Jamestown, ND (KCSi-T.V. News Nov 16, 2012) — The Buffalo City Tourism Foundation, Executive Board met in monthly session, on Friday, and reviewed issues concerning the soon to expire contract with the City of Jamestown.
Board representatives will attend Tuesday’s (Nov 20, 2012) Jamestown City Council Civic Center and Promotion Committee meeting, where the committee will discuss with the board, the upcoming contract, any recommend any changes in a new contract.
City Attorney Ken Dalsted is drafting language in the proposed agreement.
At Friday’s BCTF Executive Board meeting, the panel reviewed the existing contract, and received information from Jamestown City Attorney Ken Dalsted, from Jamestown Mayor Katie Andersen.
In his opinion, Dalsted recommends the city not appoint Foundation Board members, as a requirement in a new contract.
The opinion stated in part that, “If a city does not have a specific power granted to it by the legislature, that power does not exist.”
Research of opinions by the North Dakota Attorney General and case law from other jurisdictions suggests that it is not appropriate for a city to do indirectly what it may not be able to do directly – control a corporation through the control of the appointment of its board of directors.
Dalsted’s opinion is, that because Buffalo City Tourism is an independent corportation, it is recommended that the entity be allowed to elect its own directors, as provided by law.
The BCTF may, under the city’s Enterprise Ordinance, make application to the city, making a request to perform services on behalf of the city.
Under the Ordinance the city can provide funding to independent entities that essentially perform certain services that would otherwise be appropriate for a city to perform.
The proposed changes are a way to make the BCTF a independent entity run on tax dollars.
The major proposed change would eliminate the $75,000 the Jamestown Stutsman Development Corp. pays annually and replacing with funds from city lodging and restaurant taxes.
BCTF could still apply to JSDC for the funds on an annual basis if the proposed changes take place.
Currently BCTF receives 100 percent of the city’s motel tax, 40 percent of the net city restaurant tax and nearly $200,000 annually in combined JSDC operating revenue and grant funds.
In other business, the BCTF Grant Advisory Board met and received funding requests.
Jamestown College Athletic Director, Lawrie Paulson requested $10,000 in tourism funds to support the college hosting the National All Men’s and Women’s Basketball Tournament in Jamestown, February 21,25, 2013, in connection with A.I.I basketball conference.
The event is expected to bring ten teams to play at the Jamestown Civic Center, with travel parties of 15-20 individuals plus fans, with teams requiring 6-10 motel rooms per night.
Paulson said, projected expenses are almost $25,000, with the projected revenue, from gate receipts sponsorships and booklet sales at $15,600.
Jamestown College has pledged $8,000.
Following the presentation, the Grant Advisory Board voted unanimously to authorize up to $10,000 to pay the cost of officials and advertising.
The Jamestown Rural Fire Department requested $3,000 to hold a fishing derby early in 2013. Other funding sources would come from raffle sales.
Representative Travis Lemieux said the dollars would be used to advertise the event with billboards in Fargo and Devils Lake, along with advertisements in on line and print publications along with local media.
The board voted to table the request, until it has more information including an itemized list of expenditures.
The panel also reviewed the Stutsman County Memorial Museum 2012 season, visitor count.
The total for the year was 1,861, with 1,266 visitors from Jamestown, with a total North Dakota count of 1,459. Visitors came from 36 states.
Internationally there were 11 visitors from Canada, 2 from Denmark, 1 from Australia, 1 from Bosnia, and one from Thailand.
The total amounted to 1,758 visitors.
Jamestown, ND (KCSi-T.V. News Nov 16, 2012) — The Jamestown Arts Center is in the process of tidying-up, the Arts Park, in downtown Jamestown.
Arts Center, Director, Taylor Barnes says a crew from Humes Landscaping in Jamestown is performing the work, including pulling about five feet of rubble from the adjacent building’s wall, cleaning the edge of the property, and leveling that area of the park.
She says as funds become available the area is planned for a performing arts space.
Ms. Barnes added, that juniper trees will be planted along the edge of park at the alley.
She anticipates this work will be finished by Thanksgiving.

