FARGO, N.D. (AP) — An effort by 11 former University of North Dakota women’s hockey players to bring back the program that was dropped in 2017 has gotten a reprieve. The 8th U.S. Circuit Court of Appeals revived the players’ lawsuit on Tuesday. The original complaint alleged that when the school dropped hockey, it violated Title IX laws that prohibit women from being treated differently because of gender. But a federal judge said the lawsuit did not show a “substantial disproportionality” between men’s and women’s athletic opportunities. The players appealed in October and a three-judge panel ruled that the athletes may be able to state an actionable Title IX claim.

— Isiah Kiner-Falefa and Yonny Hernandez each hit an RBI single in the 10th inning, and the Texas Rangers snapped a 14-game road losing streak with a 5-4 win over the Seattle Mariners. The Rangers rallied twice to end their six-game skid overall, taking a 3-2 lead in the ninth on rookie Adolis García’s 25th home run before reliever Spencer Patton blew it. Patton walked three of the first four batters he faced to tie the game 3-all and load the bases with no outs. But he struck out J.P. Crawford and Mitch Haniger, and Brett Martin got the third out to send the game into extra innings.
— Austin Nola hit a go-ahead single in the seventh inning, lifting the San Diego Padres over Miami 6-5 and sending the Marlins to their fifth straight loss. Nola had two hits and two RBIs. He extended his hitting streak to a career-best nine games. With the score tied 5-all and Adam Frazier on second base with two outs, Nola hit a sharp single to left field against Richard Bleier. Mark Melancon got the last out of the eighth, worked around a leadoff double in the ninth and notched his MLB-leading 34th save.
— LaMonte Wade Jr. scored the winning run with two outs in the ninth inning when first baseman Christian Walker failed to handle Kris Bryant’s sharp grounder, and the San Francisco Giants danced on the field celebrating an 8-7 victory against the Arizona Diamondbacks. The Giants won their third straight and fifth in six games, doing it the hard way after going up 5-0 in the fifth. Brandon Crawford hit a go-ahead double in the eighth and Buster Posey homered. After scoring from first on Crawford’s hit, Posey came up from his feet-first slide smiling and told Bryant, “I’m so fast.”
— Salvador Perez homered twice to set a career high with 29 this season, and the Kansas City Royals rallied to beat the New York Yankees 8-4. Perez put the Royals ahead with a two-run blast in the first inning estimated at 418 feet, and he tied the game at 4 leading off the sixth. It was the fourth multi-homer game this season and 10th of his career for Perez, who marked the 10th anniversary of his major league debut.
— Adam Duvall hit a two-run homer, Stephen Vogt’s bases-loaded walk in the sixth forced in the go-ahead run and the Atlanta Braves beat the Cincinnati Reds 3-2 in a matchup of second-place teams. — Justin Upton and Phil Gosselin each had two hits and two RBIs, and the Los Angeles Angels defeated the Toronto Blue Jays 6-3 in the first game of an unusual doubleheader. The opener of a four-game series featuring the top two home run hitters in the majors didn’t produce any long balls from Shohei Ohtani or Vladimir Guerrero Jr. Toronto batted last and was the “home” team at Angel Stadium in the first game, a makeup from an April 11 rainout at the Blue Jays’ temporary home field early this season in Dunedin, Florida. In the regularly scheduled nightcap, the Angels will be the home team.
— J.A. Happ combined with a trio of relievers on a one-hitter, Tommy Edman and Paul DeJong homered early and the St. Louis Cardinals beat the skidding Pittsburgh Pirates 4-1. Comtois was the leading scorer for the NHL’s lowest-scoring team last season, posting a team-best 16 goals and 33 points in 55 games for the Ducks. LaFleur said Rodgers will “most likely not” play in any preseason games.
— Denver coach Vic Fangio has chosen Drew Lock to start the Broncos’ preseason opener this weekend at Minnesota. Fangio says Lock gets the nod because he’s the incumbent quarterback. He’s in a training camp competition with veteran Teddy Bridgewater. There’s been little separation between the two so far at training camp.

