Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council’s Finance and Legal, Building Planning, and Zoning, and Civic Center and Promotion Committees met Wednesday afternoon (Oct 23, 2012) at City Hall. Council Member Gumke was not present.

 

With Finance and Legal Business:

The request from Leo and Kari Ness tabled from the October 1, 2012, City Council meeting, regarding interest in purchasing City Lots in Beverly Hills 6th Addition.

Mayor Andersen said the committee did not have specific information for the meeting for consideration, as the memo from City Attorney Ken Dalsted arrived late Tuesday afternoon.

The item will be moved to the Thursday committee meeting, after review of the memo from Dalsted.

 

The committee then considered the request from William Mickelson for reconsideration of a license to operate a Taxi Service.

Mayor Andersen said a background check raised concerns about Mickelson, and his license request was denied.

At Tuesday’s meeting it was stated that the Aggravated Assault and Terrorizing charges against him were dismissed.

He said he has custody of his daughter, and is employed in Jamestown.

The Mayor said the city’s previous concerns are no longer concerns, in light of the new information.

He said the taxi service is proposed to be 24 hours.

Mikelson said another person will be able to fill in driving if he unable to do so.

He said he is not requesting a city subsidy.

With reconsidering the previous denial of a taxi license, committee recommends granting the taxi license to Mikelson.

 

The committee discussed license and permit fee modifications and rate adjustments for the city utility funds, to be effective January 1, 2013.

City Administrator Jeff Fuchs says the figures are the same as in the 2013 budget.

He said the utility rates are adjusted annually, and the license and permit fees were last increased in 2009.

He said Jamestown has a total of 25 liquor licenses of all types.

Council Member Buchanan proposed that the license and permit fees should be higher, an average of 50 percent higher .

Mayor Andersen said the proposed increases are appropriate.

The committee recommends the proposed increases, which was opposed by Council Member Buchanan.

 

The committee recommends accepting of the 2011 City Audit, as prepared by Schauer & Associates, PC. The report is available on the city’s web site.

A presentation will be made at the November 5, 2012 City Council meeting.

Informational: Monthly departmental and financial reports were presented.

 

A property owner talked about water backups in his neighborhood, along 13th Avenue Southeast, which he has asked the city for assistance with, concerning a curb cut installed by the city at his driveway.

He said vehicles scrape on the curb when trying to use the driveway.

Mayor Andersen said the committee will meet with the City Engineer, and the city’s legal council, for more information, and possible solutions.

 

With Building Planning, and Zoning Committee Business:

 

Informational: Planning Commission minutes of October 8, 2012 were presented.

The committee considered the plat of Berndt’s Addition, a portion of Blocks 39, 40 & 47 and a portion of vacated 18th Avenue adjacent to Block 32 together with a portion of those unplatted lands within Government Lot 12 of Section 26, T140N, R64W, referred back to committee from the October 1, 2012, City Council meeting.

Mayor Andersen said the plat does not comply with a city Ordinance because of a lack of a plan for water, and sewer, availability, and the road being able to be brought to grade.

The City Attorney, City Administrator, City Engineer and City Planning Commission Chairman will meet to address issues before acting further on the plat.

The committee recommends forwarding the plat to the November 5, 2012 City Council meeting without recommendation.

 

Discussion concerning the draft ordinance amendment for Section 8, Appendix B, of the City Code as a result of the public input meeting previously held, was delayed, pending a draft of the City Attorney.

 

Civic Center and Promotion Committee:

Committee Chairman Charlie Kourajian suggested a meeting be held soon concerning a contract, and funding of the Buffalo City Tourism Foundation.

News Oct. 23, 2012) — While most people in the U.S. are preparing for holiday activities, Jamestown volunteers with Operation Christmas Child—the world’s largest Christmas project of its kind—are filling shoe box gifts with toys, school supplies and hygiene items for needy children overseas.

This year-round project of international Christian relief and evangelism organization Samaritan’s Purse, headed by Franklin Graham, is ramping up as local businesses, churches and community groups prepare to collect 850 gift-filled shoe boxes during National Collection Week (Nov. 12 – 19).

Anyone can drop off a packed shoe box at Temple Baptist Church. Then, using whatever means necessary—trucks, trains, boats, bikes and even elephants—the shoe box gifts will be hand-delivered to hurting children in 100 countries around the world.

