VALLEY CITY, N.D. (AP) – 85 year old Art Kirschenmann has died from injuries suffered in a house fire in Valley City.
Fire Chief Gary Retterath says it appears the blaze broke out shortly before 3 a.m. Sunday in the home’s basement.
Retterath says the body of Kirschenmann has been sent to the State Forensic Examiner’s Office for an autopsy to determine his cause of death.
Kirschenmann’s wife Arlene, was injured in the fire, and was reported in fair condition in a Fargo hospital, Monday.
State fire marshal investigator, Ken Sisk said Monday the cause of the fire is still under investigation and didn’t know when a determination will be made.

Valley City (CSi) Valley City’s City Attorney, Russell Myhre claims Valley City Mayor Bob Werkhoven has created a hostile work environment in City Hall, also alleging Werkhoven harassed city employees including Myhre
Myhre has issued a grievance about Werkhoven’s behavior to his attorney Joseph Larson who represents Myhre and three other city employees.
After reviewing the Myhre grievance Larson says Mayor Werkhoven’s conduct is erratic and his behavior combative.
In a another issue, four city employees want an investigation into whether Robert Drake’s ‘letter of 15 questions,” presented to the city in December are defamatory and if Mayor Werkhoven was involved in creating the letter.
Meanwhile, Valley City Police Lt. David Swenson is accusing Valley City Mayor Bob Werkhoven of creating an abusive and hostile work environment.
In his grievance Swenson accused the Mayor of trying to get people to protest his promotion to Lieutenant during a swearing in ceremony in November of 2015.
Swenson said this issue stems from 2011 when the city of Valley City tried to fire Dean Ross and myself over false accusation. He said Ross and the city reached a settlement and he retired in good standing. Swenson said Mayor Werkhoven has disliked him since this incident.
Swenson’s attorney Joseph Larson said Mayor Werkhoven has hated Swenson for supporting former police chief Dean Ross and carried a personal grudge against Swenson.
BISMARCK, N.D. (AP) – North Dakota Attorney General Wayne Stenehjem (STEHN’-juhm) says it’s “no surprise” the Supreme Court will not allow the state to enforce a law banning abortions when a fetal heartbeat is detected as early as six weeks into a pregnancy.
The justices on Monday turned away the state’s appeal of lower court rulings that struck down the 2013 fetal heartbeat law as unconstitutional. The law never took effect, and abortion rights supporters said it was the strictest anti-abortion measure in the country.
Stenehjem called review of the law a “longshot,” especially after the high court last week rejected Arkansas’ bid to enforce its own fetal heartbeat law, banning some abortions at 12 weeks.
Stenehjem says he now considers it to be settled law
DICKINSON, N.D. (AP) – No criminal charges will be filed in the death of a Bismarck man at a construction site in Dickinson.
The remains of 30-year-old Eric Haider were found last May, three years after he went missing at a work site where he had been working with a plumbing company.
Police say Haider was buried alive, and there was nothing suspicious in the autopsy report.
Stark County State’s Attorney Tom Henning declined to file any charges, and the case is closed.
MANDAN, N.D. (AP) – A 38-year-old Mandan man will spend three months in prison for sexually assaulting a girl.
Jeromy Don Krueger was sentenced Monday to one year with all but three months suspended, followed by four years of supervised probation.
Krueger was accused of sexually assaulting a girl on several occasions between December 2013 and March 2015.
He was arrested last March after one of the victim’s friends told Burleigh County Sheriff’s Department deputies about the sexual abuse. Court documents show that both the victim and Krueger confirmed the abuse when they were interviewed by investigators.
Krueger pleaded guilty to felony sexual assault in October.
BISMARCK, N.D. (AP) – A homeless man charged with murder in North Dakota has changed his plea to guilty.
Forty-five-year-old Mark Butts pleaded guilty Monday in Bismarck.
Butts was initially charged with class AA felony murder in December 2014 after authorities said he stabbed 57-year-old Richard Glover in a car in Bismarck. Police found Glover’s body on the street next to the car.
For pleading guilty, Butts’ charge has been lowered to a class A felony, punishable by up to 20 years in prison.
Judge Bruce Haskell ordered a pre-sentence investigation to be done before Butts is sentenced.
MINOT, N.D. (AP) – A North Carolina man says he will plead guilty to a federal drug charge in North Dakota.
Roderick Harris is charged with four counts, including possession with intent to distribute methamphetamine. In exchange for pleading guilty to that charge, the government says it will drop the other three counts.
