Jamestown (CSi) The Jamestown City Council met in Regular Session Monday evening at City Hall.  All member were present.

NO CONSENT AGENDA ITEMS CONSIDER INDIVIDUALLY:

On the Consent agenda a Resolution passed to award the bids for Civic Center Equipment Replacement to Robbins Sports Surfaces for Bid Package # 1-Alternate, in the amount of $99,650.00 (Basketball Flooring); and to Squibb DeBeers for Bid Package #2, in the amount of $26,696.00 (Basketball Backboards).

RESOLUTIONS:

Approved the request from GRE for an amendment to the Spiritwood Station Water Supply and Discharge Agreement dated May 26, 2009…. the addition of Dakota Spirit AgEnergy as a user, pending further study by the City Attorney.

ORDINANCES:

A FIRST READING: Concerning an ordinance to enact a section of the City Code pertaining to landscaping requirements.

A FIRST READING: Concerning an ordinance to amend and re-enact a section of the City Code pertaining to seizure of vehicles for certain violations. In compliance with the North Dakota Century Code.

Approved the appointment of Tonya Duffy to serve as an Assistant City Prosecutor.

Reviewed the appointment of a City resident) and possibly a City Council Member to serve as members of the James River Valley Library System Board for three year terms to expire March 2018. No action was taken, with discussion at next month’s meeting.

Approved the requests for street closings and/or permits to allow alcoholic beverages in fenced areas for the St. Patrick’s Day Run, on March 14, 2015, for the following: All Vets Club; Buffalo Lanes, Inc.; Corner Bar; Cork and Barrel, Inc.(Elk’s location); Middles LLC d/b/a Fred’s Den; Frontier Fort & Grill; Knights of Columbus; Los Molcajetes Mexican Restaurant, Office Bar & Lounge; Shady’s; and Wonder Bar Sports Bar.

Approved Change Order No. 1, to George Abel Construction, for the Jamestown Civic Center Seating Replacement Project.

Approved payment number three to Abell Construction for the Civic Center replacement project in the amount of $53,113.00

Approved and authorized payment reimbursement to the Jamestown/Stutsman Development Corporation for 2014 real estate in the amount of $16,045.72.

Approved the request of the Jamestown/Stutsman Development Corporation to enter into a lease for office space within the Center for Economic Development with Aaron McCardle, with Nodak Mutual Insurance. The space previously occupied by the South Central Dakota Regional Council, which has moved to a portion of Legacy Center in downtown Jamestown.

HAZELTON, N.D. (AP) – A warrant has been issued for a 29-year-old North Dakota man accused of sexually assaulting an 8-year-old child.

The Bismarck Tribune reports that the child’s mother reported the alleged abuse to the Emmons County Sheriff’s Office on Wednesday. The woman told authorities that the man fondled the child while the child was at the man’s Hazelton home.

Emmons County Sheriff’s Deputy Myron Rankins in an affidavit reported that the child was taken to a hospital where the results of an examination were consistent with the alleged abuse that was recounted to authorities.

Records show that the child’s account during an interview also supported the nurse’s findings.

The man hasn’t been formally charged. A judge has issued an order forcing the man to provide a buccal swab for DNA testing purposes.

 

GRAND FORKS, N.D. (AP) – University of North Dakota police say one of its officers shot and wounded a person at the conclusion of a pursuit.

The incident happened early Saturday morning in the parking lot of Altru Hospital in Grand Forks, but police released few details until Monday.

UND police say the pursuit covered multiple counties as well as the city of Grand Forks. A UND police officer fired into the suspect’s vehicle.

The injured person is being treated at Altru. No condition report has been issued.

The officer has been placed on administrative leave. The state Bureau of Criminal Investigation is investigating the incident.

 

GRAFTON, N.D. (AP) – A woman is accused of locking four young children in a dog cage and turning out the lights in the basement of a Grafton home.

23-year-old Jordan McKay is charged with four counts of abuse and neglect of a child, and four counts of felonious restraint. A preliminary hearing is April 13.

The children are between the ages of 5 and 9. Court documents say they were held under “terrorizing conditions” and at least one of them was forced to eat dog food.

During a police interview one boy drew a picture of himself in the kennel with the words “help me.”

Police say Nelson is in a relationship with the children’s biological mother. Her lawyer did not immediately return a phone call seeking comment.

 

FARGO, N.D. (AP) – Two more people have been charged in a federal investigation into numerous drug overdoses in the Grand Forks area linked to powdered fentanyl, bringing the total number of defendants to five.

The first document with details of the case was unsealed involving 20-year-old Ryan Jensen of Grand Forks. He’s charged with five counts, including conspiracy to possess with intent to distribute controlled substances resulting in serious bodily injury and death, and money laundering.

