Valley City, ND (KCSi-T.V. News) — The Valley City Commission met in Regular Session Monday evening (Jul 16, 2012). All members were present.

Approval of Consent Agenda items included:

Approval of a Game of Chance Raffle permit for 164

th Infantry Association.

The oath of office was given to Valley City Police Chief Fred Thompson.

Thompson thanked the city for the opportunity to become the Valley City Police Chief, and looks forward to the challenges of the office. He added that he hopes,”to do the city proud.”

Public Forum: No one spoke.

Resolutions

The City Commission approved a Resolution to approve final plans and specifications and estimate for probable cost and directing advertisement of construction bids for Pavement Marking Improvements. Funding for the project comes from the State Department of Transportation.

New Business

The City Commission approved a Construction Engineering Agreement for Paving Improvement District No. 98 to Kadrmas Lee & Jackson in the amount of $138,575. The project is expected to be completed in 6-8 weeks.

Commissioners approved a Construction Engineering Agreement for Paving Improvement District No. 100 to Kadrmas Lee & Jackson in the amount of $509,800.

City Commissioners considered installing a fence which encroaches on city property for Curtis Marshall at 1110 3

rd Avenue Northwest. City Building Inspector, Dave Andersen said he is comfortable with the fencing. Any damage to the fence, by city snow removal would be Marshall’s responsibility. The bushes currently in place will be removed.

The Commissioners voted unanimously to approve.

The City Commission discussed the Flood Task Force committee membership.

The current make-up of the Task Force was reviewed.

Discussion then centered around improving internal communication. Commissioner Magnuson said, he feels the City Commissioners need to, for example, be contacted about news conferences without hearing about them from the media. Commissioner Luke added that the judgement of whether to hold open meetings should be based on holding an open meeting, if there is any question, if the meeting should be open. She added any committee that has a city commission on it, should be open. She said any meeting that determines that city funds be expended should be open to the public. She pointed to the advertisement of meetings, for the public.

She suggests public postings of all committee meetings. She said media notification is not required by law. City Auditor, Avis Richter pointed out the only charge for notification is if paid space is taken in the newspaper. She added the city web site, posting at City Hall, and notification of other media is at no charge.

City Attorney Russell Myhre added, that, by law, the open meetings require a person to take the minutes. He said if media coverage is “over-done,” the public has a tendency to become apathetic over some issues. Mayor Werkhoven pointed to the availability of the media to attend all scheduled meetings. He added Valley City is meeting it’s responsibility of notifying the public of required open meeting announcements.

Mayor Werkhoven suggested posting committee meeting notifications at the end of meeting agenda publications.

The city will publish committee meeting dates, times and locations, and minutes will be taken at each meeting.

City Administrator Shelkoph’s Report:

With the water treatment plant project and force main project, the dedication of the plant is set for August 15, 2012. He said a Valley City Police officer is going to be replaced, and new Chief Thompson is expected to have new approaches to new hires.

He pointed to a great deal of street construction in Valley City the next two months, and reminds residents to watch for direction signs. With empty city lots, he said, the city will come forth with a plan to sell those lots.

City Updates & Commission Comments;

Commissioner Luke pointed out the Valley City water quality has improved, in the latest report.

She said water volume on the Sheyenne River is greater, with pumps in operation at Stump Lake.

With tourism, Commissioner Nielson said, tourist numbers are on the increase at the Rosebud Visitors Center, the first quarter of this year.

City Attorney Myhre said about one-third of the city flood property buyouts are completed.

City Fire Chief Retterath, reminds residents of electrical safety using cooling appliances, and the over heating of extension cords and wiring within walls.

Police Chief Thompson said he has held a meeting with his staff.

The meeting was shown live on CSi 68, followed by replays.

 

Valley City, N.D KCSi-T.V. News July 16, 2012) — The fourth annual Debbie Gabel Memorial Motorcycle Ride, Raffle and Street Dance will be held Saturday, July 28 in Valley City. Registration for the motorcycle ride begins at 9 a.m. in the Veterans Memorial Park parking lot, with the ride beginning at noon. Cost to participate is $20 per bike, and net proceeds benefit Hospice of the Red River Valley.

In addition to the motorcycle ride, this year’s event will also include a silent auction, street dance and raffle. The street dance will begin at 9 p.m. on Main Street between Central Avenue and 2nd Avenue East. The Christian Simmons band will play.

The raffle and silent auction, hosted at the VFW, will benefit Hospice of the Red River Valley. Raffle prizes include a 2012 Harley Davidson Heritage Classic, a 32″ flat screen TV, $300 gas card and a $300 beef bundle from Valley Meats. BISMARCK, N.D. (AP) – A removal hearing for Stark County Sheriff

Clarence Tuhy (TOO’-ee) is going ahead after a theft investigation

against him ended.

Tuhy was questioned for taking a bookcase and cabinet from a

Dickinson charity that takes donated furniture to give to the

needy.

