Jamestown (CSi) A Minot man is be sought by the Stutsman County Sheriff’s Office, who allegedly sold stolen heavy equipment to two Stutsman County residents earlier this year.

37 year old Benjamen Wayne Smith, was charged September 21, 2015, in Southeast District Court in Jamestown with three counts of theft of property. The first count, a Class A felony, alleges that Smith transferred a stolen Caterpillar skid steer loader to a Pingree resident on April 14th. The second count, a Class C felony, is for the flatbed trailer the skid steer loader was on. The skid steer loader and trailer were stolen from a Harbor, Washington, company.

The third count, a Class B felony, alleges Smith sold a second skid steer loader to a Buchanan resident on May 15th. The second skid steer was stolen from a Bismarck-based landscaping business.

Stutsman County Sheriff’s Office detective, Major Jason Falk says,

Smith did not appear in court for these charges because he has not been apprehended.

The investigation is in cooperation with the Bismarck Police Department

Falk’s report lists two other suspects, a man from Watford City and a man from Bismarck, who were involved in transporting the allegedly stolen equipment. No charges had been filed against those men as of Tuesday afternoon.

Anyone with information about Benjamen Smith is asked to call the Stutsman County Sheriff’s Office at 251-6200.

The maximum penalty for a Class A felony is 20 years in prison and a $20,000 fine. The maximum penalty for a Class B felony is 10 years in prison and a $20,000 fine. The maximum penalty for a Class C felony is five years in prison and $10,000 fine.

 

Valley City (CSi) The Valley City Commission met Tuesday evening at City Hall. Commissioner Luke was present via conference telephone call.

NEW BUSINESS …

The City Commission approved a special assessment policy for tree removal. Auditor Richter said the issue concerns those who have a hardship in removing trees, giving those property owners more time to pay for the work through Special Assessment.

Commissioners then considered selling fire damaged city property located at W 42.5’ lot 1 & e 7.5’ of alley between lots 1 & 2 block 31 (50’) Benson’s Addition (Lavake property), 626 4th St SW. Paul Diegel requested to buy the property. Special Assessments will be transferred to the new property owners. The property without the house is to be advertised for $5,000, plus the current Special Assessments of $11,000.

The Commissioners approved the advertising of the property for sale.

 

The City Commission reviewed a Valley Recycling Contract. City Administrator Schelkoph said the changes in the new contract includes a five year contract with two renewal options.

Changes in the advertising was included, with a minimum of $2,000 per calendar year.

Another change is recycling of materials, at two sites, and moved to transfer station, plus a second location. The 90 percent of total compensation will remain the same.

Commissioners approved the contract.

 

CITY ADMINISTRATORS REPORT

David Schelkoph said a Job Service request will be made to advertise for a new police chief, in the wake of Fred Thompson’s resignation.

He said resumes and applications will be taken through the end of November, then interviewing candidates in the first part of December and have someone ready to go by the middle of January.

City Attorney Russell Myhre said Chief Thompson has brought several improvements to the police department.

Thompson says most of his family lives in the Henderson area and he will be moving back to Henderson, Nevada, where he was police chief prior to coming to Valley City, after he retires. Thompson says, his time with the Valley City Police Department has been good.

 

CITY UPDATES & COMMISSION REPORTS

Fire Chief Retterath said six applicants have applied for open positions.

KLJ indicated a change in traffic flows with the finishing of some of the permanent flood control project areas. A news release will be issued by KLJ when the changes become effective. Work will continue as along as the weather permits. When winter weather arrives Viking Drive will be graveled until next spring.

Jamestown (CSi) The Jamestown City Fire Department Tuesday at 3:30-pm responded to a grass fire outside of 904 Thomas Avenue, Northeast, adjacent to an apartment building.

Jamestown City Fire Chief Jim Reuther says, the fire was reported under control at 3:35-p.m.

Five city fire units, and 23 fire fighters were on the scene about 10 minutes.

He said the probable cause was discarded smoking materials.

Damage was confined to a small area of grass next to the building, and tires on two bicyles parked in the fire area.

Chief Reuther asks residents to be extremely careful with smoking materials and other flamables with the extremely dry conditions.

 

Valley City (CSi) The Barnes County Sheriff’s Department has lifted the burn ban, that has been in place since earlier this month by the Barnes County Commissioner.

Currently, burn bans remain in effect for McIntosh, LaMoure, Dickey, and Sargent counties.

 

Valley City (CSi) On Monday evening, at the Hi-Liner Activity Center, the public gathered to give input in the search for a new Valley City Public Schools Superintendent.

A search committee is in the process of selecting a successor to current Superintendent, Dean Koppleman, who retires at the end of this school year.

North Dakota School Board Association, Executive, Jon Martinson led the meeting.

Martinson has been working with the Valley City School Board to help coordinate the process. He met with students and staff earlier in the day, and at the public meeting, asked the audience:

What are the qualities would you like to see in your new superintendent?

Are there any issues with the school district?

The school board will begin advertising the superintendent position on November 15, 2015, and interviews will start the first week in February.

