APPROVAL OF CONSENT AGENDA ITEMS:

Monthly Reports from the Fire Chief, Building Inspector, Auditor, Municipal Judge and Public Works Accountant.

Monthly Bills for the City and Public Works in the Amount of $ $2,420,372,33

Parade permit for the annual Rally in the Valley on June 18, 10 am.

Raffle permit for Chamber of Commerce “Duckin’ Down the Sheyenne”.

A request to block off street for Prom Drill on April 20th.

ORDIANCES…

Approved the second and final reading of an Ordinance repealing, amending, and reenacting Title 1, General Provisions of the revised ordinances of the City of Valley City, North Dakota. Attorney Myhre said the action is part of the city’s recodification process.

Approved the first reading of an amended Ordinance to correct a typo,creating a Perpetual Restrictive Covenant where properties were removed in accordance with the State Water Commission.

Attorney Myhre the State Water Commission requires the Covenant concerning properties purchased under Permanent Flood Protection.

Approved the first reading of an Ordinance rezoning NDDOT property located at from “N/A” to B-2 Highway Business District. Attorney Myhre said the rezoning is required in conjunction with the new PetroServe near the Interstate.

Approved the first reading of an Ordinance repealing, amending and reenacting Title 2, Administration, of the revised ordinances of the City of Valley City. Attorney Myhre said the Ordinance is also a part of recodification, with new changes to existing document.

The City Auditor’s position will now be titled City Finance Director.

Commission Luke asked that under the Ordinance that the City Administrator have an annual review, by June 30^th each year, on job performance, by the mayor. Commissioner Nielson suggested input from City Commission members which was included in the Ordinance.

Approved the first reading of an Ordinance repealing, amending, and reenacting Title 8, Business & Occupations of the revised ordinances of the City of Valley City, North Dakota. Attorney Myhre said there are no major changes, however the revisions include bringing city licenses into one chapter. E-Cigarettes also regulated by the state, would be included with tobacco products.

Licensing of taxis or Ubber would be regulated.

RESOLUTIONS

Approved a Resolution awarding construction contract for Water Main Improvement District No. 98. KLJ recommends awarding the contract to Sherman’s of West Fargo, in the amount of $899,539.

Approved a Resolution awarding construction contract for Sanitary Sewer Improvement Districts No. 61 and 61B (re-lining) to Visu-Sewer Inc. in the amount of $387,625.85.

Determining the Sufficiency of Protests of Paving Improvement District No. 110. one protest was received, which is insufficient.

Approved a Resolution determining the Sufficiency of Protests of Paving Improvement District No. 111. KLJ said one protest letter was received, which is insufficient.

Approved was a Resolution approving final plans and specifications for Paving Improvement District No. 110, and authorize advertisement for bids.

NEW BUSINESS

City Commissioners considered purchasing a property at 737 6th Avenue SW. City Administrator Schelkoph said the property owner is no longer living at the property. He said the parcel in within the flood buyout area.

The City Commission approved starting the property buyout process.

The City Commission selected Pedersen a commissioner, to be on the Planning and Zoning Board to replace Commissioner Magnuson who stated a conflict of interest on the board. This is a required position on the board.

Discussion was held concerning Water Treatment Plant Costs. Commissioner Luke said there are no quality concerns, and noted the increases over the previous lime pit use.

She said city engineers and NDSU authorities are looking into why there are issues as to why the water needs the amount of treatment it’s receiving.

No action was taken by the Commission.

CITY UPDATE & COMMISSION REPORTS

City Auditor Richter said the 2007 bonds are up for refinancing, and a bond sale by the end of this month.

City Assessor Hansen noted that the City Board of Equalization meeting is Tuesday April 12, 2016, at 4-p.m., at City Hall.

City Fire Chief Retterath said the city will partner with the Red Cross in getting more smoke dtectors in homes. He said city hall has information on the safe use of fire pits.

The new city fire truck will be put into service on Wednesday.

KLJ reported that the storm sewer project will start next week, at 8th Avenue Southwest, which will be closed.

The Flood Wall project on College Street contiues and the new pump is operational by the city.

 FARGO, N.D. (AP) – A Fargo businessman and entrepreneur is the Libertarian Party candidate for North Dakota governor.
 
     Marty Riske is the former chairman of the state’s Libertarian Party who owns numerous video stores and hair salons. He began his business career in 1971 when he founded a chain of waterbed and furniture stores in six North Dakota cities.
 
     Riske says both the state Democrats and Republicans have allowed government to get too big and he will hire independent auditors to examine every agency in the state. Riske says he wants to keep more tax dollars in North Dakota and use the money for schools, infrastructure and communities.
 
     Riske is a native of Grafton.
 
     State Republicans have endorsed Attorney General Wayne Stenehjem for governor.  Democrats are backing state Rep. Marvin Nelson of Rolla.

 

BISMARCK, N.D. (AP) – North Dakota Republican Gov. Jack Dalrymple has rejected a request by Democratic leaders who believe a special session is needed to deal with the state’s projected budget shortfall.
 
     The governor said in a statement to The Associated Press Tuesday that a special session is not necessary and there is a “plan in place” that will guide the state through the end of the year.
 
