FARGO, N.D. (AP Mar 27, 2013) – An attorney representing a Fargo TV station being sued by a former anchorwoman has asked a federal judge to dismiss the case.
The Forum newspaper reports that attorney Gina Janeiro told U.S. District Judge Ralph Erickson during a Tuesday hearing that the decision by KXJB-KVLY TV to remove then-50-year-old Robin Huebner from the station’s 10 p.m. newscast and replace her with a woman about half her age did not constitute age discrimination.
Huebner is suing KXJB-KVLY parent Hoak Media. She’s seeking more than $75,000 in damages.
Huebner’s attorney, James Kaster, told Erickson that the station’s decision to shift Huebner to another time slot and cut her pay by more than one-third was an undeserved demotion designed to make her quit, which she did.
Erickson will rule later.
