Update

Jamestown (CSi) Authorities, Friday evening, arrested a 37 year old man and a 17 year old male after an alleged robbery in Jamestown, followed by a pursuit that ended in northern Barnes County.

The pair are accused in the incident where a woman’s purse was stolen, between 5-p.m., and 6-p.m., witnessed by a man, in the parking lot between Perkins Restaurant and First Community Credit Union’s branch office, on Highway 281 South. The woman was then purportedly pushed to the ground by one of the males.

A witness called 9-1-1 and shortly after, a North Dakota Highway Patrol unit pursued the suspect vehicle on I-94 at mile marker 277 east bound. The vehicle crossed I-94 and went back west bound on the interstate, exiting at mile marker 276 and headed north on Barnes County Road 7. The vehicle continued through Eckelson on a gravel road. The suspect’s vehicle was able to distance itself from law enforcement.

As the search for the vehicle continued, deputies were alerted by a person who was hunting geese in the area. The suspect’s vehicle became stuck in a slough and the pair fled on foot.

The two suspects were captured and taken into custody by two Barnes County deputies.

The vehicle was impounded and taken back to Jamestown.

37 year old Darrell Boggs of Hazen is charged with 19 charges, including 13 felonies, in Stutsman and Barnes Counties.

Boggs was charged with 10 Class C and two Class B felony charges in Stutsman County, including robbery, criminal conspiracy to commit robbery, felon in possession of a firearm and five drug-related charges.

In Barnes County, Boggs is charged with a Class C felony, possession of a controlled substance, methamphetamine. He is charged with three Class B misdemeanors: carrying a loaded firearm in a motor vehicle, drove or in actual physical control of a motor vehicle while under the influence of alcohol or drugs and reckless driving. Boggs is also charged with fleeing or attempting to flee a police officer, a Class A misdemeanor.

A preliminary hearing is scheduled for 2:30 p.m. on May 27 for the Barnes County charges. No date has been set for a preliminary hearing on the Stutsman County charges.

Boggs is in the Stutsman County Correctional Center on a $250,000 cash bond.

The 17-year-old male was also allegedly involved in the robbery, but no details have been released about the juvenile. The suspect is being held in a youth correctional facility in Cass County,

Valley City (CSi) The Barnes County Sheriff’s office is informing the public of a High Risk Sex Offender living in the county.

Robert Joseph Schultz (aka Joe Schultz) is a High Risk Sex Offender, a life time registrant, now living at 230 2nd Street in Eckelson, North Dakota.

Schultz was convicted in Jefferson County, Colorado on December 22, 1997 of Sexual Assault on a Child.

Jamestown (CSi) The week of April 28th thru May 2nd has been designated, “Severe Summer Weather Awareness Week,” for the entire state of North Dakota by Governor Jack Dalrymple. This annual event is designed to remind the public of the dangers associated with severe summer weather including: lightning, high winds, large hail, flash floods and tornadoes. All of which, can cause severe property damage, personal injury, and even death.

 As part of the awareness week activities, the annual statewide tornado exercise will also be conducted. This year, the exercise has been scheduled to begin at about 11:15 a.m. on Wednesday, April 30 with a simulated tornado warning issued by the National Weather Service. In response to this simulated warning, a countywide exercise of the emergency operations plan will also take place. The plan is designed to warn the greatest number of people in the least amount of time.

 As part of the exercise, sirens will be activated in area communities including the City of Jamestown. In most communities, sirens will be activated for approximately 3 minutes. In addition, the simulated warning will be broadcast over the National Weather Service all-hazards weather radio system, local AM/FM radio stations and local cable television interrupt systems.

 During the summer, the most common reason a community’s warning sirens are activated is to warn the public of a possible tornado. However, the sirens could also be activated to alert the public of other types of events that could be a danger to the community. Hearing the sirens is the signal to tune into any of the local radio stations and to follow official instructions being broadcast. Cable television subscribers will also be able to turn on their TV and hear official instructions being broadcast by either the National Weather Service or officials at the Law Enforcement Center.