     Dalrymple says the Legislature could take action as soon as December, at which time more budget information will be available.
 
     Democrats said last week they don’t believe that Dalrymple’s across-the-board cuts were strategic or thoughtful and asked for a “brief and focused” session to discuss restoring about 20 percent of the reductions.
 
     Senate Minority Leader Mac Schneider was not immediately available for comment.

 

 

FARGO, N.D. (AP) – Fargo police say a 23-year-old man has been arrested in a drug bust on the city’s north side that yielded numerous narcotics, weapons and counterfeit bills.
 
     Authorities recovered methamphetamine, heroin, fentanyl, marijuana, ecstasy, LSD, various painkillers, testosterone and anabolic steroids. Fargo Police Lt. Shannon Ruziska calls it “one of the most significant and visually appealing busts” in recent memory.
 
     Ruziska says the weapons included an AK-47 rifle. He says the guns “were loaded and ready to go” in various rooms in the residence.
 
     Formal charges have not been filed, but Ruziska said the list of offenses includes possession with intent to distribute narcotics within 1,000 feet of a school, possession of drug paraphernalia and child neglect. Police say there was a 1-year-old child in the residence.

 

 OMAHA, Neb. (AP) – A North Dakota mother has had a chance to hear her late son’s heart beat inside a Nebraska transplant recipient.
 
     Lisa Swanson cried as she heard the ultrasound of Terry Hooper’s heart at Nebraska Medical Center in Omaha on Friday.
 
     Hooper received the heart on Dec. 10, 2012, three days after 18-year-old Levi Schulz of Horace, North Dakota, died in a car crash. Hooper had cardiomyopathy, which makes the heart lose its ability to pump blood effectively, and had been placed on the transplant list.
 
     Hooper and Swanson have corresponded through letters since 2013, but Friday was their first face-to-face meeting. Schulz’s twin brother, Shelby Schulz, also attended and listened to the ultrasound.
 
     Swanson says she’s sad her son isn’t here, but also happy he was able to help Hooper.

 

In sports…

Jamestown  (CSi)  University of Jamestown head men’s basketball coach Danny Neville has announced the signing of Elijah Kess, who will join the Jimmies in the 2016-2017 season.

This past year, Kess, a 6′ 0″ guard, averaged 10 points, 3 rebounds, and 3 assists per game　for Trinidad State College, a Division 1 junior college in Colorado. Elijah also shot 41% from three-point range. 　As a freshman, Kess averaged 7 points, 3 rebounds and 3 assists. He played his high school ball at Lake Clifton High School in　Baltimore, MD.　　

Coach Neville says of Kess, “Elijah had a great career at Trinidad State College. He was a two-year starter who’s a tough and hard-nosed competitor. He will bring toughness and leadership to our team. We are very excited about Elijah!”

University of Jamestown was established in 1883 and is ranked as a top regional school in both US News and World Report and The Princeton Review. The school features development of the whole person through its distinctive Journey to Success experience.

WASHINGTON (AP) – Donald Trump’s idea for how to get Mexico to pay for a border wall is being ridiculed by President Barack Obama as a “half-baked notion.” In a memo released by his campaign, Trump says he would cut off part of the money sent back to Mexico by immigrants, unless Mexico would agree to a “one-time payment” of between five and ten billion dollars to help pay for the wall. Obama responds, “Good luck with that.” He said the plan would end up forcing more immigrants to cross the border in search of jobs.
 
     MILWAUKEE (AP) – Republican Ted Cruz is continuing his call for Ohio Gov. John Kasich (KAY’-sihk) to get out of the presidential race. He told a Milwaukee radio station (WTMJ) Tuesday that any candidate who doesn’t have a path to winning should end his campaign. Cruz’s comments come as Wisconsin voters cast ballots in the state primary. Cruz has been leading in the polls, but Kasich is trying to win in at least one congressional district. The statewide winner gets 18 delegates, while three delegates are awarded to the winner of each of the state’s eight congressional districts. Donald Trump has also called on Kasich to leave the race.
 
     RALEIGH, N.C. (AP) – North Carolina Gov. Pat McCrory said it’s up to individual companies to decide how to deal with a new law that requires transgender people to use bathrooms that conform to the sex listed on their birth certificates. The law also limits protections for gay and transgender people. The governor spoke after a decision by PayPal to withdraw its commitment to Charlotte, where it planned to expand and create 400 jobs in North Carolina’s largest city. 
 
     MONTGOMERY, Ala. (AP) – An Alabama lawmaker says he is filing an impeachment resolution against Gov. Robert Bentley in the wake of a scandal involving one of the governor’s top aides, who has since resigned. Bentley has admitted that he made inappropriate remarks to the former aide, Rebekah Caldwell Mason. However, he has denied suggestions that the two had an affair.
 
     NEWARK, N.J. (AP) – Federal authorities in New Jersey have arrested 21 people in an alleged visa scam involving more than 1,000 foreign nationals. The U.S. attorney’s office says it created a fake university in 2013 staffed by undercover agents, who were given cash for helping the purported students in the visa process. The defendants are charged with conspiracy to commit visa fraud and conspiracy to harbor aliens for profit. Most of the foreign nationals who benefited from the alleged scheme hailed from China and India.