 

Jamestown (CSi) Jamestown Regional Medical Center will be celebrating 20 years of Hospice Care in the area on November 12, 2015.

JRMC, Manager of Hope, Health, and Healing Tammy Gerntholz says Hospice began in 1995.

The organization covers a 20 mile radius of Jamestown.

Gerntholz says there will be a very special speaker at the event.

The event will be held at the University of Jamestown Reiland Fine Arts Center at 6:00 PM with Dr. Kathleen Rusnak speaking at 7:00 PM. Those in attendance will learn more about Hospice care.

The event is free and open to the public.

 

BISMARCK, N.D. (AP) – A North Dakota woman accused of driving under the influence is facing a number of charges after she hit a traffic light pole while her four children were in her vehicle.
 
     The 26-year-old Brittany Hale, of Bismarck, has been charged with DUI while accompanied by a minor, reckless endangerment and criminal vehicular injury.
 
     Authorities say Hale’s blood alcohol level was nearly three times the legal limit when her vehicle left the road and hit the pole Sunday in Bismarck. Court records show she told a witness that she was “texting and driving” and didn’t see where she was going.
 
     The four children were transported to a hospital. A 7-year-old boy was injured in the crash.
 
     Hale’s court record doesn’t list an attorney who could comment on the charges.

 

 BISMARCK, N.D. (AP) – The judge presiding over a sex trafficking trial underway in Bismarck has become frustrated with the defendant who is representing himself because he doesn’t appear to be ready for the proceedings.
 
 The  frustration from U.S. District Judge Daniel Hovland was evident when defendant Keith Graves cross examined a witness Tuesday. Hovland told Graves he ignored advice to work with a professional attorney.
 
     Graves faces 11 charges related to sex trafficking by force or coercion, obstruction, and methamphetamine possession and distribution. Authorities say Graves beat some of his victims and forced at least one woman to perform sex acts on him.

The Bismarck Tribune reports, on Tuesday, one of those women got the chance to tell the jury her story.

The Jamestown woman spent only four or five days with Graves, but in that time she told the jury that he forced her to perform sexual favors on clients and himself on several occasions.

As Assistant U.S. Attorney Brandi Sasse Russell questioned her, she told the jury how, in addition to sexual favors, Graves made her hand drugs over to buyers in exchange for money, despite Graves being present at the transaction.
 
     Graves was one of the main subjects in “The Overnighters,” which won an award at the 2014 Sundance Film Festival. It followed a pastor who opened his church to homeless oil workers.

 

FARGO, N.D. (AP) – U.S. Attorney Chris Myers says a federal officer was justified in shooting and killing a man on the Spirit Lake Indian Reservation last summer.
 
     Bureau of Indian Affairs Officer Terry Morgan shot and killed 31-year-old Joseph Charboneau during a standoff with officers on June 16. Myers says an investigation by his office concluded Morgan was justified in using deadly force.
 
     The FBI has said the incident began when officers went to a residence to arrest another person, and an altercation ensued with Charboneau. Myers says Charboneau had a loaded gun and also grabbed a blow torch, and that he refused to comply with officers’ orders to drop the gun.
 
     Myers says Charboneau threatened not only the officers but also another person in the home.
 

 

 BISMARCK, N.D. (AP) – A Houston oil company says crews have successfully plugged an oil well in western North Dakota that had been spewing a mixture of oil and saltwater for several days.
 
     Oasis Petroleum spokesman Brian Grove says the well near White Earth was under control at midmorning on Tuesday.
 
     State environmental scientist Bill Suess (sees) says the well had been out of control since Saturday night.
 
     Regulators say a light sheen was seen on the White Earth River, about 850 feet from the well. Absorbent booms have been placed across the river.
 
     Suess says 1,760 barrels of oil and 2,000 barrels of saltwater had been recovered as of Sunday night. A barrel is 42 gallons.
 

 BISMARCK, N.D. (AP) – Population gains attributed to nearby oil fields have led to Minot being on track to become North Dakota’s fourth metropolitan area as defined by the federal government. A census official says the distinction could be short-lived if oil prices and drilling activity continue to slide in the state. Minot would be required to maintain at least 50,000 residents for two years.

 

FARGO  (AP)  Dry conditions over the past week have aided North Dakota farmers with harvest, but the conditions and resulting fire danger also have prompted some producers to stop fall tillage work.
 
     The Agriculture Department says in its weekly crop report that strong winds also caused damage to some corn and sunflower crops.
 
     The report says the harvests of soybeans, potatoes and sugar beets all are wrapping up. About one-third of the corn and sunflower crops are in the bin.
 
     North Dakota ranchers have been busy the past week hauling hay, moving cattle and weaning calves. Pasture and range conditions statewide are rated 44 percent good to excellent. Stock water supplies are 77 percent adequate to surplus.

 

 BISMARCK, N.D. (AP) – North Dakota’s congressional delegation says a U.S. International Trade Commission ruling that Mexico dumped heavily subsidized sugar on U.S. markets is good news for sugar beet farmers in the Red River Valley.
 
