Valley City   (Valley News Live) –  The attorney for the family of  Warren Lindvold, Cash Aaland says, “They’re doing OK. But this is a horrible injustice.”   Aaland is representing Lindvold’s family after the 72-year-old died earlier this year after being arrested by the Valley City Police Department and held in the Barnes County Correctional Center.

In a memo released Wednesday, the State’s Attorney’s Office says law enforcement isn’t responsible for Lindvold’s death, but Aaland disagrees. He says, “We believe the conduct of the Valley City Police Department – the officers involved – and the Barnes County Jail – is reckless, horrible, it involved the use of excess force. But we were not at all confident there would be criminal charges.”

An autopsy finds Lindvold died of a broken neck. His chronic arthritis, which didn’t allow him to turn his neck, is also listed as a significant contributing factor. Aaland says dash cam video of Lindvold’s arrest shows him being put in a pain compliance hold and the state’s own memo says Linvold was ‘assisted’ into the patrol car.

In the memo, the state says Lindvold’s cervical fracture was “probably due to a fall” before his arrest. Even if that were true, Aaland says law enforcement’s actions still brought about Lindvold’s death.

Aaland says, “People with a fracture of their spine don’t die. But when they are hauled around and dragged by their arms – or exposed to the kind of force these officers game him, yeah. That’s certainly, I think, responsible for Warren’s death.  When the whole story comes out, and it will come out, I believe that justice will be done for Warren Lindvold and his family.”

Aaland says Lindvold’s family is considering whether or not to go after the Valley City Police Officers and the Barnes County Correctional Center in civil court.

FARGO, N.D. (AP) — James Hendricks came to North Dakota State as a highly touted quarterback with monster numbers, eager to follow in the footsteps of Bison stars Carson Wentz and Brock Jensen.

When it became clear that Easton Stick was next in line to take over at QB, Hendricks was asked by coaches and others if he would be interested in switching positions.

“I was actually asked that question quite a bit,” Hendricks said. “And I was like, ‘No, absolutely not. I don’t want to do that.'”

But he did. And the junior is now a standout safety, earning first-team all-Missouri Valley Football Conference honors this season. And Stick? Well, he has been quite good.

The senior who owns school records for total offense, passing touchdowns and total touchdowns will try for his 46th victory Saturday when the top-ranked Bison (11-0) begin their quest for their seventh FCS title in eight years with a home playoff game against Montana State (8-4). A victory would get him within two of the school record held by Jensen, who guided the team to FCS titles in 2011, 2012 and 2013.

While Bison coach Chris Klieman has a whopping 15 all-conference players to brag about this season, he knows the significance of the player taking the snaps.

“You look at the best teams in the NFL and the best teams in major college football as well as FCS, they have a trigger man,” Klieman said. “We’re so excited because we have a guy who has been here, done this, for a number of years in the playoffs.”

UNDATED (AP) — Georgia Tech suddenly finds itself in the market for a head football coach.

Paul Johnson is retiring after 11 seasons with the Yellow Jackets, making the surprising announcement Wednesday after meeting with his players. He will continue to coach the team until after its bowl game.

The 61-year-old Johnson was 82-59 with three trips to the ACC championship game while at Georgia Tech. The Jackets have gone to eight bowl games and are eligible for a ninth after recording a 7-5 record this year.

Matthews now has 12 goals and 19 points in just 12 games this season.

Fournette suspension sticks

UNDATED (AP) — The Indianapolis Colts won’t have to deal with running back Leonard Fournette when they go for their sixth consecutive victory Sunday against Jacksonville.

Fournette’s appeal of a one-game suspension for fighting has been denied, leaving him unavailable against the Colts. The running back was suspended without pay for leaving the sideline, running across the field and punching Bills defensive end Shaq Lawson during Sunday’s loss at Buffalo.

The Jaguars could also be without cornerback Jalen Ramsey versus Indianapolis. Ramsey missed practice Wednesday because of a knee injury and might not do any on-field work all week.

In other NFL news:

The Jets have placed left guard James Carpenter on the injured reserve list with a shoulder injury, ending his season. Carpenter had started in 58 straight games since signing with the Jets as a free agent in 2015 until missing New York’s 27-13 loss to New England last Sunday. New York also said rookie quarterback Sam Darnold was limited at practice Wednesday, a positive sign after he sat out team drills since injuring his right foot more than three weeks ago.

— Eric Berry was back on the Chiefs’ practice field Wednesday for the first time since early in training camp, though it remains unclear when the star safety will be ready for games. Berry tore his Achilles’ tendon in last season’s opener and rejoined the team for the start of training camp last summer before being sidelined by a troublesome heel problem.

— Lions return specialist Jamal Agnew is returning to practice after sitting out since Week 5 because of a knee injury. The team removed him from the reserve-injured designation on Wednesday.

— Defensive end Derrick Shelby has become the Falcons’ seventh former starter to land on injured reserve this season. Shelby has a groin injury.

— Eric Reid says he’s being targeted by the NFL because of his pending collusion case after being drug tested five times since signing with the Panthers on Sept. 27. Drug screenings throughout the NFL are random, but the Panthers safety says this year for him it has been “excessive.”

— Redskins coach Jay Gruden (GROO’-dehn) says the team will continue to investigate Rueben Foster’s legal problems amid the outcry from signing the running back following his latest domestic violence arrest over the weekend. Gruden said Wednesday there are “no guarantees” Foster ever plays for Washington.

In world and national news…

HONG KONG (AP) — China’s government has ordered a halt to work by a medical team that claimed to have helped make the world’s first gene-edited babies. Vice Minister of Science and Technology Xu Nanping told state broadcaster CCTV that his ministry is strongly opposed to the efforts that reportedly produced twin girls born earlier this month. Xu called the team’s actions illegal and unacceptable and said an investigation had been ordered.

SHANGHAI (AP) — Top global brands are among more than 200 automakers in China sending real-time data about electric vehicles to government monitoring centers, the AP found. Officials say it’s for public safety and infrastructure planning. Critics argue the tracking of over 222,000 vehicles in Shanghai alone could give China a powerful new surveillance tool as it steps up the use of technology to track citizens. Automakers worried about undermining their competitive position initially resisted complying.

MOSCOW (AP) — The Kremlin says that Russian President Vladimir Putin and U.S. President Donald Trump will discuss an array of issues, including nuclear arms control, at their meeting on Saturday on the sidelines of Group of 20 summit in Buenos Aires, Argentina. Kremlin spokesman Dmitry Peskov told reporters Thursday that the two leaders will start with one-on-one talks and then continue broader negotiations involving officials from both sides.

WASHINGTON (AP) — President Donald Trump is heading to the Group of 20 summit in Argentina, where the homebody commander in chief will spend just 48 hours on the ground yet pack in eight high-level meetings with foreign leaders. When Trump travels abroad, he increasingly likes to keep it quick. International summits are taxing events for any leader, but Trump has made his visit even more so by design, as the travel-averse president looks to minimize his time abroad.

WASHINGTON (AP) — President Donald Trump’s remarks about a possible pardon for his former campaign chairman Paul Manafort are the latest sign of his disdain for the Russia investigation. In a New York Post interview on Wednesday, Trump likened the Russia probe to Sen. Joe McCarthy’s pursuit of communists in the 1950s and said he wouldn’t take a Manafort pardon “off the table.” Democratic Sen. Mark Warner of Virginia says if Trump pardons Manafort it would be a “blatant and unacceptable abuse of power.”
