MINOT, N.D. (AP) — The North Dakota Supreme Court has ruled that a Minot man should not have been convicted of child abuse for allegedly assaulting a woman in front of a young girl. Brent Castleman was found guilty last year of a Class B felony after the jury watched a recording of the assault and the girl crying after witnessing the attack. Castleman was sentenced in January 2021 to five years in prison. The Supreme Court said in an opinion released last week that the incident does not qualify as child abuse under state law because prosecutors did not prove that there was any lasting effect to the girl’s psychological, emotional, or mental health. Castleman will be released from the James River Correctional Facility in Jamestown

FARGO, N.D. (AP) — A federal judge says defense attorneys cannot use intellectual disability as a factor in the second death penalty debate for a man convicted in the 2003 kidnapping and killing of University of North Dakota student Dru Sjodin. Judge Ralph Erickson last year ordered a new sentencing phase for Alfonso Rodriguez Jr., after ruling that misleading testimony from the coroner and other factors had violated Rodriguez’s constitutional rights. Defense attorneys then asked Erickson to reconsider intellectual disability as a defense. The judge said in an order last week that it cannot be used to consider Rodriguez’s eligibility for capital punishment. Rodriguez, a convicted sex offender from Crookston, Minnesota, is being held in a federal jail.

MELBOURNE, Australia (AP) — An Australian judge has reinstated tennis star Novak Djokovic’s visa, which was canceled last week because he is unvaccinated for COVID-19.

Circuit Court Judge Anthony Kelly also ordered the government to release Djokovic from Melbourne hotel quarantine within 30 minutes of his decision.

The Australian government canceled the visa shortly after Djokovic arrived in Melbourne last week because officials decided he didn’t meet the criteria for an exemption to an entry requirement that all non-citizens be fully vaccinated for COVID-19.

Djokovic is in Australia to compete in the Australian Open, which he has won nine times.

The judge noted that Djokovic had provided officials at Melbourne’s airport with a medical exemption given him by Tennis Australia.

In world and national news…

NEW YORK (AP) — Doctors are working to save the lives of several people gravely injured when smoke from a fire knocked them out or trapped them in their apartments in a New York City high-rise building. Nineteen people, including nine children, died in the blaze. Dozens of people were in the hospital Monday, and as many as 13 were in critical condition. Sunday’s fire in the Bronx is already the city’s deadliest in three decades. Investigators determined that a malfunctioning electric space heater started the fire in the 19-story building. The flames damaged only a small part of the building, but smoke escaped through the apartment’s open door and turned stairwells into dark, ash-choked horrors.

CHICAGO (AP) — Chicago school leaders are canceling classes for a fourth day in the nation’s third-largest school district, taking the dispute with the teachers union over remote learning and COVID-19 protocols into another week. The announcement Sunday came as individual principals of some schools had already notified some parents that their children could not return to schools on Monday due to staffing shortages. Chicago schools face the same pandemic issues as others nationwide, with a growing number of districts reverting to remote learning as infections explode during the omicron-fueled surge and sideline staff. But the situation in union-friendly Chicago has been amplified in a labor dispute that’s familiar to families in the mostly low-income Black and Latino district.

ROME (AP) — Pope Francis is now speaking about getting the coronavirus vaccination as a “moral obligation.” Francis used some of his strongest words yet calling for people to get vaccinated in a speech to ambassadors accredited to the Holy See on Monday. He denounced how people had been swayed by “baseless information” to refuse one of the most effective measures to save lives. Francis has generally shied away from speaking about vaccination as a “moral obligation,” though his COVID-19 advisory body has spoken of a “moral responsibility.” On Monday he said that individuals had a responsibility to care for themselves “and this translates into respect for the health of those around us.”

BEIJING (AP) — Asian stock markets are mixed after Wall Street fell on worries the Federal Reserve will raise interest rates as soon as March. Shanghai and Hong Kong advanced. Seoul and Sydney declined. Japanese markets were closed for a holiday. Oil prices rose. Investors were rattled last week after notes from the latest Fed meeting showed officials thought the U.S. job market is healthy enough that it might no longer need ultra-low interest rates and other stimulus. That was reinforced by U.S. employment numbers Friday that showed stronger-than-expected wages, though with only about half as much hiring as forecast. Wall Street’s benchmark S&P 500 index declined but was within 2.5% of its record high.

WASHINGTON (AP) — Republican Rep. Jim Jordan of Ohio, one of former President Donald Trump’s closest allies in Congress, has rejected a request for an interview by the House panel investigating the Jan. 6 Capitol insurrection. In a combative letter Sunday to committee chairman Bennie Thompson, Jordan says, “The American people are tired of Democrats’ nonstop investigations and partisan witch hunts.” Thompson told Jordan in a letter last month that the panel wants him to provide information surrounding his communications with Trump on Jan. 6 and Trump’s efforts to challenge the result of the 2020 election.

GENEVA (AP) — Senior U.S. and Russian officials have formally launched special talks on strategic stability as part of a flurry of diplomatic activity in Europe this week aimed at defusing tensions over a Russian military buildup on the border with Ukraine. Russian Deputy Foreign Minister Sergei Ryabkov led a delegation arriving by Swiss police escort at the U.S. diplomatic mission in Geneva for the latest round of face-to-face talks with Wendy Sherman, the U.S. deputy secretary of state, and her team.
