Valley City  (Valley News Live) A Valley City woman’s Facebook posting has received over 159 reactions,  within a day, when she related that  she  is missing something special from her military garden.

Valley City locals say it’s not the only garden in the city  that’s been vandalized.

Valley News Live reported in an interview with Donna Lemer that she calls it her military garden: with its red, white and (at the right time of year) blue flowerssaing that it’s emptier these days.

She commented that, “I bought it in memory of my dad and in honor of my son.”

Lemer adds that the ‘military man’ statue stood in her garden in honor of her late father, a Vietnam army veteran, and her son, who served in the National Guard.

Lemer says “He just sat there with the two flags and by the road, so that as people drove by they knew that we supported our American veterans.”

She stated, “I was really surprised by the number of people who knew that little, tiny, round, beat-up garden even existed,  I think one person said, ‘I drive by there and look at him every time I go to bingo.”

Wimbledon  (CSi)  Film crews are at the Peggy Lee Museum, and the former Midland Continental Railroad depot, in Wimbledon, to shoot the pilot for Three Dog Films, new T.V. series called “Generation Hops,” a television pilot on the emergence of the Craft Beer Industry.

It will first appear on YouTube before being offered to Netflix, Amazon and HBO among other networks.

Producer/Director David Sabbath says, “You appreciate people like Peggy Lee. They were what was hot back in the day.”

Peggy Lee was Born in Jamestown, and she graduated from Wimbledon High School in 1937.

Her career spanned being  a musician over six decades, earning her a Grammy for the Lifetime Achievement Award.

In 1975 Peggy Lee received North Dakota’s the Theodore Roosevelt Rough Rider Award.  She passed away on January 21, 2002.

Fargo  (NDAAA)  — Gas prices for the Labor Day weekend are lining up to be about a quarter less than last year.

Monday, the average price for gasoline in North Dakota is $2.58 per gallon. The average is 21 cents less than Labor Day 2018 ($2.79), but 6 cents higher than Labor Day 2017 ($2.52). The average could fall a little more leading up to the holiday weekend, according to AAA.

Looking beyond Labor Day, prices are poised to continue to move lower due to several factors, including less expensive crude oil prices, the drop-off in gasoline demand after Labor Day and the move to winter-blend gasoline. AAA forecasts the North Dakota statewide average to drop to $2.40 or lower this fall.

Bismarck  (Sen. Cramer’s Office)  U.S. Senator Kevin Cramer (R-N.D.) Monday announced he will hold a “Coffee With Cramer” town hall in Jamestown on Friday, August 30.

Jamestown  (CSi)  The community is welcome as the Frontier Village Post Office will be hosting a stamp cancellation on Saturday August 31 from 2-p.m., to 6p.m., to include the date and post office location from where the stamps were mailed in addition to lines or bars designed to cover the stamp itself.

Frontier Village Board President Nicole Moslof has established a physical address for a mailbox there.

Frontier Village spokesperson, Tina Busche says they’ll also feature their own stamp. She says a cancellation will allow individuals to keep their postcards and mail as souvenirs.

 

BISMARCK, N.D. (AP) — An American Indian activist accused of inciting a riot during protests against the Dakota Access pipeline in North Dakota wants law officers’ testimony in his now-resolved case to be unsealed.

The Bismarck Tribune reports that Chase Iron Eyes says the depositions will demonstrate what he describes as injustice done to American Indians and the environment. Prosecutors argue Iron Eyes’ intention is to publicly smear law officers.

Iron Eyes and 73 others were arrested Feb. 1, 2017, after erecting teepees on disputed land that authorities said is owned by a Texas-based pipeline developer. The protesters maintained they were peacefully assembling on land that belongs to American Indians under old treaties.

Iron Eyes reached a plea deal in the riot case in 2018.

A hearing is slated for Wednesday in Mandan.

 

 

MINOT, N.D. (AP) — Ward County sheriff’s officials say a man from Canada has been arrested for trying to lure a minor for sex.

The North Dakota Internet Crimes Against Children Task Force began communicating with a 44-year-old Winnipeg, Manitoba man on a mobile app in March. The suspect thought he was communicating with a 14-year-old boy. Investigators say contact continued through the summer and until he arranged to meet the minor for sex in Minot. He was arrested Sunday when he arrived for their meeting.

