Jamestown City Planning Commission
June 10, 2013 – 8:00 a.m.
Present: Tressler, Purdy, Trefz, Bergquist, Hillerud, Ritter, Bensch, Johnson, Trautman
Absent: None
Others Present: Kourajian, Klundt, Wollan, Harty, Fuchs, Schwartzkopf
- Chairman Hillerud called the meeting to order. Correction requested by Purdy to change wording from Chairman Trefz to Commission member Trefz on last months’ minutes. Ritter made a motion to approve the May 13, 2013 regular Planning Commission meeting minutes as corrected. Seconded by Bergquist. Unanimous voice vote. Motion Carried.
- Public Hearing:
The preliminary plat of Walicski’s Third Extension, A Re-plat of Lots 7-11 of Meland Second Addition together with part of the North Half of the Southwest Quarter of Section 23, T140N, R64W, City of Jamestown, Stutsman County, North Dakota.
Stephanie Falkers, of SRF Consulting Group gave the staff report relating to the preliminary plat. She stated that the purpose of the plat was to satisfy North Dakota State Law which requires that any lots utilizing onsite septic be at least one acre in size. The new layout will satisfy that requirement.
Chairman Hillerud opened the public hearing. No one appeared. The public hearing was closed.
Commission member Trefz made a motion to accept the findings of staff and approve the preliminary plat of Walickski’s Third Extension, as it meets the requirements of Section 9 of Appendix B. The motion was seconded by Ritter. Roll Call showed unanimous aye vote. Motion Carried.
- Public Hearing:
Zoning Ordinance Amendment to amend and re-enact Section 5.4, Appendix C, of the Code of the City of Jamestown pertaining to uses permitted in R-3 Districts.
Stephanie Falkers of SRF Consulting Group explained the text amendment and recommends approval of this text amendment.
Chairman Hillerud opened the public hearing.
Clarice Liechty, of 511 8th St SW, spoke of her concerns relating to the need of more detail in the R-3 zoning for land developers. Clarice asked for clarification of the change and asked to be emailed what is allowed in R-3 zones.
Cindy Gray, of SRF Consulting Group, Inc. and Chairman Hillerud stated that the need for the proposed text amendment was to allow the historical practices which are currently being allowed for permitting of structures of greater than 12 units in a R-3 zoning district to continue in a legal manner. Chairman Hillerud’s only concern was whether or not a maximum limit of dwelling units should be established.
Chairman Hillerud closed the public hearing.
A lengthy discussion was held amongst the Planning Commission Members. Stephanie Falkers, of SRF Consulting Group, Inc. handed out examples of units that would work in the R-3 zone utilizing the proposed text amendment.
A motion made by Johnson to accept the findings of staff, and recommend approval of the text amendment to allow for multiple dwellings and dwelling groups with no maximum number of dwelling units per structure in the R-3 District as long as the requirements of Section 8 of Appendix C were satisfied. Motion seconded by Bensch. Roll Call. Unanimous aye vote. Motion Carried.
- Public Hearing:
Jamestown Growth Management Plan – recommendation to City Council.
Cindy Gray, of SRF Consulting Group, briefly summarized the GMP, and related that they have been working with JSDC and the City to develop and prepare an up- to- date Land Use Plan to serve as a guide for the City’s decisions.
Discussion amongst members continued with Cindy Gray explaining and answering questions from the Commission.
Chairman Hillerud opened the public hearing.
Bart Davis, owner of 149 acres west of Wal-Mart in SW Jamestown, related his concerns with the Growth Management Plan. Bart presented a concept drawing he had obtained that SRF completed.
Cindy Gray explained that the concept drawing Mr. Davis presented is not part of the GMP, and that it is a first look at what development may look like in the future in this area. Commission member Trefz explained that the GMP is a conceptual plan so that the public has an idea of what the City is anticipating.
Clarice Liechty, 511 8th Ave SW, spoke regarding her concerns with the GMP and recommended the Planning Commission have more information before recommendation to the City Council.
Commission member Trefz explained that every time there is a zone change that it is approved by the Planning Commission, then the City Council. He explained that the LUTP will be looked at within the next 18 months.
Clarice Liechty, spoke again about the communication with the land owners and questioned the process of changing the LUTP and the zoning process. Cindy Gray, of SRF Consulting Group explained that these requests can be processed together.
Connie Ova, JSDC, spoke in appreciation of SRF Consulting Group, Inc. and that the JSDC staff has been working very hard at contacting land owners for their input.
Denise Steele, 3573 81st Ave SE, expressed her concerns about the land use development process and the concern about the ability to meet with land owners. She stated her concern that her residence and the surrounding area were indicated as being zoned industrial.
Chairman Hillerud closed the public hearing.
A lengthy discussion among members and staff concluded that the GMP consists of suggested uses for future zoning and land development.
Commission member Purdy excused himself.
Motion made by Trautman to recommend approval of the Growth Management Plan with the exception of a section of I-94 & Hwy 281 Bypass being changed from Industrial Zone to Commercial
Zone. Commission member Ritter seconded. Roll call. All aye. Motion Carried.
- Approve the final plat of Anne Carlsen Center Addition, Lot 1, Block 1, Anne Carlsen Center Addition within NE 1/4, Section 3, T139N, R64W, Stutsman County, North Dakota.
Stephanie Falkers, of SRF Consulting Group, Inc. gave the staff report.
A motion to accept the findings of staff and recommend approval of the final plat of the Anne Carlsen Center Addition, as it meets the requirements of Section 13 of Appendix B was made by Commission member Bensch. The motion was seconded by Trautman. Roll call. All aye. Motion Carried.
- Commission member Trefz spoke of the ‘On Common Ground’ magazine he receives and that it is very helpful in the planning process and urged Commission members to review.
- A motion was made to adjourn by Bergquist. Seconded by Ritter. Meeting Adjourned.