 GRAND FORKS, N.D. (AP) – State and local health officials are
investigating what they call a cluster of tuberculosis cases in
Grand Forks County.
     The state Health Department has confirmed three cases of active
TB in the county – a man in his 20s and two men in their 40s.
Officials are working to identify people the men might have exposed
to the contagious bacterial infection that usually attacks the
lungs.
     Health Department TB specialist Dee Pritschet says TB cases are
not common in North Dakota. T

There were eight confirmed cases last year, 11 in 2010, five in 2009 and three in 2008.

The three cases in Grand Forks bring this year’s total to 14.

 

FARGO, N.D. (AP) – Several people have been charged in federal
court in Fargo in what authorities say is a drug-trafficking ring
that involved members of violent street gangs in the Minneapolis
area.
 Federal warrants were issued this month for eight people in the
investigation that authorities have been working on for nearly 1  1/2
years.
     Assistant U.S. Attorney Brett Shasky says the suspects allegedly
were involved in trafficking crack cocaine, along with some powder
cocaine, heroin, marijuana and oxycodone.
     The investigation involved officials with the U.S. Drug
Enforcement Agency, the Minnesota Bureau of Criminal Apprehension
and the Cass County Drug Task Force in North Dakota.

 

BISMARCK, N.D. (AP) – North Dakota’s Supreme Court has upheld
the conviction of a man who hired a hit man to kill his son-in-law.
     Philip Gattuso (gah-TOO’-soh) was found beaten to death in his
Fargo home three years ago.
     Gattuso’s father-in-law, Gene Kirkpatrick of Jones, Okla., was
convicted of conspiracy to commit murder. Authorities said
Kirkpatrick didn’t want Gattuso, a dentist, raising his
preschool-aged granddaughter after Gattuso’s wife died, so he hired
Michael Nakvinda (nahk-VINH’-dah) to kill him.
     Kirkpatrick said statements he made to police shouldn’t have
been used against him. He contended jurors got improper
instructions and should have been allowed to consider a less
serious charge.
     The Supreme Court rejected those arguments Tuesday and affirmed
the convictions.
     Both Kirkpatrick and Nakvinda are serving life prison terms.

 

 BISMARCK, N.D. (AP) – A Democratic state senator says a letter
meant for reading at North Dakota Roman Catholic church services is
intended to support Republicans.
     Fargo Sen. Tim Mathern says the letter could jeopardize the
church’s nonprofit status.
     Mathern is Catholic. He says he’s asked Bismarck Bishop David
Kagan to withdraw the letter. Kagan oversees North Dakota’s
Catholic churches.
     The letter says abortion, euthanasia, same-sex marriage and
embryonic stem cell research is “never acceptable.”
     It doesn’t name any candidate or political party. But is says
“the positions of the two political parties and the positions of
their candidates are well known” on those issues.
     A church spokesman says the letter doesn’t violate any laws.
Christopher Dodson says it outlines Catholic doctrine on political
responsibility and doesn’t tell anyone how to vote.
     BISMARCK, N.D. (AP) – Some people who bought or upgraded flood
insurance and were not covered during last year’s Missouri River
flooding may be covered for damages after all.
 Gov. Jack Dalrymple and the North Dakota congressional delegation
announced Tuesday that the new five-year National Flood Insurance
Program reauthorization bill changes the date the flood insurance
had to be purchased retroactively.
     The original cut-off date last year to purchase insurance had
been May 1, and many homeowners were deemed ineligible for coverage
because FEMA said the 30-day window to buy the insurance did not
apply to last year’s flood.
     The new bill changes the date to June 6, 2011, provided the
property was not damaged for 30 days after the purchase date.

 

 BISMARCK, N.D. (AP) – A new study estimates electrical demand in
North Dakota’s energy-producing counties is expected to nearly
triple over the next 20 years.

The North Dakota Industrial Commission provided $100,000 for the study earlier this year.

The commission says the study provides valuable information in
addressing “future power demand.”

 

 BISMARCK, N.D. (AP) – If you’re a North Dakota tree owner,
listen to this. If your tree’s branches damage your neighbor’s
house, you may have to pay to repair the damage.

     The North Dakota Supreme Court ruled Tuesday that a Lisbon
chiropractor may be eligible to collect repair money for clinic
damage caused by a neighbor’s trees.
     Richard Herring says he had to replace his clinic’s roof and
repair his building’s walls because tree branches brushed his roof
and leaves clogged his gutters.
     The high court says it’s never ruled before on whether a tree
owner is responsible for damage to a neighbor.
     The court says Herring still has to prove the damage to his
building was caused by tree branches. Showing that tree leaves got
into his gutters won’t be enough.

