ORDINANCE

The City Commission approved the Second & Final Reading of, an Ordinance Recodifying the Revised Ordinances of the City of Valley City and Repealing & Re-enacting Title 1, General Provisions.

City Attorney Schoenack explained how she changed the language, concerning wording, and definitions.

 

Approved was the Second & Final Reading of an Ordinance Amending Various Sections of Valley City Municipal Code (V.C.M.C.)  City Attorney Schoenack said, this is the final Ordinance of the recodification process, with the draft to be prepared over the next few months.

 

RESOLUTION

City Commissioners approved a  Resolution Amending & Recreating Storm Sewer Improvement District No. 50.  KLJ said various drainage issues were addressed, including along 10th Street and Winter Show Road.  A new list of properties affected has been drawn up.

 

NEW BUSINESS

Approved was the Urban Roads Project Submittal List for Fiscal Year 2020-2023. KLJ said this is a yearly process in December of each year.

Approved was the Amended Employee Policy & Procedure Manual as drawn up by City Attornery Schoenack.

 

 

CITY ADMINISTRATOR’S REPORT

David Schelkoph said the preliminary 2019 Public Works budget has been approved, with zero rate increases for 2019.

He pointed out the new city website that is now on line, adding that it is more user friendly.

The public is invited to give additional ideas to include, or not working correctly.

StreetScape II has made a recommendation of KLJ to perform the work for the city.

Three firms were interviewed.

 

CITY UPDATES & COMMISSION REPORTS

City Attorney Schoenack said, a new binder will be included in the recodified Ordinance, with the former ones from the 60’s and 80’s.

Building Inspector Dave Andersen reminded residents of removing snow from sidewalks with 24 hours of a new snow fall event.

He added asbestos is being removed from the old power house, with demolition slated to start next week.

Gary Retterath reminded residents to be careful with heating devices.

The meeting was shown live on CSi Cable 68 followed by replays.

 

Jamestown  (CSi)  Jamestown Tourism Director, Searle Swedlund says digital technology will be implemented moving away from distributing brochures, and the North Dakota Tourism web site.

On Tuesday’s Wayne Byers Show on CSi Cable 2, Swedlund said, the time line for implementation is May of 2019, as tourists typically use a 30 to 60 day window for planning trips.

The Tourism Board has approved re-allocating $8,500 in the Tourism budget for the project.

He added that three businesses are being considered, for the project, as best for knowledge of the area in offering tourist sites to visitors.

Also on our show, Swedlund added that he’s a member of the North Dakota Rural Leadership program.

Over two years, members travel the state, and other locations sharing information concerning jobs, along with agriculture issues, as they network. Eight classes are held, with the 20 members.

He said 18 locations are on the agenda to visit, including a visit early next year to Chile.

Previous visits were to Bowman, North Dakota, along with out of state trips to Washington, DC and the Twin Cities.

There will be no December meeting of either the executive or full board.

The Tourism Annual Meeting  is January 14, 2019, at 5:15-p.m., at the Holiday Inn Express in Jamestown.

 

Valley City  (VCPD)   Valley City Police is investigating at least  three vehicle burglaries that occurred over this past weekend in Northwest Valley City.

Police Lt. Dana Rustebakke said items were reported missing by the vehicle owners, and reminds residents to lock their vehicle doors.

The burglaries are still under investigation by the Valley City Police Department.

Anyone with information is asked to call Valley City Police.

 

Jamestown (CSi)  The Jamestown Salvation Army, is seeking more bell ringers at their locations.

Major Tim Nauta says the goal of raising $168,000 this years, is still far off.

Each bell ringing shift is two hours.

There are six kettle locations in Jamestown.

He adds, another match in dollars collected is this week and in to receive the match, more volunteer bell ringers area needed.

Jamestown  (JRMC) — Jamestown Regional Medical Center (JRMC) is hosting a blood drive on Thursday, Dec. 6 to help save lives.

The blood drive is open to the community from 9:30 a.m. to 3:45 p.m. in conference rooms A, B and C of the lower level at JRMC.

JRMC Clinical Service Assistant Katie Mittleider says the blood drive is a great event for the community and staff.

