Omaha  –   (USACE)  – The U.S. Army Corps of Engineers reports that inflows to Jamestown Reservoir, due to snowmelt, have remained higher than expected. As a result, reservoir water releases have increased to 600 cubic-feet-per-second on Monday April 22, 2019, in order to evacuate flood storage with the goal of meeting the June 1 target evacuation date.

Pipestem Reservoir is currently at a pool elevation 1467.9 feet which is approximately 30% of the reservoir’s capacity.  The release prior to Monday was 10 cfs.  Pipestem Dam continues to rise as it stores snowmelt runoff.  Ice is out at the reservoir as of Monday afternoon, and releases were being shut down to 0 cfs  on Mondayday.  The combined release will be 600 cfs after the releases are shut to 0 at Pipestem.

The Corps of Engineers does not expect combined releases to exceed 750 cfs.

Jamestown  (Valley News Live)A Jamestown mother says her son with autism was hit on the head by his bus driver. She claims she didn’t hear about it until the end of the school day.

Now, she wants something done to change within the district.

She reached out to Valley News Live’s Whistleblower Hotline.

Washington Elementary School student, Kyler Smith says, he was hit on the back of the head, on the way to school one morning.

Amber Smith tells the T.V. station that her son  Kyler was riding the school bus to Washington Elementary.

She says two kids decided to change seats on the bus. But that’s when Smith says the driver mistook her son, who she claims wasn’t doing anything, for one of the kids changing seats.

Amber says “The bus driver smacked my son in the back of the head pretty hard,” says Jamestown Mother.

She says, she didn’t hear anything from the school, adding that  she found out about it through her daughter when her kids got home.

That prompted the school district and the bus company, Dietrich, to investigate. First, the driver was suspended. Then shortly after, the bus driver as they put it, was let go.

There’s  a new a bus driver now on his route.

She says school Superintendent  Robert Lech apologized to her and she’s grateful for that. But now she says if something like this ever happens again to her child, she wants to know.

An official with the Jamestown Police Department tells KVLY that  they investigated the incident and it’s now been passed over to the State’s Attorney office. They’ll review if any charges are necessary.

 

Jamestown  (CSi)  The Jamestown City Fire Department responded to a grass fire at the railroad tracks adjacent to Hillcrest Golf Course Friday

Lt.  Sheldon Mohr, says the fire burned less than 10 acres and could have been started by a spark from a passing train.

Then the fire rekindled Saturday as railroad ties reignited.

15 city firefighters were on the scene for two hours on Friday and then one hour on Saturday.

The Jamestown Rural Fire Department responded to a grass fire Monday south on Highway 281.

Jamestown  (CSi)  Jamestown Public Works informs residents that beginningMonday, April 29, 2019, City Sanitation crews will resume trash collection in the alleyways. Recycle North Dakota crews will also resume recycling collection in the alleyways.
Place carts so arrows face the alley for automated collection.

All materials must be INSIDE the cart for automated lifting into the truck. Any materials on top or next to the cart WILL NOT be collected.
Carts should be placed out for pick up by 7:00 a.m. Trucks WILL NOT return to the area due to missed garbage placed out after the scheduled garbage route has been completed.

 

DEVILS LAKE, N.D. (AP) — Sheriff’s officials have identified the man who drowned while fishing on a Benson County lake this past weekend.

Authorities say 52-year-old Jim Kirkeide, of Fessenden, was fishing with two other men when their airboat began to take on water in Pelican Lake north of Devils Lake Saturday. The two other men, from Langdon, made it to shore.

Benson County Sheriff Steve Rohrer says life jackets were in the boat but the men didn’t have time to put them on. KFGO reports it has not been determined what caused the boat to take on water. The sheriff says much of the lake still has ice on it.

 

BISMARCK, N.D. (AP) — Legislation to comply with a voter-approved constitutional amendment aimed at ethics reform appears no closer to a resolution in the waning days of the Legislature than when the session began in January.

Monday was the Legislature’s 72nd day in a session capped at 80.

Legislators are considering competing Republican and Democratic bills on how to comply with voters’ wishes for government ethics oversight.

The GOP House bill is embroiled in conference committee negotiations. The Democratic Senate bill is awaiting action in the House.

Democratic Sen. Erin Oban says the GOP bill appears to be a “done deal” in the Legislature.

