Valley City (VCPS) Valley City Public Schools informs those bringing students to school, that Thursday, September 19th the intersection of Central Avenue and 9th Street North in Valley City will be closed for additional street repairs.
School Superintendent Josh Johnson says the only access into the Jefferson Elementary and the Hanna Field parking lot will be from the north using 12th Street and then Central Avenue.
He adds that Valley City officials has informed the school district that the intersection will re-open next week in Valley City.
Jamestown (CSi) On Tuesday September 24, 2019 Jamestown Public School District voters will have the opportunity to have their voices heard, on the referendum, concerning the proposed increasing the building fund levy authority from 10 to 20 mills, to update existing facilities.
The polls will be open at Jamestown Middle School’s Community Room from 7-a.m. to 7-p.m.,
Absentee ballots are available at the School District, Office, at 207 Second Avenue, Southeast through Monday September 23, from 7-a.m. to 4-p.m.
All Jamestown Public School District patrons, urban and rural are eligible to vote.
To pass, the “yes” votes must be 60-percent of the total votes cast.
On Wednesday’s Wayne Byers Show on CSi Cable 2, Jamestown Public Schools, Superintendent Robert Lech said, if the referendum was successful, the maximum impact of the levy authority for an additional 10 mills on a $100,000 home would provide a tax impact of $45 annually or $3.75 per month. This levy would be approved annually by the school board and the number of mills levied would be dependent upon facility needs in that tax year.
He pointed out that the school district pursued referendums in 2015 and 2018 to update and enhance aging facilities. In both instances, the community said that this was not the right plan at the right time. The last referendum included school building additions. However Lech stressed that this time voters will either approve or disapprove, needed infrastructure improvements, only.
As a result, Lech said, “We have explored different opportunities to address our biggest concerns and believe the best remaining option exists with increasing our building fund. The JPS school board, on July 24, approved a special election on September 24, 2019 for the public to consider increasing building fund levy authority from 10 to 20 mills.” The levy will be revisited annually.
He said, currently, the district’s building fund allows Jamestown Public Schools, to levy for 10 mills only to support our facilities as governed by the North Dakota Century Code.
He added, expansion of the building fund has been determined to be the most effective opportunity to address immediate issues, while also being a flexible option for any future facility planning to address long-term facility needs.
A Capital Projects Plan (CPP) was approved by the school board in 2016. The CPP outlined an average of $2.16 million per year in facility needs over a 10-year span across seven schedules: 1) Asbestos Abatement, 2) Building Repairs, 3) Sites, 4) Roofs, 5) ADA Remodeling, 6) Security and Safety, and 7) Equipment. $1.3 million, or 60%, of this annual $2.16 million in needs is attributed to Building Repairs. Similarly, the Roof schedule equates to an average annual cost of $560,000, or 26%, of these expenses.
He added that with the existing levy providing about $700,000 annually, the district is woefully short of the average annual costs to adequately update these facilities.
Lech said, that it is important to note that the district has been utilizing the existing levy beyond its maximum capacity. Since the approval of the CPP, the district has expended an average of $820,090 annually through the building fund with the vast majority of these expenses directly tied to the Capital Projects Plan. This average expense outpaces revenue from the building fund’s 10 mills and has resulted in spending down the interim balance of the building fund. While these projects have been necessary, spending more than we receive in revenue is not a sustainable model.

Jamestown (CSi) At Tuesday’s negotiating session, the Jamestown Education Association JEA) and the Jamestown Public School Board did not reach an agreement on a two-year contract with the school board declaring the negotiations at impasse, meaning the talks were not moving ahead.
Jamestown Public School Board President, Jennifer Schmidt added that the JEA elected not to provide a counter offer.
Schmidt said the two parties have met five times since June, which was when the board gave JEA its last best offer.
JEA negotiator, David Dooley added, “I don’t think it’s (negotiations) are in good faith. The board is undervaluing teachers compared to everyone else in the district. Teachers help students become better people.”
Sanborn (CSi) The Barnes County Sheriff’s Office reports a 24-year-old man was seriously injured in a work-related accident on Tuesday, September 17, 2019 near Sanborn, ND at approximately 2:10 pm.
The news release from the Barnes County Sheriff’s office stated that 24-year-old Dacotah McGough was airing up a tire on a piece of heavy equipment, there was a failure which caused severe injury to his face.
McGough was transported to a Fargo hospital for surgery.

