FARGO, N.D. (AP) — The lead defense attorney in the 2006 kidnapping and murder trial of Alfonso Rodriguez Jr. is among those who’ve been ordered to testify at next week’s hearing in Fargo.
KFGO reports attorney Richard Ney has been subpoenaed by federal public defenders who are appealing Rodriguez’s death sentence.
Rodriguez is on death row for the 2003 kidnapping and murder of University of North Dakota student Dru Sjodin (shuh-DEEN’). Rodriguez’s attorneys are trying to prove that he’s not mentally competent to be put to death.
Court documents say Ney is expected to testify when the hearing begins Jan. 28 in federal court. A federal judge ruled last month that despite objections from prosecutors, a psychologist and a medical toxicologist will also testify at the hearing.
BISMARCK, N.D. (AP) — A female Beulah High School teacher is accused of sending nude photos of herself to a 17-year-old male student via social media.
The Bismarck Tribune reports that 22-year-old Kelsie Schmidt faces a felony luring charge. Defense attorney Tom Dickson calls it “a very unfortunate situation for everyone.”
School Superintendent Travis Jordan says the first-year teacher has been placed on administrative leave, and that the school district is conducting its own investigation.
Schmidt’s attorney, Tom Dickson, calls it “a very unfortunate situation for everyone.” Dickson says, “certainly it’s a very serious allegation and we are treating it very seriously.”
Schmidt is due in court Feb. 27 for a preliminary hearing. She faces up to five years in prison if convicted.
MINOT, N.D. (AP) — A Lansford man has been sentenced to nine months in jail for punching his girlfriend’s 11-month-old daughter in the head.
Thirty-year-old Derrick McLean pleaded guilty to felony child abuse in district court in Minot.
Judge Stacy Louser ordered McLean to have no contact with the child or her mother, to complete anger management classes, get a psychological exam and pay $1,350 in court costs.
The Minot Daily News reports McLean had been babysitting for the child while her mother was at work in January 2018. The woman took her daughter to the hospital after she returned and found bruising on the girl’s face. McLean later admitted he had punched the toddler because she wouldn’t stop crying.
BISMARCK, N.D. (AP) — The North Dakota Industrial Commission is reducing the number of required vapor pressure tests that are aimed at making crude oil safer for transportation.
The commission will mandate that companies submit vapor-pressure tests twice a year instead of quarterly, prioritizing winter months when issues are more likely to occur, the Bismarck Tribune reported.
The state requires companies to remove the most volatile gases from crude oil and test the vapor pressure to ensure it doesn’t exceed 13.7 pounds per square inch.
Lynn Helms, a Department of Mineral Resources director, said the industry has conducted more than 60,000 vapor pressure tests and about one in 1,000 tests exceeded the state’s limit since the guidelines took effect in 2005.
The new regulations will require one vapor test between Oct. 1 and Dec. 31 and a second between Jan. 1 and March 31.
BISMARCK, N.D. (AP) — A North Dakota judge has upheld a state permit allowing construction to begin on an oil refinery near Theodore Roosevelt National Park, upsetting environmental groups hoping to stop the project.
Judge Dann Greenwood ruled that the state Health Department has effectively supported its position that the $800 million Davis Refinery will not be a major source of pollution that will negatively impact the park just 3 miles (5 kilometers) away.
The agency’s “expertise is entitled to deference when, as here, the subject matter is complex,” Greenwood wrote in a ruling dated Wednesday.

UNDATED (AP) — The head of the baseball players’ association expressed concern over a second straight offseason that has seen Bryce Harper, Manny Machado and many other free agents remain without deals less than a month before spring training.
Wanting to increase the pace of games and concerned about a drop in offense, management has made proposals to the union that include a pitch clock and rules changes. The players’ association says it will respond, and unlike last year the union appears open to discuss the issues.

NCAA’s Emmert expresses concern over wagering, esports
UNDATED (AP) — NCAA President Mark Emmert told his group’s annual convention that it must stick to what he calls “values-based bold leadership” when dealing with issues such as improving diversity in college sports, the legalization of sports wagering and the addition of esports as an offering at many schools.
Emmert, speaking Thursday in Orlando, Florida, says he isn’t sure what the best course of action is for the NCAA when it comes to esports. Earlier this week, Marquette announced that it would become the first major-conference school to offer esports as a varsity team starting in the fall semester.
Emmert also says sports betting is “going to threaten the integrity of college sports” unless the NCAA acts “boldly and strongly.”
