting and retaining faculty, staff, employees and students. He said the VCSU Foundation is working on funding support.
Mayor Werkhoven said he supports the concept, but cautions not to lump the Wellness Center, with permanent flood control with the City Sales Tax, in a public vote. Commissioner Luke believes the two issues are separate. Others speaking indicated support for the issues to come before voters in separate votes.

David Schelkoph said 3,744 AMI automated meters have been installed.
A new woodchipper policy is in effect during tree branch pick up, on a scheduled basis, with three pick ups during the summer months.
He asks the public to be patient with several construction projects going on, including street projects.

City Auditor Avis Richter said an audit of the city books is in draft form.
City Budgeting is coming, up, and last year’s paving projects are being certified for Special Assessments.
City Building Inspector Dave Andersen indicted the fast die-off of elm trees, and noted that the tree roots have to be removed when the tree is cut down.
He said houses damaged by fires are in the process of being inspected for asbestos content.
KlJ reported detours for 7-10 days on Main Street due to water main replacement work, starting Wednesday.
Commissioner Nielson said the Welcome To Valley City gathering attracted 80-families, and noted that the recent Crazy Day was successful.

Jamestown (CSi) The Stutsman County Commission has approved selling the Stutsman County Library building.
If sold, the new owners may ask the library to move out.
The James River Valley Library System yet to determine what the future holds for the county library space.
Currently, the Library Board is circulating a petition that would place a 1/4 percent sales tax on the ballot for the November 4, 2014 elections, for the planned combined Alfred Dickey Public Library and county library to consolidate under one roof in the expanded, renovated, downtown location.
Signatures need to be turned in 60 days prior to the election.
Commissioners are to create a committee to study the county’s space issues and make recommendations to the board, with members representing the Library Board, County Commission, city of Jamestown, North Dakota State University Extension Service and other organizations.
Jamestown (CSi) Jamestown/Stutsman Development Corporation (JSDC) Executive Committee has approved a $75,000 matching grant to Jamestown Tourism provided the city restaurant tax is not able to fund the program. Tourism uses the money to fund operations and improvements at tourist sites around the community.
The committee also recommends paying the city and county dues to South Central Dakota Regional Council in the amount of $33,810, providing a Flex Pace Interest buy down to Jamestown Regional Airport for its T-hangar construction project and approved about $15,000 in repairs to the roof at the Center for Economic Development.
The board approved articipation by the JSDC in the Flex Pace Affordable Housing Program on a 3-1 vote.
The Flex Pace Affordable Housing Program provides a $25,000 Bank of North Dakota grant and a loan of about $10,000 from the JSDC for each unit . The plan provides incentives for up to 60 affordable housing units in Stutsman County.
Jamestown (CSi) Jamestown Public Schools has available a Smartphone and tablet APP for Droid and Apple iOS operating systems.
Superintendent Rob Lech told the School Board that the initial implementation includes a scrolling information box, updates, important information, and upcoming meetings, plus streaming information coming from the school district’s Twitter feed.
The system includes notifications, and messages sending.
It also includes school calendars, sports schedules and scores, plus lunch menus, district maps and photos.
The Jamestown Public School District App is free to download.
In other business the school board, assigned new board members to committees to replace outgoing board members Shelly Jystad and Tanya Ostlie.
Mindy Schmitz will replace Jystad on the District School Improvement Committee and Ostlie on the Co-curricular Activity Committee and the Two Rivers Activity Center Committee.
Bob Toso will replace Jystad on the Health Insurance Committee and Ostlie on the Negotiations Committee.
Brenda Roemmich will take Jystad’s place on the Bullying Committee and the Athletic Committee.
The Jamestown school board has voted to eliminate the second regular board meetings in August and September due to light agendas.
The board will meet again on Tuesday September 2, 2014 and resume its regular meeting schedule of the first and third Mondays of the month beginning at the October 6, 2014, meeting.
A budget hearing is set for the October 6, 2014,board meeting at 6 p.m.
Carrington (CSi) A recount, Monday of the June 2014 Primary election by the Foster County recount board showed the ballots recounted came up 300 votes short with 1,151 total votes.
The board recently approved to not accept the two unsigned absentee ballots during the June 2014 primary for the county.
Foster County State’s Attorney Paul Murphy, the board followed the instructions from the Secretary of State in order to recount the ballots.
Murphy says the totals were not including the votes that were approved as invalid in July.
Murphy says it has not yet been determined why the shortage has occurred, adding that, being short that many votes in the recount can make it so everyone that was a candidate for anything in the Foster County Election can justifiably challenge the results of the entire election.

