JAMESTOWN — Alan and Genny Lindberg have a home in rural Stutsman County that now stands at the center of a dispute that has stalled a planned $3 billion fertilizer plant.

The Fargo Fourm reports that he Lindbergs’ property includes a lake they have stocked with fish and use for recreation. It was created by a dam built in 1958 for industrial purposes, a gravel operation.

The couple has objected to a water permit seeking to pump water from the Spiritwood Aquifer for the proposed CHS plant, at Spiritwood.

They contend they would be “unduly affected” by the groundwater pumping permit and in late April asked for a hearing before an administrative law judge to hear their concerns. The request is still pending.

The Lindbergs are not trying to block the fertilizer plant project, but have understandable concerns about the lake,

The Stutsman Rural Water District, which is seeking the permit on behalf of the CHS project, said extensive analysis by consulting hydrologists and the State Water Commission determined the permit would not impair the aquifer.

State Water Commission hydrologists recommend approval of the permit, subject to certain conditions, after concluding the aquifer could sustain the withdrawals, even during dry periods.

Despite those findings, Alan Lindberg, a Jamestown businessman, believes the lake by his home could be jeopardized.

Spiritwood Energy Park 10 miles northeast of Jamestown, would use an average of 3,800 gallons per minute of water, peaking at 4,200 gallons per minute, mostly for cooling. To meet that demand, CHS proposes to use water from the Jamestown Aquifer when the James River is high and, during drier periods, the Spiritwood Aquifer, as well as reused industrial “gray water.”

Industrial water would come from the nearby Cargill malting plant, which would supply about a third of the water, with about two-thirds coming from groundwater, according to State Water Commission figures.

Gray water also would come from other plants at Spiritwood Energy Park: Dakota Spirit AgEnergy and Great River Energy’s 99-megawatt power plant.

Still, the planned Spiritwood Regional Wastewater Reuse Facility would need 2,325 gallons per minute of groundwater, according to the State Water Commission.

GRAND FORKS, N.D. (AP) – A Grand Forks Wal-mart store was evacuated and searched after receiving a telephone threat, but police say nothing was found.

Police Lt. Bill Macki said a Wal-mart employee received a call Sunday evening that a man had a weapon and hostages in the store. The caller demanded money and said a hostage could be harmed.

A SWAT team was sent to the store and about 150 shoppers and employees evacuated. Police searched the store.

“It did not appear that there was a threat at the store,” Macki said. Police have now given the all clear, he said.

The incident was just weeks after a U.S. airman opened fire at the same store on May 26, killing one worker and injuring a second employee before killing himself.

BISMARCK, N.D. (AP) – The synthetic drug trial of the owner and manager of the Discontent skate shop in Bismarck is in the hands of the jury.

Owner Thomas Teply, of Moorhead, Minnesota, and manager Steven Johnson, of Bismarck, are accused of operating a business where synthetic drugs were sold.

Jurors began deliberating Friday, then were sent home for the weekend. They were to reconvene Monday.

Bismarck police busted the business in June 2012. Authorities also initially charged eight store clerks but dropped the charges after the clerks agreed to cooperate with the state investigation.

Teply could face up to 30 years in prison and Johnson 45 years if convicted. Both testified in their own defense last week, saying they did not knowingly sell controlled substances.

ASHLEY, N.D. (AP) – The State Historical Society of North Dakota is holding a public meeting in Ashley to gather comments about the management and promotion of the Lawrence Welk homestead outside of Strasburg.

The Tuesday meeting is at 6 p.m. at the Shed Cafe and Bar in Ashley.

The Legislature two years ago included $100,000 in the Historical Society’s budget to buy the boyhood home of the famous band leader and turn the 6-acre site into a state historic site. Earlier this year, lawmakers agreed to pay $50,000 annually for maintenance and other costs at the home.

“The Lawrence Welk Show” ran from 1951 to 1982, featuring what became known as “champagne music.” Welk died in 1992.

MINOT, N.D. (AP) – State transportation officials say the expansion to four lanes on portions of the U.S Highway 83 bypass in Minot will include flood protection measures and several intersection improvements.

Construction on the more than $53 million project could begin as early as 2017.

The project will include replacing a bridge over the Souris River. The new structure will be 100 feet longer than the old one and have a grade rise of 3 feet, enough to handle a record flood.

The North Dakota Department of Transportation is taking written comments on the proposal through July 24.

Rebecca Provost is the academy’s assistant recreation director. Provost says the Monday class focuses on exploration and socialization, while the Friday class is about control.

Provost says the gym had wanted to offer the special needs classes for a long time, but wasn’t able to do so until it connected with the group BisMan Autism Families.

The classes are set to continue through mid-August, and the academy eventually hopes to add more diverse programs.

BISMARCK, N.D. (AP) – A food co-op in Bismarck must raise about $455,000 by the end of July to be able to open.

The BisMan Community Food Co-op has fewer than 20 days left to accomplish its start-up funding goal. The group needs $900,000 before approaching a commercial lender for the remaining capital.

Outreach coordinator Heidi Demars says  the co-op is reaching out to member-owners to ask for owner equity as part of the start-up funds. Demars says the co-op is also offering individuals and businesses a chance to purchase preferred equity, which is similar to owning stock in the co-op.

The group is aiming for $600,000 in loans from co-op members and $300,000 in preferred equity.

Demars says this type of capital campaign is typical of start-op food co-ops.

MEXICO CITY (AP) – Still no trace of drug lord Joaquin Guzman following his escape from a supposedly escape-proof lockup in Mexico. The escape has turned the crowning achievement of President Enrique Pena Nieto’s (PAYN’-yuh nee-EH’-tohz) government in its war against drug cartels into a national embarrassment. It’s the second time Guzman has escaped custody. The last time was some 13 years before his capture in 2014. Guzman slipped into a tunnel apparently dug over the past year, right under authorities’ noses.