BISMARCK, N.D. – The North Dakota Department of Human Services is alerting Supplemental Nutrition Assistance Program (SNAP) households about a telephone scam that is targeting program benefits. The program helps qualifying low-income households buy food.
In the telephone scam, a caller indicates that an individual or household will lose their SNAP benefits because he or she owes the program money. The caller provides a telephone number the individual should call to pay back the money using a credit card or another form of payment.
Michele Gee, director of the Economic Assistance Policy Division for the North Dakota Department of Human Services said, “Households that qualify for SNAP would never receive a telephone call about an overpayment or potential case closure.”
Gee said that SNAP households should not call the number provided in the telephone scam.
SNAP households should notify their county social service office if they receive any of these scam calls relating to SNAP benefits. County contact information is online at www.nd.gov/dhs/locations/countysocialserv/.
Program benefits are placed on an electronic benefit transfer (EBT) card. Qualifying households use EBT cards to purchase food at approved grocers, participating farmers markets and other vendors.
In August 2019, SNAP served about 48,000 qualifying low-income North Dakotans. The federally-funded program tends to serve mainly low-income children, often in single-parent families, people with disabilities, and seniors on fixed incomes.

Fargo (valleynewslive.com) Police are asking for the public’s help in finding 16-year-old Jzainea Breann Livingood.
Jzainea was last seen at home in the 4300 block of 9th Ave. Cir. S. on September 14th wearing sweatpants and a sweatshirt.
Jzainea has a tattoo on her right wrist of a line with a sun coming up. Police say Jzainea left her apartment with a friend and it’s unknown where she may have gone. Jzainea also goes by the last name “Thompson.”
Anyone with information as to her whereabouts is asked to call law enforcement agency, or dispatch at 701.451.7660. You can also submit a tip by texting 701.730.8888.

BISMARCK, N.D. (AP) — A Bismarck man who fatally shot another man after they argued over a debt has been sentenced to time served behind bars in a plea agreement with prosecutors.
But, Aundra Fontenot won’t be released until he’s served more time on a federal drug crime. The 36-year-old defendant was charged with manslaughter in the June 2018 death of Derrick Left Hand. Fontenot agreed to plead guilty to reckless endangerment and illegally possessing a gun as a felon.
The Bismarck Tribune reports South Central District Judge Daniel Borgen sentenced Fontenot to time served Wednesday. Fontenot was on pretrial release on federal drug charges at the time of shooting. He eventually pleaded guilty to conspiracy to distribute and possession with intent to distribute drugs and was sentenced to 4½ years in prison.
BISMARCK, N.D. (AP) — The North Dakota Department of Health says the state has one confirmed case of severe vaping-related lung illness and six probable cases under investigation.
Health officials say the state is working with the U.S. Centers for Disease Control and Prevention as the agency continues to investigate the vaping illness cases.
The CDC says 36 states and 1 U.S. territory have reported more than 380 potential cases of severe respiratory illness associated with the use of e-cigarette or vaping products among teenagers and adults. Seven deaths have been reported from six states.
The agency hasn’t identified any consistent e-cigarette or vaping product, substance, or additive in all the cases.
BISMARCK, N.D. (AP) — An attorney for a South Dakota man says DNA evidence found on a cigarette butt doesn’t prove his client participated in a riot during the Dakota Access pipeline protest three years ago.
The Bismarck Tribune reports attorney Bruce Nestor on Monday filed a motion in state court seeking dismissal of the charges against Lawrence Malcolm Jr., of Sisseton.
Nestor says it’s impossible to determine where the butt originated or how long it might have been there.
Prosecutors charged Malcolm earlier this month with felony conspiracy to commit criminal mischief and engaging in a riot.
The charges relate to protest on the Standing Rock Indian Reservation. An affidavit says more than 100 demonstrators, many with their faces covered, halted construction and vandalized equipment.
BISMARCK, N.D. (AP) — The North Dakota Department of Health says more people in the state are using child car seats correctly.
Data compiled by health officials show 72 percent of those with car seats were using them improperly in 2018. That figure is actually an improvement and compares with 86 percent in 2009.
During the last five years in North Dakota, 8 children have died and 1,037 youngsters 12 and younger were injured in motor vehicle crashes.
The health department recommends keeping children in rear-facing car seats for as long as possible. Once a child outgrows the rear-facing seats, a forward-facing car seat with a harness should be used. And, after outgrowing the forward-facing seat, children should be placed in a booster seat until they are the right size to use just a seat belt.
BISMARCK, N.D. (AP) — The federal government says it should not have to reimburse North Dakota for the $38 million the state spent policing protests against the Dakota Access oil pipeline.
The Army Corps of Engineers filed a motion Tuesday asking a federal judge to dismiss the state’s lawsuit seeking to recoup the costs. The Corps says the state had the authority and responsibility to enforce the law on federal land.
Thousands of opponents of the $3.8 billion pipeline that’s been moving North Dakota oil to Illinois for two years gathered in southern North Dakota in 2016 and early 2017, camping on federal land and often clashing with police.
The state argues the Corps allowed protesters to illegally camp without a permit on federal land and failed to maintain law and order.

