 Jamestown (CSi)  Two officers involved in the March 17, 2015 shooting incident in Southwest Jamestown, are back on the job.

Stutsman County State’s Attorney Fritz Fremgen released a memo he sent on April 12, 2015, to Jamestown Police Chief Scott Edinger, Stutsman County Sheriff Chad Kaiser and special agent Mark Nickel, with the North Dakota Bureau of Criminal Investigation, about the officer-involved shooting.

The Jamestown Police officer and Stutsman County Sheriff’s deputy fired their weapons into a vehicle allegedly driven by a Tracy, Minnesota, man, who had led police agencies on a chase through southwest Jamestown in the early morning hours of March 17th

Fremgen wrote: “After considering whether any charges including attempted murder, aggravated assault, or reckless endangerment are warranted, I have determined no charge is warranted for either of those offenses or for any lesser offense.”

Fremgen did not name the Jamestown police officer and Stutsman County Sheriff’s deputy who fired their weapons.

The North Dakota BCI also conducted use of force investigations on the Jamestown police officer and the Stutsman County Sheriff’s deputy at the request of those agencies.

The North Dakota BCI investigated the incident involving 43 year old Lee Charles Ellingson, who allegedly led law enforcement officers from Jamestown Police and the Stutsman County Sheriff’s Office and North Dakota Highway Patrol on a chase that started at the Exxon convenience store at 808 20th St. Southewest in Jametown, and ended in the 1000 block of 4th Avenue Southwest, between the Jamestown Motel and Dairy Queen.

Witness accounts and information from law enforcement agencies, indicated that during the pursuit, Ellingson allegedly rammed law enforcement vehicles. When he stopped on 4th Avenue Southwest, Ellingson allegedly tried to run over a police officer. It was at this time that a Stutsman County Sheriff’s deputy and a Jamestown police officer fired their weapons into the vehicle Ellingson was driving.

Ellingson was transported by ambulance to Jamestown Regional Medical Center after the chase ended for treatment of injuries.

He was later flown by air ambulance to a medical facility in Fargo. Ellingson’s present medical condition is unknown.

Ellingson was charged with reckless endangerment, criminal mischief and driving while under the influence of liquor or any other drug or substance, all Class C felonies. He is also charged with fleeing or attempting to elude a police officer, a Class A misdemeanor.

He is scheduled to appear at 1:15 p.m. May 20 in Southeast District Court in Jamestown. An unsecured bond was set at $100,000 on April 2, 2015.

Kulm (CSi) The North Dakota Highway Patrol reports, five teens from Kulm were involved in an injury crash occurred roughly two miles east of Kulm at around 3:53 pm Thursday.

Sgt. Tom Herzig, says 15 year-old Heather Ukanou was traveling north on a gravel road at approximately 50 miles per hour to a residence northeast of Kulm. The vehicle began to lose control and entered a ditch. The driver’s side of the Impala was severely damaged upon impact with a large tree. Two of the occupants required extraction from the vehicle.

Ukanou, along with 19 year-old Steven Mueller, and 15 year-old Katelynn Holmgren were injured.

Two additional passengers, 13 year-old Zane Holmgren and 15 year-old Wyatt Nitschke were not wearing their seat belts and their injuries are unknown.

 The injured teens were taken to hospitals in Fargo, Jamestown, and Aberdeen, South Dakota, by Kulm, Edgeley ambulances. Aberdeen Life Flight.

The crash remains under investigation by the North Dakota Highway Patrol.

 

Jamestown (CSi) The Jamestown City Council met in Special Session Thursday at City Hall.

The Cavendish water tank, Requests For Quotes was reviewed. All members were present.

The Coucnil approved entering into an engineering agreement with WSB & Associates, Inc., in an amount not to exceed $89,508, for the interior re-coating of the 1.5 million gallon water tower.

The committee recommends a bid award relating to Sidewalk, Curb & Gutter District #15-11, to Strata.

The committee recommends approving the cost estimate from Recovery Systems Co., Inc. of approximately $47,100 and approximate cost from Dan Poland Machine, Inc. of $13,000 relating to work at the City Baling facility. The facclity will be off line about 3-4 days.

The committee discussed approving an Agreement for Services from Impact Dakota, Inc. relating to employee training & development at the Water Treatment Plant.

Mayor Andersen suggested the agreement be reviewed during the upcoming city budget meetings.

Requests for proposals will be sent out.

 

The committee recommends approving a request for $3600.00 to cover training three (3) new staff people relating to Public Works software.

Considered joining the National Joint Powers Alliance.

City Engineer, Reed Schwartzkopf said, he organization, is a national bidding clearing house, and is in 21 or 22 states, and is being utilized by Stutsman County. The city is not limited, and may still work with local bidders on items. Titan Machinery is involved with utilizing the organization. There would be no cost to the city, as the participating manufacturers paid the fees.

Mayor Andersen said she wants to see the City Attorney review legal aspects of joining the organization, with a written opinion.

The committee recommends the agreement be reviewed by the City Attorney.

Possible payment to FEMA for Disaster Recovery (DR) 1907 (2010).