 

Jamestown (CSi) On May 4th the American Legion Auxiliary in Jamestown will host a Tea, to commemorate members of the club that have served for 50 years or more.

On Tuesday’s Wayne Byers Show on CSi Cable 2,auxiliary member, Delores Rath, said, all of these members will be honored during the event at the All Vets Club on Sunday, May 4th, beginning a 1-p.m. The event is free and open to the public. The guest speaker will be First Lady Betsy Dalrymple. She added that auxiliary members from around the region have been invited to attend.

Also on the show, long-time Auxiliary member Merna Ronholm, said there are currently 30 members in the region that have served with the American Legion Auxiliary with 50 years of service or more, six local member including Merna.

She pointed out that the American Legion Auxiliary in Jamestown activities and service includes visiting nursing homes, providing cookies to patients waiting at the Jamestown V.A. Clinic, along with sponsorship of Girl’s State, and the Poppy Distribution program.

She added the poppies are put together by residents of the Veterans Home in Lisbon, with proceeds going to veterans programs.

Merna added that the American Legion Auxiliary is the world’s largest patriotic organization established in 1919, supporting the American Legion’s service to veterans.

She said to become a member of the auxiliary the individual must either be a veteran, or have an affiliation to a veteran.

 

Valley City (CSi) Visitation and Funeral services have been set for Daniel C. Buehner, in Lino Lakes, Minnesota.

Buehner was a Valley City State University business student and baseball player.

Buehner died in a rafting accident on the Sheyenne River in Valley City on April 21, 2014.

WEST FARGO, N.D. (AP) – A West Fargo man accused of attacking his neighbor with a tomahawk has been charged with attempted murder.
 
     Thirty-year-old Kokouvi Afidegnon is accused of attacking the woman on Friday while she was walking to her car.
 
     Police originally believed the woman was attacked with a hatchet, but later found a tomahawk lodged in the wall of an apartment building. The victim suffered a head injury.
 
     Afidegnon is also charged with aggravated assault, reckless endangerment, criminal mischief and simple assault.
 
     The defendant’s lawyer was not immediately available for comment.

 

 WILLISTON, N.D. (AP) – A judge has ordered a Williston man serve to five years in prison for hindering authorities investigating the fatal shooting of an area hobby rancher.
 
     District Judge Paul Jacobson sentenced 31-year-old Issac Steen on Monday but gave him 300 days credit for time served. Prosecutors say Steen failed to notify police after Jack Sjol’s (shohl) body was left in a family dump near his home for three weeks after the rancher was killed.
 
     Ryan Stensaker is accused of killing Sjol and is scheduled for trial in July on a murder conspiracy charge.
 
     Three other people also face charges in the killing.

 

BISMARCK, N.D. (AP) – A North Dakota judge has sentenced a white supremacist to four years of supervised probation but no additional prison time for terrorizing the small community of Leith, where he tried to set up an all-white enclave.

Sixty-two-year-old Craig Cobb has been jailed since November when he was arrested on felony charges that he scared residents while patrolling Leith with a gun.

Cobb says his actions were in response to violence and harassment directed toward him.

He has since sold most of his Leith properties and in late February agreed to a plea agreement. The deal allowed him to plead guilty to five misdemeanor menacing counts and one felony terrorizing charge.

In return, Judge David Reich sentenced him Tuesday to probation

 

 WILLISTON, N.D. (AP) – Unpaved roads in two North Dakota oil-producing counties have been closed to heavy vehicles due to recent rain and snow.
 
McKenzie and Williams counties have closed all gravel roads to vehicles weighing more than 12,000 pounds. Gravel roads crisscross the state’s oil patch and are essential to the oil industry in the area.
 
     Officials say roads in McKenzie County will be re-evaluated at 8 a.m. on Wednesday. Williams County officials say the roads in their county will remain closed until conditions improve.
 