Jamestown, ND (KCSi-T.V. News Nov 15, 2012) — The participants in the 2012 Holiday Dazzle Parade are asked to stop in at Babb’s Coffee House today (Monday, November 19, 2012) to get their final instructions for the parade.
Also at the gathering, parade officials will be handing out position numbers for the floats.
All entries who have not handed in the description of their floats, are asked to do this at this time.
The narratives are important, so the announcers along the parade route can identify the floats and give credit to the builders.
All entries are asked to be at the south end of McElroy Park by 6:15 p.m. Friday, November 23 for the parade lineup.
This year’s judges, Chris Rathjen, Jessica Haak and Alex Looysen will be viewing and judging the floats at 6:30 p.m.
This year the Main Street Downtown Association, parade sponsor, will be awarding cash prizes for the floats, first prize being $500, second $250 and third $100.
Jamestown, ND (KCSi.T.V. News) – The Main Street Association invited the community to the City Christmas Tree lighting ceremony set for Wednesday, Nov. 21, 2012 at 5:00 p.m., at the Jamestown Civic Center.
Church members from Victory Luthern Brethern Church will be in charge of the program with Pastor Shawn Bowman speaking and musicians from Victory providing the music.
Cookies and refreshments will be provided, courtesy of the Corey Bayer family and the Jamestown Civic Center. The tree lighting will be promptly at 5:30 p.m.
The public is invited to participate in the event.
VALLEY CITY, N.D. (AP) – Four people face burglary and theft
charges after a two-month investigation in Barnes County.
Sheriff Randy McClaflin says the group allegedly
burglarized a number of farmsteads, homes and a Valley City
business this fall. He says about $8,500 worth of property has been
recovered so far.
The suspects are from the Valley City and Rochester, Minn.,
areas, and also face possession of stolen property charges in the
Rochester and Moorhead, Minn., areas. They range in age from 25 to
32, and face a total of 50 felony counts.
BISMARCK, N.D. (AP) – A North Dakota House candidate who lost by
50 votes says she won’t ask for a recount.
Democrat Sharon Buhr finished third in the election in District
24 in southeastern North Dakota. The district includes Barnes
County and parts of Cass and Ransom counties.
Democrat Naomi Muscha and Republican Dwight Kiefert were the top
two finishers and won the district’s two House seats. Buhr was 50
votes behind Kiefert.

The race was the only state legislative contest that was close
enough to allow the loser to seek a recount.

Buhr is a hospital dietitian in Valley City and a former city
school board member. She says she enjoyed the House campaign.
North Dakota’s Canvassing Board took less than an hour Friday to
certify the final election results.
The closest statewide race was for the U.S. Senate. Democrat
Heidi Heitkamp beat Republican Rick Berg by 2,936 votes. Berg says
he won’t ask for a recount.

