NIOBE, N.D. (AP) – Authorities say a 5-year-old boy has died after he was run over by a grain truck at a farmstead in northwest North Dakota.

The North Dakota Highway Patrol says the accident happened around 2 p.m. Monday on a farmstead about 6 miles northwest of Niobe in Burke County.  Authorities say the boy was struck by the rear dual tires on the truck’s passenger side.

According to the highway patrol, the truck was being driven by a 39-year-old Powers Lake man. The highway patrol says he drove it forward about 5 feet while putting canola from a bin in a truck box

NEW TOWN, N.D. (AP) – Authorities in North Dakota say a body has been found on the shore of Lake Sakakawea near New Town.

Mountrail County Sheriff Ken Halvorson on Monday said the body was reported Saturday night east of Van Hook Park, but authorities could not retrieve it until Sunday morning because of the difficult terrain in the area.

Halvorson says two fishermen spotted the body, which has not been identified. Halvorson says his department is reviewing local and state missing persons files in an attempt to assist in identifying the remains.

The state’s Medical Examiner’s Office is conducting an autopsy to determine the cause of death and the body’s identity.

BISMARCK, N.D. (AP) – Authorities are searching for a state prison inmate who went missing from a minimum security facility in Bismarck.

Thirty-nine-year-old Earnesto Difabio walked away from the Missouri River Correctional Center on Sunday afternoon.

Authorities say Difabio is Caucasian and has black hair and brown eyes. He is 5-feet-6-inches tall and weighs about 180 pounds.

State corrections officials say Difabio was incarcerated on theft and burglary charges. Authorities say he is not considered dangerous.

BISMARCK, N.D. (AP) – A Grand Forks man accused of disarming and assaulting a police officer has pleaded not guilty.

Paul Smith entered pleas to several charges on Monday.

The incident dates back to February when a Bismarck police officer pulled over Smith for not having license plates on the vehicle he was driving. The vehicle was later determined to be stolen.

Authorities say during the traffic stop, a fight broke out between the officer and Smith. Sometime during the scuffle, the officer’s gun came out of its holster. The gun fired, hitting Smith in the leg.

Smith’s attorney, Kent Morrow, says a defective holster was responsible for the loose firearm.

BISMARCK, N.D. (AP) – Authorities say a Bismarck man is accused of hitting a woman in the head with a can of soup and holding her against her will for three hours by threatening to cut her throat.

52-year-old Brian Shermer was arrested Sunday morning. He was charged Monday in South Central District Court with felonious restraint, felony terrorizing and misdemeanor simple assault.

STANLEY, N.D. (AP) – Authorities in northwest North Dakota are accusing an Idaho man of stabbing an Alaska man over the weekend.

31-year-old Travis Barnes has been charged with attempted murder. The Mountrail County sheriff’s office says Barnes stabbed 23-year-old John Daly three times in the torso during an altercation Sunday at the White Earth Rodeo Grounds near Stanley.

Authorities say deputies found Daly, of Wasilla, Alaska, propped up against a corral panel while people applied pressure to his wounds. He is in stable condition at a Minot hospital.

Authorities say Barnes fled the scene in his vehicle with Idaho plates. He was later pulled over while driving on Highway 2 and arrested.

Barnes, who works in Tioga, is from Post Falls, Idaho. Court records don’t list his attorney.

MINOT, N.D. (AP) – Two Minot police officers who are being sued by a man who spent 542 days in jail on an attempted murder charge says the complaint should be thrown out of federal court.

Thomas Mashburn was accused of stabbing another man after an argument that started inside a Minot bar in September 2011. The case was dismissed in March 2013, five days before trial, after Ward County prosecutors said there was a lack of credible evidence.

Mashburn filed a lawsuit in June 2013 against Minot police and others, alleging civil rights violations and false imprisonment. The complaint seeks unspecified damages.

The attorney for officers Caisee Sandusky and Jason Sundbakken says the evidence does not support the lawsuit and the complaint should be dismissed.

Mashburn’s lawyer was not immediately available for comment.

BISMARCK, N.D. (AP) – The North Dakota Legislature is returning to Bismarck today to consider a budget bill left unresolved by lawmakers when they adjourned in April.

The session ended with House and Senate Republicans still at odds over legislation aimed at ensuring that thousands of public employees, including lawmakers, can keep the same health benefits and medical providers when their insurer changes next month.

Infighting among Republican lawmakers in the GOP-led House and Senate held up the more than $14 million appropriations bill for the state’s public employee retirement system.

A panel of legislative leaders resolved the dispute last week, agreeing to add one lawmaker from each party to a board that oversees the benefits.

Bismarck (CSi) The North Dakota Farmers Union official says the group has collected enough signatures to force a referendum on a bill signed by Gov. Jack Dalrymple in March.

They plan to deliver the signed petitions to the secretary of state’s office today.

Traffic is down to one lane and stoplights have been turned off. Temporary stop signals are being used to control traffic.

The project on the bridge that connects Grand Forks and East Grand Forks, Minnesota, is expected to last until mid-October. The bridge is 283 feet long and was built in 1929.

DENVER (AP) – Michael Malone is an NBA head coach once again, accepting a position with the Denver Nuggets.      CHARLOTTE, N.C. (AP) – The Charlotte Hornets have given up on Lance Stephenson, sending the guard to the Los Angeles Clippers for center Spencer Hawes and forward Matt Barnes.

The Hornets signed Stephenson to a three-year, $27 million contract after he averaged 13.8 points, 7.2 rebounds and 4.6 assists for Indiana in 20013-14. But he struggled with Charlotte, providing just 8.2 points, 4 1/2 boards and 3.9 assists while starting just 25 of his 61 games.

The deal was also a chance for the Clippers to unload Hawes’ contract.

He has three years left on a four-year, $23 million deal he signed last summer with the Clippers.

Hawes didn’t play in half the Clippers’ 14 playoff games.

Speaking of the Hornets, center Al Jefferson has exercised the third-year option on his contract and will remain with the team next season.

Jefferson struggled with injuries last season and appeared in 65 games, averaging 16.6 points and 8.4 rebounds.
