Valley News Live (Jamestown ND) – The man who allegedly assaulted three law enforcement officers in Jamestown has been charged with multiple felonies, while the woman who initially called 911 has recanted her allegations against him, according to court documents filed in Stutsman County District Court.

Dylan Jay Biloff, 38, of Jamestown, faces two charges of simple assaule on a peace officer, preventing arrest, and disorderly conduct following his November 12 arrest.

The charges stem from an incident in the 600 block of 34th Avenue NW, where officers responded to a 911 call in which a woman reported that her fiancé was putting his hands on her, according to court documents.

The woman initially told a Jamestown Police Officer that Biloff had tried to smother her by putting a pillow case over her head. However, court documents say the woman later recanted her previous statements, saying that Biloff had not assaulted her that night.

Despite the recantation, his charges for assaulting the officers remain.

Court documents reveal specific details about how the officers were injured during Biloff’s arrest. Sgt. Andrew Stoen was struck in the face, causing an injury. Officer Carson Toedter sustained a knee injury described as a “popping sound followed by pain and instability/weakness” during a struggle when Biloff attempted to flee.

Deputy Sam Potter of the Stutsman County Sheriff’s Office sustained a cut inside his lip and neck pain during the arrest.

The probable cause statement details Biloff’s repeated attempts to evade arrest. When he was told he was being detained, Biloff reportedly tried to retreat inside his residence. After being handcuffed, he tried to flee again while being escorted to a patrol vehicle.

Officers used a restraint device to secure Biloff before transporting him to the Stutsman County Correctional Center. All three officers were treated at Jamestown Regional Medical Center and released.
