1. Chairman Hillerud called the meeting to order. A motion to approve the minutes from the April 28, 2014 Planning Commission meeting was made by Commission member Bergquist. Seconded by Commission member Bensch. Unanimous voice aye vote. Motion Carried.
2. Public Hearing: Land Use Plan Amendment Request
Hearing on an application requesting a land use plan amendment from Industrial to Commercial on the East 81-feet of Lots 2 and 4, Block 2, Hi-View Second Addition and from Low Density Residential to Commercial on an unplatted 18.46 acre tract of the Southeast Quarter of Section 23, Township 140 N, Range 64 W; bordered on the east by Fifth Northwest and Second Northwest Additions, and on the west by Fourth Northwest, First Northwest, Hi-View, and Hi-View 2nd Additions. (1611 and 1601 9th Avenue NW and 1000 18th Street NW).

Chairman Hillerud opened the public hearing.
Clarice Liechty, 511 8th St SW, had questions about the land use plan and when it was adopted.
Mayor Andersen clarified that the growth management was talked about but not adopted, but the land use plan was officially adopted.
Stephanie Falkers of SRF Consulting explained the two plans.
Cynthia Schlaht of 1805 8th Ave NW, asked what is being planned in the area and is someone putting up man camps? Stephanie Falkers of SRF Consulting Group, Inc. explained what uses areallowed in the proposed zone change are.

Commission member Trautman made a motion to accept the findings of staff and recommend approval of the land use plan amendment from industrial to commercial for the east 81-feet of Lots 2 and 4, Block 2, Hi View 2nd Addition and Low Density Residential to Commercial for an unplatted 18.46 acre tract of land in the Northeast Quarter of Section 23, Township 140North, Range 64, West bordered on the east by Fifth Northwest and Second Northwest Addition s and on the west by Fourth Northwest, First Northwest, Hi-View and Hi-View Second Additions to the City Council.
Motion seconded by Ritter.
Roll Call. Unanimous aye vote. Motion Carried.
3. Public Hearing: Zone Change Request
Hearing on an application requesting a zone change from M-1 (Limited Industrial and Manufacturing District) to C-2 (General Commercial District) on the East 81-feet of Lots 2 and 4, Block 2, Hi-View Second Addition and from R-1 (One Family Residential District) to C-2 (General Commercial District) on an unplatted 18.46 acre tract of the Southeast Quarter of Section 23, Township 140 N, Range 64 W; bordered on the east by Fifth Northwest and Second Northwest Additions, and on the west by Fourth Northwest, First Northwest, Hi-View, and Hi-View 2nd Additions. (1611 and 1601 9th Avenue NW and 1000 18th Street NW).

Commission member Trefz made a motion to accept the findings of staff and recommend approval of the zone change from M-1, Limited Industrial and Manufacturing District to C-2, General Commercial District for the east 81-feet of Lots 2 and 4, Block 2, Hi-View Second Addition and from R-1, One-Family Residential District to C-2, General Commercial District for a 18.46 acre tract of land within the SE ¼ of Section 23, Township 140, Range 64; bordered on the east by Fifth Northwest and Second Northwest Additions and on the west by Fourth Northwest, First Northwest, Hi-View, and Hi-View Second Additions to the City Council. Motion seconded by Rath. Roll Call. Unanimous aye vote. Motion Carried.
4. Public Hearing: Zone Change Request (CONTINUED TO JUNE)
Hearing on an application requesting a zone change from R-1 (One Family Residential District) to P-O-C (Public, Open Development, and Conservation District) on Lot 2, Block 1, of the proposed Hammer Addition, Lots 5 through 11, Block 1, Homestead III Addition, Lots 1 and 2, Block 2, Homestead III Addition, and Lots 7-9, Block 6, Homestead Addition. (Undeveloped property south of 7th Street SW between 12th Avenue SW and 10th Avenue SW).
Secretary Wollan explained that this is City owned property and that Lot 2, Block 1 of the proposed Hammer Addition was erroneously described as Lot 1, Block 1 of the proposed Hammer Addition and will be re-advertised correctly and this item will have another public hearing on June 9, 2014.
5. Public Hearing: Zone Change Request
Hearing on an application requesting a zone change from C-2 (General Commercial District) and R-1 (One Family Residential District) to R-2 (One- to Six- Family Residential District) on Lots 2-12, Block 3, Lots 7-14, Block 4, Lots 7-14, Block 5, and Lots 7-10, Block 6 of the Proposed Country Side Estates Subdivision, a replat of City West Subdivision. (Undeveloped land west of 17th Avenue SW and north of Witzig’s 2nd Subdivision)

