BISMARCK, N.D. (AP) – Seven couples have filed a federal lawsuit challenging the ban on same-sex marriage in North Dakota, the last remaining state without a court challenge.

The clerk of the court confirmed that the lawsuit was filed Friday in U.S. District Court in Fargo.

It challenges both North Dakota’s constitutional ban on gay marriage and its refusal to recognize marriages of same-sex couples who legally wed in other states.

The lawsuit means cases are currently pending in all 31 states with gay marriage bans. Judges have overturned several of those bans since the U.S. Supreme Court struck down part of the federal Defense of Marriage Act last year.

Minneapolis-based attorney Josh Newville, who is representing the North Dakota couples, also filed a lawsuit on behalf of South Dakota couples in May.

The North Dakota Attorney General says he hasn’t seen the lawsuit challenging the state’s ban on same-sex marriage yet, but he notes that it’s his duty to defend the state when it’s sued.

Wayne Stenehjem (STEHN’-juhm) says ultimately, only the U.S. Supreme Court can determine whether North Dakota’s law is constitutional.

BISMARCK, N.D. (AP) – An audit of North Dakota’s Game and Fish Department found scores of discrepancies with the agency’s practices, including improper payments to employees and more than 100 guns that are missing from a volunteer hunter education program.

The state auditor’s office criticized the agency’s misuse of public money. The audit and also found the agency in “noncompliance with laws, rules, and policies.”

Game and Fish Director Terry Steinwand says the agency was “stunned” by the audit but corrective actions are being taken.

Game and Fish regulates hunting, fishing and trapping, manages land and promotes conservation. The agency receives no money from the state’s general fund. It is supported by state licensing fees and federal tax money from the sale of firearms, ammunition and other sporting equipment.

WAHPETON, N.D. (AP) – A suspect is in custody in the armed robbery of a Wahpeton gas station.

Police in Moorhead, Minnesota, on Thursday night arrested a 31-year-old man who they say confessed to robbing the Tesoro station in Wahpeton early that day. Investigators say the man gave them a detailed account of the robbery in which a man with a pistol demanded money from the cash register and fled with between $200 and $250 in cash.

The man was arrested at a Moorhead motel on an armed robbery charge. Authorities say they also recovered evidence tying the man to the robbery.

FARGO, N.D. (AP) – A Fargo man accused of using a knife to cut a man whom he lured through an online sex ad has pleaded not guilty to felony robbery and kidnapping charges.

Eighteen-year-old Obsa Omer entered his pleas on Thursday. A trial date was not immediately set.

Authorities say the victim had responded to a Craigslist ad placed by Omer when he was assaulted.  Police in Fargo and neighboring Moorhead, Minnesota, suspect Omer in other assaults and robberies in the area.

BISMARCK, N.D. (AP) – The North Dakota Department of Health says a brine spill cause by a failed pipe fitting has been reported at an injection well site in Bottineau County.

Officials estimate that about 1,000 barrels of salt brine were released, with about 100 barrels escaping the site into a neighboring wetland.

Inspectors from the Health Department and the Oil and Gas Division have been at the site, which is owned by Denbury Onshore.

A temporary berm has been built to prevent additional fluid from reaching the wetland.

About 700 barrels of brine have been recovered.

WILLISTON, N.D. (AP) – The northwestern North Dakota city of Williston has settled a lawsuit filed by a Florida-based advertising agency over signs in the city.

The City Commission in August 2013 denied sign applications from Great Plains Outdoor Advertising, saying the signs did not conform with city guidelines. Great Plains then sued in state district court.

The  settlement agreement reached through mediation includes undisclosed compensation and also gives Great Plains the right to put up signs at six sites in the city. Mayor Ward Koeser signed the agreement Wednesday.

OUISTREHAM, France (AP) – Before there can be any further talks on Ukraine, Russian President Vladimir Putin says there will have to be an immediate ceasefire.
