BISMARCK, N.D. (AP) — North Dakota’s first medical marijuana dispensary is set to open next week, the culmination of a nearly two-year effort by the state Health Department to establish a distribution system for the drug.

New York City-based Acreage Holdings plans to open The Botanist in Fargo on Feb. 28, selling drugs produced by a manufacturing facility in Bismarck, the company and state announced Thursday. The dispensary first will need to undergo what amounts to a final state inspection to ensure it meets all security rules, according to state Medical Marijuana Division Director Jason Wahl.

The facility also will offer an educational station, according to Harris Damashek, chief marketing officer for Acreage Holdings, which has operating licenses in 19 states and dispensaries in Maryland, Massachusetts, New York and Ohio.

North Dakota voters approved the drug in November 2016. The Health Department has been working on the system since lawmakers crafted rules in early 2017 allowing the use of medical marijuana for 17 medical conditions, along with terminal illnesses. A bill passed by the state House on Monday and sent to the Senate would expand the list of legal conditions to 30.

The state began accepting applications in October from residents for medical marijuana cards and has been issuing them for about a month. Only about 120 have been approved so far, but the state expects as many as 4,000 residents will legally be using the drug by summer 2021. That’s based on the experience in Delaware, which North Dakota officials have cited as a model.

The state hopes to have dispensaries operating in its eight major cities by fall. It already has named operators for facilities in Fargo, Grand Forks, Bismarck and Williston. Applications for dispensaries in Devils Lake, Dickinson, Jamestown and Minot are being accepted through Tuesday.

BISMARCK, N.D. (AP) — A North Dakota man has been sentenced to time served and a year of supervised release for stealing a forklift that he planned to use to attack President Donald Trump’s limousine during a visit to a refinery in 2017.

Forty-two-year-old Gregory Leingang is already serving time for unrelated offenses at the North Dakota State Penitentiary. He pleaded guilty in federal court to entering the presidential motorcade route in Mandan prior to Trump’s arrival at the Andeavor Mandan Refinery on Sept. 6, 2017.

The forklift got stuck in a gated area and Leingang fled on foot. Prosecutors say Leingang planned to harm the president by flipping the limo with the forklift.

The Bismarck Tribune reports Leingang’s attorney Michelle Monteiro says he was suffering “a serious psychiatric crisis” during the incident.

BILLINGS, Mont. (AP) — A former Montana high school trainer already facing charges he sexually abused students over decades also pretended he was a teenager to meet underage boys online and abused students on trips to North Dakota and California, prosecutors said in new court documents.

The latest accusations against James Jensen were disclosed ahead of a scheduled hearing where he was expected to change his plea on charges of coercion and enticement.

On Thursday afternoon, U.S. Magistrate Judge Timothy Cavan delayed the hearing originally set for Friday until March 4 after Jensen’s public defender asked for more time because of the new documents.

Jensen, 78, earlier this month requested to change his not guilty plea to guilty in U.S. District Court in Billings. But U.S. Magistrate Judge Timothy Cavan told prosecutors that he wanted a better explanation about their case against the former trainer.

Assistant U.S. attorneys Zeno Baucus and Bryan Dake filed their response Wednesday in which they described instances when Jensen crossed state lines, used the internet or otherwise engaged in interstate commerce. That’s an element that must be proven in a federal case to convict a person of enticing or coercing a minor to engage in sexual activity.

FARGO, N.D. (AP) — The National Weather Service says the threat of significant spring flooding in the Red River Valley of North Dakota and Minnesota has increased, though current estimates show manageable levels for cities along the river. The weather service said in a report released Thursday that substantial snowpack in late January and February means that “widespread, above normal” runoff is now likely, with ultimate levels likely to depend on the rate of runoff and precipitation in March. In the James River Basin, the Weather Service says there’s more snow south of Jamestown, than north of Jamestown, and indicates that the Jamestown and Pipestem Reservoir are at or below conservation levels.South of Jamestown there’s more snow on the ground, that may lead to overland flooding. The forecast shows a 50 percent chance the river will reach 31 feet in the Fargo and Moorhead, Minnesota area, which would only shut down a couple of roads. Flood stage in Fargo-Moorhead is 18 feet.Fargo-Moorhead residents fought several major floods early in the last decade but have avoided serious threats for several years.

BISMARCK, N.D. (AP) — The North Dakota Legislature has finished work on bills in its respective chambers and lawmakers have left the Capitol. When the session resumes, lawmakers will be faced with hundreds more measures in what’s known as “crossover.” Measures under consideration include those on ethics, infrastructure funding, income tax, abortion and Sunday shopping restrictions.

OMAHA, Neb. (AP) — A monthly survey of rural bankers in parts of 10 Plains and Western states shows nearly two-thirds of banks in the region have raised farm loan collateral requirements on fears of weakening farm income. The Rural Mainstreet survey for February showed nearly one-third of banks report an increase in the farm loan rejection rate for the same reason. The survey’s overall index dropped to 50.2 from January’s 51.5. Any score above 50 suggests a growing economy in the months ahead, while a score below 50 indicates a shrinking economy.Creighton University economist Ernie Goss, who oversees the survey, says the rural economy appears to be expanding outside of agriculture, but that tariffs and low agriculture commodity prices continue to weaken the farm sector.Bankers from Colorado, Illinois, Iowa, Kansas, Minnesota, Missouri, Nebraska, North Dakota, South Dakota and Wyoming were surveyed.

BISMARCK, N.D. (AP) — Online sales tax collections in North Dakota have totaled more than $5 million since last fall. The U.S. Supreme Court ruled last June that states can force online shoppers to pay sales tax. North Dakota began collecting from remote sellers last October. State Tax Commissioner Ryan Rauschenberger (RAW’-shuhn-bur-gur) says his office has registered more than 2,500 remote sellers. The state expects online sales tax collections to total $25 million in the 2019-2021 budget period.