Mittleider says, “As professionals in the healthcare industry, we see how important it is to have donor blood readily available. That’s why we host blood drives every year.”

People can donate blood up to three times each year.

Jamestown  (CSi)  Jamestown Public Schools will begin the Holiday Break at the close of the regular school day on Friday, December 21, 2018.

School will resume at the regular time on Thursday, January 3, 2019.  Buses will run at the regular scheduled time.

 

Jamestown  (NDFU)  – The state’s largest farm organization will kick off its 92nd annual state convention in Bismarck on Friday, Dec. 14, at the Bismarck Event Center. Highlighting the mix of educational speakers, entertainment and policy debate will be the unveiling of a Family Farms chopper and formal introduction of Our Family Farm, a children’s book commissioned by North Dakota Farmers Union (NDFU).

NDFU President Mark Watne says consumer education has always been a high priority for Farmers Union.  He adds, “We created the chopper and book as educational tools to grab consumers’ attention and help broaden their understanding of family farm agriculture. We know there is value in what we do as farmers and ranchers. We want them to understand that, too.”

A conversation between Watne and Paul Teutul, Jr., who designed the bike, will be featured in 2019 on an episode of “American Chopper,” a Discovery Channel (CSi Cable 19)  television show, along with footage from the convention where the bike will be revealed for the first time. The author of the children’s book, Dana Sullivan, will be sharing his creation with convention-goers, as well.

Dr. Adnan Akyuz, state climatologist, and Dr. Frayne Olson, crop economist at NDSU, will be hosting seminars at 8 a.m. on Friday and Saturday morning, respectively. National Farmers Union President Roger Johnson will be addressing NDFU members Saturday afternoon. Policy debate, election of officers, Farmers Union Insurance’s annual meeting, live and silent auctions, the Torchbearer Award ceremony honoring youth, and entertainment by Two Old Two Stand and the Johnny Holm Band round out the two-day celebration.

MINOT, N.D. (AP) — The North Dakota Highway Patrol has identified the driver killed after crashing his pickup truck on an icy gravel road in Renville County.The Highway Patrol says 53-year-old Edward Miller, of Glenburn, lost control of his truck about 4:45 p.m. Monday and it spun into the ditch, where it came to rest on its top.The crash happened about 3 miles northwest of Minot Air Force Base.

 

BISMARCK, N.D. (AP) — North Dakota Gov. Doug Burgum is presenting the Legislature with his proposed budget for state government over the next two years.The governor will unveil his blueprint to a joint session of North Dakota’s House and Senate on Wednesday.Burgum is expected to hit a frugal note, with a call to hold down spending and refill state savings accounts that have been tapped to balance previous budgets. But he’s expected to recommend pay raises for state employees, who didn’t get pay hikes in the current budget cycle.North Dakota has a better than expected revenue picture due to record oil drilling, but the state’s biggest businesses — oil and agriculture — face some challenges. 

MANDAN, N.D. (AP) — A man who police say was high on drugs when he stripped naked and climbed into the holy water font during Mass at a North Dakota church has pleaded not guilty to an indecent exposure charge.

Authorities say 21-year-old Zachary Burdick was asked to leave the Spirit of Life Catholic Church in Mandan on Oct. 9 because he was trying to bless congregants. He later returned, took off his clothes, climbed into the fountain then walked down the aisle performing a lewd act in front of the congregation that included preschool children.

KFYR-TV reports that Burdick pleaded not guilty Monday to felony indecent exposure and misdemeanor disorderly conduct. A trial date has not been set.

The felony charge against him carries a maximum punishment of five years in prison.

 

BISMARCK, N.D. (AP) — A North Dakota man has pleaded guilty to a federal charge after admitting to stealing a forklift in a plan to attack President Donald Trump’s limousine during his visit to a refinery in the state.

Forty-two-year-old Gregory Lee Leingang, of Bismarck, stole a forklift and entered the presidential motorcade route in Mandan prior to Trump’s arrival at the Andeavor Mandan Refinery on Sept. 6, 2017. The forklift got stuck in a gated area and Leingang fled on foot. Prosecutors say Leingang planned to harm the president by flipping the limo with the forklift.