Harris, of Maxton, North Carolina, faces a maximum penalty of life in prison and a minimum sentence of 10 years behind bars.
Authorities charged Harris after a search of a Minot home turned up several pounds of meth, two stolen guns, $20,000 in cash and hundreds of prescription pills from a home.
Harris’ brother, Frederick Harris, has pleaded not guilty in federal court to drug and weapons charges. Frederick Harris is from Minot.
FARGO, N.D. (AP) – A federal judge has sentenced two men to more than three years in prison for distributing a powerful synthetic drug that led to numerous overdoses in the Grand Forks area.
Kain Schwandt and David Noye Jr. pleaded guilty earlier to conspiracy to possess with intent to distribute controlled substances. Authorities say the two men continued to deal powdered fentanyl after they knew that one of their customers died from an overdose.
U.S. District Judge Ralph Erickson on Monday sentenced Schwandt to 42 months in prison and Noye to 39 months behind bars. The judge said the case is “as bad as it gets” for a drug conspiracy.
Attorneys for the two defendants say their clients have taken responsibility for their actions and both have been model citizens since their arrests.
BISMARCK, N.D. (AP) – Attorney General Wayne Stenehjem (STEHN’-juhm) says the fundraising arm of North Dakota State University violated the state’s open records law.
Stenehjem said in a written opinion issued Monday that the North Dakota State University Development Foundation and Alumni Association violated state law when it refused to release the applications for people seeking to become its next president and CEO.
Stenehjem said The Forum newspaper in Fargo requested an opinion from the state after the foundation refused to release the original applications for the positions. A search firm hired by the foundation had removed any identifying information and was in possession of the original applications.
Stenehjem said the search firm was acting as an agent of a public entity and was therefore subject to the open records law.
BUFFALO, N.D. (AP) – North Dakota’s Health Department has extended a public comment period and scheduled a public hearing on a proposed 9,000-hog operation near Buffalo.
The comment period will run to March 19, and an informational meeting and public hearing will be held March 17 at the Buffalo Senior Citizens building.
Minnesota-based Pipestone Holdings LLC is planning the $15 million Rolling Green Family Farms hog facility. It needs a permit from the Health Department.
Rolling Greens Family Farms spokesman Barry Kerkaert says the hog farm would create jobs, boost the local economy and not pose risks to the environment.
But some of the town’s 200 residents worry about problems such as odor. They held a petition-signing event over the weekend to show opposition and demand more information on potential impacts.
MINOT, N.D. (AP) – City officials in Minot will need about $109 million to complete flood resilience projects that are getting $74 million in federal grant funding.
Minot is one of 13 communities sharing in about $1 billion through the Housing and Urban Development’s National Disaster Resiliency Competition.
The federal officials liked Minot’s proposals for a one-stop social service center, a technical education center, affordable housing and non-structural techniques to reduce flood risk.
Minot’s application totaled nearly $183 million. That means other money is needed from private sources such as foundations to fully complete the work.
Minot Finance Director Cindy Hemphill says the city will have to determine how its projects fit into the missions of various foundations before pursuing funding.
BISMARCK, N.D. (AP) – A North Dakota committee is working to overhaul the state’s prison system to lower costs and ease overcrowding.
The Legislature’s Incarceration Issues Committee is meeting Tuesday at the state Capitol in Bismarck.
The group is made up of lawmakers, prison officials, judges and members of the public.
The Legislature last year appropriated $50,000 to study policy changes to cut recidivism and keep people out of prison, through treatment and sentencing alternatives.
MINOT, N.D. (AP) – Country superstar Kenny Chesney and rock legend KISS will headline the grandstand acts at this summer’s North Dakota State Fair.
KISS will close out the fair with a concert on Saturday, July 30. Fall Out Boy, another rock band, will open the fair on Friday, July 22.
Chesney’s concert is scheduled for Thursday, July 28.
Other grandstand acts lined up for the 2016 fair are country stars Billy Currington, Jake Owen, LOCASH and Old Dominion.
There also will be Enduro Races and a Monster Truck Show.
Tickets for the 51st North Dakota State Fair go on sale on March 1.

