Jamestown, ND (KCSi-T.V. News Nov 14, 2012) — On Wednesday morning, Southeast District Judge Thomas Merrick sentenced 35 year old Leron Howard, of Jamestown to life in prison without parole.
Merrick said Howard’s criminal history brought out in the pre-sentence investigation was a key factor in his decision.
Howard had 23 prior criminal convictions including five felonies.
Howard’s court appointed attorney, Steve Mottinger, suggested 20 years of incarceration, while prosecutor, Stutsman County State’s Attorney Fritz Fremgen recommended life, without parole.
Howard was found guilty by a jury in Jamestown on August 23, 2012, and convicted of murder and criminal conspiracy, Class AA Felonies, punishable by life in prison without parole.
Howard has been incarcerated in Jamestown.
Mottinger said Howard directed him to file a notice of appeal in the case.
The charges stemmed from the April 2011 death of 18-year-old Abdi Ali Ahmed of Jamestown a Somali immigrant, who was found dead in a roadside ditch near Spiritwood, on April 30, 2011.
His wounds consisted of blunt force trauma to the head and stab wounds to the abdomen.
In February, 2012, a Jamestown Southeast District Court Jury found co-defendant Janelle Cave of Jamestown guilty of manslaughter, and criminal conspiracy in the same case, and she is now serving an 11 year prison term.
Cave had appealed the conviction in the North Dakota Supreme Court, which was later withdrawn.
An order of dismissal was issued by the court on Oct. 12, 2012.
Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council will meet in Special Session, on Thursday November 15, 2012, to discuss the Stutsman Rural Water issue, at 3-p.m., at the Quality Inn & Suites 507 25th Street, Southwest in Jamestown, in the meeting rooms.
The Stutsman Rural Water District, board and staff have been invited to attend.
The meeting is open to the public.
The City Council has met three times closed Executive Session, for the purpose of consulting with the City Attorney concerning territorial service claims by Stutsman Rural Water District.
At issue is a claim by Stutsman Rural Water that Jamestown was expanding its water service into territory Stutsman Rural Water has rights to serve, in the area of the Titan Machinery facility under construction near Jamestown Regional Medical Center.
The area is in the one mile extraterritorial limits of the City of Jamestown.

BISMARCK, N.D. (AP) – Two residents in Bismarck are recovering
at a local hospital following carbon monoxide poisoning at their
home.
The Bismarck Fire Department says firefighters were dispatched
to a Bismarck home about 2:30 a.m. Wednesday following a report
that two residents had become sick from carbon monoxide.
Firefighters treated the two residents before they were
transported to a local hospital.
Officials say the carbon monoxide was coming from the boiler for
the hot water heater. The boiler had not been burning or venting
properly.
The fire department is recommending that building owners have a
licensed contractor inspect heating systems regularly.
FARGO, N.D. (AP) – A North Dakota man originally sentenced in
federal court to life in prison on a crack cocaine charge now must
serve 25 years instead.
An appeals court overturned Marcus Royston’s sentence because of
a new law that increased the quantities of crack cocaine needed to
trigger statutory minimum sentences. The change was made
retroactive to the original sentencing date.
Royston, of Bismarck, was among eight people accused of
distributing crack cocaine in North Dakota, South Dakota and
Minnesota. A jury found him guilty in May 2010 on two counts,
including conspiracy.
Prosecutors recommended Wednesday that Royston be re-sentenced
to 30 years in prison. Royston’s lawyer asked for 20 years.
U.S. District Judge Ralph Erickson said Royston’s criminal
history and his role in the conspiracy make 25 years an appropriate
sentence.
GRAND FORKS, N.D. (AP) – A North Dakota church that received
financial help from a New Jersey congregation after a devastating
flood 15 years ago is sending money east to help in the wake of
Superstorm Sandy.
The Rev. Gerard Braun says St. Michael’s Catholic Church in Grand
Forks has collected about $15,600 and donations are still coming
in. The money will be sent to St. Michael’s Catholic Church in Long
Branch, N.J., which was battered by the recent hurricane.
The New Jersey church gave the Grand Forks church $12,000 after
the spring 1997 Red River flood that swamped the North Dakota city.
