Jamestown (CSi) Stutsman County Sheriff, Chad Kaiser has terminated a Stutsman County deputy who filed a complaint about improper use of vehicles in the sheriff’s office.

Kaiser said he terminated Elizabeth Kapp from her position as a sheriff’s office deputy last week. Kapp had been employed there since 2003 and was promoted to sergeant in 2012

Mark Friese, Kapp’s attorney, said his client intended to proceed with a grievance or court case to reverse the termination.

Kaiser said Kapp had been subject to a performance improvement plan since November after receiving an unsatisfactory performance review and a letter of reprimand.

Kapp filed a written complaint in January that the staff of the Stutsman County Sheriff’s Office was improperly using office vehicles for personal use after verbally reporting it to Kaiser in October.

On February. 15th, Stutsman County state’s attorney, Fritz Fremgen,declined to pursue the complaint, saying “the extent of the use is not something I would pursue criminally when there is an employer positioned to take negative personnel action.”

Kaiser says an internal investigation into the same incident by the Stutsman County Sheriff’s Office is complete, but the results were not released pending the completion of a parallel investigation by the Jamestown Police Department.

 

Jamestown (CSi) The Stutsman County Park Board tabled action Tuesday on a proposal to phase in a rate increase for lot rent for cabins at Jamestown Reservoir.

The Bureau of Reclamation requires the annual lot rents to increase by more than 100 percent for both seasonal and year-round users. The county Park Board had requested the increase be phased in over five years. The Bureau of Reclamation said the increase must be implemented in no less than three years.

The Park Board has returned a $10,000 grant to the Garrison Diversion Conservancy District. The local share for the grant was $42,000, and the county had no projects it could fund and complete by the April 30 deadline.

 

Jamestown (CSi) The Stutsman County Commission has approved early voting to begin May 30, 2016, for the June 14, 2016 Primary Election. Early voting will be allowed at the Stutsman County Courthouse Monday through Friday during normal business hours. There will no longer be early voting on Saturdays because that incurred overtime for some staff and saw a very low voter turnout on those days.

Lloyd Nelson said he was unhappy with the increase in property taxes.

He also said it’s been 10 years since his curb and sidewalk has been fixed.

City Building Inspector Dave Andersen said he inspected the curb damage.

Mayor Werhoven suggested that Nelson, Andersen and City Administrator Schelkoph meet and rectify the situation.

Approved the second and final reading of an Ordinance amending Title 9, (Zoning, Section 27-08-02(4), Section 27-08-04(1)(c), Section 27-08-04(2), and Section 27-03-03.)

RESOLUTIONS

Approved a Resolution approving final plans and specifications for Water Main Improvement District No. 98, and authorize advertisement for bids. KLJ said the area includes 11 city blocks south of downtown.

Approved a Resolution approving final plans and specifications for Sanitary Sewer Improvement District No.61 and 61B, and authorize advertisement for bids. KLJ said the sewer lining includes North Central, and Second Avenue Northwest.

NEW BUSINESS

Mayor Werkhoven asked that City Commissioners discuss and review funding options, and consultant services for Projects on the Federal Aid System. No action was taken.

Considered a Cost Participation, Construction, and Maintenance Agreement for Urban Federal Aid Project, 6th Street NE from Central Avenue to 8th Avenue and 2nd Avenue NE from 2nd St NE to 4th St NE for Mill & Overlay and Incidentals, for Paving Improvement District No. 110. KLJ explained the cost share on various city projects. ADA compliance will affect some of the costs.

City Commissioner approved the city’s participation.

Approved the Recommended Reductions made to the 2016 City Budget. City Administrator Schelkoph, said there will be four percent state funding cuts ordered by Governor Dalrymple that make it necessary to reduce city expenditures…about 50 percent, to offset $151,000 in fiscal year 2016 cuts, in the Capital Construction projects .

The City Commissioners approved departmental reductions to offset the loss of state revenues, and implement the cost saving measures

CITY ADMINISTRATORS REPORT

David Schelkoph said there will be training to install aluminum planks for the permanent flood control project. The planks will be temporarily stored until put in to place.

He noted that public service awards were given out at a program last week, recognizing city employee’s years of service to the city.

The 2016 emergency flood control plans have been updated, due in part to the permanent flood control measures.

CITY UPDATE & COMMISSION REPORTS:

City Fire Chief Retterath reminded residents that the river ice is melting and is unsafe.