UNDATED (AP) _ Minnesota’s lead in the AL Central is down to four games over Cleveland following the Twins’ 3-1 loss to the White Sox. Eight pitchers combined to limit the majors’ top power-hitting team to just three hits, none until the sixth inning. Zack Collins homered and Yoán Moncada doubled twice as Chicago kept the Twins’ magic number at seven.
Cleveland earned its 16th consecutive win over the Tigers as Yasiel Puig (YAH’-see-ul pweeg) supplied a bases-loaded single with two out in the 10th to complete the Indians’ 2-1 victory. Carlos Santana singled home the tying run in the third before Puig’s fourth hit of the night allowed the Indians remain a half-game behind the Rays for the second AL wild card. Indians right-hander Aaron Civale (sih-VA’-lee) got a no-decision after limiting the Tigers to a run and four hits over a season-high 7 2/3 innings.
_ Atlanta has its first three-game skid since mid-July after Bryce Harper’s two-run homer helped the Phillies post a 4-1 victory in Atlanta. Zach Eflin allowed an unearned run and five hits over seven frames as Philadelphia prevented the Braves from padding their nine-game lead over Washington atop the NL East. Atlanta’s magic number remains two.
The St. Louis Cardinals have a little more breathing room atop the NL Central after moving three games ahead of the Chicago Cubs and Milwaukee Brewers.
The Cardinals took the rubber match of their series with Washington as Adam Wainwright outdueled Max Scherzer in the Redbirds’ 5-1 victory. The 38-year-old Wainwright limited the Nationals to an unearned run in seven innings, helped out by Dexter Fowler’s leaping catch at the wall to rob Asdrúbal (as-DROO’-bul) Cabrera of a three-run homer.
Tommy Edman and Matt Wieters (WEE’-turz) homered for the Cards, who open a four-game set with the Cubs Thursday night at Wrigley Field.
The Cubs will be coming off a 3-2 loss to the Reds when they begin their battle with St. Louis. José Iglesias had an RBI double in the 10th inning to score Aristides (ar-eh-STEE’-dehs) Aquino, who began the two-out rally with a single. Reds slugger Eugenio (ay-oo-HEH’-nee-oh) Suárez hit his 48th homer to break Andres Galarraga’s single-season mark for a Venezuelan-born player.
The Brewers ended a four-game winning streak as Dinelson Lamet (dih-NEHL’-suhn LAM’-eht) struck out a career-high 14 while yielding just a run and three hits over six innings of the Padres’ 2-1 victory at Milwaukee. Rookie Seth Mejias-Brean hit his first career home run as the Padres ended a six-game losing streak.