Tuhy returned the items when he was asked about them. Assistant

attorney general Paul Emerson reviewed the case and decided not to

file theft charges.

Stark County commissioners have asked Gov. Jack Dalrymple to

remove Tuhy from office. A hearing is scheduled July 24 at the

Stark County courthouse.

The commissioners asked Dalrymple to dump Tuhy after they hired

a lawyer to investigate how Tuhy runs his office. The lawyer

concluded Tuhy is a bully who doesn’t apply consistent standards.

Tuhy says he’s tough but fair.

 

BISMARCK, N.D. (AP) – A man convicted of having marijuana that

he planned to sell at a home with a daycare has been sentenced to

18 months in jail.

South Central District Judge Tom Schneider on Monday sentenced

Antonio Anderson to five years in prison with all but 18 months

suspended. Anderson will also serve four years of probation.

28-year-old Anderson pleaded guilty to possession of marijuana with

intent to deliver within 1,000 feet of a school. His lawyer says

Anderson had the drugs at the home when children were present. The

home was an unlicensed daycare that was limited to caring for no

more than five children.

The woman who ran the daycare, Carli Jo Burghart, was given a

three-year deferred sentence for child neglect.

 

BILLINGS, Mont. (AP) – A judge has delayed legal proceedings

against two men accused of killing a Montana teacher after defense

lawyers said they need more time to prepare.

The judge yesterday delayed a hearing that had been scheduled for this week to January.

Michael Spell and Lester Waters Jr. are accused of killing teacher

Sherry Arnold, whose body was found near Williston, N.D.

 

BISMARCK, N.D. (AP) – Critics of taxpayer backing for North

Dakota businesses say they’re considering new ideas to try to stop

what they call business welfare.

The North Dakota Supreme Court ruled in two recent cases that the state and local governments can provide taxpayer support for private development.

 

FARGO, N.D. (AP) – The small grains harvest is under way in

North Dakota, earlier than normal.

The Agriculture Department’s weekly crop and weather report says

recent warm weather has accelerated the development of most crops

and allowed some to reach maturity. About 4 percent of the oats

crop is harvested, along with 2 percent of the barley and 1 percent

of the spring wheat. That’s ahead of the average pace.

The report says some crops in North Dakota are being affected by

low soil moisture. Topsoil moisture statewide is rated 62 percent

short or very short. Subsoil moisture is 48 percent in those two

categories.

Stockwater supplies are rated 36 percent short or very short,

and only 35 percent of the pasture and range land in North Dakota

is rated good or excellent.

 

FARGO, N.D. (AP) – The North Dakota Department of Transportation

is holding a series of public meetings on its long-range highway

plan.

Two sessions are scheduled Tuesday, at the Hankinson Community

Center in the afternoon, and the Fargo Main Street Kelly Inn in the

evening. DOT representatives will be on hand to answer questions

and address possible problems.

Other meetings on the plan are set for July 18 in Park River and

Grand Forks, July 19 in Carrington and Devils Lake, July 20 in St.

Michael and Belcourt, July 25 in Crosby and Williston, July 26 in

Bottineau and Minot, July 27 in Fort Yates, July 30 in Linton and

Bismarck, July 31 in Bowman, Aug. 1 in Ellendale and Jamestown, and

Aug. 2 in New Town.

GRAND FORKS, N.D. (AP) – Retired Minnesota Viking Jim

Kleinsasser (KLYN’-sahs-ur) headlines this year’s class of

inductees into the University of North Dakota Letterwinners

Athletics Hall of Fame.

Kleinsasser spent all 13 of his NFL seasons with the Vikings

after being a second-round draft pick out of UND in 1999. He

appeared in more games than any tight end in Vikings history. He

retired after last season.

The Carrington native was a two-time NCAA Division II All

America tight end while at UND in the late 1990s.

The 2012 class also includes John Christen, a tennis and

wrestling standout in the 1980s, and Louise Ronnerman, a cross

country and track star in the 1990s. UND’s 1997 NCAA Division I

champion men’s hockey team also is being inducted. The ceremony is

Sept. 29.

 

MINOT, N.D. (AP) – Three candidates to be the next men’s

basketball coach at Minot State University will be on campus for

interviews this week.

They are Montana-Western coach Steve Keller, South Dakota Tech coach Jason Henry and Jamestown College coach Matt Murken.

Minot State is still accepting applications for the job and more candidates might be interviewed.

The school is searching for a successor to Peter Stewart, who has resigned after two seasons to spend more time with family and pursue other career interests.

 

BISMARCK, N.D. (AP) – Historic flooding in 2011 led to a drop in fishing license sales, but it didn’t keep most anglers from wetting a line.

The state Game and Fish Department says its annual angler survey showed 137,000 resident licenses were sold last year, down 2 percent over the year. But angler participation actually went up.