The Bismarck Tribune says Leingang reached a plea deal with the U.S. Attorney’s Office and Friday pleaded guilty to attempting to enter a restricted area while using a dangerous weapon, the forklift.

A sentencing hearing is set for Feb. 15.

 

FARGO, N.D. (AP) — City commissioners have approved a law allowing alcohol consumption on the streets of downtown Fargo during certain events.

In June, commissioners temporarily lifted the ban on liquor consumption for a street fair and several other downtown events. The commissioners’ latest action makes the move permanent.

KFGO reports Downtown Community Partnership CEO Melissa Rademacher says careful planning by police, her organization and vendors controlled the events with no problems.

‘Open carry’ was allowed at the Downtown Street Fair, two Cork and Canvas events and recently at Winterfest.

 

Bismarck  (CSi)  The Bismarck Squadron Civil Air Patrol will facilitate this year’s Wreaths Across America event at the North Dakota Veterans Cemetery on Dec. 15 starting at 11 a.m. The event will culminate with adorning all gravesites – over 6,600 – with a holiday wreath. The event will occur simultaneously with over 1,000 other ceremonies at locations in the United States and beyond, and will be highlighted by the placement of military service ceremonial wreaths by veterans of each respective service. CAP is seeking nominations from the community for veterans from each service to place these ceremonial wreaths as part of the WAA event program.

Jamestown  (CSi) The University of Jamestown Men’s Wrestling Team will hold its “Christmas Special” on Wednesday December 12 , at 7 p.m. at Harold Newman Arena. The event is free to the public.

The men’s wrestling team will be dueling Northland Community Technical College and Concordia College of Moorhead. During the wrestling duals when a UJ wrestler wins his match an elf will hand out a free gift to the crowd.

Between the two duals there will be a special wrestling match between Santa Claus and the Grinch. All children will be able to have mat side seating for this event to cheer on Santa.

There will be free gift wrapping for up to five gifts in the Harold Newman Arena lobby.

Bring up to five gifts that they need wrapped for Christmas from 6 to 8 p.m. and they will be wrapped free of charge.

The team will also be having bell ringers and red kettles for people to make a donation to the Salvation Army.

BISMARCK, N.D. (AP) — A North Dakota program that connects coyote hunters and trappers with landowners who are having problems with the critters has been activated.It’s the seventh year for the Coyote Catalog set up by the state departments that oversee agriculture and wildlife. Last year, about 30 landowners and more than 500 hunters and trappers used the program.Landowners can sign up on the Agriculture Department website , and hunters and trappers on the Game and Fish Department site.The program will remain active through March.

SEA ISLAND, Ga. (AP) — The National Hockey League is expanding to Seattle.

The NHL Board of Governors unanimously approved adding Seattle as the league’s 32nd franchise on Tuesday. Play will begin in 2021 to allow enough time for arena renovations. The as-yet unnamed franchise will be the Emerald City’s first major winter sports team since the NBA’s SuperSonics left town in 2008.

Seattle Mayor Jenny Durkan said at a watch party in Seattle: “I got a call from a mole in the room and it was a unanimous vote. We’re getting hockey.”

The decision was widely expected after the Seattle Hockey Partners group impressed the board’s executive committee in October and had all the ingredients the NHL was looking for. Strong ownership led by billionaire David Bonderman and producer Jerry Bruckheimer, a downtown arena in a sports-crazed city and a season-ticket drive that drummed up 10,000 orders in 12 minutes all cleared the way for the NHL to add another team less than three years after approving a franchise in Las Vegas.

The owners will pay a $650 million expansion fee, up from the $500 million the Vegas Golden Knights paid to join the league.

NBA-CLIPPERS-BEVERLY FINED

Clippers’ Beverly fined $25,000 for throwing ball at fan

UNDATED (AP) — Los Angeles Clippers guard Patrick Beverley has been fined $25,000 by the NBA for throwing a basketball at a fan during a game in Dallas.

The fine was handed down Tuesday by league discipline executive Kiki VanDeWeghe.

