Jamestown (CSi) The New Rockford man, accused of shooting and killing Donald “Donnie” Perleberg and shooting and wounding Mary Seiler on September 6, 2015 at a wedding dance at the New Rockford Eagles Club, on Friday was bound over for trial on seven charges. Those include murder.
Southeast District Judge Thomas Merrick has ruled there was probable cause to believe that 50 year old David Troske, had committed the crime after a preliminary hearing in Southeast District Court in New Rockford.
Troske entered not-guilty pleas to murder, attempted murder, aggravated assault, reckless endangerment and possessing a gun in a bar where alcohol is served.
Eddy County Sheriff Paul Lies testified during the preliminary hearing that Seiler said to him during questioning that Troske came up behind her and Perleberg where they sat at a table with others during the wedding dance. Troske asked Seiler who she was going home with. When she replied alone, Troske allegedly pulled a pistol and shot Perleberg in the back of the head and fired two shots into Seiler before sitting down for a drink at the table.
Troske was arrested at the scene.
No trial date has been set. Troske remains in custody on $2 million bail.

The patrol says 42-year-old Jammie Petras of Sidney was killed Friday afternoon about a mile south of Alexander, in McKenzie County.
Troopers say Petras’ pickup collided with the rear of the semitrailer after the driver of the semi slowed for a school bus that was making a turn.
The driver of the semi, 52-year-old James Stanik of LaPorte, Indiana, suffered minor injuries and was treated and released from a local hospital.
FARGO, N.D. (AP) – A man is accused in federal court of dealing large amounts of methamphetamine in North Dakota and Minnesota.
Damian Mata, of Bloomington, Minnesota, is charged in North Dakota with conspiracy to possess with intent to distribute a controlled substance. He has pleaded not guilty.
Authorities say the ring involved more than 500 grams of meth. A detention hearing for Mata is scheduled Tuesday in Fargo.
A federal public defender could not be reached for comment.
BISMARCK, N.D. (AP) – The child pornography trial for a former corrections officer with the Williams County Sheriff’s Department has been delayed again.
The federal trial of 49-year-old Steve Brooks is now expected to begin Feb. 23. It was first scheduled for September and then mid-December.
Brooks faces three charges, including sexual exploitation of a minor. Authorities accuse him of downloading child pornography and surreptitiously video recording a girl.
Assistant U.S. Attorney Gary DeLorme says the trial was postponed because defense attorneys asked for more time to prepare.
Brooks was arrested in May at his Williston home. The case began in district court but went federal in July after a grand jury indicted him.
Brooks worked for nine years at the sheriff’s department and was fired after his arrest.
BISMARCK, N.D. (AP) – Thousands of layoffs from the oil industry’s slide have taken a toll on donations in western North Dakota’s oil patch, just as charities say their need is increasing.
The Salvation Army says donations were down by more than 60 percent in Williston as of mid-December.
Capt. Joshua Stansbury with the Salvation Army in Williston says the charity is seeing an uptick in requests for help, from vouchers for bus tickets to leave the state to help with rent payments.
North Dakota Petroleum Council spokeswoman Tessa Sandstrom estimates up to 20,000 workers have been laid off.
She says companies are doing some philanthropic belt-tightening, and some are turning to such things as coat, food and blood drives to give back to communities.
STANTON, N.D. (AP) – A company has received preliminary approval for a man camp between Hazen and Beulah to house workers building a $500 million urea fertilizer plant in the area.
The Mercer County Planning and Zoning Commission recommended a plan by Civeo Corp. to move unused oil patch units from Dickinson into Coal Country on Thursday night.
Planning official Wes Klein says zoning experts are concerned about Highway 200 traffic safety and the possibility of dangerous caverns from old underground coal mines underneath the proposed site.
Civeo wants the man camp to start with 100 beds in 50 units and expand to 200 beds if need grows for the Basin Electric Power Cooperative plant.
The county commission must give final approval. It’s expected to discuss the issue Jan. 6.
BISMARCK, N.D. (AP) – Revenue is coming in at only half of the projected rate for a program aimed at helping communities deal with the effects of energy development.
The Oil and Gas Impact Grant Fund was projected to collect $6 million monthly from oil taxes over the next two-year budget cycle.
Land Commissioner Lance Gaebe says the fund is collecting only about half of that now, due to a drop in oil activity.
Gaebe says a plan needs to be developed “to moderate the pace of grant awards.”
The plan is expected to be presented next month.

BISMARCK, N.D. (AP) – North Dakota’s Game and Fish Department is reminding winter anglers that fish houses left unoccupied on state waters must be made of materials that enable them to float.
Officials say the float rule applies to campers used as fish houses. If a camper doesn’t float, it needs to be removed when the angler leaves the ice.
Unoccupied fish houses left on the ice also must have the owner’s name and either address or telephone number displayed on the outside in characters at least 3 inches high.
Other fish house regulations can be found at www.gf.nd.gov .
MANDAN, N.D. (AP) – A group of Mandan officials has been tasked with studying the future of six 50-year-old tennis courts that were last resurfaced in 1998.
The Mandan Park Board has selected a committee to analyze what should be done with the space.
The board has previously discussed turning some of the space into a parking lot.
Park superintendent Mike Zerr says the courts are pitted up and cracked. He says they have “outlived their usefulness.”
Parks and recreation director Cole Higlin says the city needs to figure out what is needed in the area – parking spaces, two or six tennis courts or even a warming house for a skating rink.
Higlin says the cost of new courts ranges between $75,000 and $100,000 each.