Fisheries chief Greg Power says the small drop in license sales is no surprise because of flooding around the state last summer, particularly along the Souris and Missouri rivers. But Power says more resident anglers fished open water than in the previous year, and a lot more anglers took part in ice fishing during the mild winter.

CINCINNATI (AP) – The Cincinnati Reds will spend the next three to four weeks without first baseman Joey Votto, who needs surgery to repair torn cartilage in his left knee.

The 2010 National League MVP hurt the knee while sliding into third base June 29 in San Francisco, but continued to play until Sunday. General manager Walt Jocketty said Votto didn’t have an MRI before yesterday because the first baseman didn’t think he needed one.

 

OLYMPICS-BASKETBALL…

WASHINGTON (AP) – The U.S. men’s Olympic basketball team found

itself trailing 27-17 late in the first quarter Monday night before

rolling to an 80-69 win over Brazil in Washington.

LeBron James scored 30 points and helped the U.S. pull away in

the final four minutes after they led by only seven.

 

TOUR DE FRANCE…

PAU, France (AP) – Pierrick Fedrigo of France won the 15th stage

of the Tour de Franc Monday while Bradley Wiggins kept the overall

lead by staying with his rivals in the main pack far behind.

 

NBA…

LOS ANGELES (AP) – Clippers forward Blake Griffin has undergone surgery to repair the medial meniscus tear of his left knee that he suffered during practice with the U.S. national team in Las Vegas.

Griffin returned to Los Angeles last Thursday after experiencing discomfort in the same knee that bothered him during the playoffs. He will miss the London Olympics, but the Clippers say he should be ready for the start of the NBA season.

 

UNDATED (AP) – Raymond Felton and Kurt Thomas are returning to

New York after the Knicks completed a sign-and-trade deal that

sends Jared Jeffries and Dan Gadzuric (GAD’-zoo-reek) to the

Portland Trail Blazers.

The Blazers also receive Kostas Papanikolaou (pah-pah-NIK’-ah-low) and Giorgos Printezis, and a protected future second-round pick. Felton and the Knicks agreed to a multiyear deal Saturday, providing them another option if they

decline to match the offer sheet point guard Jeremy Lin signed with

Houston.

CHARLOTTE, N.C. (AP) – Carl Edwards has a new crew chief just 19 races after losing last year’s championship to Tony Stewart on a tie-breaker.

 Roush Fenway Racing says Tuesday that Bob Osborne will become a senior member of the organization’s management team and steering committee.

Chad Norris was chosen crew chief for the No. 99 Ford.

Osborne had run the team since 2004, and Edwards took over that ride for the final 13 races that year.

Edwards and Osborne won 18 races, and tied Stewart for the championship last season. Stewart won the title based on victories, and Edwards is stuck in a 52-race losing streak dating back to Las Vegas last season.

Edwards is currently 11th in the point standings and in danger of missing the Chase for the Sprint Cup championship.

SYRACUSE, N.Y. (AP) – Syracuse has the green light to move to the Atlantic Coast Conference.

The Big East has reached an agreement with the school, allowing the Orange to leave the league a year early for the ACC. The move will cost Syracuse a fee of $7.5 million.

 

STATE COLLEGE, Pa. (AP) – Joe Paterno’s family strongly denies the findings of a special investigator who described the late coach as one of four high-ranking university officials who covered up child sex abuse allegations against former assistant Jerry Sandusky.

In a statement, the family says they “vehemently disagree” with the conclusions reached by a team of investigators led by former FBI director Louis Freeh (LOO’-ee free). Freeh’s scathing report last week said Paterno and other university officials covered up for Sandusky to avoid bad publicity.

BRUSSELS (AP) – A European Union official says Microsoft may not

have kept its 2009 promise to provide customers clear alternatives

to the Internet Explorer browser.

The EU’s executive body, the Commission, is opening an investigation, warning that penalties for non-compliance could be severe.

 

WASHINGTON (AP) – The question in Washington today is whether

Federal Reserve Chairman Ben Bernanke will drop any hints about

possible steps to light a fire under a sluggish U.S. economy.

Bernanke will give his semiannual report to the Senate Banking

Committee today and to the House Financial Services Committee

tomorrow.

 

WASHINGTON (AP) – Republican Mitt Romney is trying to mount a

political counterattack as he continues to face criticism from the

other side about his business tenure and his tax returns.

He’s campaigning in Pittsburgh and plans to step up criticism of

President Barack Obama’s record.

Obama is turning to Republican-leaning Texas today to raise money from gay, Latino and big-dollar donors.

 

BEIRUT (AP) – Activists say the latest clashes are a clear

escalation in the most serious fighting in the Syrian capital since

the uprising began last year.

Syrian government forces backed by helicopter gunships battled rebels in heavy clashes in Damascus today.

 

ALMATY, Kazakhstan (AP) – It’s move-in day on the International

Space Station for three astronauts who blasted off in a Russian

space capsule two days ago from southern Kazakhstan.

They will work at the orbiting laboratory until November, joining a crew of three

already aboard.