The incident occurred with 9:10 remaining in the fourth quarter of the Clippers’ 114-110 loss to the Mavericks on Sunday.

Beverley said after the game that the fan uttered an expletive about his mother.

— One of two men serving a life sentence for the 1993 murder of Michael Jordan’s father is slated to begin his latest bid to convince a court that he didn’t do it. A Wednesday hearing in North Carolina will consider the argument by Daniel Green that he helped dump James Jordan’s body but didn’t kill him. Green was convicted of first-degree murder, and two state courts upheld the conviction.

— The Memphis Grizzlies have signed 33-year-old forward Joakim Noah, a former All-Star attempting a comeback. The team has signed the 6-foot-11 Noah for the remainder of the season. Noah made consecutive All-Star appearances in 2013 and 2014. But he hasn’t been much of a factor in recent years as injuries curtailed his production.

 

NFL-REDSKINS QBs

Gruden says Redskins ‘discussed’ Kaepernick

WASHINGTON (AP) — Washington Redskins coach Jay Gruden says the team “talked about and discussed” bringing in quarterback Colin Kaepernick (KAP’-ur-nihk) for a tryout “but we will probably go in a different direction.”

Gruden told reporters during a conference call Tuesday that would there have been “a greater possibility” of considering Kaepernick if the Redskins were in need of a QB in Week 1 rather than at this stage of the season now.

Washington lost Colt McCoy to a broken right leg in a 28-13 loss at the Philadelphia Eagles on Monday night that dropped the Redskins’ record to 6-6. McCoy had replaced Alex Smith as the starting quarterback after Smith broke his right leg last month.

Kaepernick hasn’t played since the 2016 season, when he began kneeling during the national anthem as a way to protest police brutality and social and racial injustice.

— Former NFL cornerback Brandon Browner has been sentenced to eight years in prison for trying to kill his ex-girlfriend after breaking into her Southern California home. Prosecutors in Los Angeles say Browner was sentenced Tuesday after pleading no contest to attempted. Browner won Super Bowls with the Seattle Seahawks and New England Patriots.

—The Pittsburgh Steelers are looking into an altercation in the stands involving a female fan during Sunday night’s game against the Los Angeles Chargers. Photos published by the Pittsburgh Current and video presented to KDKA-TV showed two men arguing. A woman who is seen intervening was briefly grabbed by the throat by one of the men.

—The NFL has placed official Roy Ellison on administrative leave while it investigates an accusation that he called Bills defensive end Jerry Hughes a vulgar name during Buffalo’s game at Miami on Sunday. Hughes confronted Ellison in the tunnel near the locker room following Buffalo’s 21-17 loss, and video of the incident shows him accusing the umpire of using a derogatory term.

— San Francisco 49ers long snapper Kyle Nelson has been suspended 10 games for violating the league’s policy on performance-enhancing substances. Nelson will miss the final four games of this season and the first six in 2019 under the suspension.

UNDATED (AP) — A person familiar with the deal says All-Star pitcher Patrick Corbin has agreed to a six-year contract with the Washington Nationals, pending a physical exam.

The person confirmed the length of the agreement to The Associated Press on condition of anonymity on Tuesday because nothing had been announced by the team.

The left-handed Corbin, who left the Arizona Diamondbacks, joins a Nationals starting rotation that already includes three-time Cy Young Award winner Max Scherzer and Stephen Strasburg.

The 29-year-old Corbin is coming off his best season in the majors, going 11-7 with a 3.15 ERA while pitching 200 innings for the second time in his career..

—The Detroit Tigers and left-hander Matt Moore have agreed to a one-year contract. Detroit announced the move Tuesday, adding a 29-year-old pitcher with a chance to compete for a spot in the rotation in 2019. Moore was 3-8 last season with a 6.79 ERA.

— The Texas Rangers have filled out new manager Chris Woodward’s staff with two more assistant coaches. Texas has hired Oscar Marin as bullpen coach and Callix Crabbe as assistant hitting coach.

Ohio State coach Meyer to retire after Rose Bowl

COLUMBUS, Ohio (AP) — Ohio State coach Urban Meyer says it was a series of factors that led to his decision to step down.

