buehnerValley City (CSi) Valley City Fire Chief Gary Retterath says the body of one of three men thrown out of a rubber raft early Monday morning on the Sheyenne River in Valley City was located beneath the 8th Avenue bridge in Southwest Valley City, about 10:20-a.m., Tuesday about 200 yards from where he went into the river.

The call coming into 9-1-1 about 1:15 a.m., Monday.

The body was identified as 23 year old Dan Buehner, a senior, at VCSU, from Blaine, Minnesota.

Buehner’s body has been transferred to the Grand Forks medical examiner’s office for an autopsy.

Buehner was a member of the VCSU baseball team (photo). The baseball team has canceled its scheduled games on Tuesday and Wednesday. The Vikings were scheduled to host University of Winnipeg on Tuesday, April 22, and play at University of Jamestown on Wednesday, April 23.

Earlier Tuesday, water releases were reduced to 50 cfs from Bald Hill Dam to reduce the water level in an effort to help searchers recover the body.

They got into the raft near the footbridge by West Main Street and floated downstream on the fast-moving river about a half mile to the Little Dam, where they ended up in tailwater that was at least 12 feet deep.

Valley City Police Chief Fred Thompson says 22-year-old Ryan Shaw and 21-year-old Hayden Johnson made it ashore, but Buehner did not.

Buehner was last seen in the tailwater of the “Little Dam.”

Shaw and Johnson are recovering from hypothermia at Mercy Hospital, as the National Weather Service says the water temperature was 40 degrees.

Their condition has not been released.

Thompson says the three were not fishing and that no paddles or lifejackets were found after the raft capsized.

Authorities continue to investigate what led to the incident. and if any criminal charges would be in order.

Since Monday morning searchers had been using boats and walking along river banks with search dogs, looking for the missing person.

Retterath says members of Valley Water & Rescue out of Fargo assisted Valley City crews by using a sonar device to help search for the missing man, as the water released from Bald Hill Dam was cut back about 3:30 a.m., Monday to aid in the search, as the river was high and dangerous when the incident occurred.

Tuesday morning, Valley City State University President Dr. Steven Shirley said “It is with a heavy heart and great sadness to inform you that authorities this morning discovered the body of VCSU student Dan Buehner in the Sheyenne River. Dan was a senior majoring in business administration and played catcher on the VCSU Baseball Team. He was from Blaine, Minnesota.”

Valley City Mayor Bob Werkhoven said, “It puts some closure on the tragic situation for the family and the city of Valley City.”

Jamestown (CSi) A former University of Jamestown student, 19 year old Robert Flores, Tuesday was found guilty of terrorizing Tuesday in Southeast District Court, in Jamestown. The jury of five men and seven women deliberated for about four hours before reaching the verdict.

Robert Flores, originally from Southgate, California, currently living in Valley City, showed no emotion as the verdict was read.

He, his family and William Mackenzie, court-appointed defense attorney, declined to comment on the verdict.

Prosecuting attorney Katherine Marilyn Naumann, said she was pleased with the decision and commended the judge and jury for the decision.

Flores was accused of threatening to kill and drink the blood of three University of Jamestown students in satanic rituals. The threats resulted in the university campus being placed on lockdown for about an hour on November 7, 2013. No one was hurt in the incident.

He was picked up by Jamestown Police later that morning in downtown Jamestown.

Testifying in his own behalf, Flores said he had no recollection of the time period due to a combination prescription drugs and ingesting two or more bottles of cough syrup each day.

A sentencing date for Flores will be set later. The charge, a Class C felony, carries a maximum sentence of five years in prison and a $10,000 fine.

 

Jamestown (CSi) The Jamestown Rural Fire Department responded to a grass fire southwest of Jamestown at 3:10 p.m. Tuesday.

Five units and 10 firefighters responded to the call.

Reports indicate that the grass fire had spread into a nearby shelterbelt.

No damage estimate was immediately available.

 

Jamestown (CSi) The Jamestown City Council’s Finance & Legal, Building Planning & Zoning, and Civic Center & Promotion Committee met Tuesday evening at City Hall.

With Finance and Legal Committee business:

The committee recommends approving the request from the JSDC for Economic Development Funds in the amount of $40,000 to provide a Flex PACE interest buy down to Custom Contracting Solutions, with the City Share to be $8,000 and paid from the City Sales Tax Fund. The business is located in Stutsman County, outside city limits.

Recommends approving the request from the JSDC for Economic Development Funds in the amount of $15,000 to provide ACT Stutsman County program funding, with the City Share to be $12,000 and paid from the City Sales Tax Fund.

The committee recommends approving the request from the JSDC for Economic Development Funds in the amount of $100,000 as a pledge to the ND State College of Science Manufacturing Training Center to be paid over 4 years and contingent upon local industry support, with the City Share to be $20,000 per year and paid from the City Sales Tax Fund.

The committee recommends the recommendation from the JSDC to allow the purchase of Lot 2, Block 1, I-94 Business Park Addition to Charlie Rickets and Ben Pesek, in the amount of $67,954.