FARGO, N.D. (AP) – Junior guard Carlin Dupree has rejoined the North Dakota State basketball team, two weeks after leaving because he was unhappy with his role.
Dupree said in a statement issued by the school Monday that he made “a selfish decision” and hopes he’ll be forgiven.
Coach David Richman says Dupree is a member of the Bison family and will be supported. But he also says Dupree is returning with “some adjusted expectations,” and it hasn’t been decided whether he’ll play again this season.
Before leaving, Dupree had played in 17 games and was averaging seven points, three rebounds and two assists. The Milwaukee native is best known for coming off the bench and scoring four straight points in overtime to spark an 80-75 win over Oklahoma in the 2014 NCAA Tournament.

MINNEAPOLIS (AP) – Third baseman Trevor Plouffe and the Minnesota Twins have agreed to a $7.25 million, one-year contract to avoid arbitration.
Plouffe gets a raise of $2.45 million under Monday’s agreement. He hit .244 last season with 22 homers and a career-high 86 RBIs. He also set career bests in hits (140), runs (74) and games (152), solidifying himself in the middle of the Twins order.
The settlement was $225,000 below the midpoint between the $7.9 million Plouffe had asked for in arbitration and the $7 million Minnesota had offered.
Plouffe’s development as a solid power hitter and capable defensive third baseman led the Twins to move prized prospect Miguel Sano to the outfield. Sano came up through the minors as a third baseman and mostly served as a DH in his 80 games with the Twins last year.

Karl Anthony-Towns led Minnesota with 26 points and 11 rebounds.

Safety Harrison Smith, quarterback Teddy Bridgewater and linebacker Anthony Barr all were added to the Pro Bowl roster on Monday. That trails only the 54.9 million for the 2011 Steelers-Jets matchup, which was played in a later time slot. CBS’ records go back to 1978.

Futures point to opening losses today on Wall Street. In China, market strategists say investors are in near-panic in the absence of a shift in government policies and economic fundamentals. Benchmark U.S. crude oil fell below $29.50 a barrel and the dollar lost ground.

FLINT, Mich. (AP) – Some big retail companies are rallying to Flint Michigan’s side during the city’s crisis over lead-tainted drinking water. Walmart, along with Coca-Cola, PepsiCo and Nestle, say the collective donation will include up to 6.5 million bottles of water through December for at least 10,000 schoolchildren.
CUMMING, Ga. (AP) – Authorities say a Georgia woman went skydiving, rode in a hot air balloon, took a free trip to New Orleans, went fishing in the Gulf of Mexico and received a signed letter from members of baseball’s Atlanta Braves as part of a terminal cancer scam. The Forsyth County Sheriff’s Office says 29-year-old Mary Bennett of Cumming is charged with felony first-degree forgery and misdemeanor theft. She’s also accused of accepting thousands of dollars in donations.
LONDON (AP) – For people who fondly remember childhood tales of Peter Rabbit, he’ll be back in a new book this year, but older now, thanks to a find by publisher Jo Hanks. “The Tale of Kitty-In-Boots” is a previously unpublished story by children’s author Beatrix Potter. Hanks found a reference to the manuscript in a book about the author, who had written to her publisher about the story of “a well-behaved prime black Kitty cat, who leads a double life.” The manuscripts were in a museum archive.
