Valley City (CSi) Valley City (CSi) – A second SPECIAL MEETING of the Valley City Commission was held Thursday afternoon at City Hall.
Mayor Werkehoven was not present. The meeting was conducted by Commission Vice President Pedersen.
The City Commissioners discussed the permissibility of the grievances filed against Mayor Werkhoven, and how the employee manual and code of conduct apply to the process going forward.
The city commission had requested the Barnes County State’s Attorney to determine the status of the grievances. Under review is rights of four city employees in the city employee personal policy and procedure manual.
At Thursday’s meeting, Pedersen said State’s Attorney Carl Martineck said it was not within his scope to provide the information.
The Commission voted unanimously to hire Vogel Law Firm to make a determination on the permissibility and how the process pertains to the city’s Code of Conduct and Employee Manuel, with a fee cap of $7,500.
Next the City Commissioners considered retaining an attorney for the limited purpose of investigating the grievances filed against Mayor Werkhoven and advising the City Commission during the Grievance procedures.
The City Commission voted unanimously to potentially engage attorney Pat Monson as a mediator, if Vogel determines that mediation is the approach.
A fee cap is to be determined.
BISMARCK, N.D. (AP) – A team from Jamestown has won the state finals of the annual LifeSmarts competition.
Ten teams of students representing seven North Dakota high schools competed in the annual LifeSmarts competition this week in Bismarck.
LifeSmarts tests students about personal finance, health and safety, the environment, technology, and consumer rights and responsibilities.
The Jamestown team will represent North Dakota at nationals in Denver, Colorado in April.
JHS team Number two is coached by Jamestown High School social studies teacher Marchel Krieger and consists of team captain Courtnay Kiecker and members Colton Carson, Cris Dupre, Leo Fremgen and Julia Shirley. The team prevailed through elimination rounds in a field of 10 teams and defeated Flasher High School team Number two in the finals at the Heritage Center in Bismarck.
FARGO (AP) – Police have identified the man suspected of shooting a Fargo police officer as 49-year-old Marcus Schumacher (SHOO’-maw-kur).
Authorities say Schumacher held police at bay for about 11 hours, Wednsday night through Thursday morning, firing numerous rounds at law enforcement, when police responded to a domestic violence report.
The injured officer, Jason Moszer died Thursday afternoon about 12:45, according to Fargo Deputy Police Chief Joe Anderson.
Court records show Schumacher was sentenced in 1989 on charges of manslaughter and reckless endangerment for the death in downtown Grand Forks of 17-year-old Maynard Clauthier. The North Dakota Supreme Court ordered a new trial the following year and Schumacher was convicted of negligent homicide and sentenced to five years.
Separate court documents show that Schumacher was convicted of disorderly conduct in January 2013. He served a year of probation.
Police Chief David Todd says a SWAT team entered the Fargo home shortly before dawn Thursday and found his body. Todd says he doesn’t know if the suspect was hit in an earlier exchange of gunfire with a SWAT officer or if he shot himself. Continuing updates at WDAY.
The six-year veteran of the force with a wife and two children is just the second Fargo officer to die in the line of duty and the first in more than a century.
An account has been set up at Bell State Bank & Trust for the behalf of the family of Officer Jason Moszer.
Moszer was the officer shot during Wednesday night’s standoff in North Fargo.
Donations can be dropped off at any Bell State Bank locations for the “Moszer Family Benefit Account.”
FARGO, N.D. (AP) – Officials around North Dakota are expressing grief and condolences in the wake of an incident in Fargo that left a police officer dead.
Fargo Mayor Tim Mahoney said in a statement the city was “profoundly saddened” by the death of Moszer, who won a Silver Star commendation after he and another officer were credited with risking their lives in 2011 to rescue two children from an apartment fire.
Late Thursday, hundreds gathered for a candlelight vigil in his honor.
Gov. Jack Dalrymple issued a statement offering prayers for Moszer’s family, Fargo police and the city itself. He said he will direct flags to be flown at half-staff statewide to honor Moszer on the day of his funeral.
Members of North Dakota’s congressional delegation also issued statements expressing condolences. Grand Forks Mayor Michael Brown said that nearby city’s police department stands ready to help Fargo police if needed.
NEW ROCKFORD, N.D. (AP) – Authorities have identified a body recovered from the Sheyenne River as a 36 year-old Halstad, Minnesota, woman who disappeared last fall.
Eddy County Sheriff Paul Lies says the medical examiner identified the woman as Amanda Engst. A dive rescue team from Jamestown recovered her body from the river on Tuesday afternoon.
A cause of death was not released, although foul play is suspected. Lies says a car owned by Engst was used by two people linked to burglaries and robberies in Minnesota and North Dakota.

Jamestown (CSi) The Jamestown Rural Fire Department spent about six hours at the scene of a truck fire Wednesday night into early Thursday morning.
Rural Fire Chief Ben Maulding, says nine rural firefighters and three units responded to the call of a semi on fire on the U.S. Highway 281 bypass west of Jamestown about 7:30 p.m. The van trailer of the rig was hauling dry pasta.
The fire started in the tractor of the semi and had spread to the trailer and load by the time units arrived.
Firefighters put out the exterior fire in less than an hour during which time traffic on the bypass was blocked.
They had to unload pallets of pasta to get at the fire inside the trailer, taking several hours.
The cause of the fire is listed as electrical or mechanical in the tractor of the rig.
The semi tractor, trailer and contents were all total losses. No injures reported.
Washington (CSi) North Dakota Senators John Hoeven and Heid Heitkamp have announced that the North Dakota Housing and Urban Development has awarded 15 grants totaling $2.1 million to several housing authorities in the state.
The Barnes County Housing Authority will receive $53,893.
The funds were made available through HUD’s Capital Fund program and supports management improvements and modernization of public housing.