The committee recommends approving the recommendation from the JSDC to enter into an Addendum Agreement with Kal Patel to extend the option to purchase Lot 1 and the southerly 85.82 feet of Lot 2, Block 3, I-94 Business Park Addition through May 14, 2014.

Bismarck (CSi) North Dakota Insurance Commissioner Adam Hamm recently served a cease and desist order against Robert Lewis Heier, a resident of Kathryn and his business in Valley City, Dakota Bond & Tracking.

The order alleges Heier wrote bail bonds in North Dakota over a two-year period without having the necessary authorization to do so legally. The order bars Heier and anyone working with him from engaging in the business of insurance.

Bail bond agents must have a valid insurance agent license in North Dakota and must be appointed by an insurance company selling surety bonds. Heier is licensed but allegedly not appointed with a surety insurance company.

Hamm says, “Bail bond agents must be trustworthy to protect consumers and the court system. Anyone that has done business with Mr. Heier and has questions or concerns is encouraged to contact the Insurance Department at 1-800-247-0560.”

Heier has a right to request an administrative hearing within 30 days.

 

FARGO, N.D. (AP) – An Alaska Airlines flight en route from Boston to Seattle made an unexpected stop in North Dakota when a passenger had a medical problem.

The  plane landed at Hector International Airport in Fargo on Tuesday night, and the passenger was removed from the plane and taken to a hospital.

The flight resumed a short time later.

 

DICKINSON, N.D. (AP) – Police say a 33-year-old Mandan man accidently lit himself on fire at a Dickinson gas station while high on meth.

The  man poured gas on himself after he thought police had sprayed him with chemicals.  He lit a cigarette afterward and accidently caught fire. He then ran through a carwash to put out the fire.

A witness called police and told them the man then stole a car. He eventually ditched the car and entered a home. Police found him there later with 2nd- and 3rd-degree burns on much of his body.

Dickinson Police Capt. Dave Wilkie says the man hasn’t been officially charged yet. He faces seven counts including ingestion of a controlled substance, theft of a motor vehicle and criminal trespassing.

 

BISMARCK, N.D. (AP) – A North Dakota man accused of punching and strangling his girlfriend has pleaded guilty in federal court.

Christopher McMillan, of New Town, is charged with assault of a dating partner resulting in substantial bodily injury. He faces a maximum penalty of five years in prison.

The incident happened on the morning of Dec. 9. Authorities say McMillan and his girlfriend began drinking after she got her children ready for school. The assault happened about 11 a.m.

Sentencing is scheduled for July 28.

 

MINOT, N.D. (AP) – A truck driver from Georgia has pleaded not guilty to three counts of negligent homicide stemming from a fiery crash in the western North Dakota oil patch that killed three men.

Fifty-year-old Vernon Wright, of Hiram, Ga., could face up to 15 years in prison if convicted.

Authorities allege that Wright was driving a tanker trailer filled with crude oil and was at fault for a crash on U.S. Highway 2 three miles east of Stanley last June. The tanker trailer exploded and five other vehicles involved in the accident burned for about five hours at the crash site. Two men from Minot and one from Rhame were killed.

A judge on Tuesday did not immediately set a trial date for Wright.

 

BISMARCK, N.D. (AP) – North Dakota landowners have been given more time to apply for grants to enhance their property and restore habitat damaged by overland flooding, erosion, and weed infestations.

Agriculture Commissioner Doug Goehring has extended the deadline to May 9 for the second round of grants through the Land Enhancement and Habitat Renewal Program.

Goehring says the program will provide up to 50 percent reimbursement of most costs associated with reclamation, landscaping, soil conditioning, re-vegetation and weed control. Proposed projects must involve land that has at least 10 percent woody vegetation or is adjacent to wooded vegetation.

Goehring says $50,000 is available for this year’s program. Last year, the state Agriculture Department distributed 11 grants totaling $40,000.

 

BISMARCK, N.D. (AP) – The U.S. Department of Agriculture says it’s providing $8 million in financing for five projects to improve water and wastewater services in rural North Dakota.

USDA state director Jasper Schneider says the funding will help improve water quality and protect the environment and natural resources.

Schneider says the USDA will provide $4.3 million in grants and $3.6 million in loans to the rural cities of Rolla, Napoleon, Oakes and Michigan. Included in that $3.6 million is about $800,000 to expand rural water to the Berthold and Carpio area.

 

BISMARCK, N.D. (AP) – North Dakota oil companies don’t like a proposal that would have the industry cut back on oil production to control the amount of natural gas that’s being wasted.

Companies spoke out against the proposal at a hearing Tuesday in Bismarck. Instead, the industry wants regulators to consider self-imposed steps to curb natural gas flaring.

North Dakota drillers currently burn off, or flare, a record 36 percent of the valuable gas because development of gas pipelines and processing facilities haven’t kept pace with oil drilling.

Oil industry officials have pledged to capture 85 percent of the gas by 2016, and 90 percent within six years as infrastructure catches up with oil development.

