PUBLIC HEARING:

Regarding  Special Assessments confirmed by the Special Assessment Commission for Paving Improvement District No. 109. City Auditor Richter, said written comments had been received.

Four issues were addressed, including water retention in an ADA ramp, a slump in the street, that will be resolved, a driveway issue that will resolved yet this fall.  The owner asked to have the work done this spring, and doesn’t want to pay the specials until completed.   It was suggested to have the area tilled, now.  A seal coat was brought to attention, which was explained and no concerns by officials. City Auditor Richter those properties in questions can be held off special assessed for a year.

 

Following the Public Hearing, City Commissioners approved Special Assessments as recommended by the Special Assessment Commission for Paving Improvement District No. 109 with the adjustments.

 

ORDINANCE

The City Commission approved the Second and Final Reading of an Ordinance adopting the 2019 City Budget.   No changes from the First Reading.

 

The City Commission approved the Second and Final Reading of an Ordinance amending and reenacting Title 20, Taxation. City Attorney Schoenack  said the Ordinance combines several ordinance into one, under recodification.

 

 

RESOLUTION

City Commissioners  approved a Resolution approving Plat of Hanna Field Addition. City Attorney Schoenack  said a Public Hearing was held and recommended for approval by the Planning Committee.

 

Approved a Resolution approving the  Plat of Olsberg Addition, also recommended for approval by the Zoning and Planning Committee.

 

Approved a Resolution Setting Salaries for Commissioners.

 

Approved a Resolution amending Electrical Rates.  The resolution clarifies the rate structure, and when it is in effect.

 

NEW BUSINESS

Commissioners approved a Special Alcohol Beverage Event Permit for City Lights at VCSU on October 12, 2018 from 5:00 PM to 7:30 PM. at the Viking Hall of Fame Banquet.

 

Commissioners approved  the  appointment of Ruth Berg to the Valley City Barnes County Library Board to fill vacancy until June 30, 2019.  Commissioner Powell said a member stepped down and Berg was deemed the most qualified of the applicants.

 

Approved the recommendation from Renaissance Zone Authority Board for 809 8 ½ Avenue NW for 5 year income tax exemption and 5 year property tax exemption up to $250,000 for purchase of a new home.

 

City Commissioners then approved  2019 Scheduled Board Meetings. City Auditor Richter the Commission meetings will continue the first and third Tuesday of each month, with the exception of holiday dates when the meeting will be moved.

 

The City Commission approved the 2019 Blue Cross Blue Shield Contract.  City Auditor Richter pointed out the contract in the budget needed to be formally approved.  The increase over 2018 amounts to 11 percent.

City Fire Chief Retterath requested more applicants for firefighters, and noted the sirens will be tested on Wednesday.

KLJ gave an update on street projects being completed.

Commissioner Bishop thanked police and fire fighter for their work.

Mayor Carlsrud noted city updates on work being done following the construction season.

He said electrical service was on  99 percent of the time.

Valley City  (CSi)  Valley City officials report that paving of 3rd AVE SE in Valley City  resumed on Tuesday 10/2/2018.

During paving operations, the intersection of 3rd AVE and 4th ST SE will be closed. It is expected that the intersection will be reopened the morning of Wednesday 10/3/2018.

During this shutdown 3rd Ave will be closed from College Street to Main Street. Access VCSU from 4th Ave SW during this closure.

KLJ reports the work should be completed on time, pending weather conditions.

Valley City   (CSi)  The Valley City Eagles Club will be hosting a FREE WILL DONATION benefit fundraiser Spaghetti Feed for the Barnes County Museum, Monday,October 8 from 5:30-7pm.

Support is asked for the  local museum’s efforts to keep doing what they’re doing!  They will also have a drawing for the “Crazy Log Cabin” quilt made by Sandy Goeller and 2nd prize is a cutlery set.  Tickets are $5 each or three for $10.  Drawing will be Monday night, need not be present to win!

Jamestown  (CSi)  Jamestown Tourism Director, Searle Swedlund says, a number of new events are going to Jamestown over the next few months, that will boost tourists and tourism dollars.

