Water outages will be temporary  – water service will be resumed as soon as is possible.

Jamestown  (CSi)  The Jamestown City Council met in Special Session Wednesday evening at City Hall.

Council Member Gumke was not present.

The Council discussed the Services Enterprise Agreement for residential recycling with Renaissance Recycling, LLC.

Mayor Katie Andersen reviewed the basics of the updated agreement which included:

A five year contract, with a renewal after five years, and reviewed annually.

A description of the drop off site includes that it be maintained and operated in a safe manor for the public.

Be open five days a week for  four hours, and include openings on Saturdays.

The holiday schedule will be the same as the city’s garbage collection schedule.

During the first six months of the recycling the city and Renaissance Recycling will split the costs of residuals that are not collected.

There will be  written permission with the city to transfer to another recycler, except to a one time transfer to a company owned by Renaissance Recycling.

With the Rates $5.55 per month, per household, for the first year….year two rates increased by a predetermined multiplier.

Years 6-10 the rate will be negotiated within the five year renewal.

An Act of God provision is included in the event of a natural disaster and the recycler not able to meet obligations.

Council Member Buchanan said the public has informed him of wanting  an opt-out clause.

It was explained, that those not wanting to recycle can select the smallest recycling bin, and see little changes in the present rate.

City Administrator Jeff Fuchs said the $5.55 is the cost of the city to recycle, and not necessarily the rate charge to the residential customer.

He added the present rate to the consumer, could be the same or less as they are paying now.

Recycling rates are based on the volume of recycled items, versus items disposed of in the garbage bins, and determined by the size of the bins.

Recycling of glass materials will continue at the recycling center, only.

Renaissance Recycling’s Ralph Friebel said glass recycling is only profitable if its sorted at the center, and shipped off from there.

The public will be further educated about rates, containers and other issues before implementation

The City Council voted unanimously to approve entering into the agreement.

Mayor Andersen and City Administrator Jeff Fuchs will sign the agreement.  Any minor changes such as language can be made without their approval.

Residential recycling in Jamestown is anticipated to start on July 1st this year, pending equipment purchase and any unforeseen circumstances.

CANNON BALL, N.D. (AP) — The company building the Dakota Access oil pipeline says it plans to immediately resume construction on the long-stalled project.

Dallas-based Energy Transfer Partners on Wednesday got final permission from the Army to lay pipe under a Missouri River reservoir in North Dakota. The project had been delayed for months before President Donald Trump last month instructed the Army Corps of Engineers to advance work on the pipeline.

The Standing Rock Sioux tribe has vowed to continue fighting the construction. Tribal Chairman Dave Archambault said in a statement Wednesday that the Standing Rock Sioux are prepared to continue battling the pipeline “in the courts.”

The tribe fears a pipeline leak could contaminate its drinking water. But ETP contends the pipeline is safe.

Opponents of the project held demonstrations Wednesday in several cities, including Chicago, New York and Washington, D.C.

FARGO, N.D. (AP) — Notorious drug trafficker Juan “El Chapo” Guzman is behind bars in New York after extradition from Mexico last month. Now federal prosecutors in North Dakota have their sights set on bringing one of his organization’s onetime rivals to the United States to face charges.

Juan Sillas-Rocha has been fighting extradition to North Dakota, where federal officials more than a decade ago began gathering evidence on him. He was a top lieutenant for the Arellano Felix cartel, a competitor of Guzman’s Sinaloa cartel.

The case wound up in North Dakota after Jorge “Sneaky” Arandas, a member of the Arellano Felix gang, set up shop in the Red River Valley of North Dakota and Minnesota. Investigators say Arandas ordered the killing of Lee Avila in June 2005.

Sillas-Rocha’s case was unsealed Tuesday.

BISMARCK, N.D. (AP) — A North Dakota man accused of enticing a 14-year-old girl from the Philippines to produce sexually explicit images has been sentenced to 50 years in prison.

A jury in October found 54-year-old Calvin Bernhardt, of Tuttle, guilty on five counts, including attempted sexual exploitation of a minor and tampering with a witness or evidence.

Authorities say Bernhardt pursued the victim for about seven months and at one point tried to arrange a meeting with the victim in a Philippines hotel with the intent of having sex with her.

After he found out about the investigation, Bernhardt allegedly contacted the mother of the victim and told her to delete images on the girl’s cellphone and instructed her not to talk to federal authorities.

BISMARCK, N.D. (AP) — A broken water line has flooded a large portion of an indoor shopping mall in Bismarck.

The leak started in the eastern side of Kirkwood Mall on Wednesday but quickly spread across the carpeted floor as shop owners and workers watched and others sandbagged and mopped entrances.

Mall officials say the leak was detected quickly but the valves to shut off the water were frozen and closing them took two hours.

The Scheels sporting goods store was unaffected but supplied pumps from their store. Local carpet cleaners were also called in to help pump out water.

The south end of the mall will be closed while the carpet is removed and the affected areas are re-floored. Stores with outdoor entrances will stay open.