Viking Drive, and south, will close starting Monday March 7, 2016, for work on the permanent flood control projects. KLJ will issue a news release for distribution to the media.

Mayor Werkhoven said what appears to be cracks in some of the new permanent flood is not a problem, and is made to look that way, and will be safe for flood protection.

The meeting was shown live on CSI Cable 68 followed by replays.

 

Jamestown (CSi) Jamestown Police is asking for the public’s assistance, looking for the driver of a gray-colored subcompact car that brushed a 12-year-old Jamestown girl while she crossed a street Friday afternoon, February 26, 2016. The car left the scene.

Police say an older male with a white beard may have been driving the car.

The girl was walking home from school in the 200 block of 2nd Street Southeast at 3:05 p.m. Friday. She was crossing the street in a designated crosswalk when an unidentified gray subcompact car traveling east on 2nd Street Southeast drove through a yield sign and brushed the girl. The car may have also run over the girl’s foot.

The police say the girl left the scene and went home, and the incident was later reported to the police. Minor injuries were reported.

Anyone with information about this incident who may have seen the car and or driver in question is asked to call the Jamestown Police Department at 252-2414.

 

ENDERLIN, N.D. (AP) – Authorities have identified an Enderlin man who died in a vehicle crash in Ransom County late last month.

The Highway Patrol says Joshua Ertelt was killed in the crash the evening of Feb. 26 at the junction of state Highways 46 and 32 west of Enderlin.

The driver of the other vehicle 21 year old Dylan Claus of Enderlin, was flown to a Fargo hospital for medical treatment with undisclosed injuries.

The crash remains under investigation by the North Dakota Highway Patrol.

 

Valley City (CSi) One of the many features at the 2016 North Dakota Winter show in Valley City is the PRCA Rodeo Performances.

Coming back this year is stock contractor and rodeo producer, Sutton Rodeo, of Onida, South Dakota.

Performing at all three performances will be specialty act John Payne, “The One Arm Bandit”, of Shidler, Oklahoma, along with clown and barrelman, JJ Harrison, of Lowden, Washington.

The rodeo announcer will be Will Rasmussen, of Choteau, Montana, bullfighters Josh Rivinius, of Elgin, Northe Dakota, and Colin LaMont, of Lodgepole, South Dakota plus a pickup men JJ Hunt, of Ridgeview, South Dakota and Mike Greenleaf, of Greensburg, Kansas.

New this year, will be a Friday night performance

Rodeo performances are scheduled for Friday, March 11th, at 7 pm, and Saturday, March 12th, at 2 and 7 pm. Tickets are $20, or $10 for kids 10 and under, or, at the Friday performance, kids will be admitted FREE, with the purchase of an adult ticket per child. The first 100 kids will also receive a free cowboy hat.

During each rodeo, kids ages 4-8 may enter the “Stick Horse Rodeo” and compete on a stick horse in “bronc riding”

Friday is also be “Military Appreciation Day.” All military personnel will be admitted FREE, with proof of military service.

GRAND FORKS, N.D. (AP) – A Griggs County Central High School gym teacher has been sentenced to 20 hours of community service for supplying alcohol to underage people.

Authorities said 59-year-old Nancy Paintner gave alcohol to an 18-year-old and a 20-year-old at a University of North Dakota hockey game last October.

Paintner pleaded guilty late last month to unlawful delivery, a misdemeanor.

School district officials  say Paintner is still employed at the school, and it will be up to the state Education Standards and Practices Board to determine if further action is needed.

 

Jamestown (CSi) The 38th Annual, 2016 Runnin O’ The Green take place on Saturday March 19th.

Runners travel the pre-set route on the streets of Jamestown stopping at participating bars.

Once again, proceeds support people battlingcancer and to the Elks Camp Grassick, a summer camp near Dawson, for children and adults with disabilities or special needs.

This year’s run is dedicated to the memories of three event supporters who have passed away, Gene Keller, Wayne Deery and Jay Thompson are presented with a coat of arms on the event posters.

Run founder Larry Knoblich, recently told the city council that about 3,000 participants are expected with good weather.

He said that there are no other conflicting St. Patrick’s Day events scheduled that day in the region.

Registration at Frontier Fort starts at 11 a.m., with six heats starting at 2-p.m. in 10-minute increments.

The participants who actually run are in the first heat. The first 15 men and 10 women who finish the course first are timed.

The run concludes at Shady’s Restaurant & Lounge, at the Gladstone Inn & Suites.

