FARGO, N.D. (AP) — The engineer who was at the helm of a BNSF train that derailed near Casselton in 2013 says his lawsuit against a Pennsylvania steel company should be heard in state court.

Bryan Thompson filed suit in East Central District Court accusing Standard Steel of manufacturing a faulty axle that was found after the accident to be broken. The steel company moved the complaint to federal court.

Thompson’s attorneys say federal law does not allow a Federal Employers’ Liability Act lawsuit brought in state court to be switched to federal court.

The accident about 30 miles west of Fargo on Dec. 30, 2013, set off a fire that could be seen from nearly 10 miles away. Thompson says he suffers from post-traumatic stress disorder and isn’t capable of returning to work.

 

FARGO, N.D. (AP) — Fossil hunters led by experts from the North Dakota Geological Society have made some interesting finds during annual public digs this summer.

Senior Paleontologist Clint Boyd says the discoveries include a large bird found in a sandstone deposit near Medora. The presbyornis is about the size of a Canada goose. The fossil bed is about 60 million years old and used to be a swamp.?

At another dig at the Pembina Gorge near Walhalla, diggers discovered a fossil bone from a massive, 80-million-year-old aquatic lizard called a mosasaur.

Boyd says officials also found a 30-million-year-old partial skeleton of an alligator at a site near Dickinson.

 

PORTLAND, Ore. (AP) — A Pacific Northwest tribe has begun a 4,800-mile road trip with a 22-foot-tall totem pole in tow.

The Lummi Nation embarked on its fourth “totem journey” since 2012 to galvanize opposition to coal and crude oil projects it says could imperil native lands.

The tribe took a similar totem trip last year to raise awareness about a massive coal export terminal being proposed in their ancestral homeland in northwest Washington state.

The U.S. Army Corps of Engineers denied a permit for the Cherry Point project earlier this year over concerns it would impact the Lummi Nation’s treaty-protected fishing rights.

This year, the focus is on the Millennium coal export terminal proposed for Longview, Washington along the Columbia River.

It would be the largest such terminal in the U.S.

 

BILLINGS, Mont. (AP) — A Montana man is accused of fatally shooting a 63-year-old construction worker at a job site near Sidney.

Raymond Blair Hansen of Sidney was charged Thursday with deliberate homicide in the death of Terry Klein.

The 35-year-old suspect was arraigned in Richland County Justice Court, where Judge Gregory Mohr set a $2 million bond.

Mohr said Friday that Hansen initially did not want an attorney, but later changed his mind and would be appointed a public defender.

Richland County Sheriff John Dynneson says Klein was working for Franz Construction on a breached irrigation canal at the time of the Wednesday morning shooting.

He suffered at least one gunshot wound and was pronounced dead at the scene.

Hansen was arrested less than two hours later. Authorities were investigating a possible motive.

TORONTO (AP) — The Minnesota Twins have selected the contract of right-handed pitcher Alex Wimmers from Triple-A Rochester, promoting their 2010 first-round draft pick to the major leagues for the first time.

The move was made Friday before the game at Toronto.

Wimmers and left-hander Andrew Albers are taking the place on the staff of starters Jose Berrios and Tyler Duffey, who were sent to Rochester after the game Thursday. The rotation for next week is up in the air.

The 27-year-old Wimmers has struggled through several of his seven minor-league seasons since being taken with the 21st overall selection out of Ohio State. Wimmers has a 4.04 ERA in 55 2/3 innings this year between Double-A and Triple-A, with 24 walks, 55 strikeouts and 11 saves in 44 games.

WASHINGTON (AP) — Federal officials say it’s time for all U.S. blood banks to start screening for the Zika virus. Friday’s move by the Food and Drug Administration is a major expansion of U.S. intervention aimed at protecting the nation’s blood supply from the mosquito-borne disease. The new advisory means all states and territories will need to begin testing blood donations for Zika.

ANKARA (AP) — Turkish officials say Turkish President Recep Tayyip Erdogan (REH’-jehp TY’-ihp UR’-doh-wahn) and Russia’s Vladimir Putin have agreed to “speed up” efforts to deliver aid to Aleppo. Officials from Erdogan’s office said the decision was reached during a telephone conversation about Syria between the two leaders Friday. The officials provided the information on condition of anonymity in line with Turkish government regulations. They did not elaborate on the plans.

WASHINGTON (AP) — President Barack Obama Friday expanded a national monument off the coast of Hawaii, creating a safe zone for tuna, sea turtles and thousands of other species in what will be the world’s largest marine protected area. Obama’s proclamation quadrupled in size a monument originally created by President George W. Bush in 2006. The land designated for protection covers roughly 582,578 square miles, more than twice the size of Texas.

RICHMOND, Va. (AP) — Prosecutors and former Virginia Gov. Bob McDonnell’s attorneys want more time to figure out the next steps after the U.S. Supreme Court overturned his corruption conviction. The high court ruled in June that McDonnell’s actions were distasteful but didn’t necessarily violate federal bribery laws. The case was returned to an appeals court to decide whether there’s enough evidence for another trial.

MIAMI (AP) — The Coast Guard this week has repatriated 161 Cuban migrants to the island nation following more than a dozen interdictions at sea. The Coast Guard said in a news release that 27 migrants were repatriated today, with 68 returned Thursday and 66 on Monday. All were returned to the city of Bahia de Cabanas.
