Fargo (CSi) Attorney General Drew Wrigley says the State Bureau of Criminal Investigation will conduct a thorough investigation into the deadly shooting of a Jamestown man by a Fargo police officer.
28-year-old Shane Netterville died after he was shot by Officer Adam O’Brien.
Cass County State’s attorney birch Burdick has now asked his office to review the results of the investigation and determine whether the shooting was justified. He did not give a timeline on when the investigation will be completed.

About 50 people gathered Monday evening outside Fargo City Hall to press for the video’s release. Wrigley says the footage will be made public once all the proceedings are complete. He says law enforcement rarely releases evidence to the public ahead of the conclusion of a case. A police reports states that Officer Adam O’Brien, an 11-year veteran of the department, shot Netterville after he drove a van directly toward officers.

The shooting came after a report of two people slumped over in the van. When police arrived, Netterville sped out of the garage and was shot. Court documents filed by prosecutors say a van drove toward Fargo police officers before one of the officers fatally shot the man behind the wheel. Police Chief David Zibolski previously said he does not know how O’Brien interacted with the van prior to the shooting, including whether O’Brien believed the vehicle was going to run him over.
O’Brien has been placed on paid administrative leave while the case is being reviewed by the Bureau of Criminal Investigation. Another man was arrested at the scene after he ignored commands of officers and was found to have methamphetamine. A third person who was in the van remains at large, he is identified as 31 year old Derek Stanley. He’s about 5 feet 9 to 5 feet 11 inches tall with a medium build, with short hair.

The court documents filed Monday outline charges against 25-year-old Cody Kenneth Dunn of Devils Lake, North Dakota. Prosecutors allege Dunn was in the van with Netterville and fled the scene.

Police Chief Dave Zibolski says the 28-year-old Jamestown man, who has not been publicly identified, died at a hospital several hours after the shooting at an apartment building in the 3400 blk. of 15th Ave. S. The shooting occurred shortly after 8 a.m. Friday.
The officer, an 11-year veteran of the force, has been placed on paid administrative leave while the case is being reviewed by the state Bureau of Criminal Investigation.
25-year-old Colby Dunn with no permanent address, a passenger in the van, was arrested at the scene for not following commands of officers to stop and having methamphetamine.
A search continues for another passenger who police are still trying to identify.
Zibolski says the shooting will be reviewed by the Cass County State’s Attorney’s Office once the state investigation is concluded.

FARGO, N.D. (AP) — Authorities say a Fargo police officer shot a person Friday morning after law enforcement responded to a medical emergency call. City spokesperson Katie Ettish says the person was taken to a local hospital after the incident Friday morning outside a south Fargo apartment complex. The person’s condition is not known. KFGO radio reports that the officer was not hurt. The circumstances leading up to the shooting have not been disclosed.
