BISMARCK, N.D. (AP) — The huge white tube between Washburn and Underwood that once carried coal over U.S. Highway 83 is coming down.

The Bismarck Tribune reports the tube that for decades served as a landmark along the road in central North Dakota is being removed Monday.

It’s part of a 3-mile conveyor that the Falkirk Mining Co. installed in 1992 to transport coal from its mining operations east of the highway to its handling facilities on the west side. The company last used the conveyor in 2001.

In the years since, Falkirk has relied on large trucks, which can each haul more than 200 tons of coal. The vehicles pass underneath the highway to Great River Energy’s Coal Creek Station. The power plant burns it to generate electricity.

NEW ORLEANS (AP) — A federal appeals court has upheld the constitutionality of a 1978 law giving preference to Native American families in foster care and adoption proceedings involving American Indian children.

Friday’s decision by a panel of the 5th U.S. Circuit Court of Appeal upholds the Indian Child Welfare Act and reverses a Texas-based federal judge. It comes in a case involving non-Indian families in multiple states who adopted or sought to adopt Native American children.

Opponents of the law called it an unconstitutional race-based intrusion on states’ powers to govern adoptions. But the 5th Circuit majority disagreed, saying the law’s definition of an “Indian child” is a political classification.

The decision was a victory for supporters of the law who say it’s needed to protect and preserve Native American culture and families.

Republican Kevin Cramer defeated Heitkamp last year in her bid for a second term in the Senate. Heitkamp has worked since her defeat as a political commentator. She’s also serving as co-chairwoman of a coalition advocating for Congress to pass a trade agreement with Canada and Mexico.

NEW YORK (AP) — France’s government wants prosecutors to open an investigation into Jeffrey Epstein’s links to France following his death in a Manhattan jail cell.

The secretaries of state for women’s rights and protecting children said in a statement Monday that it is “fundamental” to launch an investigation in France so that his death “doesn’t deprive the victims of the justice they deserve” and to protect other girls from “this kind of predator.”

U.S. authorities say Epstein had a residence in Paris and used a fake Austrian passport to travel to France in the 1980s. The French statement didn’t elaborate on other links to France.

The high-flying U.S. financier was accused of sexually abusing underage girls for years and charged with sex trafficking and conspiracy. He pleaded not guilty.

The Paris prosecutor’s office did not immediately comment.

NEW YORK (AP) — The apparent suicide of Jeffrey Epstein has brought new scrutiny to a chronically understaffed federal jail in New York.

The financier’s death Saturday is also the latest black eye for the U.S. Bureau of Prisons following last year’s fatal beating of Boston gangster James “Whitey” Bulger in federal custody.

The Metropolitan Correctional Center in Manhattan is so short-staffed that the BOP is offering correctional officers a $10,000 bonus to transfer there from other federal lockups.

For more than a decade, the union representing correctional officers has warned of what it describes as “unsound” and “dangerous” staffing levels at federal prisons.

Attorney General William Barr announced the FBI and the Justice Department’s inspector general will investigate Epstein’s death.

The 66-year-old Epstein had been jailed on federal sex trafficking charges.

HONG KONG (AP) — The chief executive of Hong Kong’s Cathay Pacific Airways says there will be “disciplinary consequences” for employees involved in “illegal protests,” as the airline joins a slate of businesses that have appeased and apologized to China in recent days over political flaps.

Rupert Hogg’s comments Monday came just hours before the Hong Kong airport announced it was shutting down after thousands of pro-democracy demonstrators occupied the main terminal.

Hogg warned in an internal memo to employees that the company has a “zero tolerance approach to illegal activities,” referring apparently to protests unapproved by the police force.

Companies from luxury fashion brands to bubble tea shops have been under pressure to distance themselves from protesters and declare their support for the ruling Communist Party’s position on Hong Kong.

NEW DELHI (AP) — An uneasy calm is prevailing in Indian-administered Kashmir as people celebrate a major Islamic festival during an unprecedented crackdown after India moved to strip the region of its constitutional autonomy and imposed an indefinite curfew.

All communications and the internet remained cut off for an eighth day Monday.

News reports say authorities will allow Eid al-Adha prayers at neighborhood mosques during the day but will not permit large congregations to avoid anti-India protests.

The security lockdown appeared aimed at avoiding a backlash in India’s only Muslim-majority region where most people oppose Indian rule. The restrictions had been briefly eased on Friday for residents to attend mosque prayers, and people also were allowed to shop for the Eid festival on Saturday and Sunday.