On Tuesday’s Wayne Byers Show on CSi Cable 2, he said those events include the first ever NAIA National Women’s Wrestling Tournament, along with Hockey Day, the University of Jamestown Basketball Shootout, and indoor tennis tournament at TRAC.

He pointed out the facilities in Jamestown at UJ and TRAC, along with expanded hotel rooms are supporting Jamestown’s ability to attract participants and tourists.

He said at this month’s tourism Executive/Grant Committee meeting, requests will be considered under the Capital Construction fund.

Those include requests from Frontier Village, the National Buffalo Museum, Jamestown Parks and Recreation for Jack Brown Stadium.

Other monthly grant requests are scheduled on the agenda.

Searle also said a new Tourism Office Manager has been hired.

He said Allison Limke has been hired, adding that Allison is originally from Casselton, ND and recently joined her husband who recently moved to Jamestown for a job at UTC.

He pointed out that Allison brings a wealth of knowledge from her previous role with the Pella Historical Society.

The 50 or so members of Kiwanis are working toward their $20,000 Kids Against Hunger goal. Kids Against Hunger is a meal-packaging event in which 300 volunteers pack meals for hungry families. The meals are distributed throughout North Dakota and Minnesota through the Great Plains Food Bank. This year’s event is set for Saturday, Nov. 3.

 

Jamestown Kiwanis Club, President, Sarah Griego, says,  “Members of the Kiwanis Club of Jamestown volunteer at this event every year in our effort to help children thrive, prosper and grow.  We know kids need Kiwanis, in our community and in communities around the world.”

 

Last year, about 60 Kiwanians and community members attended the Kids Against Hunger Dinner & Live Auction. They raised about $4,000 or enough to package about 16,000 meals.

WILLISTON, N.D. (AP) — The Highway Patrol has identified an Alexander man who died when the pickup truck he was driving was caught between two semitrailers in a construction area in Williams County.Authorities say 58-year-old Terry Lynn died at the scene Monday afternoon on U.S. Highway 85, about 4 miles south of Williston.The patrol says the pickup and the semi ahead of it started to slow due to construction, and the second semi struck the pickup, pushed it into the back of the first semi and came to rest on the top of the truck.The driver of the second semi suffered unknown injuries. The driver of the first semi wasn’t hurt.

 

ROSE CREEK, Minn. (AP) — Authorities have arrested a Minnesota mother who was on the run and have located four of her five missing children.

Police say 39-year-old Izetta Cooley and the four children were found at a home in Moorhead Tuesday. Officials say Cooley was arrested on a felony kidnapping warrant from Mower County. She’s being held in the Clay County Jail.

One child, a 17-year-old boy, is still missing.

Authorities say Cooley was under court order not to have contact with her children, but she came to a home in Rose Creek and took some of them Saturday night.

Cooley’s husband, 44-year-old Miguel Cooley of Moorhead, is accused of fatally shooting 20-year-old Gabriel Perez outside a McDonald’s restaurant in Fargo, North Dakota, on Sept. 23. Miguel Cooley was later arrested in southeastern Minnesota.

 

GRAND FORKS, N.D. (AP) — Grand Forks police have arrested a suspect in the armed robbery of a gas station last month.

Twenty-seven-year-old Terrance Gourdine of Grand Forks is charged with felony robbery and preventing arrest in the holdup at Orton’s Cenex Gas Station on Sept. 23. No one was hurt in the robbery.

He could face up to 15 years in prison if convicted. Court documents indicate he’s representing himself in court, and a home telephone listing for him couldn’t be found. He could enter pleas at a Nov. 5 hearing.

 

BISMARCK, N.D. (AP) — Environmental groups opposing the site of an oil refinery being developed near Theodore Roosevelt National Park in North Dakota want a judge to reconsider his recent recommendation that state regulators dismiss the groups’ challenge.

The Environmental Law and Policy Center and Dakota Resource Council say Davis Refinery developer Meridian Energy didn’t update the state Health Department about its decision to lower the refinery’s capacity. They say that might indicate the project might end up being larger than the company says.