(KCSi-T.V. News) – The Norht Dakota Highway Ptrol reports, a Hurdsfield, woman was killed in a crash between a minivan and a semi-truck Friday afternoon (Nov.16, 2012) about 4:30-p.m., in Wells County.
The report says, 26 year old, Joshua Denaeyer, of Holyoke, Colorado, was driving a 2001 Freightliner pulling an empty flatbed trailer northbound on N.D. Highway 3 en route to Bottineau, from Valentine, Neb.
The rig came over a hilltop at about two miles south of Hurdsfield and saw 52 year old Kathy WhiteWoll, of Hurdsfield, ahead of him in a 2005 Pontiac Montana minivan.
WhiteWoll had just made a slow U-turn to go northbound after retrieving her mail from a mailbox on the other side of the road.
Denaeyer moved into the left-hand lane to go around the slower-moving Pontiac, but WhiteWoll turned left in front of him to go west on a gravel road that leads to her residence.
The semi hit the minivan, which came to rest ditch facing south, while the semi jack-knifed and came to rest blocking both lanes.
WhiteWoll was not wearing a seat belt and was pronounced dead at the scene. Denaeyer was wearing his seat belt.
The Pontiac was totaled in the crash and the Freightliner sustained moderate damage.
The crash remains under investigation, by the NDHP.
NEW TOWN, N.D. (AP) – A woman and her three grandchildren have
been shot and killed in New Town. Authorities are investigating
whether a man’s death in Parshall is connected.
Mountrail County Sheriff Ken Halvorsonsays the New Town incident happened about 3 p.m. Sunday, and the death in Parshall about 8:30 p.m. The five bodies are being brought to Bismarck for autopsies.
New Town School Superintendent Marc Bluestone called off classes Monday because of what he called “the tragedy in our community.”
Halvorson and FBI spokesman Kyle Loven (LOH’-vuhn) did not
immediately return telephone calls to The Associated Press early
today.
New Town is on the Fort Berthold Indian Reservation in
northwestern North Dakota. It is the headquarters for the Three
Affiliated Tribes.
FARGO, N.D. (AP) – Defense testimony is set to resume in the
trial of a Fargo surgeon accused of drugging and sexually
assaulting his wife.
Dr. Jon Norberg has pleaded not guilty to gross sexual
imposition and reckless endangerment. Trial began on Nov. 5 with
jury selection.
Authorities say Norberg injected Dr. Alonna Norberg with the
anesthetic propofol and had sex with her against her will. Jon
Norberg says the couple agreed to use the drug to treat her chronic
pain.
Propofol gained notoriety in the investigation into the death of
Michael Jackson.
Monday will be the eighth day of testimony. Defense attorneys
have not said whether Jon Norberg will take the stand.
The Associated Press typically does not identify alleged victims
of sex crimes but Alonna Norberg has spoken publically about the
case.
BISMARCK, N.D. (AP) – The president of the North Dakota Farm
Bureau says he’s worried about the possibility of a large increase
in the federal estate tax.
Farm Bureau President Doyle Johannes says the estate tax rate could jump from 35 percent to 55 percent, and estates worth more than $1 million could be taxed.
Right now estates aren’t taxed unless they’re worth more than $5 million.
Johannes says that could lead to the breakup of family farms.
BISMARCK, N.D. (AP) – The North Dakota University System says
its impact on the state’s economy was worth $4.4 billion in fiscal
2011.
The university system’s economic study says that’s up from $3.7
billion in fiscal 2009.
The study estimated that the 11 state colleges and universities
contributed $1.6 billion into local economies in fiscal 2011. The
study says that money multiplies when cycled through the state’s
economy.
The system includes six four-year universities and five two-year
colleges with an enrollment of about 48,000 students and more than
11,000 employees.
GRAND FORKS, N.D. (AP) – A study set to be released this week
shows that the number of homeless people on the streets in North
Dakota has exceeded the number of homeless people in the state’s
emergency shelters.
The North Dakota Coalition for Homeless People report says the
number of unsheltered people as of July 2011 was 966, and the
shelters were at full capacity with 807 people.
The study cites an increasing number of people who have been
drawn to the state’s oil patch. Officials say that has created a
housing shortage in western North Dakota that has spilled over into
other parts of the state.
Michael Carbone, director of the North Dakota Homeless
Coalition, says service providers are receiving calls from people
around the country seeking shelter while they try to find jobs.
BISMARCK, N.D. (AP) – Turkey growers are planning to donate
Thanksgiving birds to North Dakota shelters for abused women and
the homeless.
North Dakota Gov. Jack Dalrymple and Agriculture Commissioner
Doug Goehring (GORE’-ing) are taking part in the Monday
presentation at the Capitol.
The turkeys are going to the Ruth Meiers Hospitality House and
the Abused Adult Resource Center in Bismarck.
The growers bring a live turkey to the ceremony, which can make
things interesting. In 2006, then-Gov. John Hoeven tried to handle
the bird, and it protested by flapping its wings and trying to take
off.