Participants follow a map to visit 10 bars where they purchase a beverage ….that doesn’t have to be alcohol. Their name tag is stamped at each location. Participants must be 21 years or older and carry a photo ID.

At the March City Council meeting the council will consider approving the requests for street closings and/or permits to allow alcoholic beverages in fenced areas for: All Vets Club; Buffalo Lanes, Inc.; Corner Bar; Cork and Barrel, Inc.(Elk’s location); Middles LLC d/b/a Fred’s Den; Frontier Fort & Grill; Knights of Columbus; Johnny B’s, Office Bar & Lounge; Sabirs II, LLC; Shady’s; and Wonder Bar Sports Bar.
Jamestown Police Chief Edinger asks that he and Fire Chief Reuther be consulted before any tents are erected.

Knoblich would like to see people who join the fun downtown register for the event. Unregistered participants are called “bandits.”

He adds that those individuals buy beer and spend their money, benefiting the community. However he says, if all of those individuals would step up and give $10 each for for charity then a lot more dollars would be raised, while experiencing “the wonderful feeling of giving.”

Iverson Construction will offer rides to participants who call a number provided on their tags. The drivers accept donations, part of which goes to Camp Grassick.

Jamestown Police Chief Scott Edinger told the city council committeee that more officers will be on foot this year. Participants are required to stay out of traffic and not carry alcoholic beverages outside of bars or designated outdoor drinking areas.

Meanwhile, Jamestown Municipal Court will set up a temporary court at Jamestown Fire Department to expedite minor violations related to the event, mostly open container and public urination.

Knoblich says he’s working with the bars to provide more portable restrooms.

Early registration before March 16 is $30 and includes a T-shirt. Participants can also register for $10, which does not include a T-shirt, at the event.

Jamestown CSi Dan Buchanan of Jamestown will host “Backyard Birding,” on Tuesday March 8, 2016 at 6-p.m., at the Alfred Dickey Public Library.

Dan will answer such questions as, what species come to Jamestown in the spring? How long will they stay? Is that a crow or a starling on the top my garage? How can I attract birds? What tools do I need? field guides, binoculars, spotting scopes. What plantings attract birds? Dan will have lists from the Birding Drives Dakota website, Christmas bird counts, URLs for other sites to learn about birds, including the ND listserv.

He will have magazines that offer help to attract birds, such as Birds & Blooms.

Over the years Dan has mastered the art and science of birdwatching by watching out his kitchen window and travelling around the country looking for as many species as he can to put in his bird diary.

 MINOT, N.D. (AP) – Minot police say a 28-year-old man has been found fatally stabbed in an apartment.
 
     The Minot Police Department said in a news release that it responded to a report of a stabbing around 5:40 p.m. Tuesday. Upon arrival at the residence, police say the man was found dead. Police say a 19-year-old man had a stab wound to his hand and was taken to a hospital for treatment.
 
     According to police, a third man at the scene was taken into custody as a person of interest. Police say he was later arrested for murder, aggravated assault and terrorizing, and was taken to Ward County Jail.
 
     An investigation is ongoing.

 

 FARGO, N.D. (AP) – A man accused in the robbery of a Fargo convenience store a year ago has been sentenced to three years in prison.
 
     Authorities say 20-year-old Jacob Black and another man showed a pistol during last March’s robbery. They got away with an undisclosed amount of cash.
 
      Black pleaded guilty to conspiracy to commit robbery.
 
     The second man accused in the holdup, 21-year-old Mifti Dire, pleaded guilty last summer and was sentenced to a year in the county jail.

 

 BISMARCK, N.D. (AP) – The North Dakota Department of Health says it has been notified of an estimated 10,000-gallon gasoline release near Alexander.
 
     The department says the leak resulted from a structural failure of a 20,000 gallon underground storage tank at Patriot Fuels LLC. The release occurred on Thursday.
 
     Officials say initial estimates indicate approximately 10,000 gallons of premium gasoline were released. Health Department personnel are at the site and are continuing to monitor the situation

 

RUGBY, N.D. (AP) – Amtrak is eliminating its station agent in Rugby effective June 1.

Amtrak spokesman Marc Magliari says the change is being made because of the high volume of train passengers obtaining tickets online.

The Rugby agent is being moved to the Minot station. Magliari says a caretaker will open and close the Rugby station.

Amtrak’s Empire Builder line between Chicago and the Pacific Northwest passes through eastern and northern North Dakota. There are stations in Fargo, Grand Forks, Devils Lake, Rugby, Minot, Stanley and Williston. Former Rugby Mayor Dale Niewoehner (NEE’-wahn-ur) says stations in Stanley, Devils Lake and Grand Forks also have no ticket agent.