FARGO, N.D. (AP) – Fargo police are searching for a male who robbed a convenience store at gunpoint.
Lt. Joel Vettel says the suspect walked into the Petro Serve USA station shortly before 3:30 a.m. Friday, pointed a handgun at a customer and demanded money from the store’s clerk.
No one was hurt. A police dog unsuccessfully tried to track the suspect.
BISMARCK, N.D. (AP) – North Dakota’s Parks and Recreation Department is funding 13 projects through the state’s Outdoor Community Grant Program.
The Legislature last year approved half a million dollars for the program for the two-year budget cycle. Grants are in two categories – outdoor recreation facilities and recreation leadership grants.
The program received 19 applications totaling more than $1 million. Grants were awarded for projects in Almont, Barnes County, Bathgate, Belfield, Beulah, Bismarck, Bowman, Cavalier County, Crosby, Devils Lake, Harvey, Morton County and Mooreton.

FARGO, N.D. (AP) – North Dakota State football coaches enjoyed some free advertising on the recruiting trail for this year’s class.
Standout quarterback Carson Wentz happened to be wowing observers at the Senior Bowl just as the Bison staff was giving their final pitches to new recruits. The Bison cashed in with more than two dozen signees.
Wentz is projected by some experts to be selected as high as Number 2 in the NFL draft. The Bison won their fifth straight FCS title last month when Wentz, after missing 10 weeks with a broken wrist, came off the injury list for the January finale in Frisco, Texas.
Bison head coach Chris Klieman (KLY’-min) says Wentz’s exposure was “like a walking billboard for North Dakota State.”

VERMILLION, S.D. (AP) – Tyler Flack had season highs of 18 points and 10 rebounds and Tre Burnette 11 points and 10 boards to lead South Dakota to a 72-58 win over North Dakota State Thursday night.
Flack posted his first double-double of the season and Burnette his fifth. D.J. Davis added 13 points and Casey Kasperbauer 10 for the Coyotes (12-14, 4-8 Summit), who never trailed.
A free throw by Flack gave South Dakota its largest lead of 20 points, 52-32, with 10:13 remaining. North Dakota State briefly got within nine with 4:41 to go.
Carlin Dupree had 14 points and Khy Kabellis 12 for the Bison (16-9, 6-5), who scored only six points in the game’s first 10 minutes and trailed 29-21 at halftime.
South Dakota won its second in a row while North Dakota State lost for the first time in three games.
CHENEY, Wash. (AP) – Austin McBroom scored a career-high 35 points and Eastern Washington beat North Dakota 95-85 on Thursday night to take over sole possession of third place in the Big Sky Conference.
McBroom was 9 of 17 from the floor, 5 of 8 from the arc and made 12 of 14 free throws for the Eagles (14-10, 8-4), who won their fifth straight.
Venky Jois added 24 points on 9-of-9 shooting.
McBroom scored 20 points in the first half when the Eagles took a 44-34 lead. The Hawks (12-11, 7-5) got within four early in the second half but an 18-5 run that included 10 points from Vois put EWU up 17. North Dakota cut it to seven with 38 seconds remaining but eight free throws, six by McBroom, ensured the win.
Quinton Hooker led North Dakota with 20 points while Drick Bernstine had 10 rebounds with his 14 points.

NASCAR-RULE CHANGES…
DAYTONA BEACH, Fla. (AP) – NASCAR has announced that it is shifting to an unlimited green-white-checkered finish format when late-race cautions come out. It’s establishing an “overtime line” to determine the winner.
The line will vary by track. If the race leader passes the line on the first lap under green before a caution comes out, it will be considered a valid green-white-checkered attempt. If a caution comes out before the leader passes the overtime line on the first lap under green, it will not be a valid attempt. The race continues until a valid attempt.
NASCAR previously had a limit of three tries to complete the race.

MUNICH (AP) – Diplomats didn’t get their lasting cease fire but have agreed to work toward a temporary “cessation of hostilities” in Syria’s civil war within a week, along with moving more humanitarian aid. Meanwhile, U.S. Defense Secretary Ash Carter says United Arab Emirates has agreed to send special forces soldiers to Syria to assist in training local fighters focused on recapturing Raqqa. Russia is warning against ground forces.
BRUSSELS (AP) – French Finance Minister Michel Sapin is taking an act now approach in urging the European Union to adopt ways to choke off some of the money supply going to extremist groups. Last week, the EU unveiled a plan aiming at tracking extremists as they move money or assets and limiting their ability to raise funds by targeting their sources of income. Sapin recalled that France has pushed for such measures since the Charlie Hebdo attacks last year.
BRUSSELS (AP) – The European Union says the migrant crisis is posing an increasing risk to the EU’s Schengen area of borderless travel and is pointing an accusing finger at Greece. The EU nations said in a statement that there are “serious deficiencies” to how Greece is protecting its border, which also is an external border of the whole Schengen zone, and urged Athens to address them.
JAKARTA, Indonesia (AP) – People ran out of houses and buildings in panic today as a strong, 6.5 magnitude earthquake rocked parts of Indonesia’s main island of Java. There were no immediate reports of injuries or damage. Authorities say there is no tsunami danger. The world’s largest archipelago, Indonesia is prone to seismic upheaval due to its location in an arc of volcanoes and fault lines.
BERLIN (AP) – European scientists say they’ve pulled the plug on signals to the first space probe to land on a comet. The German Aerospace Center, or DLR, says it last made contact with the Philae (FY’-lee) lander July 9, but efforts since then have failed. Scientists say the comet is just too cold now. Still, before it stopped communicating, Philae sent back reams of data that will take years to analyze.