_ The Athletics pulled out a 1-0 win over Kansas City to stay two games ahead of Tampa Bay for the first AL wild card. Mark Canha (KAN’-ah) ended it with a bases-loaded double in the bottom of the 11th, a half-inning after winning pitcher J.B. Wendelken worked in and out of a bases-loaded jam. A’s starting pitcher Homer Bailey struck out 11 while limiting the Royals to three hits over seven scoreless innings.
_ The Rays erased a 6-4 deficit against Kenley Jansen in the ninth inning and scored twice in the 11th to hold off the Dodgers, 8-7. Austin Meadows homered leading off the final inning, but the Rays needed Ji-Man Choi’s sacrifice fly to win it after Edwin Rios delivered an RBI single with two out in the 11th. Tommy Pham had a career-high five hits for the Rays.
_ The Astros picked up their 100th win and Gerrit Cole went over 300 strikeouts for the season in a 3-2 decision over the Rangers. Cole allowed two runs on six hits in earning his 14th straight win and 18th of the season. Yuli Gurriel (YOO’-lee gur-ee-EHL’) and Jose Altuve (al-TOO’-vay) homered for Houston, which locked up a playoff berth and reduced its magic number to two for clinching the AL West.
_ Adam Ottavino (ah-tah-VEE’-noh) sailed a 30-foot throw home on Albert Pujols’ (POO’-hohlz) bases-loaded chopper in the sixth inning to score the tiebreaking run in the Angels’ 3-2 win over the Yankees. Giancarlo Stanton hit a second-inning double in his first at-bat since returning to the Yankees’ lineup. Stanton had been out since June 25 with a strained right knee ligament.
_ Pete Alonso crushed his 49th home run and later worked out a tiebreaking, bases-loaded walk in a four-run ninth that gave the Mets a much-needed 7-4 win over the Rockies. Alonso is three away of Aaron Judge’s major league rookie record of 52 home runs set two years ago. Jeff McNeil also went deep for the Mets, who have set a club record with 225 homers this season.
_ Mike Leake pitched into the seventh inning and Domingo Leyba had two RBIs as the Diamondbacks knocked off Miami, 5-4. Leake navigated through traffic while yielding three runs and eight hits over 6 2/3 innings. Abraham Almonte hit his first career leadoff home run and Christian Walker added a solo shot for the Diamondbacks.
_ The Giants’ 11-3 rout of the Red Sox made Bruce Bochy (BOH’-chee) just the 11th manager in major league history with 2,000 victories. Stephen Vogt (voht) slammed a two-run homer and had four RBIs to back Jeff Samardzija (sah-MAHR’-jah), who carried a no-hitter into the sixth inning.
_ The Blue Jays came away with an 11-10 win over the Orioles on Randal Grichuk’s (GRIH’-chuhks) grand slam in the top of the ninth. Grichuk’s 30th home run highlighted a six-run ninth that began with Toronto trailing 9-5.
_ The Mariners knocked off the Pirates, 4-1 behind back-to-back homers by Kyle Lewis and Tom Murphy. Lewis has homered five times since making his major league debut on September 10. Tommy Milone (mih-LOHN’) worked five scoreless innings of relief in Seattle’s fourth consecutive win.

Brees has surgery on right hand
UNDATED (AP) _ New Orleans Saints quarterback Drew Brees (breez) will miss several weeks while recovering from surgery to repair a ligament near his right thumb.
Coach Sean Payton wouldn’t discuss a timetable for Brees’ return, but said it’s unlikely he will be placed on injured reserve. That means doctors think Brees will be able to return this season.
Payton declined to name a starter for the Sunday’s game at Seattle. Teddy Bridgewater entered last Sunday’s loss to the Rams after Brees injured the thumb on his throwing hand while attempting a pass.

_ Pro Bowl left tackle Eric Fisher will undergo surgery on his injured groin, leaving the Chiefs without their blindside protector for Patrick Mahomes (mah-HOHMZ’) for the foreseeable future. Fisher hurt his groin in practice Friday but tried to play Sunday in Oakland. He only lasted a few plays before Cam Erving replaced him.
_ The Cowboys have waived defensive end Taco Charlton, who didn’t live up to his billing as a 2017 first-round pick but should get a second chance with another team. The move clears a roster spot for defensive end Robert Quinn, who was suspended the first two games for violating the NFL’s policy on performance-enhancers.

_ Two people with knowledge of the investigation into Antonio Brown being accused of sexual assault tell The Associated Press that one of the accusers has met with NFL investigators and that there is no timetable for concluding the probe. One of the people also confirmed that the district attorney’s office and police in Allegheny County, Pennsylvania, have reached out to Brown’s lawyer about the allegations Britney Taylor made against the Patriots wide receiver in a civil lawsuit.

Wizards’ Thomas has thumb surgery
UNDATED (AP) _ Washington Wizards guard Isaiah Thomas has undergone thumb surgery that is expected to keep him sidelined six to eight weeks.
The team says Thomas underwent surgery on Wednesday, two days after he ruptured the radial collateral ligament in his left thumb during routine workouts.
This injury is another blow to the Wizards, who are expected to be without guard John Wall for at least the first half of the season and perhaps all of it because of a ruptured Achilles tendon.