 

FARGO, N.D. (AP) – Fargo’s Planning Commission has approved a zoning change for a proposed large-scale apartment complex that some homeowners oppose.

Bison Village would be a 400-unit apartment complex in north Fargo. Many area homeowners don’t want apartments geared toward college students in the area because they fear it could lead to traffic and other problems.

The Planning Commission on Tuesday voted 7-2 to recommend a zoning change that would clear the way for Bison Village. The City Commission will have the final say.

 

 

 BELCOURT, N.D. (AP) – An operation targeting fugitives on the Turtle Mountain Indian Reservation in northern North Dakota resulted in 18 arrests.
 
     The U.S. Marshal’s Service and the Bureau of Indian Affairs conducted Operation Northern Lights Tuesday with help from other federal, state and local agencies.
 
     A similar sweep on the Spirit Lake Indian Reservation in December resulted in 22 arrests. Turtle Mountain Tribal Chairman Richard McCloud took note of the success and suggested an operation be done on his reservation.
 
     Tribal lands often are viewed as a safe haven by people wanted on state or local warrants. State authorities can arrest only non-enrolled members on a reservation, and not all tribal governments have extradition laws in place to transfer an enrolled member to a state or local jurisdiction that holds an active warrant. 
 

 MINOT, N.D. (AP) – About 275 airmen and four B-52 bombers from Minot Air Force Base that have spent six months in Guam are returning home.
 
     The base says some are returning from Andersen Air Base on Wednesday, while the main body is tentatively scheduled to come home Friday.
 
     The deployment was part of a bomber rotation maintained by the U.S. Pacific Command.

 

 BISMARCK, N.D. (AP) – A North Dakota legislative committee may restrict so-called angel funds from being used for out-of-state companies. The Legislature’s interim Political Subdivision Taxation Committee began reviewing a draft measure that would provide more oversight of the funds that are designed to provide investment dollars for fledgling companies through tax credits.
 

 

 MINOT, N.D. (AP) – Minot residents have voted to give themselves the authority to change the makeup of the City Council.
 
  Voters approved changing the city’s home rule charter in a special election Tuesday. One approved measure includes language to give the city power to change its structure of government, while another outlines how to change the form of government.
 
     Changes could be proposed by the City Council or by petition, and a simple majority would be needed in an election to make a change.
 
     A citizens group urging residents to approve the measures submitted petitions in October to reduce the council’s size from 14 members elected from wards to five members elected at large. But the home rule charter didn’t include a procedure for changing the council’s structure.

 

 BISMARCK, N.D. (AP) – A U.S. Senator from New York will be a featured speaker at the North Dakota Democratic convention next month.
 
     Kirsten Gillibrand will give the convention’s keynote speech on April 2. The convention is being held at the Bismarck Civic Center March 31 to April 2.
 
     Gillibrand is an attorney. She was elected to the U.S. House in November 2006. She was appointed to the Senate in January 2009 to fill the seat left open when President Barack Obama appointed then-Sen. Hillary Clinton’s appointment to secretary of state.
 
     North Dakota Republicans are holding their convention April 1-3 in Fargo. The party has not announced featured speakers.

MADISON, S.D. – The North Star Athletic Association (NSAA) has announced the 2015-16 Men’s Basketball All-Conference selections and postseason awards. The all-conference and postseason awards were announced at the conclusion of the championship game at Dakota State University Fieldhouse.

Bellevue (Neb.), Dakota State (S.D.) and Valley City State (N.D.) shared the North Star Athletic Association (NSAA) Men’s Basketball regular-season title with 11 points. Dakota State won its second consecutive NSAA Men’s Basketball Postseason Tournament with a 79-65 victory over Jamestown (N.D.) in Madison, S.D. Monday evening.

Kyle Kilgore of Dakota State was selected to Most Valuable Player and Newcomer of the Year awards. Justyn Galloway of Valley City State was chosen as Defensive Player-of-the-Year.

Gary Garner of Dakota State was named as the NSAA Men’s Basketball Coach-of-the-Year.

GRAND FORKS, N.D. (AP) – The University of North Dakota men’s hockey team has moved up to No. 2 in both national polls after a weekend road sweep of Omaha.

UND jumped two spots in both the USCHO.com poll and the USA Today/USA Hockey Magazine poll after securing at least a share of the NCHC regular-season title.