Republican Rep. Jim Kasper says “nothing is a done deal” in the Legislature.

Backers of the citizen initiative have signaled a lawsuit if the GOP bill becomes law.

 

BISMARCK, N.D. (AP) — Legislation to commit public money for a Theodore Roosevelt presidential library in western North Dakota has hit a snag.

Some lawmakers want use $50 million from the state treasury and loans to help fund some costs of the proposed library in Medora that has been a top priority with Gov. Doug Burgum.

The amendment is in the governor’s budget.

House negotiators also inserted language in the bill that would force Burgum to take a salary. Senators voted against the amendment and House negotiators walked out in protest.

None of the lawmakers would comment.

Burgum ran on a campaign promise to forgo his salary. He did not take any salary during the current two-year budget cycle.

 

 

MANDAN, N.D. (AP) — The owners of a Mandan bar say they’re prepared to take legal action to fight the city’s demands that they paint over their Western-themed mural.

The Bismarck Tribune reports that the Mandan City Commission ordered the Lonesome Dove last month to remove its mural of a rearing horseman against brown hills at sunset. City officials argue that the business doesn’t have a permit for the outdoor artwork.

The bar first received a citation for the mural in October.

Co-owner Brian Berube says the owners didn’t apply for a permit because they weren’t aware of the requirement.

The bar’s owners are working with a libertarian legal group, the Institute for Justice, to defend the mural.

Berube says he hopes to avoid a lawsuit, but he refuses to paint over the art.

 

BISMARCK, N.D. (AP) — North Dakota’s Legislature has passed a bill that establishes occupational license reciprocity for military spouses.

The House passed the measure unanimously on Monday. It now heads to Gov. Doug Burgum for his signature.

The bill would allow military spouses who are licensed in a field in another state to get a similar license in North Dakota.

North Dakota is home to some 7,000 active duty airmen at Air Force bases in Minot and Grand Forks. Another 4,000 North Dakotans serve in the National Guard and Air Guard.

 

 

 

PORTLAND, Ore. (AP) — The remains of a World War II soldier who went missing in final weeks of the Guadalcanal campaign have been identified 76 years after he was listed as missing in action.

The Department of Defense says skeletal remains found in a bag recovered two years ago in the South Pacific are those of Pfc. Dale W. Ross, whose surviving family lives in Ashland, Oregon.

The remains and the dog tags were found by an 8-year-old boy in the jungle and his family gave them to a visiting American tourist, asking her to help find the soldier’s surviving family.

The woman, Donna Esposito, found Ross’ nephew and niece and the family gave the bones to the military for analysis.

The trio traveled to the Solomon Islands in 2017.

 

In sports…

VALLEY CITY  (VCSU)  – Valley City State University scored eight runs in the sixth inning Monday, breaking open a back-and-forth game en route to a 14-7 non-conference victory against Presentation College.

Christian Peery‘s second home run of the day capped the big sixth inning – putting the Vikings ahead 13-7 – and Aaron Schuster pitched three shutout innings to close out the win.

Valley City State improves to 16-18 overall. Presentation College drops to 18-20 overall. The two teams will meet on the field again this weekend for a four-game conference series. Saturday’s doubleheader is currently scheduled for 1 p.m. in Aberdeen, S.D. Sunday’s doubleheader is scheduled for 1 p.m. in Valley City. The two teams are currently third and fourth in the NSAA standings. If they remain in those positions, they will also face each other in the first round of the NSAA Tournament starting May 3 in Valley City.

On Monday, Valley City State struck first in the bottom of the second inning. Aiden Brook and Jorun Hamre opened the inning with back-to-back singles, and then Brook came in to score when Nate Soulis grounded into a double play. The Vikings loaded the bases with one out in the third inning, and Jorun Hamre pushed across a run with a sacrifice fly to make it 2-0 in favor of the Vikings. In the fourth inning, Peery pulled a pitch over the right field fence for his first home run and a 3-0 lead.

The Saints broke through in the top of the fifth, tying the game with back-to-back two-out hits. Kyle Angielski’s RBI double scored Jesse Spangler to make it 3-1, and then Zane Hunt hit a two-run single to tie the game at 3-3.