He announced Tuesday that he will be retiring after the Rose Bowl on January 1. Co-offensive coordinator Ryan Day will become the team’s 25th head coach after that game.

Meyer says his headaches have become a persistent problem. He also says he is not sure he is able to coach at the intense, demanding level he has used for more than 30 years.

Meyer was suspended for three games at the start of this season for his role in handling domestic violence allegations against a now-fired assistant coach. He says the investigation of him also played a role in his decision.

Meyer was 81-9 with a national championship at Ohio State after six years at Florida, where he won two national titles.

APNewsBreak: President Donald Trump to attend Army-Navy game

WASHINGTON (AP) — President Donald Trump will attend Saturday’s Army-Navy Game in Philadelphia.

The White House confirmed Trump’s attendance to The Associated Press on Tuesday. Trump also went to the 2016 game when he was president-elect.

Trump will be the 10th sitting president to attend Army-Navy, a tradition that began with Theodore Roosevelt in 1901. Barack Obama was the most recent president to attend the game, in 2011 at FedEx Field in Landover, Maryland.

Navy athletic director Chet Gladchuk said at the annual pregame luncheon in Philadelphia last week that that school is always prepared for the president to attend.

The 108th football meeting between Army and Navy will be the 20th game attended by a president. The Commander-in-Chief traditionally switches sides of the field at halftime.

UNDATED (AP) —  Jason Zucker broke a tie late in the second period and the Minnesota Wild scored on all three of their power plays, beating the staggering Vancouver Canucks 3-2 to stop a three-game slide. Ryan Suter and Zach Parise also scored for Minnesota.

Having already missed 14 games with a shoulder injury, Toronto Maple Leafs forward Auston Matthews wasn’t going to let a little fatigue prevent him from jumping into the play for one last rush.

Rather than go to the bench with Kasperi Kapanen flying up the left wing, Matthews drove down the middle, received his teammate’s pass and snapped a shot over Buffalo Sabres goalie Linus Ullmark’s left shoulder to seal Toronto’s 4-3 win with three seconds on the clock in overtime Tuesday night.

 

Patric Hornqvist’s natural hat trick in the third period powered the Pittsburgh Penguins past the Colorado Avalanche 6-3 on Tuesday night.

The Avalanche had erased a three-goal deficit to tie the game going into the third when Hornqvist went to work.

His power-play goal 6:11 into the final period gave the Penguins the lead. Hornqvist beat Semyon Varlamov again just 1:21 later to push Pittsburgh’s advantage to two, and the veteran from Sweden completed the hat trick on his next shift when he fired a wrist shot by Varlamov less than 90 seconds later.

Jake Guentzel, Evgeni Malkin and Derick Brassard also scored for the Penguins, who halted Colorado’s 11-game point streak. Kris Letang added two assists for Pittsburgh. Casey DeSmith finished with 42 saves.

— Nate Schmidt scored twice in the final two minutes to lift the Vegas Golden Knights over the Washington Capitals 5-3. It was the first time Washington skated at T-Mobile Arena since winning and hoisting Stanley Cup in June. Schmidt burst through the neutral zone and beat goalie Braden Holtby with a tiebreaking wrist shot with 1:24 left for his first goal of the season. The former Capital added an empty-netter moments later.

— Nick Schmaltz had a power-play goal, Adin Hill made 25 saves for his fourth straight win and the Arizona Coyotes beat the Los Angeles Kings 2-1. Lawson Crouse scored a short-handed goal for the Coyotes, undefeated since acquiring Schmaltz in a trade with Chicago on Nov. 25.

 

— Max Domi had two goals and an assist and Jonathan Drouin added a goal and two assists as the Montreal Canadiens defeated the Ottawa Senators 5-2 Tuesday night. Artturi Lehkonen and Brendan Gallagher also scored for the Canadiens, who entered the game with one win in their last seven. Carey Price stopped 28 shots.