 

MANDAN, N.D. (AP) — A Mandan woman has been sentenced to two years of probation for neglecting children in her care.

Prosecutors say the three children, all under 8, were unsupervised in a dirty house where they had access to guns and knives. Twenty-six-year-old Hope Althoff pleaded guilty to three felony counts of child neglect Monday and misdemeanor animal neglect in South Central District Court.

The Bismarck Tribune says police were called to Althoff’s home in late June by neighbors who saw children playing unsupervised outside in dirty clothes. Police say a dog, a cat and an iguana were found in cages in poor condition. A judge also ordered Althoff to complete substance abuse evaluation and treatment.

A co-defendant in the case, Colby Ereth, is scheduled for a change-of-plea hearing on Tuesday.

ARNEGARD, N.D. (AP) — The driver of an off-road utility vehicle has died in a crash in western North Dakota.

The North Dakota Highway Patrol says 27-year-old Joel Sistrunk of Philadelphia, Mississippi, was driving on a private road near Arnegard Sunday about 5 p.m., crested a hill and lost control of the vehicle, striking a barbed wire fence.

The patrol says the vehicle overturned several times and pinned the victim underneath. Sistrunk was pronounced dead at the scene. A 44-year-old passenger was not injured

KANSAS CITY, Mo. (AP) — A federal judge says he will issue an order Tuesday that will determine whether a law banning abortions at or after the eighth week of pregnancy takes effect this week.

U.S. District Judge Howard Sachs heard arguments Monday on a motion by Planned Parenthood and the American Civil Liberties Union seeking a temporary restraining order for the new law until a lawsuit against it is decided. The law is set to take effect Wednesday.

Claudia Hammerman, an attorney for the organizations, said previous abortion-related rulings have made it clear the law is unconstitutional.

Missouri Solicitor General John Sauer’s argument centered on his contention that Planned Parenthood and the ACLU do not have standing to challenge the law.

Yankton S.D.  (uj.edu)— Treyton Forsman (SO/Lewiston, Idaho) shot a 4-under 68 Monday to help lead the University of Jamestown men’s golf team to first place after the opening day of the Mount Marty Fall Invitational.

Forsman was the only player to shoot under 70 at Hillcrest Golf & Country Club, and holds a three-shot lead over Morningside’s Torben Boerger and Tyler Danke.

Austin Rene (SR/Jamestown, N.D.) is fourth after an even-par 72. Tate Olson (SO/Cook, Minn.) is tied for eighth at 2-over 74, while Hudson Roling (SO/Thermopolis, Wyo.) and Michael Pruss (SR/Red Deer, Alberta) are tied for 23rd at 8-over 80.

Jamestown’s team score of 294 is four shots ahead of Morningside A (298) and seven shots ahead of Morningside B (301).

The tournament concludes Tuesday at Fox Run Golf Course in Yankton.

UNDATED (AP) _ The St. Louis Cardinals have added another half-game to their lead in the National League Central by blowing out the Brewers in Milwaukee.

Yadier (YAH’-dee-ehr) Molina and Paul DeJong (deh-YUHNG’) each homered and drove in three runs as the Cardinals hammered the Brewers, 12-2 to move three games ahead of the second-place Cubs. Marcell Ozuna’s (oh-ZOO’-nahz) bases-loaded double keyed a six-run second that jumpstarted the Redbirds’ fifth straight win.

John Gant struck out three in 2 1/3 hitless innings to get to 9-0. He replaced Adam Wainwright, who was reached for two runs, six hits and three walks before leaving with two out in the fourth.

The third-place Brewers dropped 5½ off the NL Central lead and 2 ½ games behind the Cubs for the second NL wild card.

_ The Yankees earned a 5-4 win at Seattle as Mike Ford went deep twice and Gleyber (GLAY’-bur) Torres smacked his 13th homer of the month. Torres sparked a four-run second with his 33rd homer and helped New York take a quick 4-0 lead before the Mariners got within a run. The Yanks stayed on top after Dylan Moore’s three-run blast made it a 4-3 game in the bottom of the second.

_ Ryan McMahon belted a two-run homer in the bottom of the ninth to send the Rockies past the Braves, 3-1. Nolan Arenado (ar-eh-NAH’-doh) led off the rally with a walk before McMahon blasted his 18th home run of the season, a half-inning after Adeiny Hechevarria (ah-DAY’-nee heh-chah-vah-REE’-ah) tied it for Atlanta with a sacrifice fly. The Braves ended an eight-game winning streak and saw their division lead trimmed to 5 ½ games over Washington.

