The Bismarck district responded with statements that showed the number of hours worked and the amount of money billed by each attorney, but the descriptions of services were blocked out.

Attorney General Wayne Stenehjem says the district should have reviewed each description of services to determine whether it met the definition of work that would not have to be reported under open records laws.

They discovered that one of the boys had broken a friend’s window and hurt himself on the glass. The boys became scared and created the stabbing cover story.

The states filed a lawsuit in June challenging the rule by the U.S. Environmental Protection Agency and the Army Corps of Engineers. The states say the new rule illegally expands the jurisdiction of those agencies under the federal Clean Water Act.

The law goes into effect Aug. 28. The injunction seeks to suspend the new rules until a court can decide the case.

The other states joining the lawsuit with North Dakota are Alaska, Arizona, Arkansas, Colorado, Idaho, Missouri, Montana, Nebraska, New Mexico, Nevada, South Dakota and Wyoming.
