Valley City (CSi) The Valley City Commission met in Special Session, Tuesday morning at 7-O’Clock, and was considering and acting upon an agreement with City Attorney Russell Myhre.
The agreement calls for Myhre to step down.
Myhre has served since 2011, and participated in grievances against city officials.
The agreement calls for a settlement of damages on behalf of the city.
Mayor Carlsrud said the Myhre law firm suffered economic hardships due to allegations of a hostile work environment, involving former mayor Bob Werkhoven, Myhre and three other city employees earlier in 2016.
The severance and release agreement, states that, on January 25, 2016, Myhre, together with the City Administrator, the Chief of Police, and a lieutenant in the Valley City Police Department filed a Grievance against the former Mayor of the City, in which Myhre alleged that he was being subjected to a hostile and abusive work environment.
It further states that Myhre has alleged damages as a result of the hostile and abusive work environment, and Myhre and the City desire to enter into a severance agreement related to Myhre’s appointment as City Attorney.
The parties agreement, settles all claims against the other, whether known or unknown, related to Myhre’s term as City Attorney.
The settlement includes a severance package of a $150,000 pay out over two years.
Myhre will stay on as the City Attorney for six months, or until a new City Attorney is hired.
Myhre will continue during a transition to a new City Attorney.
Myhre said it’s been “A rocky road,” serving as City Attorney.
He noted working with the city on Permanent Flood Protection, and Re-codifying the city’s code.
He said he enjoyed working with city officials.
He said while not retiring he is “winding down,” his career.
Commissioners voted to approve.

Jamestown (CSi) The Jamestown Salvation Army ended the 2016 Christmas Campaign short of the $157,000 goal, collecting just $96,000.
Major Tim Nauta says, the Red Kettles netted $56,000, as the campaign wrapped up last Saturday. The balance coming from the Salvation Army’s mail, individual donations and revenue from the thrift store.
Donations are still accepted when paying for items at Hugo’s Family Marketplace.
Online donations through salvationarmynorth.org/community/jamestown are to be distributed to the local Salvation Army by the donor’s zip code. The deadline for donating in 2016 is Saturday, December, 31.
A tax-deductible check can also be mailed or delivered to the Salvation Army, 320 1st Avenue, North Jamestown, ND 58401.
Nauta stresses that unless fundraising goals are met there will be cuts to services. There will be continuing efforts to raise funds in 2017 to help keep programs.
Jamestown (CSi) A Jamestown restaurant that’s been closed the past six weeks, is back open today.
Officials with Burger King announces that the Jamestown location along Highway 281 South, reopens today, after extensive interior and exterior remodeling.
In addition to exterior changes, the interior infrastructure including new booths and new tables are in place.
Burger King held a “soft reopening,” for employees, families and friends on Tuesday evening.
The restaurant reopens at 10:30-a.m. Wednesday.
Regular hours are seven days a week from 6-a.m., until midnight.
FARGO, N.D. (AP) — Federal court documents show that a North Dakota man who has been embroiled in a long legal battle with the state over a confiscated pay loader should receive $20,000 in a civil lawsuit.
The loader was seized by a state Bureau of Criminal Investigation agent in May 2014 from Darrell Schrum’s shop in Forbes after it was found to be stolen. Schrum has argued that he didn’t know the loader was stolen and bought it in good faith. The equipment was lost in transit.
Schrum turned to federal court after the North Dakota Supreme Court reversed a state judge’s decision that Schrum be paid nearly $54,000 for the loader.
Schrum’s attorneys say the $20,000 award compensates Schrum for the purchase price, repairs and transport costs of the loader.
BISMARCK, N.D. (AP) — North Dakota’s largest power plant is making operational changes to remain competitive in a changing market.
The Bismarck Tribune reports the Coal Creek Station will be able to ramp its electrical output up and down more quickly depending on whether the wind is blowing and more renewable energy is available. Most of North Dakota’s other coal plants aren’t designed to do that, while gas-fired plants can.
Great River Energy spokesman Lyndon Anderson says the company is adapting the plant’s operations in a process called cycling, which allows it to fluctuate between its full capacity of more than 1,100 megawatts to 300 megawatts or less when the wind is blowing.
Anderson says the plant will never completely cease operations, but will change its output to match the market.

The league runs from Jan. 21-Feb. 25, held on Saturday mornings. Cost is $20. Deadline to register is Jan. 13. Cost after the deadline is $30.