 SAN FRANCISCO (AP) – The first-ever World Series between the
Giants and Tigers gets under way in San Francisco later today.

Giants manager Bruce Bochy (BOH’-chee) has set up a rotation that
has Barry Zito starting the opener, followed by Madison Bumgarner,
Ryan Vogelsong and Matt Cain.

Justin Verlander will be followed by Doug Fister, Anibal (AH’-nih-bahl) Sanchez and Max Scherzer in the Tigers’ pitching alignment.

The grounds crew at AT&T Park worked until midnight last night
and began again at 8 this morning to get the field in shape after
last night’s heavy downpour.

  MIAMI (AP) – Marlins manager Ozzie Guillen has been fired after
one year in Miami. The team announced the firing yesterday.

Guillen is still owed $7.5 million for the three years remaining on his
contract.

 

 BOSTON (AP) – The Boston Red Sox have introduced John Farrell as
their new manager.
     Farrell appeared Tuesday at a news conference with club
officials two days after the team announced it had reached an
agreement with the Toronto Blue Jays to allow him to leave with one
year left on his three-year contract as manager.

 

Cycling…

SYDNEY (AP) – The head of the World Anti-Doping Agency thinks
cycling’s world body must remove the officials who presided over
the drug-tainted Lance Armstrong era for the sport can regain
credibility.

WADA (WAH’-duh) President John Fahey tells Australia’s
Fox Sports that the UCI has to “take the blinkers off” and
examine its own past.

Fahey says “everyone” doped during the Armstrong era and the UCI had to address how such widespread doping went undetected.

 NHL-LABOR
     

     NEW YORK (AP) – The NHL Players Association has notified the
league that it’s ready to return to the bargaining table as early
as Wednesday in an effort to save a full schedule. NHL deputy
commissioner Bill Daly quickly told the union to forget it.
     Daly told The Associated Press he didn’t anticipate any
negotiations taking place for the balance of the week, saying the
union has rejected the proposal management made last week and is not offering another one.
     The league set an Oct. 25 deadline for the two sides to work out
a new collective bargaining agreement before the NHL cancels
regular-season games for good.
     The sides haven’t met since the NHL turned down three counterproposals from the union on Thursday.

     CHARLOTTE, N.C. (AP) – Dale Earnhardt Jr. has been cleared for
this weekend’s race at Martinsville Speedway after missing the last
two weeks to recover from a pair of concussions.

WASHINGTON (AP) – With only a couple of weeks to go before the
election, President Barack Obama and Republican Mitt Romney are
picking up the pace.

 Obama will campaign nearly around the clock
today, covering 5,300 miles. He’ll be on the stump in Iowa,
Colorado, California and Nevada, and then he’ll overnight to
Florida. Romney, too, is on the move with stops in Nevada and Iowa,
before a three-stop swing in Ohio on Thursday.
     
     UNDATED (AP) – The U.N.-Arab League envoy to Syria says the
Syrian government and some rebel leaders have agreed to a ceasefire
during the upcoming Muslim four-day holiday, which begins Friday.
Meanwhile, activists say Syrian warplanes have struck a village
near a strategic rebel-held town in the country’s north, killing
five members of an extended family.
     
     JERUSALEM (AP) – Things are heating up along the Israel-Gaza
border.

Rockets and mortars from the Gaza Strip pummeled southern
Israel early today and an Israeli airstrike killed a Palestinian
militant. Crossings between Gaza and Israel are shut down following
the exchanges of fire.

The sharp escalation of violence follows a landmark visit to Gaza by Qatar’s leader.
     
     BRUSSELS (AP) – The European Union has sent Microsoft a formal
complaint, accusing the software giant of failing to comply with a
European order to give customers a choice among Internet browsers.
Microsoft did create a “choice screen” but a technical error
meant millions of users in the EU may not have seen it.

Microsoft could face a fine of up to 10 percent of its annual revenue if
found in breach of antitrust law.
     
     PHILADELPHIA (AP) – A man who drove an SUV onto the runway of
Philadelphia International Airport says he’s undergone treatment
for prescription drug addiction that contributed to the incident.

Twenty-five-year-old Kenneth Mazik is scheduled to be sentenced
today for crashing through a gate on March 1 and leading police on
a runway chase at speeds topping 100 mph.