Valley City State struck back in the fifth inning, loading the bases with no outs on a leadoff single by Austin Smith and back-to-back walks. The Saints limited the damage with a double play, but Smith crossed the plate to put the Vikings back ahead 4-3, and Grant Wehseler later came in on a throwing error to make it 5-3.

The Saints took their first lead of the game in the sixth inning when Johnny Radomskiy crushed a three-run home run over the center-field fence, putting the Saints ahead 6-5. Kyle Angielski delivered a two-out RBI single later in the inning, pushing the lead to 7-5.

Valley City State answered back in a big way with eight runs in the bottom of the inning. Grant Wehseler was hit by a pitch with the bases loaded, and then Brady Smith doubled down the left-field line to score two more runs and put VCSU back ahead 8-7. The Vikings would tack on five more runs in the inning, including a two-out RBI double by Nate Soulis and Christian Peery‘s second home run – a two-run shot. When the dust cleared, Valley City State held a 13-7 lead.

Aaron Schuster took the mound for VCSU to start the seventh inning and was lights out the rest of the way. The senior gave up just one hit and no runs as he earned a three-inning save. Jacob Miller started on the mound for VCSU and went three scoreless innings. The junior right-hander gave up only one hit, walked three and struck out four. The Vikings used five different pitchers in the game. Brady Engebretson earned his third win in eight days after he closed out the top of the sixth and was the beneficiary of VCSU’s eight-run outburst in the bottom of the inning.

Peery had a big game at the plate, finishing 3-for-5 with his two home runs and three RBIs. Austin Smith and Grant Wehseler each had a pair of hits, while Brady Smith, Aiden Brook and Jorun Hamre all drove in two runs.

Up next: Valley City State travels to Mayville State for a mid-week conference doubleheader on Wednesday. First pitch is scheduled for 2 p.m. in Mayville.

Blake Griffin had 22 points before fouling out with 7:06 remaining.Next up for the Bucks are the Celtics, who completed a four-game sweep of Indiana on Sunday.The Jazz have forced a fifth game in their first-round series. Donovan Mitchell scored 19 of his 31 points in the fourth quarter to rally Utah to a 107-91 victory over the Rockets. PHOENIX (AP) — The Phoenix Suns have fired coach Igor Kokoskov after one season.

The longtime NBA assistant was the first European-born head coach in league history when Phoenix hired him to replace interim coach Jay Triano last year. The Suns finished 19-63 despite adding No. 1 overall NBA draft pick Deandre Ayton to their roster.

Kings new coach accused of sexual assault in suit

SACRAMENTO, Calif. (AP) — A female sports reporter has filed a lawsuit accusing new Sacramento Kings coach Luke Walton of sexual assault.

Kelli Tennant is suing Walton over an incident that allegedly took place in 2016 during his time as an assistant coach for the Golden State Warriors. Tennant claims she went to Walton’s hotel room to discuss a book she was writing when Walton pinned her to the bed, forcibly kissed her and groped her.

She said Walton continued to harass her after he became coach of the Lakers and she was working as a broadcaster in Los Angeles for Spectrum SportsNet and SportsNet LA.

TMZ first reported the lawsuit.

Stars, advance, Hurricanes earn a Game 7

UNDATED (AP) — The Dallas Stars have advanced to the second round of the Stanley Cup playoffs by winning in overtime.

John Klingberg scored from the left circle 17:02 into overtime to complete the Stars’ 2-1 victory in Game 6 against the Nashville Predators. Klingberg’s first goal of the playoffs came on a cross-ice pass from Alexander Radulov (RAD’-yoo-lahv).

Blake Comeau (KOH’-moh) scored his first playoff goal for the Stars, tying the game at 1-1 in the second period.

Vezina (VEH’-zih-nuh) Trophy finalist Ben Bishop had a playoff career-high 47 saves for the Stars and blanked the Predators following Austin Watson’s goal 5:47 into the game.

Predators netminder Pekka Rinne (PEH’-kuh REE’-nay) also set a playoff career best by stopping 49 shots.

The Stars now prepare to face the Blues, who will have home-ice advantage in the series.

Meanwhile, the Carolina Hurricanes have earned a return trip to Washington by forcing a seventh game in their first-round series with the Capitals.

Jordan Staal snapped a 2-2 tie in the third period before adding an assist in the Hurricanes’ 5-2 victory over the defending Stanley Cup champs. Staal set up former Cap Justin Williams, who beat Braden Holtby to make it 4-2 just seconds after Washington had a goal disallowed due to goaltender interference.