— Nikita Kucherov and defenseman Victor Hedman scored in a shootout to give the Tampa Bay Lightning a 6-5 comeback victory over the Detroit Red Wings. The Lightning, who have won seven of eight, erased a 5-3 deficit in the third period and overcame Frans Nielsen’s hat trick.

—Johnny Gaudreau had two goals and two assists, and the Calgary Flames scored five goals in the second period to rally past the Columbus Blue Jackets 9-6. Cam Atkinson netted a hat trick for Columbus to extend his point streak to 11 games, but the Blue Jackets lost their second straight.

— Jacob Trouba and Adam Lowry scored 22 seconds apart early in the third period, rallying the Winnipeg Jets to a 3-1 victory over the New York Islanders. Nikolaj Ehlers added an empty-net goal with 2.1 seconds left and Connor Hellebuyck (HEHL’-eh-buhk) stopped 27 shots as Winnipeg won for the fifth time in six games.

— Roberto Luongo earned his 77th career shutout and the Florida Panthers beat the Boston Bruins 5-0 on Tuesday night. Gymnastics federation creates $2M project to fight sex abuse

BAKU, Azerbaijan (AP) — The International Gymnastics Federation has approved a $2 million project to safeguard athletes after an American sex abuse scandal.

The sport’s governing body says the Gymnastics Ethics Foundation will have a help desk for athletes, judicial panels to prosecute and judge cases, and a compliance section to monitor good governance.

FIG acted in response to “abuse cases in the United States which so shocked the world of gymnastics.”

Hundreds of girls and women, including many Olympians, said they were molested by Larry Nassar, a former USA Gymnastics doctor. He was jailed after pleading guilty to sexual assault and possessing child pornography.

WASHINGTON (AP) — The public viewing for late former President George H.W. Bush at the Capitol Rotunda has drawn to a close. A funeral service at Washington National Cathedral on Wednesday will cap three days of remembrance by dignitaries and ordinary citizens as they honor Bush, who died in Houston last week at age 94. Bush’s remains will be returned to Houston to lie in repose before burial Thursday at his family plot on the presidential library grounds at Texas A&M University in College Station.
WASHINGTON (AP) — Current and former occupants of the Oval Office are coming together to honor a late member of their exclusive fraternity: the presidents club. Wednesday’s state funeral for George H.W. Bush will be attended by ex-Presidents Barack Obama, George W. Bush, Bill Clinton and Jimmy Carter and by President Donald Trump. The last time they were together was at Trump’s inauguration in 2017.

 

WASHINGTON (AP) — President Donald Trump’s former national security adviser will probably not be sentenced to prison because has cooperated with the special counsel’s Russia investigation. Special counsel Robert Mueller says Michael Flynn cooperated with his probe into Russia meddling in the 2016 election and contacts with the Trump campaign. Mueller recommended that Flynn not serve time in prison on his guilty plea to lying to the FBI about his conversations with the Russia ambassador.

 

MADISON, Wis. (AP) — The Republican-controlled Wisconsin Legislature has approved a sweeping package of bills weakening the incoming Democratic governor and attorney general. The state Assembly approved the lame-duck legislation Wednesday morning. The Wisconsin Senate did the same less than three hours earlier after lawmakers worked through most of the night. The bills now go to outgoing Republican Gov. Scott Walker, who has signaled his support.BEIJING (AP) — President Donald Trump is expressing optimism that China will to push forward with a cease fire on trade as tensions between Washington and Beijing escalates. WASHINGTON (AP) — President Donald Trump is signaling caution on his trade truce with China, saying his team is working to see whether a “REAL deal” is doable and stressing “I am a Tariff Man.” Trump tweeted Tuesday that the negotiations with China have begun. He said the talks will end in 90 days, “unless extended,” suggesting there is flexibility to that deadline.

 

WASHINGTON (AP) — The special counsel in the Russia investigation is set to give the first public insight into how much information President Donald Trump’s former national security adviser has shared with prosecutors. Robert Mueller’s team is facing a Tuesday court deadline to file a memorandum recommending a sentence for retired U.S. Army Lt. Gen. Michael Flynn. Flynn pleaded guilty last year to lying to the FBI about his contacts with Russia in the weeks before Trump took office.