While Garrett is out, Browns starting linebacker Anthony Walker Jr. returned on a limited basis after missing a week with a knee injury.

Dawkins is no longer wearing a mask while watching practice from the sideline.
— Saints veteran cornerback Patrick Robinson is retiring despite being a candidate for a starting job. Robinson was a 2010 first-round draft choice by New Orleans and turns 34 in September. He’d been getting first-team snaps as the Saints try to fill a vacancy created when they allowed Janoris Jenkins to become a free agent in a cost-cutting move. Coaches charged with murder in heat death of Georgia student
JONESBORO, Ga. (AP) — A grand jury has charged two coaches with murder and child cruelty in the death of a Georgia high school basketball player who suffered a heat stroke after practicing outdoors in nearly 100-degree weather.
Court records indicate the Atlanta-area grand jury indicted Larosa Walker-Asekere and Dwight Palmer last month. Sixteen-year-old Imani Bell was a junior at Elite Scholars Academy in Clayton County. She was participating in required conditioning drills for the girls’ basketball team in August 2019 when she collapsed after running up the football stadium steps. She died later that day of heat-related cardiac arrest and kidney failure. Court records don’t list an attorney for either defendant.
In world and national news…
WASHINGTON (AP) — Democrats have pushed a $3.5 trillion framework for bolstering family services, health, and environment programs through the Senate. The chamber’s party-line approval of the budget resolution advances President Joe Biden’s expansive vision for reshaping federal priorities. And it happened just hours after senators handed him a triumph on a companion $1 trillion infrastructure package. The budget’s passage was crucial for a president and party set on training the government’s fiscal might at assisting families, creating jobs and fighting climate change. That’s because the fiscal blueprint will protect a subsequent bill this fall actually enacting Democrats’ policies from GOP Senate filibusters that would kill it.
ALBANY, N.Y. (AP) — New York Lt. Gov. Kathy Hochul is preparing to take the reins of power after Gov. Andrew Cuomo announced he would resign from office. The western New York Democrat will become New York’s first female governor in two weeks following an unorthodox transition period in which Cuomo has said he will stay on and work to ease her into the job. Hochul stayed out of public sight Tuesday but said in a statement that she was “prepared to lead.” Cuomo announced Tuesday that he would resign rather than face a likely impeachment trial over allegations that he sexually harassed several women. He denies touching anyone inappropriately.
KABUL, Afghanistan (AP) — Officials says the Taliban seized three more provincial capitals in Afghanistan and a local army headquarters in a blitz across the country’s northeast. The insurgents now control some two-thirds of the nation as the U.S. and NATO finalize their withdrawal after its decades-long war there. The fall of the capitals of Badakhshan and Baghlan provinces to the northeast and Farah province to the west put increasing pressure on the country’s central government to stem the tide of the advance, even as its lost a major base in Kunduz on Wednesday. SEOUL, South Korea (AP) — North Korea has repeated a threat to respond to U.S.-South Korean military exercises it claims are an invasion rehearsal, while the United States insisted the drills were “purely defensive in nature” to maintain the South’s security. A senior North Korean official condemned South Korea for continuing the drills and warned of counteractions that would make Seoul “realize by the minute” it had walked into a security crisis. Reports say preliminary work is underway before larger computer-simulated drills start next week. State Department spokesperson Ned Price stressed “the United States harbors no hostile intent” toward North Korea and said the U.S. supported inter-Korean dialogue.
SINGAPORE (AP) — World stocks are mixed ahead of U.S. inflation data offering a glimpse at how the world’s largest economy is recovering. European indexes climbed in early trading, while S&P 500, Dow and Nasdaq futures fell. Analysts are expecting the latest U.S. headline inflation rate, due Wednesday, to grow at a slower pace of 5.3% in July from a year earlier. This is slightly lower than June’s 5.4%. Air travel fares and used cars were driving past increases, but investors will be looking at food and housing prices in the new data. They are also looking at the spread of the coronavirus and the impact on restrictions to curb transmission of the virus.