Alex Ovechkin’s first-period goal put the Capitals ahead 2-1, but he killed his team’s shot at tying the game by running into netminder Petr Mrazek (muh-RA’-zehk) while Evgeny Kuznetsov (kooz-NEHT’-sahf) was scoring.

Mrazek finished with 23 saves for the Hurricanes, who visit the Capitals on Wednesday.

The home team has won each game of the series.

— The Twins won their fourth in a row as Jorge Polanco went 4-for-5 with a two-run homer and four RBIs in their 9-5 win over the Astros. Max Kepler and Nelson Cruz had RBI singles around Polanco’s two-run single in a four-run sixth as the Twins built a 7-1 lead. C.J. Cron put Minnesota ahead with a two-run double in the first, and Jason Castro led off the second with a home run to back Jake Odorizzi, who held Houston to two runs over 5 2/3 innings.

 

— Steven Matz atoned for a dismal start last week in Philadelphia by holding the Phillies to one run and three hits over six innings of the Mets’ 5-1 victory. Jeff McNeil hit a solo homer and Pete Alonso drove in two runs as New York won for the second time in six games. DeGrom slated to start Friday

UNDATED (AP) — Mets ace Jacob deGrom remains on track to start Friday night against Milwaukee after an MRI on his right elbow showed no damage.

The reigning National League Cy Young Award winner threw a 30-pitch bullpen session Monday after reporting soreness last week, an issue that caused the Mets to put him on the injured list while the team was in St. Louis. The move followed two shaky starts by deGrom, leaving him 2-2 with a 3.68 ERA.

 

In other MLB news:

— Gio González has been released from his minor league contract with the Yankees at his request. The 33-year-old Gonzalez agreed to the deal in mid-March and was 2-1 with a 6.00 ERA in three starts and 15 innings with Triple-A Scranton/Wilkes-Barre. He exercised his right Saturday to ask the Yankees to put him on the big league roster or release him within 48 hours.

— Red Sox right-hander Nathan Eovaldi (eh-VAHL’-dee) is scheduled to have surgery Tuesday to remove loose bodies from his pitching elbow, an operation expected to sideline the pitcher for four-to-six weeks. Eovaldi had similar surgery on March 30 last year while with Tampa Bay and made his season debut May 30.

— The Pirates have activated Gregory Polanco off the 10-day injured list after the right fielder completed a lengthy rehab from a dislocated left shoulder suffered last September. Polanco set career highs last season with 23 home runs and a .499 slugging averaging last season while hitting .254 with 81 RBIs.

— Cardinals right-hander Michael Wacha (WAH’-kah) was placed on the 10-day injured list because of patellar tendinitis in his left knee. Wacha is 1-0 with a 4.64 ERA in four starts this season. He beat Milwaukee 6-3 last week, allowing two runs in six innings.

Backup offensive lineman signs tender to stay with Colts

INDIANAPOLIS (AP) — Offensive lineman Evan Boehm has signed a one-year tender to play for the Colts next season. The 6-foot-6, 310-pound interior lineman made four starts and played in 11 games with Indianapolis last season. He became a restricted free agent in March and is the 11th free agent re-signed by the Colts.

In other NFL moves:

— Safety J.J. Wilcox has signed a one-year deal with the Falcons after playing combined seven games with the Jets and Colts in 2018. The 28-year-old Wilcox started 35 games in four seasons with the Cowboys.

— Nearly three dozen men and women have filed a federal class-action lawsuit against Florida authorities alleging they unlawfully videotaped them as they received legal massages at a parlor where Patriots owner Robert Kraft allegedly paid for sex. The lawsuit alleges that prosecutors and the Jupiter Police Department violated their rights to privacy when they were videotaped receiving massages in January at the Orchids of Asia Day Spa.

Georgia Tech center James Banks declares for NBA draft

ATLANTA (AP) — Georgia Tech has confirmed that center James Banks is entering the NBA draft.

Banks led the ACC with 2.5 blocks a game while averaging 10.5 points and 7.7 rebounds. He was named to the ACC’s all-defensive team.

He has until May 29 to withdraw his name and remain eligible for his final season at Georgia Tech.