Company CEO William Prentice has signed an affidavit saying it won’t be. And Meridian maintains it had no reason or requirement to update the Health Department because the revision won’t result in higher emissions.

The environmental groups question that. They say a decrease in capacity could result in less efficiency.

 

FARGO, N.D. (AP) — Officials with the first Veterans National Cemetery in North Dakota say they should begin accepting burials by late spring or early summer of 2019.

KFGO radio reports that construction on the cemetery started earlier this year on the 5-acre site near Harwood, north of Fargo. The VA purchased the property two years ago.

The Fort Snelling National Cemetery in Minneapolis is overseeing the project. It will have more than 3,000 gravesites for eligible veterans and family members, as well as a memorial wall.

The VA is setting aside another 5 acres for expansion, which officials say is likely in about 10 years.

 

MINOT, N.D. (AP) — The public is being given more time to comment on a study of Souris River management options.The International Souris River Study Board has moved the deadline to Nov. 12 due to a prolonged harvest season that has kept many farmers in the field.The study is aimed at finding the best ways to manage the river and its reservoirs on both sides of the U.S.-Canada border.Water science engineers are setting up various management models. Public responses will help the experts better understand the impacts and benefits to communities in different parts of the basin.A June 2011 river flood caused by heavy spring snowmelt and rains damaged or destroyed thousands of homes and other structures in Minot and caused an estimated $1 million in damage in the region. 

MINOT, N.D. (AP) — An African spurred tortoise rescued from Lake Sakakawea has been given a home at Minot’s Roosevelt Park Zoo.

The Minot Daily News reports an angler found the tortoise floating on a log this summer, rescued it and turned it over the state Game and Fish Department. Officials think it was a pet that was released or escaped. It’s unlikely to survive a North Dakota winter without shelter.

Game and Fish has given the tortoise to the zoo. It’s been named Wilson and will be used to help educate people about choosing pets wisely.

UNDATED (AP) — Last year’s American League Manager of the Year is looking for work.

The Minnesota Twins have dismissed Paul Molitor following a 78-84 season, one year after he led the team to the AL wild-card game against the Yankees. The Hall of Fame hitter was 305-343 in four seasons at the helm, including an 85-77 mark in 2017.

Molitor had two seasons left on his contract and has been offered another position within the organization.

— Luis Severino will start the AL wild-card game for the Yankees for the second straight year. Yankees manager Aaron Boone made the announcement on the eve of their playoff clash with Oakland. — Indians manager Terry Francona has announced that right-hander Mike Clevinger (KLEH’-vihn-jur) will start Game 3 of the AL Division Series against the Astros, when the best-of-five series shifts to Cleveland next week. Clevinger went 13-8 with a 3.02 ERA and 200 strikeouts in 32 starts this year.

— Cleveland All-Star catcher Yan Gomes (yahn gohmz) said he’ll “absolutely” play Game 1 of the AL Division Series against Houston despite cutting his right thumb last weekend. Gomes got hurt when he accidentally connected with the bat of Royals outfielder Alex Gordon while trying to throw out a runner Saturday in Kansas City.

— Three wheelchair users are suing the Baltimore Orioles over accessibility at Camden Yards. News outlets report the lawsuit filed Friday against the team and the Maryland Stadium Authority says each plaintiff has been stuck in a wheelchair lift while trying to get to their seats. And the view from lower-level wheelchair-accessible seats is obstructed whenever fans stand up. The plaintiffs seek damages of at least $75,000 each, and a Camden Yards that’s compliant by the next baseball season.

UNDATED (AP) — If Le’Veon Bell is returning to the Pittsburgh Steelers later this month, he hasn’t let his teammates and coaches know.

Coach Mike Tomlin said Tuesday he hasn’t heard from the All-Pro running back, who told ESPN on Monday that he will end his standoff with the team around Pittsburgh’s bye week, which begins after the Steelers face the Bengals on Oct. 14.

Bell has refused to report to the team since training camp.