Quinnipiac continues to top both polls. Providence and Boston College swap the No. 3 and No. 4 spots, and St. Cloud State is fifth in both polls.

The Fighting Hawks close out the regular season this weekend at home against unranked Western Michigan.

 ST. PAUL, Minn. (AP) – Charlie Coyle and Nino Niederreiter each scored twice to give the Minnesota Wild a 6-3 win over the Colorado Avalanche on Tuesday night. Coyle scored the game-winner at 5:34 of the third period after Zach Parise knocked down the puck at mid-ice, rushed toward the other end and fed a streaking Coyle. Jarome Iginla scored on a one-timer 33 seconds into the game to give Colorado an early lead.

 MINNEAPOLIS (AP) – Kevin Martin has accepted a buyout of his contract from the Minnesota Timberwolves. Martin has been one of the most consistent shooters in the league over the last decade. But he has averaged just 10.6 points per game and shooting 36.9 percent from 3-point range in 39 games this season.
 
     MINNEAPOLIS (AP) – A person with knowledge of the deal says the Minnesota Timberwolves are planning to call up forward Greg Smith from the D-League for a 10-day contract. The Timberwolves are in need of some depth in the front court. Karl-Anthony Towns and Gorgui Dieng are playing heavy minutes. The Wolves want to reduce the load on their promising young big men.
 

ATLANTA (AP) – The Atlanta Hawks have signed 12-year veteran forward Kris Humphries, who was waived by Phoenix on Sunday after averaging 7.3 points in four games. He was 0-for-9 from the field in his last game against the Nets on Thursday.
     He began the season with Washington, where he averaged 6.4 points in 28 games, including 14 starts.

MINNEAPOLIS (AP) – Minnesota coach Richard Pitino has suspended guards Kevin Dorsey, Nate Mason and Dupree McBrayer for the remainder of the season. The suspensions stem from a sexually explicit video that appeared on Dorsey’s social media accounts. The clip was posted Friday on Dorsey’s Instagram and Twitter feeds.

NEW YORK (AP) – New York Yankees closer Aroldis (ah-ROHL’-dihs) Chapman has agreed to accept a 30-game suspension under Major League Baseball’s domestic violence policy following an incident with his girlfriend last October. He will begin serving the penalty on opening day and lose 30 days of both pay and major league service, although he will still be eligible for free agency after the season. Chapman said he did not harm his girlfriend but added that he should have exercised better judgment with respect to certain actions.

 PHILADELPHIA (AP) – Sam Bradford has agreed to a two-year contract with the Philadelphia Eagles. Bradford started 14 games last year and threw for a career-high 3,725 yards, the fourth-highest yardage total in franchise history. Bradford’s 346 completions and his career-best 65.03 completion percentage were Eagles single-season records.

 MIAMI (AP) – Donald Trump says his presidential candidacy is a “movement,” and that he is expanding the Republican Party even as many of its leaders have distanced themselves from him. Trump won in seven states during Super Tuesday. Ted Cruz won in three states, including his home state of Oklahoma, while Marco Rubio chalked up his first victory of the campaign, in Minnesota.
 
     MIAMI (AP) – Democrat Hillary Clinton, who won seven states, tried to turn Donald Trump’s “Make America Great Again” slogan on its head. Clinton told supporters the country instead must be made ”whole again.” Fellow Democrat Bernie Sanders picked up victories in four states, including his home state of Vermont. He assured supporters he’d take his fight to “every one” of the remaining contests.
 
     UNITED NATIONS (AP) – The U.N. Security Council votes today on a resolution that would impose the toughest sanctions on North Korea in two decades. The U.S. and North Korea’s traditional ally China spent seven weeks negotiating the new sanctions in response to Pyongyang’s latest nuclear test and rocket launch. Both are in defiance of previous council resolutions.
 
     DUBAI, United Arab Emirates (AP) – A Saudi-led bloc of six Gulf Arab nations has formally branded Hezbollah a terrorist organization. The move by the Gulf Cooperation Council ramps up the pressure on the Lebanese militant group fighting on the side of President Bashar Assad in Syria.
 
     BAYONNE, N.J. (AP) – A cruise ship previously battered by a major storm in the Atlantic Ocean has returned to port early, cutting short another cruise. Royal Caribbean’s Anthem of the Seas docked in Bayonne, New Jersey, this morning. Planned stops in Barbados and St. Kitts were skipped so the ship could avoid predicted bad weather.