     The McKenzie County Sheriff’s Department warns that willful damage to public roads is a Class B misdemeanor. The Sheriff’s Department’s Facebook page advises drivers of heavy vehicles who were on unpaved roads before the restrictions went into effect Monday to stay onsite.

 

 BISMARCK, N.D. (AP) – Some state employees and others are slated to bag lunch and instead walk laps around the state Capitol in Bismarck.
 
     Today is National Walk at Lunch Day. First Lady Betsy Dalrymple and Lt. Gov. Drew Wrigley’s wife, Kathleen, are slated to lead the ceremonial first lap around the Capitol at 11:30 a.m. on Wednesday.
 
     The effort is part of a nationwide initiative aimed at encouraging Americans to take time to walk on their lunch breaks to help improve their health.

 

 BISMARCK, N.D. (AP) – State data show that 1 billion barrels of oil have been produced from the rich Bakken shale formation in western North Dakota and eastern Montana.
 
     Drillers first targeted the Bakken in Montana in 2000 and moved into North Dakota about five years later using advanced horizontal drilling and hydraulic fracturing techniques.
 
     Data show that North Dakota has tallied 852 million barrels of Bakken crude, and Montana has produced about 151 million barrels.
 
     The Bakken encompasses some 25,000 square miles in North Dakota, Montana, Saskatchewan and Manitoba. About two-thirds of the acreage is in western North Dakota.
 
     Oklahoma-based Continental Resources is the biggest leaseholder in the Bakken. The company says two-thirds of the production from the Bakken has come in the past three years.

 

FARGO, N.D. (AP) – Cool, wet conditions over the past week have hampered North Dakota farmers trying to get their crops in the ground.
 
     The federal Agriculture Department says in its weekly crop and weather report that only about two days were suitable for field work. The department now pegs the average start of field work in North Dakota at May 1, two days later than last week’s estimate.
 
     The 10-year average start date in North Dakota is April 20. The average over the past five years is April 25.
 
     The report says only about 3 percent of the state’s staple spring wheat crop is in the ground, compared with 19 percent on average.

FARGO, N.D. (AP) – The North Dakota Racing Commission has approved medication rules and penalty guidelines recommended by a national group seeking uniform standards for horse doping.
 
     The commission is backing a plan endorsed by the Association of Racing Commissioners International, or RCI. It has regulations for 26 therapeutic medications allowed to be administered to horses in certain dosages.
 
     State racing director Gunner laCour says model medication rules are important for the industry and horsemen are worried the federal government will intervene if the industry fails to adopt uniform standards.
 
     Larry Eliason, executive director of the South Dakota Commission on Gaming, says his state generally follows the RCI guidelines for horse doping, especially when it comes to determining penalties for violations.
 
     North Dakota has live horse racing at two tracks, in Fargo and Belcourt.

CHICAGO – Guard John Wall scored 24 points and capped off his first career playoff series by leading the Washington Wizards to a 75-69 victory over the Chicago Bulls at the United Center on Tuesday, clinching the best-of-seven first-round playoff series 4-1.

Washington won a playoff series for the first time since 2005, when it beat the Bulls, and for just the second time since 1982.

Coming off a one-game suspension for head-butting Jimmy Butler, Wizards forward Nene delivered another strong offensive performance, scoring 20 points.

LOS ANGELES – Several hours after owner Donald Sterling was banned from the NBA for life, the Los Angeles Clippers sprinted and soared through a playoff game as if a weight had been lifted from their collective shoulders.

The Clippers finished a tumultuous day with a 113-103 victory over the Golden State Warriors on Tuesday night, leaving their home court to high-fives and standing ovations from fans enthralled by the prospect of watching an NBA title chase without Sterling in his front-row seat.

Oklahoma City, OK- Serge Ibaka’s tip-in came a blink after the overtime buzzer sounded, and the Memphis Grizzlies stole Game 5 of their Western Conference quarterfinal series against the Oklahoma City Thunder with a dramatic 100-99 victory on Tuesday.