In other NFL news:

— The NFL has suspended Seahawks linebacker Mychal Kendricks indefinitely after he pleaded guilty last month to federal insider trading charges. A suspension had been anticipated since his guilty plea in early September. Seattle signed Kendricks prior to Week 2 because of a need at linebacker with K.J. Wright out following knee surgery.

— Browns starting cornerback Terrance Mitchell has been placed on injured reserve with a broken right wrist suffered in Sunday’s loss at Oakland. He underwent surgery on Monday, when coach Hue Jackson said he didn’t think Mitchell’s injury was season-ending.

— The Dolphins have released defensive tackle Jordan Phillips in the wake of his angry sideline outburst after being pulled from Sunday’s 38-7 loss to the Patriots. He came off the bench this season as part of the defensive line rotation, recording one sack and five tackles.

— The Falcons have signed defensive tackle Michael Bennett in a move which could reflect a new injury concern with starter Grady Jarrett. Jarrett left the final drive of the Falcons’ 37-36 loss to the Cincinnati Bengals on Sunday with an ankle injury. Bennett was released by the Jaguars on Sept 11.

— The Bills have signed cornerback Dontae Johnson to shore up an injury-depleted secondary. Buffalo freed up room on the roster by releasing defensive end Nate Orchard. Johnson is a fourth-year player and opened this season with Seattle. He was placed on injured reserve on Sept. 8 because of a groin injury and released by the Seahawks last week.

— The St. Louis Post-Dispatch is reporting that a Missouri appeals court is allowing a lawsuit against the NFL to proceed. The St. Louis Regional Convention and Sports Complex Authority, St. Louis city and St. Louis County filed suit in 2017, alleging that the Rams’ departure violated a 1984 league guideline that was established after the Raiders moved from Oakland to Los Angeles. The league, the Rams and team owner Stan Kroenke have argued that the disagreements should be settled outside of a courtroom based on an arbitration agreement.

— The parent company that owns the NFL’s Buffalo Bills and NHL Sabres has hired Christopher Schoepflin to oversee its dealings with federal, state and local governments. The Pegula Sports and Entertainment-owned teams will be seeking public financial support to upgrade their facilities, including the possibility of the Bills building a new stadium.

Swinney: Clemson QB Lawrence will play at Wake Forest

UNDATED (AP) — Clemson coach Dabo Swinney says injured quarterback Trevor Lawrence will play against Wake Forest.

Lawrence missed the second half of fourth-ranked Clemson’s 27-23 win over Syracuse last weekend after taking a hard hit right before halftime. At first Swinney said Lawrence had concussion-like symptoms. On Monday, coaches said the injury was more of a neck strain.

Lawrence took part in all of Clemson’s practice Monday. Swinney says the 6-foot-6 freshman looks and feels great.

Swinney also said Clemson receiver Hunter Renfrow is splitting time at quarterback and could come in if something happens to Lawrence and backup Chase Brice.

In other Top 25 news:

— No. 23 North Carolina State and East Carolina have agreed to play on Dec. 1 after both teams had a game against other opponents canceled due to Hurricane Florence. It will take place only if neither team reaches its conference championship game. Both the ACC and American Athletic Conference are holding their title games that day.

Darling out, Hurricanes claim McElhinney off waivers

UNDATED (AP) — Carolina Hurricanes coach Rod Brind’Amour (BRIHN’-dah-mohr) says injured goalie Scott Darling will miss a few weeks because of a hamstring injury suffered in the preseason finale against Nashville.

The injury has prompted the Hurricanes to claim Curtis McElhinney off waivers from Toronto. The 35-year-old McElhinney went 11-5-1 with a 2.15 goals-against average in 18 games for the Maple Leafs last season.

Petr Mrazek (muh-RAH’-zehk) is Carolina’s other netminder.

The loss of McIlhinney and Calvin Pickard leaves the Leafs with just Frederik Andersen and backup Garret Sparks as their goaltending options.

In other NHL news:

— The Capitals have picked up Dmitrij Jaskin off waivers from St. Louis, where the forward became the odd-man out once the Blues set their 23-man roster. Jaskin has 25 goals and 61 points in 266 games over six NHL seasons.