_ Alibaba co-founder Joe Tsai (tsy) has completed his purchase of the Nets and Barclays Center, then announced that he had hired former Turner Sports President David Levy as CEO. Tsai’s purchase of the Nets was unanimously approved by the NBA’s board of governors. He spent nearly $3.5 billion for the team and the arena, a record sale for a U.S. sports franchise.

Louisville, Pitino settle lawsuit
LOUISVILLE, Ky. (AP) _ The University of Louisville Athletic Association and former men’s basketball coach Rick Pitino have settled lawsuits stemming from his departure from the school.
Pitino’s personnel file has been changed to note he resigned and wasn’t terminated. He received no money in the settlement.
Pitino sued the ULAA for more than $38.7 million in November 2017. He accused the association of breaching its contract by firing him for cause the previous month in the wake of a federal bribery investigation of college basketball.

DUBAI, United Arab Emirates (AP) — Iranian Foreign Minister Mohammad Javad Zarif is warning that any U.S. or Saudi military strike on Iran will result in “all-out war.”
Zarif made the comment in an interview published by CNN Thursday.
It comes after U.S. Secretary of State Mike Pompeo called an attack on Saudi oil installations an “act of war.”
The U.S. accuses Iran of being behind the attack. Iran denies that.
Yemen’s Iranian-backed Houthi rebels have claimed the attack, saying it is over the yearslong Saudi-led war there that’s killed tens of thousands of people. However, experts told The Associated Press the cruise missiles used in the assault did not have the range to have been launched from Yemen and reach their targets.
TORONTO (AP) — Canadian leader Justin Trudeau’s campaign is working to contain a growing scandal following the publication of a yearbook photo showing him in brownface makeup at a 2001 costume party.
The prime minister apologized and begged Canadians to forgive him.
Time magazine published the photo Wednesday, saying it was taken from the yearbook from the West Point Grey Academy, a private school in British Columbia where Trudeau worked as a teacher.
Trudeau, who launched his reelection campaign exactly one week ago, said he should have known better.
“I’m pissed off at myself, I’m disappointed in myself,” Trudeau told reporters traveling with him on his campaign plane.
The Canadian prime minister is but the latest politician to face scrutiny over racially insensitive photos and actions from their younger days.
JERUSALEM (AP) — Israelis are coming to grips with an uncertain political future two days after an election that left the country’s two main political parties deadlocked and with no clear path to a coalition government.
With nearly 95 percent of votes counted Thursday, the Blue and White party stood at 33 seats in Israel’s 120-seat Parliament. Prime Minister Benjamin Netanyahu’s Likud stood at 32 seats. But with the election’s apparent kingmaker, Avigdor Lieberman, insisting on a secular government between the two, and Blue and White refusing to sit in such a coalition with Netanyahu still heading Likud, it was unclear what the way forward may be.
Israel’s president will consult in the coming days with all parties before selecting the candidate he believes has the best chance of forming a stable coalition.
SAN DIEGO (AP) — President Donald Trump is capping a three-day trip to the West with a visit to the border wall in San Diego, where he is showing reporters details of the ongoing construction.
Trump calls it “an amazing project.”
Trump is riding a string of wins on the wall and on immigration. Arrests on the Mexican border arrests plunged well beyond the usual summer dip in August. Last week, the Supreme Court gave Trump a green light to deny asylum to anyone who passes through another country on the way to the U.S. border with Mexico without having sought protection in that third country.
At the same site last year Trump saw wall prototypes, which were destroyed to make way for 14 miles (22.4 kilometers) of steel bollards currently under construction.
LONDON (AP) — The British government says it has sent written proposals to the European Union on how to rework the rejected Brexit divorce deal.
The government said Thursday it sent “confidential technical non-papers which reflect the ideas the U.K. has been putting forward.” Non-papers are documents intended for discussion, rather than formal proposals.
Although Prime Minister Boris Johnson insists Britain is working hard to get a deal, the EU says it is still waiting to hear concrete ideas.
Britain’s statement came after Finland’s prime minister said the U.K. needed to submit its proposals by the end of September, or “it’s all over.”
Britain said it would not meet an “artificial deadline” but would make formal submissions “when we are ready.”
The U.K. is due to leave the EU on Oct. 31.