Chairman Hillerud opened the public hearing. No one appeared. Chairman Hillerud closed the public hearing.
Commission member Trefz made a motion to accept the findings of staff and recommend approval of the zone change from R-1 and C-2 to R-2 for Lots 2-12, Block 3, Lots 7-14, Block 4, Lots 7-14, Block 5, and Lots 7-10, Block 6, of the Proposed Country Side Estates Subdivision to the City Council. Seconded by Trautman.
Discussion was held among members relating to annexation issues.
Clarice Liechty, 511 8th St SW, spoke relating that the City should have definite plans about annexation and septic tanks.
Secretary Wollan did the Roll Call. Unanimous aye vote. Motion Carried.
6. Public Hearing: Land Use Plan Amendment Request
Hearing on an application requesting a land use plan amendment from High Density Residential to Commercial on Lots 1 through 4, Block 3, Leapaldt Addition (1500 and 1510 11th Avenue NE).

Neil Klein, applicant and owner Klein’s Collision in Jamestown, spoke about his understanding of the zoning in this area and the protests received, he asked for approval of this amendment request.
Clarice Liechty, 511 8th St SW, owns property to the south of this area and asked that the property be kept in the current zone district and opposes the changing of the land use plan and re-zoning request.
Neil Klein, applicant, spoke again and asked again for consideration of the request.
Chairman Hillerud closed the public hearing.
Commission member Trefz made a motion to accept the findings of staff and recommend denial of the land use plan amendment from High Density Residential to Commercial for Lots 1 through 4, Block 3, Leapaldt Addition to the City Council. Seconded by Trautman. Roll Call. One nay, eight aye. Motion Carried.
7. Public Hearing: Zone Change Request
Hearing on an application requesting a zone change from R-3 (General Multiple Dwelling District) to C-2 (General Commercial District) for Lots 1 through 4, Block 3, Leapaldt Addition (1500 and 1510 11th Avenue NE).

Chairman Hillerud opened the public hearing.
Clarice Liechty, 511 8th St SW, spoke of her objection to the fact that anyone, not even an owner of the property, can apply for a zone change and opposes the zone change in question. Chairman Hillerud closed the public hearing.
Commission member Trefz made a motion to accept the findings of staff and recommend denial of the zone change from R-3, General Multiple Dwelling District to C-2, General Commercial District for Lots 1 through 4, Block 3, Leapaldt Addition to the City Council. Seconded by Bensch. Roll Call. Unanimous aye vote. Motion Carried.
8. Chairman Hillerud stated that the next meeting will be held on May 22, 2014 at 8:00 a.m. Secretary Wollan said public hearings for the preliminary and final plat of Menard, Inc. and the preliminary plat of Jamestown Court Rowhomes will be held at that time.
9. Planning Commission members Bayer and Bensch spoke about the zone change coming up in June for the City owned lots in the proposed Hammer addition and the role of the State Historical Society. Commission member Trefz suggested that June’s agenda include a follow-up of the City’s intention of use relating to these lots.
Jeff Fuchs, City Administrator, related that the first step was the zone change, then making sure , on record, that there can be no construction on these lots. This issue is on the Building, Planning & Zoning Committee that will be held later this month.
Clarice Liechty, 511 8th St SW, relayed that she got a letter from the Stutsman County Water Board their upcoming meeting and encourages members of the Planning Commission to attend.
Chairman Hillerud also encouraged the Planning Commission members to attend the SCRWC meeting on May 12, 2014 at 9am at the LEC. This meeting will be relating to growth, management and additional topics. Chairman Hillerud, Commission members Bayer and Ritter will attend the meeting representing the Planning Commission.
10. Adjournment. Commission member Rath made a motion to adjourn, seconded by Commission member Tressler. Motion Carried. Meeting adjourned.