With an update on storm sewer cleaning and possible repairs. Schwartzkopf said the main line and a number of laterals have been cleaned. Other work is continuing until a decision is made on some repairs that need to be made, with those areas blocked off to traffic, at this time. Options will be considered, along with costs.

No action was taken by the committee.

The committee recommends the purchase of between 4-6, six cubic yard containers for the Sanitation and Solid Waste Departments at just under $1000.00 per container.

Jamestown (CSi) As part of the awareness week activities, the annual statewide tornado exercise will be conducted. This year, the exercise has been scheduled to begin at about 11:15 a.m. on Wednesday, April 29, 2015, with a simulated tornado warning issued by the National Weather Service. In response to this simulated warning, a countywide exercise of the emergency operations plan will also take place. The plan is designed to warn the greatest number of people in the least amount of time.

The week of April 27 th thru May 1st, 2015, has been designated, “Severe Summer Weather Awareness Week,” for the entire state of North Dakota by Governor Jack Dalrymple. On Thursday’s Wayne Byers Show on CSi Cable 2, Stutsman County. Emergency Manager, Jerry Bergquist said, this week is an annual event designed to remind the public of the dangers associated with severe summer weather including: lightning, high winds, large hail, flash floods and tornadoes. All of which, can cause severe property damage, personal injury, and even death.

As part of the exercise, sirens will be activated in area communities including the City of Jamestown. In most communities, sirens will be activated for approximately 3 minutes. In addition, the simulated warning will be broadcast over the National Weather Service all-hazards weather radio system, local AM/FM radio stations and the CSi cable television interrupt system.

Bergquist pointed out that during the summer, the most common reason a community’s warning sirens are activated is to warn the public of a possible tornado. However, the sirens could also be activated to alert the public of other types of events that could be a danger to the community. Hearing the sirens is the signal to tune into any of the local radio stations and to follow official instructions being broadcast.

Cable television subscribers will also be able to turn on their TV and hear official instructions being broadcast by either the National Weather Service or officials at the Law Enforcement Center.

On our show, Bergquist said the Jamestown area has seven outdoor sirens including the siren at the marina. Five are rotating and timed to sound for three minutes when activated and automatically shutdown.

He pointed out, that with Jamestown growing the city may need to add sirens in the southwest and eastern expansion areas.

On another topic, Bergquist reminded viewers that the CodeRed telephone alert system is available to residents in the Jamestown area. Those who have signed up will received the alerts they opted for. Otherwise if a phone subscriber adds, a cell phone number, or land line, they need to have it added to the CodeRed data base. Other alerts through the 9-1-1 telephone system will be sent through land line phones, without CodeRed signup.

Jamestown (CSi) The 31st Last Annual Comedy Revue is set for 7:30 p.m. Friday and Saturday, May 1-2, at 7:30-p.m., each evening at the Arts Center.

Tickets for the Comedy Revue are $10 for adults. Students $3.

Emcee, Bruce Berg, says the show brings back Dave McDowell, Tim Bratton, and Richie Wolf.

McDowell, in his 20th year, does a musical duo.

Bratton brings music and topical jokes, in addition to being an excellent musician.

Also performing will be, Joel Lees, Nick Scherbenske, Dave Hillerud, Brooke Carroll, Nancy and Steve Kuykendall and North Dakota poet laureate, Larry Woiwode.

Berg says, over 200 people have performed in the show during the run.

He adds, the show will last 1 hour and 22 minutes, because it almost always does.

Berg points out that the Comedy Revue is a part of Jamestown Performing Arts, a nonprofit organization that he and Conrad Davidson started together in 1980, and its raised between $40,000 and $45,000 for charity over the years, going to the arts community, Jamestown High School or the Arts Center, for arts-related activities such as camps, trips or scholarships.

Valley City (CSi) The Barnes County Veteran Services Officer Scott Crump’s resignation has been accepted by the Barnes County Commission. Crump’s resignation becomes effective on May 29, 2015.

The Barnes County Commission has started the process of looking for a replacement.

He’ll be moving to Hudson, Wisconsin to be with his wife who accepted a job there last year.

Crump has served as the Barnes County Veteran Services officer for nearly two years.

Crump worked as a Barnes County Sheriff’s Deputy for 6 years before becoming the the Veteran Services Officer.

A farewell Open House for Crump will be held May 29 from 2pm to 4pm inside the Barnes County Courthouse.

 

BISMARCK, N.D. (AP) – A Bismarck woman is facing a felony child neglect charge after allegedly pushing her 3-month-old baby in a stroller while under the influence of prescription drugs.

Authorities allege that 44-year-old Dawn Bacon was swerving and falling down while pushing the stroller at a mall about mid-day Wednesday. Officers who responded to the scene say Bacon repeatedly fell asleep when being questioned.

The charge against Bacon carries a maximum punishment of five years in prison. Court documents do not list an attorney for her.

The child was turned over to the custody of the woman’s boyfriend.

 

  WILLISTON, N.D. (AP) – Authorities have issued an arrest warrant for a Trenton woman accused of stealing more than $170,000 from a Williston business.
 