_ The Phillies earned a 6-5 win over the Pirates on a solo blast by Sean Rodriguez in the bottom of the 11th. Rodriguez victimized his former club after Josh Bell slammed a tying solo homer off Hector Neris in the ninth. Corey Dickerson smacked a two-run homer and Bryce Harper hit a solo shot as the Phils pulled within one game of the second NL wild card.

_ The Padres put together a three-run sixth to beat the Dodgers, 4-3. A throwing error by outfielder A.J. Pollock brought home the tying run before Manny Machado slapped an RBI grounder that sent the NL West leaders to their third loss in four games. The rally allowed Eric Lauer to improve to 5-0 in seven career starts against Los Angeles as he allowed three runs and six hits over six innings.

_ Adam Jones slammed his third pinch-hit home run this season and Wilmer Flores added three hits and an RBI to help the Diamondbacks to their sixth win in eight games against the Giants, 6-4. Jarrod Dyson made a pair defensive gems in the sixth to keep Arizona ahead, making a leaping catch at the wall against Evan Longoria and later throwing out a runner at the plate. Alex Young gave up one earned run in 5 1/3 innings and beat the Giants for the second time this season.

 

_ The Athletics set season highs for runs and hits while thrashing the Royals, 19-4 in Kansas City. Marcus Semien homered, tripled and drove in a career-high seven runs to lead Oakland’s 22-hit assault. Jurickson Profar (JUR’-ihk-suhn PROH’-fahr), Matt Chapman and Khris Davis also went deep for the A’s, who are one percentage point ahead of the Rays for the second AL wild card.

_ The Reds doubled up the Marlins, 6-3 as Sonny Gray pitched six-plus innings and Freddy Galvis (GAL’-vees) drove in four runs. Gray walked five but limited Miami to two runs and four hits to improve to 10-6. Galvis had three hits and Eugenio (ay-oo-HEH’-nee-oh) Suárez hit his 36th homer in Cincinnati’s first win in four games.

Williams, Djokovic cruise at US Open

NEW YORK (AP) _ Serena Williams had little trouble with Maria Sharapova as the two rivals kicked off the night session at the U.S. Open.

The eighth-seeded Williams rolled to a 6-1, 6-1 rout that gives her 19 straight wins over Sharapova. Williams took control by winning the final five games of a 24-minute opening set, then the first two of the second set.

Sharapova has dropped 20 of their 22 meetings and hasn’t beaten Williams since a pair of victories in 2004, including Wimbledon.

Men’s top seed Novak Djokovic (JOH’-koh-vihch) has breezed into the second round, but it took a while for women’s No. 2 Ash Barty to get going.

Djokovic is 34-1 in his last 35 Grand Slam matches following a 6-1, 6-1, 6-4 win over Spaniard Roberto Carballes on opening day at Flushing Meadows. The 34-year-old Djokovic is seeking his fourth U.S. Open title, his 17th major championship and third Grand Slam crown this year.

Barty amassed 36 unforced errors and got less than half her first serves in before walking off the court with a 1-6, 6-3-6-2 victory. The reigning French Open champ rallied after dropping the opening set in 28 minutes.

Women’s third seed Karolina Pliskova (PLIHSH’-koh-vah) also struggled in her opener, overcoming 32 unforced errors for a 7-6, 7-6 win.

Roger Federer dropped his opening set against a qualifier ranked 190th before coming back to eliminate Sumit Nagal of India, 4-6, 6-1, 6-2, 6-4.

American Reilly Opelka pulled off an upset of men’s 11th seed Fabio Fognini, and women’s No. 14 Angelique Kerber was knocked out by Kristina Mladenovic (mlah-DEHN’-oh-vihch).

Others advancing on the men’s side include fifth seed Daniil Medvedev, seventh seed Kei Nishikori (kay nee-shee-KOHR’-ee), No. 12 Borna Coric and No. 15 David Goffin. Nishikori was leading 6-1, 4-1 when his opponent retired. Unseeded Venus Williams moved into the women’s second round, as did fifth seed Elina Svitolina (svih-toh-LEE’-nah), No. 12 Anastasija Sevastova (an-ah-STAH’-shah seh-vah-STOH’-vah) and No. 16 Johanna Konta.