Watford City physician Lyle Best says slowing oil development would improve many problems in the state, including flaring.

 

FARGO, N.D. (AP) – A week of cooler-than-normal temperatures has delayed spring planting in North Dakota.

The federal Agriculture Department now pegs the average start of field work at April 29. That’s a day later than last week’s estimate and three days later than the projection two weeks ago. The 10-year average start date in North Dakota is April 20. The average over the past five years is April 25.

The Agriculture Department says in its weekly crop and weather report that only about 1 percent of the state’s staple spring wheat crop is in the ground, compared with 10 percent on average.

Both topsoil and subsoil moisture supplies in North Dakota are rated more than 90 percent adequate to surplus.

 

BISMARCK, N.D. (AP) – Gov. Jack Dalrymple has proclaimed April as Safe Digging Month in North Dakota.

In recognition, the North Dakota Public Service Commission is reminding everyone of the potential dangers and consequences of digging without first calling 811, North Dakota’s Call-Before-You-Dig number.

Since 2009, the PSC says it has taken enforcement action in more than 20 cases related to violations of the Call-Before-You-Dig law.

Regulators say the consequences of striking an underground utility can result in injury or death, service interruptions or damage to the environment.

Officials say there were more than 1.1 million requests in North Dakota last year requesting locations of utilities.

GRAND FORKS, N.D. (AP) – The NHL’s Edmonton Oilers have signed University of North Dakota senior defenseman Dillon Simpson to a three-year entry level contract.

The Oilers drafted the 6-foot-2, 197-pound Edmonton native in the fourth round, 92nd overall, in the 2011 NHL Draft. Simpson’s father, Craig, played for the Oilers in the late 1980s and early 1990s.

Dillon Simpson says being signed by the team that he cheered for growing up is “a little bit surreal.”

Terms of Dillon Simpson’s contract were not released. He will finish his schooling at UND rather than immediately join the Oilers’ AHL affiliate Oklahoma City Barons.

Simpson had 16 goals and 59 assists in 156 games at UND. He captained the team to the NCAA Frozen Four last season.

MINNEAPOLIS (AP) – Flip Saunders has started the search for a new Minnesota Timberwolves coach with a clear list of parameters. He says he wants someone with a head coaching track record who will hold players accountable and command respect from the moment he takes the job. That list would seem to point to Saunders hiring a well-known coach to fill the opening created by Rick Adelman’s retirement.

UNDATED (AP) – San Antonio’s Gregg Popovich has joined Pat Riley and Don Nelson as the only coaches to win the NBA’s Coach of the Year Award three times. MINNEAPOLIS (AP) – The Minnesota Vikings return to playing home games outdoors when they open the preseason August 8th against the Oakland Raiders. Minnesota opens the preseason with a 7 p.m. Friday game against Oakland at the University of Minnesota’s outdoor stadium.  The Vikings will play the next two seasons at TCF Bank Stadium.

NEW YORK (AP) – Major League Baseball has doled out its punishment to players involved in Sunday’s brawl between the Milwaukee Brewers and Pittsburgh Pirates. Brewers catcher Martin Maldonado (mahr-TEEN’ mal-dah-NAH’-doh) has begun serving a five-game suspension last night against San Diego. Brewers outfielder Carlos Gomez was suspended for three games, Pittsburgh outfielder Travis Snider received a two-game penalty and Pirates catcher Russell Martin got a one-game ban, but the three are appealing their suspensions.

TOKYO (AP) – President Barack Obama has opened a four-country visit to the Asia-Pacific region to reassure U.S. partners there. Obama arrived in Japan today and dove right in with a private dinner with Japanese Prime Minister Shinzo Abe (shin-zoh ah-bay) before bilateral talks tomorrow.

CANBERRA, Australia (AP) – Officials aren’t describing material that washed ashore in Australia and is being examined to determine if it comes from a missing Malaysian airliner. Meanwhile, Australia’s prime minister says failure to find anything in the current search doesn’t mean they’ll stop looking. More powerful sonar is being brought in.

FRANKFURT, Germany (AP) – The 18 country eurozone is providing one of the clearest signs yet that the economic recovery is gaining momentum. A closely-watched survey has found business activity across the 18-country eurozone running at a three-year high. Analysts say that could take some of the pressure off the European Central Bank to take further steps to stimulate the economy.

PARIS (AP) – French authorities are trying to put a lid on an apparently increasing number of young people trying to get to Syria and become jihadis in the civil war. The Interior Ministry has announced measures that include encouraging parents to alert police to concerns they have about their children’s intentions, so that travel restrictions can be put in place. Authorities will also withdraw passports from individuals suspected of wanting to travel to Syria.

PARIS (AP) – A study by the U.N. education agency says cellphones could be one key to reducing high illiteracy in countries where books are rare. Paris-based UNESCO says 774 million people worldwide cannot read, and most people in sub-Saharan Africa don’t own any books but cellphones are increasingly widespread. The report says large numbers of people in such countries are reading books and stories on “rudimentary small-screen devices.”