Bismarck (CSi) North Dakota Game and Fish Department Director Terry Steinwand recently honored a number of employees with performance-based awards. Steinwand presented the following awards at the department’s annual staff meeting Dec. 8.
John Mazur, hunter education coordinator, Bismarck, received the Special Projects award, given to an individual who implemented a successful new project. Mazur was recognized for his efforts with successfully refining the hunter education program. “John took the concept of a hunter education instructor academy and made it a reality,” Steinwand said. “He created a volunteer instructor academy team, field days and a pilot mentoring program. He was able to accomplish this because of our well-trained and dedicated volunteer staff.”
Bill Jensen, big game biologist, Bismarck, received the Solid Foundation award, presented to staff who demonstrate exemplary work in their field. Jensen was recognized for his passion for wildlife conservation. “Bill’s professionalism, integrity, attitude and work ethic serves as an exemplary model for all employees,” Steinwand said. “He continually strives to use the best available science to help guide wildlife management, and is a go-to source for big game management in North Dakota.”
Stephanie Tucker, game management section leader, Bismarck, received the Public Outreach award, presented to an employee for showing a significant effort, ability or accomplishment in interacting with the public while promoting the Department’s programs. Tucker was recognized for her work involved with furbearer issues. “Stephanie does an outstanding job in communicating with all entities in a professional manner,” Steinwand said. “She is well spoken, highly informed and extremely courteous while working with landowners, legislators, hunters and trappers.”
Jerry Weigel, fisheries production and development section leader, Bismarck, was presented with the Innovations award, which recognizes staff for implementing a process to improve Department goals and objectives. Weigel was recognized for his statewide efforts in fish distribution. “One of Jerry’s career accomplishments has been his ability to integrate improvements to our existing program, and it’s because of his innovation, extreme interest and dedication to our overall fish culture program,” Steinwand said.
Greg Hastings, district game warden, Jamestown, was named North Dakota’s Boating Officer of the Year. Chief warden Robert Timian said Hasting’s district boasts several man-made and natural lakes that are home to many anglers and recreational boat operators. “Warden Hastings is skilled in the detection, apprehension and prosecution of boaters who are operating while operating under the influence,” Timian said. “He is dedicated to making sure his boaters are operating in a safe manner while still enjoying the outdoors.”

TOP-25 COLLEGE BASKETBALL
MADISON, Wis. (AP) — The 14th-ranked Wisconsin Badgers are 12-2 after winning their Big Ten opener.
Nigel Hayes scored 20 points and Zak Showalter added 18 to lead the Badgers’ offense in a 72-52 win over Rutgers. Wisconsin opened with a 16-4 run en route to a 15-point halftime lead. The Scarlet Knights never got closer than nine points the rest of the way.
Hayes delivered 12 points by intermission, Showalter finished with four steals and Ethan Happ had 10 points and 10 rebounds for the Badgers.
MINNEAPOLIS (AP) — Alvin Ellis III made two free throws with 10.6 seconds left in overtime to finish with 20 points and give Michigan State the lead, capping a 75-74 comeback victory by the Spartans over Minnesota on Tuesday after the Gophers took a 13-point lead into halftime.
Michigan State, the worst foul-shooting team in the Big Ten, was 8 for 20 from the line until Ellis stepped up with two swishes following a non-shooting foul by Nate Mason. Nick Ward had 22 points and 10 rebounds for the Spartans (9-5, 1-0), who have been playing without standout freshman Miles Bridges.
Mason, who led the Gophers with 18 points, misfired on his off-balance jumper from the lane at the buzzer that would’ve won the game. Jordan Murphy had 12 points and a career-high 21 rebounds, but Minnesota (12-2, 0-1) lost its fourth straight conference opener under coach Richard Pitino.