A sculpture of tennis great Althea Gibson has been unveiled at the U.S. Open, honoring the accomplishments of the first African-American to win her country’s national title.

Chiefs lose backup QB Henne to broken ankle, sign Moore

UNDATED (AP) — The Kansas City Chiefs have lost backup quarterback Chad Henne (HEN’-ee) to a fractured ankle that will require surgery.

Henne was injured during Saturday’s preseason game against San Francisco.

The Chiefs have signed veteran Matt Moore Monday to provide depth behind starter Patrick Mahomes (mah-HOHMZ’). The 35-year-old Moore sat out last season after playing 10 seasons with the Dolphins and Panthers.

_ The Browns’ new star wide receiver Odell Beckham Jr. has returned to team drills during practice for the first time in nearly three weeks. Beckham has missed Cleveland’s three exhibition games with a hip injury the team insists is minor.

_ Texans running back Lamar Miller has been placed on the injured reserve after tearing the ACL in his left knee during Saturday’s preseason game against the Cowboys.

_ The Denver Broncos have cut sixth-year defensive lineman Zach Kerr and 10th-year outside linebacker Dekoda Watson, freeing up about $3.5 million in salary cap space.

_ The Bills have claimed linebacker Jeff Holland off waivers and released punter Cory Carter. Holland was added a day after being released by Arizona.

_ The 49ers have activated projected starting center Weston Richburg from the physically unable to perform list. Richburg had been recovering from a knee injury.

_ Saints defensive tackle Sheldon Rankins has returned to practice for the first time since tearing his Achilles tendon in New Orleans’ divisional round playoff victory over Philadelphia last January.

_ The Cardinals have signed defensive linemen Clinton McDonald and Siupeli Anau. The 6-foot-2, 297-pound McDonald is entering his 10th NFL season and has played for Cincinnati, Seattle, Tampa Bay and Oakland.

_ Patriots safety Patrick Chung has waived a court appearance in New Hampshire on a cocaine possession charge and a lawyer entered a not guilty plea on his behalf. A Belknap County grand jury indicted the 32-year-old Chung on Aug. 8.

Patterson starting, but more than 1 Michigan QB could play

UNDATED (AP) — Shea Patterson is set to start for No. 7 Michigan in its season opener Saturday night against Middle Tennessee, though coach Jim Harbaugh says he would like backup Dylan McCaffrey to play as well.

Patterson threw for 2,600 yards and 22 touchdowns last season, his first with the Wolverines after transferring from Mississippi. McCaffrey played in six games last season and attempted just 15 passes.

The Wolverines will be without offensive lineman Andrew Stueber this season. Harbaugh said he has a torn ACL.

_ James Blackman will be Florida State’s starting quarterback for the season opener against Boise State in Jacksonville on Sunday. Florida State coach Willie Taggart said he and offensive coordinator Kendal Briles told Blackman on Sunday that he was the starter over Wisconsin graduate transfer Alex Hornibrook. Blackman has started 13 games, including 12 as a true freshman in 2017.

_ Virginia Tech transfer Josh Jackson will start at quarterback for Maryland against Howard Saturday. First-year coach Michael Locksley says Jackson won the job after “an extremely tight camp battle” with Tyrrell Pigrome. Jackson earned his undergraduate degree at Virginia Tech before transferring to Maryland in May.

_ Longtime backup quarterback Anthony Gordon has been named the starter for No. 23 Washington State heading into Saturday’s season opener against New Mexico State. Coach Mike Leach says Gordon beat out graduate transfer Gage Gubrud to start for the Cougars in the Air Raid offense.

Nets’ LeVert gets extension

UNDATED (AP) _ The Brooklyn Nets have signed guard Caris LeVert (leh-VURT’) to a contract extension after his remarkable recovery from injury last season.

The 2016 first-round pick was averaging a team-best 18.4 points in his first 13 games before sustaining a dislocated right foot that kept him off the court for about three months. He managed to recover without surgery, helped the Nets reach the playoffs for the first time in four years and averaged 21 points in a first-round loss to Philadelphia.