The kid who stole the show at the season-opening Daytona 500
ended the year under the biggest spotlight of them all Sunday.
Keselowski beat five-time champion Jimmie Johnson to deliver the
first Sprint Cup championship to Penske Racing.
It’s a trophy that had eluded Penske since he first entered
NASCAR in 1972.
Keselowski began the day with a 20-point lead over Johnson. He
finished 15th while Johnson faded to 36th. Keselowski finished the
season 39 points ahead of Clint Bowyer and 40 up on Johnson.

COLLEGE FOOTBALL TOP 25 POLL…
NEW YORK (AP) – Notre Dame is the beneficiary of losses by the
top two teams in last week’s AP poll.
The Fighting Irish jump two slots to No. 1 — and it’s
unanimous. It’s Notre Dame’s first time at the top since 1993.
A week after dropping from 1 to 4 following its first loss,
Alabama moves up to No. 2, followed by one-loss Georgia and
undefeated Ohio State.
Notre Dame and Alabama are 1-2 in the BCS standings as well.
Notre Dame needs only to beat struggling rival Southern California
to secure a spot in the BCS title game for the first time.
Alabama has to win two games. The Crimson Tide must beat lowly
Auburn at home to reach the SEC championship where the Tide will
probably meet Georgia.
After losing on Saturday, Oregon falls from first to fifth while
Kansas State drops from 2 to 7 in the AP Rankings. Florida sits at
No. 6.
LSU, Texas A&M and Florida State continue the round out the top
10.

LOS ANGELES (AP) – Mike D’Antoni postponed his debut on the Los
Angeles Lakers’ bench, giving the coach a few more days to recover
from recent knee replacement surgery. Instead, interim coach Bernie
Bickerstaff was guiding the Lakers in their 119-108 win over
Houston.
D’Antoni was tentatively planning to take over Sunday night
against Houston, a week after the Lakers hired him to replace Mike
Brown. But the 61-year-old coach admitted he’s not quite ready.
The Lakers host Brooklyn on Tuesday.
In world and national news…
UNDATED (AP) – The Turkish foreign minister and a delegation of
Arab foreign ministers are expected in Gaza tomorrow as efforts
continue to broker a cease-fire between Palestinian militants and
Israel. Meanwhile, the civilian death toll jumped as Israeli
aircraft struck crowded areas in the Gaza Strip today, in one case
devastating several homes belonging to one clan.
BRUSSELS (AP) – The mounting death toll in the Gaza conflict has
the attention of the European Union. The EU foreign policy chief
says the crisis can only be resolved with a long-term solution and
that the rocket attacks on Israel from Gaza must stop.
PHNOM PENH, Cambodia (AP) – White House aides say President
Barack Obama will raise human rights concerns in his meeting today
with Cambodia’s long-time prime minister. The 60-year-old Hun Sen
has held power since Ronald Reagan was in the White House, and says
he’s not stepping down until he is 90. He’s been criticized for
what some say is his violent, authoritarian rule.
BRUSSELS (AP) – Germany’s defense minister says he expects
Turkey to make a formal request to NATO for Patriot missiles to
bolster anti-aircraft defenses along the border with war-wracked
Syria. NATO’s secretary general says no such request has been
received but would be considered if it were.
LOS ANGELES (AP) – The third quarter saw more Americans taking
the shackles off their credit cards. The credit reporting agency
TransUnion says the average credit card debt per borrower in the
U.S. grew 4.9 percent between July and September. The rate of
credit card payments at least 90 days overdue hit 0.75 percent, up
from 0.71 percent in the third quarter of last year. The late
payment rate is rising from historically low levels.