SAN DIEGO (AP) — Shannon Brooks caught a tipped pass from Mitch Leidner for a 13-yard, go-ahead touchdown in the third quarter and Minnesota — beset by turmoil after 10 players were suspended after a sexual assault investigation — held on for a Holiday Bowl upset on Tuesday night.
WSU cornerback Marcellus Pippins reached up with his right hand and deflected Leidner’s pass in the end zone but it went right to Brooks for the TD and a 10-6 lead. That capped an 84-yard, 10-play drive on Minnesota’s first possession of the second half.
The Golden Gophers (9-4) were looking to regroup after backing down from a threat to skip this game if 10 teammates suspended after a sexual assault investigation weren’t reinstated. Their boycott lasted less than 36 hours.
WSU (8-5) ended on a three-game losing streak and was held to its lowest point total of the season.
Luke Falk was held to 264 yards — 86 below his average — on 30-of-51 passing.
DALLAS BOWL
DALLAS (AP) — Jordan Asberry ran for a 3-yard touchdown on fourth down in overtime, giving Army the win over North Texas in a rematch at the Heart of Dallas Bowl.
Asberry’s score was the sixth rushing touchdown in the game for the Black Knights (8-5) and 46th of the season. That broke the school record held by the 1945 national championship that had two Heisman Trophy winners in the backfield. They rushed for 480 yards.
Ahmad Bradshaw ran for 129 yards and a touchdown for Army while Darnell Woolfolk had 119 yards and two TDs.
North Texas (5-8) had its chance in overtime. But after Alec Morris scrambled for 4 yards and Jeffery Wilson lost 3, consecutive incomplete passes followed. Morris threw for 304 yards and three scores, but his desperation fourth-down throw on the run ended the game.
MILITARY BOWL
ANNAPOLIS, Md. (AP) — Wake Forest attached a positive ending to a season marred by scandal, using a strong performance by quarterback John Wolford to beat heavily favored Temple 34-26 on Tuesday in the Military Bowl.
After throwing an interception on the first series of the game — a turnover Temple used to take a 7-0 lead — Wolford helped the Demon Deacons rattle off 31 straight points before halftime.
Wolford left with a neck strain in the third quarter with the score 31-17. Wake Forest (7-6) then withstood a comeback bid by Temple (10-4) to secure its first bowl victory since 2008.
The Demon Deacons snapped a three-game losing streak and won for only the second time since Oct. 8.
Wolford, a junior, completed 10 of 19 passes for 183 yards and two scores.
CACTUS BOWL
PHOENIX (AP) — KD Cannon had 14 catches for a Cactus Bowl-record 226 yards and two touchdowns to help Baylor end a difficult season with a victory.
Baylor (7-6) went into a downward spiral the last half of the season after opening with six straight wins. Quarterback Seth Russell suffered a season-ending ankle injury, the sexual assault scandal that cost coach Art Briles his job continued to linger and the losses piled up, six straight to end the regular season.
The Bears ended on a positive note by revving up their quick-hitting offense again behind freshman quarterback Zach Smith, who threw for 375 yards and three scores.
Boise State (10-3) tried to keep up with the Bears, but struggled in the red zone: two field goals, an interception in the end zone and a failed fourth down try.
Boise State started with single coverage on Cannon and the Bears exploited it throughout the first half. Cannon had eight catches for 182 yards and two TDs by halftime.

CLEVELAND (AP) — LeBron James is The Associated Press Male Athlete of the year after leading the Cavaliers to the NBA title and ending Cleveland’s 52-year drought without a championship team.
James also captured the award in 2013 and joins Michael Jordan as the only NBA players to win it at least twice.
The Cavaliers forward collected 24 first-place votes to beat out a pair of Olympic legends: swimmer Michael Phelps and sprinter Usain (yoo-SAYN’) Bolt.

UNDATED (AP) — The Buffalo Bills have made two major changes heading into their season finale against the Jets.
The Bills have fired head coach Rex Ryan after just 31 games and a 15-16 record with the team. The move comes three days after a Week 16 loss to the Dolphins dropped the Bills to 7-8 and officially eliminated them from playoff contention. The loss extended the NFL’s longest active playoff drought to 17 seasons.
The Bills say offensive coordinator Anthony Lynn will serve as interim head coach this Sunday. Lynn will have a new quarterback under center after Tyrod Taylor was benched in favor of EJ Manuel. Taylor was demoted after going 26 of 39 for a career-best 329 yards in a 34-31 overtime loss to Miami last weekend.
Manuel hasn’t started since a 34-31 loss to Jacksonville on Oct. 25, 2015.
The Bills also said on Twitter that Rob Ryan has been dismissed as an assistant head coach and defensive strategist. Ryan is the twin brother of Rex.

BEIRUT (AP) — Media reports in Turkey are quoting the country’s foreign minister as saying a lasting cease-fire and political solution in Syria are “close.” The comments come hours after the state-run news agency said Russia and Turkey had reached an agreement for a cease-fire plan comprising the whole of Syria.
WASHINGTON (AP) — Secretary of State John Kerry is scheduled to deliver a final policy speech on Mideast peace today at the State Department in Washington. An Israeli minister is already criticizing the planned speech, saying it will limit President-elect Donald Trump’s ability to set his own policy on the Israeli-Palestinian conflict.
MOSCOW (AP) — Russia’s Defense Ministry says search teams have recovered another flight recorder from a military plane that crashed in the Black Sea Sunday, killing all 92 people aboard. Experts have begun analyzing the first flight recorder that was found a day earlier. The T-u-154 crashed into the sea two minutes after taking off in good weather.
GENEVA (AP) — Police in southern Switzerland say the body of an American hiker who apparently fell nearly 500 feet has been found in the region known for the famed Matterhorn peak. Police say they have identified the 52-year-old man but declined to release his name or home, citing Swiss privacy laws.
LITTLE TORCH KEY, Fla. (AP) — Three Orange County, California, teens are safe in the Florida Keys thanks to a marine deputy who rescued them from atop a capsized boat. A Monroe County Sheriff’s spokeswoman says the two 18-year-olds and a 16-year-old climbed atop the capsized boat and called 911 on a cellphone Tuesday.