     U.S. Sen. John Hoeven says the ruling confirms Mexico harmed American farmers and is an important step toward enforcing trade agreements.
 
     The American Sugar Alliance says the ruling means agreements to keep Mexican producers from undercutting U.S. prices remain in effect into 2019.
 
     U.S. Sen. Heidi Heitkamp says enforcing trade laws is critical to guaranteeing free trade. U.S. Rep. Kevin Cramer says foreign governments shouldn’t be allowed to subsidize their farmers at the expense of U.S. producers.
 
     North Dakota is the third-leading state for sugar beets, producing about 16 percent of the nation’s crop.

 

  MANDAN, N.D. (AP) – City commissioners have approved a ban in Mandan on floating lanterns sold at fireworks stands.
 
     The Mandan City Commission voted unanimously Tuesday in a favor of the ordinance that makes the possession or use of floating lanterns, incendiary balloons, sky lanterns and celebration lanterns an offense punishable with a $75 fine.
 
     The proposal was prompted by concerns over the possibility of lanterns igniting a structure at the Tesoro Mandan Refinery.
 
     The Morton County Commission also is considering a ban on floating lanterns.

 FARGO, N.D. (AP) – North Dakota State has confirmed that starting quarterback Carson Wentz will miss 6 to 8 weeks after breaking a bone in his throwing wrist. Bison athletic department spokesman Ryan Perreault (pur-AHLT’) says Wentz will undergo surgery Wednesday for the right wrist injury. Perreault says Wentz has a “non-displaced fracture” and is expected to miss the regular season.

 

VERMILLION, S.D. (AP) – University of South Dakota starting running back Trevor Bouma is done for the season after breaking an arm.
 
     Bouma suffered the injury Saturday in USD’s 24-21 upset of four-time defending FCS champion North Dakota State. Bouma rushed 20 times for 94 yards in the game and caught two passes for 80 yards.
 
     Coyotes coach Joe Glenn says Bouma is scheduled for surgery on the broken arm – the same one he broke a year ago that cut his season five games short. He’ll miss the final five games again this year.

 

 BISMARCK, N.D. (AP) – North Dakota’s Game and Fish Department says fall wild turkey licenses remain in Unit 25 for hunters who don’t yet have a license or want additional ones.
 
     Hunters are allowed up to 15 licenses for the fall season, which began Oct. 10 and runs through next Jan. 3.
 
     Unit 25 covers McHenry County and portions of Pierce and Ward counties.

TWINS AWARDS…

 MINNEAPOLIS (AP) – Miguel Sano is the big winner with the Minnesota Twins annual awards. Sano was chosen as most valuable player and most outstanding rookie. The awards were announced Tuesday by the Twins. The only other player in club history to win the MVP and rookie awards in the same season was Tony Oliva in 1964.

Torii Hunter also won twice, for leadership and media cooperation. Kyle Gibson was picked as the top pitcher, Aaron Hicks was named most improved player, Eddie Rosario won best defensive player and Brian Dozier won an award for community service.

The winners will be honored Jan. 28 at the Diamond Awards at Target Field, the annual kickoff to the team’s fan festival.

 

In world and national news…

 BRUSSELS (AP) – The executive arm of the European Union is bringing leaders together Sunday for an urgent mini-summit of EU and Balkan countries in an effort to deal with the emergency involving the influx of refugees and other migrants. Migrants continue to make their way across Europe by the tens of thousands. Many attempt to enter through the Balkans where some countries have closed their borders.
 
     JERUSALEM (AP) – A prominent Holocaust researcher at the Hebrew University says comments by Israeli Prime Minister Benjamin Netanyahu may have served a political purpose but essentially made him a Holocaust denier. The uproar began after Netanyahu suggested that a World War II-era Palestinian leader convinced the Nazis to adopt their Final Solution. Holocaust experts slammed Netanyahu’s comments as historically inaccurate and helping Holocaust deniers by lessening the responsibility of Adolf Hitler, as well as inciting more unrest.
 
     PALEMBANG, Indonesia (AP) – Indonesia is about to get some help fighting massive forest fires that have spread an unhealthy, smoky haze over parts of Southeast Asia. Two Russian jets that can drop 12.5 tons of water arrived on Sumatra island today. The amphibious planes can suck 3,500 gallons of water from a river or sea in seconds to later be dumped on the flames.
 
     WASHINGTON (AP) – Hillary Clinton’s latest ratings have taken an encouraging swing. A new Associated Press-GfK poll shows strong majorities viewing her favorably and more saying she can win the White House than any of her rivals. The poll also says fewer than half of Americans think any of the Republican hopefuls can win in 2016.
 
     WASHINGTON (AP) – Wisconsin Rep. Paul Ryan is waiting to see if he gets the House Republican unity he’s demanding in return for making a run for speaker. He’s given leaders until Friday to get him consensus support. Compromise-averse conservative hardliners have already made it clear that they need to be convinced. No other potential candidate is seen as having the stature to gather enough support.
