Drake  (CSi)  The North Dakota Highway Patrol reports, a head-on crash between a pickup and a semi- triple trailer about 8-a.m., Tuesday claimed the life of the 31-year old pickup driver.

The crash occurred on Highway 52, five miles north of Drake.

The reports says the Ford pickup was eastbound and the Freightliner was westbound on Highway 52. The Ford crossed the centerline and was struck head-on by the Freightliner. The Ford spun counterclockwise and came to rest on the shoulder. The Freightliner left the road and jackknifed. The cab overturned and came to rest in the ditch. The Freightliner’s triple trailer combination came to rest upright behind the semi.

The Freightliner’s 32 year old male driver was extricated and flown to Minot for treatment of non-life-threatening injuries. The Ford driver died on scene.

Hwy 52 was closed for three hours while the scene was cleared.

Names and home towns will be released Wednesday.

Assisting at the scene Velva Ambulance Service,  McHenry County Sheriff’s Office, Drake Fire and Rescue, Harvey Fire and Rescue,  and Northstar Life Flight.

BISMARCK, N.D. (AP) —  A federal judge says he’ll likely decide within a week whether to temporarily halt construction of the final section of the Dakota Access pipeline, which could be able to move oil within weeks.

U.S. District Judge James Boasberg held a hearing Tuesday in a lawsuit brought by the Standing Rock and Cheyenne River Sioux tribes, but he didn’t immediately rule.

The tribes want him to direct the Army Corps of Engineers to withdraw permission for Texas-based developer Energy Transfer Partners to lay pipe under Lake Oahe in North Dakota.

The stretch under the Missouri River reservoir is the last piece of construction for the $3.8 billion pipeline to move oil from North Dakota to Illinois.

The tribes say the pipeline threatens their right to practice their religion, which relies on clean water. The Corps and company say the claim is lacking.

Washington  (CSi)   — Senator John Hoeven Tuesday released the following statement after the president signed an executive order to eliminate the Obama Administration’s Waters of the U.S. (WOTUS) rule. The president’s order begins the process of undoing the regulation. Hoeven worked to defund the rule in 2016 and 2017, and it was put on hold by the U.S. Court of Appeals for the Sixth Circuit.

“The Obama Administration’s Waters of the U.S. rule was a regulatory overreach that would have placed unnecessary burdens on farmers, ranchers and other small businesses in North Dakota and across the nation,” said Hoeven. “The president’s executive order starts the removal of the Obama rule and ensures that we support economic growth, provide regulatory certainty and respect states’ rights.”

President Trump’s executive order directs the Environmental Protection Agency (EPA) and the Army Corps of Engineers to rescind or revise the Obama Administration’s WOTUS rule to ensure that it promotes economic growth, minimizes regulatory uncertainty and upholds the Constitutional role of states, while ensuring that the nation’s waters are kept free from pollution.

As a member of the Senate Appropriations Committee, Hoeven worked to prohibit the EPA from implementing the rule in 2016 and 2017. In November, Hoeven also worked with his colleagues to pass a Resolution of Disapproval to repeal the rule, however the Obama Administration vetoed the measure in January.

Washington  (CSi)  U.S. Senator Heidi Heitkamp was invited to the White House Tuesday to join the president as he signed an executive order effectively undoing the previous administration’s Waters of the U.S. rule—an over-reaching policy that Heitkamp has long pushed back against to protect North Dakota farmers and ranchers.

Heitkamp negotiated and helped introduce a strong bipartisan bill in 2015 to do away with the Waters of the U.S. rule. The bill offered a compromise fix by scrapping the harmful rule and sending it back to the U.S. Environmental Protection Agency (EPA), requiring the agency to take into account the concerns of farmers and ranchers whose livelihoods could be impacted given the scope of the rule. Heitkamp will continue to push Congress to pass legislation to undo the Waters of the U.S. rule. If passed, such legislation would go into effect immediately, while the new executive order—though a needed step—still has to go through the rulemaking process.

Washington  (CSi)   Senator John Hoeven Tuesday announced that Julie Schaff Ellingson, Executive Vice President of the North Dakota Stockmen’s Association will be his guest at President Donald Trump’s Joint Congressional Address tonight.

Hoeven says, “Agriculture is North Dakota’s largest industry and a central part of our nation’s economy.  Our farmers and ranchers do a tremendous job providing food, fuel and fiber to meet our needs and Julie is a great representative of this good work. I look forward to the President’s address and hearing more about his efforts to reduce the regulatory burden on our economy and empower our nation’s businesses, including our farmers and ranchers, to grow and thrive.”

Julie and her husband Chad run a seed stock business on their fourth generation family ranch near St. Anthony, ND. The Ellingsons have five children, who are also active in the business. Additionally, Julie works with CommonGround to help educate consumers on food and farming.

MINNEAPOLIS (AP) — Adrian Peterson, Minnesota’s all-time leading rusher, will be an unrestricted free agent when the market opens next week.

As expected, the Vikings declined to exercise their option for next season on Peterson’s contract. Peterson was scheduled to make $18 million in 2017, what would have been an unwieldly hit to their salary cap.

General manager Rick Spielman says the team will “continue to have conversations” with Peterson’s representatives about the potential of re-signing the soon-to-be 32-year-old Peterson. He has played 10 seasons with the Vikings, who drafted him seventh overall out of Oklahoma in 2007.

He is coming off a meniscus tear in his right knee that limited him to 72 yards on 37 carries over parts of three games.

In world and national news…

WASHINGTON (AP) — Advisers say President Donald Trump will use tonight’s prime-time speech to Congress to declare early progress on his campaign promises — including a withdrawal from the Pacific Rim trade pact. He’s also expected to map out a path on some legislative priorities, including health care and infrastructure spending.

WASHINGTON (AP) — Although House Speaker Paul Ryan is Republicans will eventually be unified around a plan to repeal and replace the health care law, there are new signs Tuesday that the differences will be hard to overcome. Three Republican senators — Rand Paul, Mike Lee and Ted Cruz — are rejecting the plan that’s emerging in the House, calling it ‘Obamacare lite.” Several House conservatives also have said they can’t support the plan being crafted by GOP leadership.

VANCOUVER, British Columbia (AP) — Protests are planned in the western Canadian city of Vancouver as a new Trump International Hotel and Tower opens in a city known for diversity and progressive politics. Steel fences surrounded the downtown property early Tuesday ahead of the grand opening ceremony. President Donald Trump’s eldest sons are expected but the mayor of Vancouver and members of his party on the City Council said they would not attend the ceremony. Police officials said protest marches were planned for downtown throughout the day.

RIVERSIDE, Calif. (AP) — Police say one survivor of a deadly plane crash in a Southern California neighborhood is hospitalized with critical burns and the other is in stable condition. Three people on the plane died when the twin-engine Cessna slammed into two homes and caught fire yesterday in Riverside east of Los Angeles.

NEW ORLEANS (AP) — One reveler says Mardi Gras is “the one time of year people can act like fools and get away with it.” Craig Channell of Tampa, Florida was in a group of visitors taking a ferry across the Mississippi to join the crowd in New Orleans for the annual celebration today. Some were wearing tutus — and others were dressed as pirates. Channell jokes that his tutu is in the wash.