WILLISTON, N.D. (AP) – Building permits have set a record in the
booming North Dakota oil patch city of Williston.
Through October, 938 permits had been issued with a total value of
$406 million. That broke last year’s record of 929 permits totaling
nearly $358 million.
Only $44 million worth of building permits were issued in
Williston in 2009. That was more than doubled to $106 million in
2010.
BISMARCK, N.D. (AP) – Two heavy equipment dealers are expanding
their Bismarck operations, and a tool distributor is opening a
store in Williston.
Butler Machinery Co. is adding 40,000 square feet to its building because it has outgrown its current space, and RDO Equipment Co. has doubled its property to 10 acres for future expansion.
Acme Tools says in a statement that its planned Williston
location will be its fifth North Dakota store and its 10th retail
location in the Upper Midwest. The store is to open late next
summer.
HORACE, N.D. (AP) – A North Dakota-based sunflower business is
beginning production this month at a sunflower roasting facility in
the Texas city of Lubbock.
The SunGold Foods plant will produce in-shell sunflower seeds to
be sold as snack food. The National Sunflower Association says the
plant will open with 40 full-time employees, with room to more than
double capacity.
SunGold Foods is based in Horace. It is a subsidiary of
Fargo-based Red River Commodities Inc., which also has a bird food
plant in Lubbock.
ORONO, Minn. (AP) — Pianist Lorie Line is facing foreclosure on her Lake Minnetonka mansion.
The 9,100-square-foot house in Orono was listed for sale last month at $3.9 million.
Documents filed in Hennepin County show Line and her husband, Tim, owe more than $2 million on the property.
The foreclosure filing comes as Line kicks off her holiday tour on Thursday. Tim Line tells the Star Tribune the economy has been tough on family finances. He says “there aren’t a lot of extra entertainment dollars out there.”
Tim Line says the couple is restructuring their business and working with their lender to avoid a sheriff’s sale. The four-bedroom house includes a columned mini-stage for Line’s grand piano, a wine cellar and an outdoor kitchen.

WASHINGTON (AP) – He says the nation can’t afford the tax hike
that would take effect in January if there’s no deal — but
President Barack Obama says he will not agree to any plan that
extends current tax rates for the wealthiest taxpayers. He told
reporters Wednesday that the tax rates for the highest-income Americans
should rise to help raise revenue. And Obama says that’s a position
that was validated by voters last week. Congressional Republicans
have said they would be willing to include new tax revenue in a
deficit reduction deal. But they have been adamant that the tax
rates themselves must not increase.
WASHINGTON (AP) – President Barack Obama is defending U.N.
Ambassador Susan Rice, amid vows by Senate Republicans to block her
nomination if she is chosen to succeed Secretary of State Hillary
Rodham Clinton. Sen. John McCain and others are angry over Rice’s
explanation of the attack on the U.S. consulate in Libya. She said
days later that it was the result of a protest over an anti-Islam
video. At his news conference Wednesday, Obama said if McCain wants to
go after someone, he should challenge the president, not Rice.
WASHINGTON (AP) – From what he’s seen so far, President Barack
Obama says there’s no reason to think that the scandal that ended
the career of former Gen. David Petraeus had a negative impact on
national security. He spoke five days after Petraeus resigned as
head of the CIA, because of an extramarital affair. Obama also says
he’s withholding judgment on the timing of the disclosure that
Petraeus was under investigation. Officials have said Obama wasn’t
told until after the election.
WASHINGTON (AP) – The Federal Reserve is signaling that it will
likely launch a new bond buying program next month to try to spur
job growth. The purchases would be intended to lower long-term
borrowing rates to encourage spending and strengthen the economy.
The hope is that more hiring would follow. The indications of the
Fed’s thinking are found in the minutes of last month’s policy
meeting.
REDWOOD CITY, Calif. (AP) – Drivers in the San Francisco Bay
Area are the first in the nation to fill up their gas tanks with a
biofuel that is made partly from algae. The San Francisco Chronicle
reports that the fuel went on sale Tuesday at gas stations in
Berkeley, Oakland, Redwood City and San Jose as part of a monthlong
pilot program. It is made from 20 percent algae and 80 percent
petroleum, and can be used by any vehicle that runs on diesel.