BISMARCK, N.D. (AP) — After a federal judge temporarily halted President Donald Trump’s refugee ban, a man who arrived in the U.S. as a refugee from Iraq was reunited with his parents in Bismarck.

Trump signed an executive order Jan. 27 that places a 90-day ban on refugees from seven Muslim-majority countries. The order also suspends the refugee program for 120 days and Syrian refugees indefinitely.

District Judge James Robart issued a restraining order to halt the ban nationwide on Friday.

Zaid Alazzawi, who arrived from Iraq in 2014, was reunited with his parents Saniya and Hasam Alazzawi on Tuesday after four years. The family’s plans to reunite were previously canceled when Trump’s order went into effect.

TWINS MOVES

MINNEAPOLIS (AP) — The Twins have agreed to minor league deals with left-hander Craig Breslow and outfielder Drew Stubbs.

Minnesota announced on Wednesday that both players will report to big league spring training.

The 36-year-old Breslow is a lefty specialist out of the bullpen. He is 22-29 with a 3.35 ERA in 539 career appearances. He won a World Series with Boston in 2013 and made 15 appearances for the Miami Marlins last season.

Stubbs was the eighth overall pick by Cincinnati in the 2006 amateur draft. He hit a career-high 22 home runs for the Reds in 2010, but he led the majors with 205 strikeouts the following year. The 32-year-old has bounced among Colorado, Texas, Atlanta and Baltimore over the last two seasons. In 901 major league games, Stubbs has a .244 batting average and a .707 on-base-plus-slugging percentage

KANSAS CITY, Mo. (AP) — The Royals have announced their two-year, $16 million contract with Jason Hammel. The move is designed to shore up the starting rotation after the death of Yordano Ventura in a car accident last month.

Hammel was 15-10 with a 3.83 ERA for the World Series-champion Chicago Cubs last season and has proven to be a workhorse with at least 30 appearances in each of the past three seasons.

FENCING…

MINNEAPOLIS (AP) — The Minnesota Vikings want to build permanent fencing around U.S. Bank Stadium to provide better security. But, the plan may not win approval from the Minnesota Sports Facilities Authority.

Temporary security fences were already placed around the stadium last season. Vikings executive Lester Bagley says permanent fencing won’t change access to the stadium.

Sports Facilities Authority chairwoman Michele Kelm-Helgen saysthe stadium needs to be connected to the neighborhoods, both visually and practically.

Bagley says fundamentally it’s a stadium security issue, especially given what happened at the last Vikings game. Bagley is referring to the Dakota Access pipeline protesters who eluded security and hung a massive banner from the top of the stadium.

NBA…

NEW YORK (AP) — The New York Knicks have added yet another wrinkle to their dysfunction.

Former Knicks forward Charles Oakley was arrested during Wednesday’s game against the Clippers following an altercation with team owner James Dolan. Oakley shouted at Dolan and shoved security guards before he was pulled away from his seat behind the baseline.

The Knicks issued a statement on Twitter saying Oakley behaved in a highly inappropriate and completely abusive manner. The altercation took place just a few rows behind the court during a stoppage in play.

Oakley was one of the Knicks’ top players during their run to the 1994 NBA Finals, but he has a poor relationship with the team because of his criticisms of Dolan.

NASCAR-RULE CHANGES

CONCORD, N.C. (AP) — NASCAR continues to tweak its rules ahead of the start of its season-opening week at Daytona later this month.

Teams will no longer be permitted to return damaged racing cars to the track unless they can be repaired on pit road during a five-minute cumulative time limit. Cars that return to the garage cannot resume racing.

NASCAR said the new rule prevents severely damaged race cars from returning to the track and creating a safety hazard for other teams.

NASCAR also announced that it will have a traveling safety crew starting this season, creating a consistent medical staff that drivers have been requesting for the last several years.

BEIJING (AP) — China is praising President Donald Trump for expressing a desire for a “constructive relationship” in a letter to Chinese President Xi Jinping (shee jihn-peeng). Trump sent belated well-wishes for the Lunar New Year from the White House on Wednesday. A Foreign Ministry spokesman dismissed suggestions that Beijing was offended by the timing of the message.

NEW YORK (AP) — Hundreds of schools are closed from the Albany, New York, area to the eastern tip of Long Island because of a major Northeast storm that’s expected to dump more than a foot of snow in some areas. Snow has been slowing the morning commute around New York City and upstate. It could be the region’s most powerful storm so far this winter.

GUERNEVILLE, Calif. (AP) — The latest in a series of storms to drench Northern California this week is predicted to pack a bigger punch as it moves into the region of already soggy hillsides and swollen rivers. Residents of the battered region are bracing for heavy rain forecast for today.

PARIS (AP) — A fire led to a blast in the machine room of a nuclear power plant on France’s northwest coast. But the plant’s operator says there was no radiation leak or casualties. The fire in Normandy was quickly brought under control; its cause is not yet clear.