MINOT, N.D. (AP) – A jury has convicted an Idaho truck driver of negligent homicide in a fatal crash in North Dakota.
The charge carries a maximum punishment of five years in prison. Fifty-eight-year-old Clark Christensen, of Shelley, Idaho, could have faced up to 10 years had he been convicted on the original charge of manslaughter.
Authorities alleged Christensen was driving a semitrailer that plowed into several vehicles stopped at a red light just west of Minot in May 2013 because his brakes were not properly maintained. Christensen said a sneezing fit and not bad brakes led to the crash.
Eight vehicles were damaged or destroyed, and 21-year-old Megan Shoal was killed. She was a Minot State University student from Plentywood, Montana.
A sentencing date for Christensen was not immediately set.
FARGO, N.D. (AP) – A Minnesota man has been sentenced for his role in the stabbing death of a man in a Fargo parking lot last spring.
47-year-old Arlen Clapper, of Dilworth, pleaded guilty to murder Tuesday in a deal with prosecutors and was sentenced to serve nine years in prison.
Clapper was one of five people charged in the March 14 death of 26-year-old Rolandas House, whose body was discovered near a grocery store on the city’s south side.
Authorities say House was killed in a dispute over drug money. Wade Garrett, of Fargo, pleaded guilty earlier to stabbing House to death and was sentenced to 25 years in prison.
BISMARCK, N.D. (AP) – North Dakota has its first confirmed West Nile virus case of the year.
The state Health Department says the case is in a Richland County woman who is in her 50s. She was not hospitalized.
At this time last year, North Dakota had eight confirmed West Nile cases in people. There were 127 human cases in the state all of last year.
Epidemiologist Alicia Lepp says it’s important for people to protect themselves from mosquitoes, which spread the virus. People can reduce their risk by using insect repellant, limiting time outdoors and getting rid of standing water where mosquitoes can breed.
BISMARCK, N.D. (AP) – A North Dakota official says no announcement was made regarding the inmate who escaped a corrections facility last week because he was not considered a public threat. Thirty-six-year-old Michael Engst was arrested in Breckenridge, Minnesota, after he walked away Wednesday from the low-risk, minimum-security Missouri River Correctional Center in Bismarck. Corrections officials alerted law enforcement in both states about the escapee, but did not notify the public.
BISMARCK, N.D. (AP) – North Dakota Gov. Jack Dalrymple has appointed Bismarck attorney James Hill to a judgeship in the South Central Judicial District Court. Hill replaces Donald Jorgensen who stepped down from the bench in July after three decades. Hill has worked as a trial attorney in Bismarck since 1981. He also served as an assistant U.S. attorney in Bismarck for five years.
BISMARCK, N.D. (AP) – The North Dakota Housing Finance Agency is holding an application round for about $900,000 in development funding.
The agency said Tuesday it’s accepting applications for the development of affordable multi-family housing for essential service workers in certain communities. It’s also open to development plans for low- to moderate-income households throughout the state.
The application deadline is Sept. 30.
The money comes from the state Housing Incentive Fund. It has leveraged more than $240 million for construction of 1,500 new rental units since its creation in 2011.
FARGO, N.D. (AP) – Farm and ranch production expenses in the Plains region last year saw little change from 2012.
The Agriculture Department says 2013 expenditures totaled $87.6 billion, down from $89 billion. That’s a drop of less than 2 percent.
The Plains region includes the Dakotas, Nebraska, Kansas, Oklahoma and Texas.
BISMARCK, N.D. (AP) – A state program that helps North Dakota residents dispose of unusable or unwanted pesticides free of charge collected a record 150 tons this year.
Agriculture Commissioner Doug Goehring says more than 300 people took part in the Project Safe Send program this year, bringing chemicals that eclipsed the 2012 record of 145 tons.
The collections were conducted in a dozen cities in July. Chemicals will be taken to incinerators out of state for disposal
The Project Safe Send program was started in 1992. It’s funded by fees that pesticide manufacturers pay to register their products in North Dakota..

SAN ANTONIO (AP) – The San Antonio Spurs are the second NBA team to have a female coach, hiring WNBA star Becky Hammon as an assistant to Gregg Popovich. She will retire from the San Antonio Silver Stars after this season to join the Spurs. The first female NBA assistant was Lisa Boyer, who served on John Lucas’ staff in Cleveland in 2001-02.
UNDATED (AP) – The U.S. men’s national basketball team has trimmed its roster to 16 players by cutting Washington’s John Wall and Bradley Beal, and Atlanta’s Paul Millsap. The Americans are off this week after training last week in Las Vegas, where Indiana All-Star Paul George was lost to a broken right leg. They will resume practice for the World Cup of Basketball on Aug. 14 in Chicago.

ABUJA, Nigeria (AP) – Nigeria’s health minister says the country has confirmed six more cases of Ebola, including a nurse who has died from the virus. All six people had direct contact with a Liberian-American man who flew into Lagos (LAY’-gohs) last month after contracting the virus. Patrick Sawyer died of Ebola five days later. Nigerian officials are checking on others who had contact with Sawyer to see if they are showing Ebola symptoms.
KABUL, Afghanistan (AP) – U.S. officials are preparing to fly the body of Maj. Gen. Harold J. Greene back home from Afghanistan. The two-star general was killed in an “insider attack” yesterday that left 15 others wounded. As the investigation into that attack is carried out, another insider attack is being reported in southern Afghanistan. Officials there say an Afghan police officer appeared to have drugged seven of his colleagues before shooting them dead.
ISLAMABAD (AP) – Two Pakistani intelligence officials say a U.S. drone has fired two missiles at a sprawling compound in North Waziristan (vah-ZEER’-ih-stahn), killing seven militants. The Pakistani army has been carrying out a major offensive against local and foreign militants in North Waziristan. U.S. officials say militants use the tribal region as a launching point for attacks on NATO and U.S. forces in neighboring Afghanistan.
BEAVERCREEK, Ohio (AP) – Authorities in southwest Ohio say a man brandishing a gun inside a Wal-Mart store has been shot to death by police. A Montgomery County coroner’s office investigator says the 22-year-old man was fatally shot at a Wal-Mart in the Dayton suburb of Beavercreek last night after he failed to comply with verbal orders from police. A woman in the store at the time also died, but the coroner’s office says she may have had a heart attack or some other medical condition.
PORTLAND, Maine (AP) – A Maine mother arrested for driving 124 mph with her two children in the car earlier this year is now facing a driving under the influence charge in a separate incident. Twenty-six-year-old Cheryl Gilson was sentenced Monday to six months in jail for the April offense after pleading guilty to endangering the welfare of a child and other charges. The second incident happened three weeks ago. Police have charged Gilson with operating under the influence with a 6-year-old in her car.