_ Dwight Howard has rejoined the Lakers six years after his acrimonious departure. The eight-time All-Star center and 15-year NBA veteran led the NBA in rebounding while spending the 2012-13 season with the Lakers. He clashed with Kobe Bryant and subsequently spurned Los Angeles as a free agent.

Original Tampa Bay Rays owner Vince Naimoli dies at 81

TAMPA, Fla. (AP) _ Original Tampa Bay Rays owner Vince Naimoli has died at 81.

The team said Monday he died Sunday nearly five years after being diagnosed with an uncommon brain disorder.

The Tampa businessman had been part of unsuccessful bids to purchase and relocate the Seattle Mariners and San Francisco Giants. But he landed an American League expansion franchise in 1995 that began play as the Devil Rays in 1998.

Naimoli sold the club to a group led by current Rays principal Stuart Sternberg in 2004 and relinquished control after the 2005 season.

COLLEGE ADMISSIONS BRIBERY

Loughlin, husband expected in court amid spat over lawyers

BOSTON (AP) — Actress Lori Loughlin and her fashion designer husband, Mossimo Giannulli, are expected in court today to settle a dispute over their choice of lawyers in a sweeping college admissions bribery case.

The couple is scheduled to appear in Boston’s federal court to determine whether they can continue using a law firm that recently represented the University of Southern California, which is an alleged victim in the couple’s case.

Prosecutors say it poses a potential conflict of interest. Loughlin and Giannulli say the firm’s work for USC was unrelated to the admissions case and was handled by different lawyers.

The couple is accused of paying $500,000 to have their two daughters labeled as recruits to the USC crew team, even though neither participated in the sport. They have pleaded not guilty.

 

In world and national news…

NEW YORK (AP) — Up to 30 women were expected to take a judge up on his invitation to speak at a hearing after financier Jeffrey Epstein killed himself before facing sex trafficking charges.

The hearing Tuesday morning was scheduled last week by U.S. District Judge Richard Berman. Berman presided over the case prosecutors brought against Epstein after the 66-year-old convicted felon was arrested July 6. A New York City coroner has formally classified the death a suicide. He died Aug. 10.

The judge set the hearing after prosecutors asked that he scrap charges against Epstein since the defendant is dead. Berman said he would give prosecutors, Epstein lawyers and any victims a chance to speak.

Epstein had pleaded not guilty to charges he sex trafficked women in the early 2000s.

 

 

TEHRAN, Iran (AP) — Iran’s president has back-pedaled on possible talks with Donald Trump and now says the U.S. president first must lift sanctions imposed on Tehran.

Hassan Rouhani said on Tuesday that otherwise, a meeting between the two would be just a photo op and “that is not possible.”

Rouhani’s change of heart came a day after Trump said Monday there’s a good chance the two could meet after a surprise intervention by French President Emmanuel Macron during the G-7 summit to try to bring Washington and Tehran together.

Rouhani says that “without the U.S.’s withdrawal from sanctions, we will not witness any positive development.” He added that Washington “holds the key.”

Earlier on Monday, Rouhani expressed readiness to negotiate a way out of the crisis following America’s pullout from the nuclear deal.

 

BIARRITZ, France (AP) — No, first lady Melania Trump hasn’t had any secret meetings with North Korean leader Kim Jong Un.

The White House is clarifying comments made by President Donald Trump during a news conference in France. He had said “the first lady has gotten to know” Kim and likely agrees he’s “a man with a country that has tremendous potential.”

Press secretary Stephanie Grisham says in a statement from aboard Air Force One that the president “confides in his wife on many issues including the detailed elements of his strong relationship with Chairman Kim — and while the First Lady hasn’t met him, the President feels like she’s gotten to know him too.”

Trump has said he’ll likely meet with Kim again to discuss Pyongyang’s nuclear program.

 

MIAMI (AP) — President Donald Trump is sparing no detail in touting the features that would make the Doral golf resort the ideal place for the next G-7 Summit — close to the airport, plenty of hotel rooms, separate buildings for every delegation.

There’s just one detail he left out: He owns the place.

Critics have long railed against the president’s company opening the doors of its Washington, D.C., hotel and other properties to foreign embassies and diplomats intent on currying favor with the White House.

But they say Trump’s proposal made at the current G-7 summit in Biarritz, France, takes it to a whole new level because foreign governments would have no choice but to spend money at the president’s resort.