Jensen is one of four men charged for their roles in the deaths of two people who allegedly ingested a combination of substances that included fentanyl, a powerful synthetic drug. Authorities say the drugs were bought online from underground websites and distributed in North Dakota and Oregon.

Jensen’s lawyer, Tyler Morrow, and federal prosecutors declined to comment.

 

OMAHA, Neb. (AP) – A new report suggests economic growth is ahead for nine Midwestern and Plains states.

The survey report issued Monday says the overall Mid-America Business Conditions Index climbed to 57.0 in February from 54.8 in January.

Creighton University economist Ernie Goss oversees the survey, and he says the regional growth is likely although areas “linked closely to the energy sector, including ethanol, are experiencing pullbacks in economic activity.”

The survey results from supply managers are compiled into a collection of indexes ranging from zero to 100. Survey organizers say any score above 50 suggests economic growth, while a score below that suggests decline.

The survey covers Arkansas, Iowa, Kansas, Minnesota, Missouri, Nebraska, North Dakota, Oklahoma and South Dakota.

 

BISMARCK, N.D. (AP) – Four Devils Lake missionaries released by Venezuelan authorities Saturday after being detained and questioned for several days are expected back in North Dakota on Tuesday.

Lead Pastor Bruce Dick at Bethel Evangelical Free Church says the missionaries are still in Aruba, where they went after leaving Venezuela. He says they’ve been “decompressing and resting.”

A spokesman for U.S. Sen. John Hoeven says the State Department told the senator the missionaries were deported for not having the proper visa. Dick says the church is still looking into what happened.

Relations between the U.S. and Venezuela have been steadily deteriorating. Last month, President Nicolas Maduro accused the U.S. of working with local opposition groups to stage a coup that involved bombing the presidential palace. Washington called the accusation ludicrous.

 

WILLISTON, N.D. (AP) – A committee working toward a new airport in Williston will hear pitches from five developers seeking to design the facility.

Williston Economic Development Executive Director Shawn Wenko says the panel received 10 applications. The list was narrowed to five for the interview round, during which the companies’ qualifications will be studied.

Williston officials are considering a $250 million airport at a site 11 miles northwest of the oil patch hub. The  the city is seeking $120 million from the Federal Aviation Administration for the project.

Traffic and passenger boardings have boomed at Williston’s Sloulin Field International Airport along with oil development in the region in recent years. Flights are now offered to Minneapolis, Denver and Houston.

FARGO, N.D. (AP) – The Minot boys and Bismarck girls are champions of North Dakota high school hockey.

Minot defeated Grand Forks Central 2-1 for the boys’ title over the weekend, and Bismarck beat Grand Forks 3-2 for the girls’ crown.

The tournaments were held at Scheels Arena in Fargo and the Veterans Memorial Arena in West Fargo.

 

In world and national news…

WASHINGTON (AP) – Even as he criticizes President Barack Obama’s efforts to reach a nuclear deal with Iran, Israeli Prime Minister Benjamin Netanyahu says his plans to address Congress Tuesday aren’t aimed at disrespecting Obama. The Israeli leader told a pro-Israel lobbying group in Washington today that he’s speaking out about the threat posed by Iran because he has a “moral obligation” to do so. Despite his criticisms, Netanyahu declared that the relationship between the U.S. and Israel remains strong.

WASHINGTON (AP) – The Obama administration is again insisting that it would never let Iran become a nuclear power. Speaking Monday to the same group that heard from Israel’s prime minister, the U.S. ambassador to the U.N. defended the diplomacy with Iran on its nuclear program. But Samantha Power said, “We know the stakes of a nuclear-armed Iran as well as everyone here. We will not let it happen.”

ALBUQUERQUE, N.M. (AP) – Students around New Mexico have been walking out of schools Monday — showing their frustration over a new standardized test that was being administered. Millions of U.S. students have begun taking the more rigorous exams aligned with Common Core standards — but many parents and students around the country have opted out. The test measures student achievement, and it can be used in teacher evaluations. Opponents say the exams take the focus away from real learning.

CLEVELAND (AP) – Lawyers for the city of Cleveland say a 12-year-old boy who was holding a pellet gun when he was shot by police died as a result of his own actions. And they say the city isn’t to blame for his death. The assertion came in a response to a federal lawsuit filed on behalf of the child’s family.

NEW YORK (AP) – A longtime ban on cellphones at New York City public schools has been lifted. Mayor Bill de Blasio had promised during his 2013 mayoral campaign to overturn the ban. He calls it “a common-sense action” that would give parents peace of mind. Each school will have a policy determined by its principal, with input from parents and teachers.