— The Sabres have claimed 23-year-old left wing Remi Elie from Dallas. He had six goals and 14 points in his first full season last year, giving him seven goals and 21 points in 90 career games.

NEW YORK (AP) — The NHL is moving forward with plans to expand to Seattle. The Board of Governors’ executive committee has recommended proceeding with Seattle’s expansion application, with an eye on voting to approve the league’s 32nd franchise in December. The recommendation came a few hours after key stakeholders presented their case to the committee yesterday. Seattle could be awarded a team two months from now.

Okafor has ankle sprain

NEW ORLEANS (AP) — The New Orleans Pelicans will spend the next 1-2 weeks of training camp without center Jahlil Okafor (jah-LIHL OH’-kah-fohr) because of a strained right ankle suffered in Sunday’s preseason opener at Chicago.

The third overall pick in the 2015 draft averaged nearly 15 points and six rebounds during his first two seasons with the Philadelphia 76ers. He had trouble receiving playing time after being traded to Brooklyn last November, scoring 6.4 points while averaging 13 minutes off the bench.

Washington  (FEMA)  The Federal Emergency Management Agency (FEMA), in coordination with the Federal Communications Commission (FCC), will conduct a nationwide test of the Wireless Emergency Alerts (WEA) and Emergency Alert System (EAS) on the backup date of October 3, 2018 due to ongoing response efforts to Hurricane Florence.

The WEA portion of the test commences at 1:18 p.m. CDT, and the EAS portion follows at 1:20 p.m. CDT. The test will assess the operational readiness of the infrastructure for distribution of a national message and determine whether improvements are needed.

 

WASHINGTON (AP) — A lawyer for Christine Blasey Ford is accusing President Donald Trump of engaging in a “vicious, vile and soulless attack” on his client. At a political rally in Mississippi Tuesday, Trump suggested that Ford’s account of being sexually assaulted at a high school party by Supreme Court nominee Brett Kavanaugh when they were teenagers is not credible. At one point, Trump imitated Ford, saying, “How did you get home? ‘I don’t remember.’ How did you get there? ‘I don’t remember.'”

 

 

WASHINGTON (AP) — Supreme Court nominee Brett Kavanaugh has drawn new attention to his time on the Kenneth Starr team investigating then-President Bill Clinton by blaming “revenge on behalf of the Clintons” for the sexual misconduct allegations he faces. A California college professor says Kavanaugh groped her at a party when they were teenagers, which Kavanaugh denies. As a young lawyer, Kavanaugh pushed Starr to ask Clinton in graphic detail about his sexual relationship with White House intern Monica Lewinsky.

 

WASHINGTON (AP) — Arizona Republican Sen. Jeff Flake says President Donald Trump’s mocking of Brett Kavanaugh’s accuser, Christine Blasey Ford, was “not right” and “kind of appalling.” But Flake isn’t saying whether he’ll vote to confirm Kavanaugh to the Supreme Court. Trump mocked Ford at a rally in Mississippi Tuesday night, running through a list of what he described as holes in her account as his audience laughed. Flake told NBC’s “Today” show Wednesday Trump’s attack “is just not right.”

 

PALU, Indonesia (AP) — Indonesia’s national disaster agency expects the death toll to increase following last week’s powerful earthquake and tsunami on Sulawesi island. More than 1,400 people are confirmed dead and thousands are injured. Aid is slowly making its way into areas devastated by the twin disasters. Meanwhile, a volcano erupted Wednesday morning in another part of Sulawesi island.

 

CHICAGO (AP) — Attorneys for the Chicago police officer charged with murder in the shooting death of Laquan McDonald are expected to rest their case Wednesday. On Tuesday, Officer Jason Van Dyke Van Dyke testified that he opened fire when McDonald kept advancing toward him while waving a knife. He said video of the 2014 shooting doesn’t show his “perspective.” Prosecutors pointed out that the dashcam footage didn’t match Van Dyke’s account of what happened.