 

COLLEGE FOOTBALL-ALABAMA-SABAN

Saban has new hip

TUSCALOOSA, Ala. (AP) — Alabama coach Nick Saban has undergone hip replacement surgery.

His doctor says the 67-year-old Saban is expected to make a full recovery and “should be able to return to work in the very new future.” Saban said after Alabama’s spring game that his hip problems would be evaluated and that he could need six to eight weeks of recovery.

MANILA, Philippines (AP) — The U.S. Geological Survey says a magnitude 6.3 earthquake has hit the central Philippines, a day after 6.1 quake hit the country’s north and killed at least 11 people.

The new quake hit Tuesday afternoon and was centered 13 kilometers (8 miles) east of Tutubigan in the country’s central region. The quake was relatively deep at 70.2 kilometers (43 miles).

A supermarket crashed down in Monday’s powerful earthquake, which damaged buildings and an airport in the northern Philippines. The death toll is now 11, with more missing.

 

COLOMBO, Sri Lanka (AP) — The office of New Zealand’s prime minister says she is aware of comments linking Sri Lanka’s Easter bombings to the mosque attacks in Christchurch, though it hasn’t “seen any intelligence upon which such an assessment might be based.”

The statement came Tuesday after Sri Lanka’s minister of defense, Ruwan Wijewardene, made the claim to Parliament, without offering evidence.

New Zealand Prime Minister Jacinda Ardern’s office also added that it understood “the Sri Lankan investigation into the attack is in its early stages.”

The Christchurch shootings killed 50 people in March.

 

 

MANCHESTER, N.H. (AP) — South Bend, Indiana, Mayor Pete Buttigieg (BOO’-tuh-juhj) says Vermont Sen. Bernie Sanders and President Donald Trump are “stupendously different in very, very many respects” as he tried to smooth over an earlier comparison of the two politicians.

At a CNN town hall in New Hampshire on Monday night, Buttigieg noted that anti-establishment energy “can find its way in a number of very different political directions.”

He says recent history shows that voters aren’t just focused on “are you close to me on a left-right political spectrum.” Rather, he said, they want to know: “Are you really going to profoundly change the system that we’re living in?”

Sanders and Buttigieg are among the Democrats seeking the party’s nomination to take on Trump in the 2020 election.

 

WASHINGTON (AP) — A Nevada Democrat who accused Joe Biden of touching her without permission is lashing out at the former vice president for joking about the matter as he considers a 2020 presidential bid.

Lucy Flores tells Fox News that Biden has been “so incredibly disrespectful” since she published her recollections of a 2014 encounter.

Biden has joked about having permission to hug people after having promised he’d do a better job respecting personal boundaries.

Last month Flores accused Biden of touching her shoulders from behind and kissing the back of her head backstage at a political event. Biden has said he doesn’t recall that, and in a video promised to learn from criticisms about his displays of affection.

 

 

LONDON (AP) — An Irish Republican Army splinter group has admitted that one of its “volunteers” killed journalist Lyra McKee, who was shot dead while reporting on rioting in Londonderry.

In a statement issued Tuesday to the Irish News, the New IRA offered “full and sincere” apologies to McKee’s family and friends.

The group said the 29-year-old journalist was killed during Thursday night’s unrest “while standing beside enemy forces” — a reference to the police.

No one has been charged. Two teenagers arrested over the shooting were released without charge on Sunday.

The IRA and most other militant groups have disarmed since Northern Ireland’s 1998 peace accord. The New IRA has been formed from small splinter groups opposed to the peace process and has carried out sporadic bombings and shootings.

 

Chicago’s top prosecutor drew heavy criticism after she recused herself from the case against Jussie Smollett and then complained in text messages to a subordinate that her office had overcharged the “Empire” actor.

But anyone who has followed Kim Foxx’s work recognized in the texts the same reforms she’s tried for years to implement. Those changes include not overcharging for nonviolent crimes and offering alternatives to taking a suspect to court.

Anger about the decision has also resulted in threats of physical harm to the prosecutor. Chief of staff Jennifer Ballard Croft told the Chicago Sun-Times the threatening messages came in the form of emails and calls, with some containing “racially-charged language.”

Critically, dropping the charges could undermine Foxx’s efforts to overhaul the nation’s second-largest district attorney’s office. For decades, it has been seen as too aggressive and reliant on abusive police practices.