These evenly-matched clubs came in tied at 2-2 and played an extra five minutes for an unprecedented fourth straight game after Russell Westbrook stripped Mike Conley at the top of the key and went in for an uncontested layup with 4.0 seconds left in regulation.

PHILADELPHIA – Right winger Wayne Simmonds scored a hat trick, goaltender Steve Mason made 34 saves and the Philadelphia Flyers avoided elimination by defeating the New York Rangers 5-2 in Game 6 of their playoff series Tuesday night.

Game 7 is Wednesday at Madison Square Garden. The Rangers are 2-1 on home ice in the series.

Defenseman Erik Gustafsson and center Claude Giroux also had goals for the Flyers, who will try to become the first team to win two in a row in the series.

 

In world and national news…

 DENVER (AP) – Prosecutors in the Colorado theater shootings say the judge shouldn’t move the trial out of the suburban Denver county where the massacre occurred in 2012.
 
     In a filing made public Tuesday, prosecutors said it’s too early to consider a change of venue. They also said the defense hasn’t shown that news coverage has made it impossible to find an impartial jury.
 
     James Holmes is scheduled to go on trial in October on charges of killing 12 people and injuring 70. He pleaded not guilty by reason of insanity. Prosecutors are seeking the death penalty.
 
     Holmes’ attorneys say the trial should be moved out of Arapahoe County because potential jurors have been exposed to prejudicial news coverage and carry emotional scars from the massacre.
 
     The judge hasn’t said when he’ll decide.

 

 BALTIMORE (AP) – Health officials are investigating what may have sickened over 100 people who attended a conference where more than 1,300 food safety experts gathered.
 
     No one at the Food Safety Summit held April 8-10 in Baltimore was hospitalized, according to health officials, and most people reported cases of diarrhea.
 
     Alvina Chu, who is leading the Maryland Department of Health’s investigation, says officials haven’t yet determined what caused people to get sick. Chu says it’s not yet clear if the illness was transmitted by food or from person to person.

 

INDIANAPOLIS (AP) – Three aircraft have made emergency landings at Indianapolis International Airport within one day.
 
     Airport spokesman Carlo Bertolini says a United Airlines regional jet landed about five minutes early shortly after 8 a.m. Tuesday after reporting a possible problem with an auxiliary power unit. He had no further details.
 
     A military A10 aircraft headed from Camp Atterbury to Fort Wayne also landed safely after diverting to Indianapolis shortly before noon due to a fuel indicator problem. Bertolini says the pilot was the only person aboard.
 
     And a Delta flight carrying 112 people from Milwaukee to Atlanta landed about 2:45 p.m. due to engine trouble. Bertolini says a Delta maintenance crew was checking out the aircraft.
 
     Bertolini says it’s unusual for the airport to have three emergency landings in one day.

 

 WASHINGTON (AP) – A federal judge in Washington is giving an early push to the Obama administration’s new program to encourage nonviolent federal prisoners to apply for early release.
 
     On Tuesday, U.S. District Judge Paul Friedman encouraged the court-appointed lawyers for defendant Byron Lamont McDade to pursue clemency for McDade – a prisoner the judge sentenced to 27 years in prison over a decade ago.
 
     A week ago, the Justice Department unveiled a new clemency push directed at low-level felons imprisoned for at least 10 years who have clean records while in custody.
 
     The effort is part of an administration effort to scale back the use of harsh penalties in some drug prosecutions and to address sentencing disparities arising from the 1980s crack cocaine epidemic
 

ANCHORAGE, Alaska (AP) – The embodiment of an Alaska cliche is for sale.
 
     The massive urethane igloo that’s a must-stop for tourists heading for Denali National Park and Preserve can be had for $300,000.
 
     The 80-foot high structure, erected more than four decades ago and never completed, sits on a 38-acre site, which is part of the sales package.
 
     Owner Brad Fisher envisions the igloo turned into an eye-catching restaurant and hotel run on green power.
 
     Here’s the catch: Creating a viable business could run a new owner at least a couple million bucks getting it ready and up to code.