     Fifty-year-old Roxanne Oen is accused of transferring money from Boldt Farm Supply into personal accounts through electronic transfers and forged checks when she worked as a bookkeeper between July 2013 and this past January.
 
   She faces 17 felony counts of theft and unauthorized use of personal identifying information. Court documents do not list an attorney for her.

 

 FARGO, N.D. (AP) – A fellow teacher of a West Fargo High School educator accused of sexual misconduct says Aaron Knodel and his female accuser spent a lot of time together.
 
     But Shawn Krinkie also testified Thursday he never had any suspicions that something might be going on between the two. Krinkie’s classroom is next door to Knodel’s.
 
     KFGO radio reports a close friend of the student testified she was suspicious about the relationship. She said her then-17-year-old friend seemed depressed, lost weight and quit answering phone calls around the time of the alleged sexual activity five years ago.
 
     The friend also said Knodel spent extra time with many students.
 
     Knodel was named North Dakota teacher of the year in 2014, before the allegations surfaced. He’s pleaded not guilty to felony corruption charges.

 

 BISMARCK, N.D. (AP) – Senate and House negotiators are polishing off amendments to a 105-page, nearly $2 billion bill on funding for North Dakota schools.
 
     The last major issue that was resolved late Thursday centered on per-pupil funding, which is distributed according to a formula based on how many students a school district has, along with weighted factors for various needs.
 
     The two sides have tentatively agreed on an increase of 3 percent for the first year and 3 percent for the second year of the biennium over the base per-pupil funding. Lawmakers say the increase is needed primarily because of an influx of students related to the state’s economy.
 
     Fargo Sen. Tim Flakoll says said it generally takes a few days to finish drafting, reviewing, adopting, and passing the bill in both chambers.

 

 BISMARCK, N.D. (AP) – North Dakota’s House wants all ballot initiatives with a “major fiscal impact” to be on the general election ballot so more people can decide an issue.
 
     The House approved the resolution 71-18 on Thursday. The Senate is slated to review it on Friday.
 
     If approved by both chambers, it would be on the November 2016 ballot as a proposed constitutional amendment.
 
     The Legislature would determine what constitutes a “major fiscal impact.”
 
     Backers of the proposal say it makes it makes sense to have measures with large fiscal impacts to be held in general elections because fewer people vote in primary elections.

 

 BISMARCK, N.D. (AP) – North Dakota’s Senate has approved amendments to a House bill aimed at restructuring oil taxes.
 
     The Senate voted 32-15 Thursday after a nearly three-hour floor fight to shave the state’s oil tax rate from 11.5 percent to 10 percent.
 
     The House proposal would permanently lower an extraction tax on oil instead of allowing a tax exemption to take effect if oil prices continue declining.
 
     Under the Senate’s proposal, the state’s so-called trigger exemptions would expire in December. And if oil prices rebound above $90 for three months, the state’s oil tax would increase from 10 percent to 11 percent.
 
     Tribal and oil industry officials say the Senate’s version of the bill is more acceptable than the original House version but it still is far from perfect.

 

 BISMARCK, N.D. (AP) – A woman with more than 15 years of experience in the behavioral health field in both the private and public sectors has been named director of the state’s Behavioral Health Division.
 
     Bowbells native Pamela Sagness worked for the Department of Human Services for 13 years as a behavioral health clinician, prevention administrator, and most recently as the division’s substance abuse lead.
 
     The Behavioral Health Division was previously known as the Division of Mental Health and Substance Abuse Services. Human Services Department Executive Director Maggie Anderson says it’s developing an integrated, comprehensive division that includes substance abuse prevention, substance abuse treatment and mental health administration.

 

 BISMARCK, N.D. (AP) – University of North Dakota junior Brett Johnson has been selected as the student representative on the state Board of Higher Education.
 
     The one-year appointment is effective July 1. Johnson will replace Christopher McEwen, whose term expires June 30.
 
     Gov. Jack Dalrymple announced the appointment Thursday. He says Johnson has diverse leadership experience with both students and administrators and has served on numerous statewide and campus committees.
 
     Johnson is the vice president of the UND student body.

 

BISMARCK, N.D. (AP) – A University of North Dakota student has received the school’s first-ever training scholarship for unmanned aircraft.
 
     Kristopher Chachula (CHAH’-chew-lah) is a senior from Orange County, California. He was awarded a scholarship that will go annually to a senior graduating with a major in unmanned aircraft systems.
 
     Chachula is currently an intern with the Northern Plains UAS Test Site. He was previously a console operator for UND and NASA, where he operated the International Space Station agricultural camera.
 
     The scholarship will allow Chachula to receive hands-on training on the Federal Aviation Administration’s first certified small drone.

     Kansas City starter Yordano Ventura snagged a grounder from Chicago outfielder Adam Eaton and the pair appeared to exchange words before Ventura threw to first to end the inning. After the play, players from both dugouts and bullpens ran onto the field. Several punches were thrown.
 
     There were five ejections – Kansas City’s Ventura, Lorenzo Cain and Edinson Volquez along with Chris Sale and Jeff Samardzija (suh-MAHR’-juh) from Chicago.

 NEW ORLEANS (AP) – The Golden State Warriors roared from 20 points down in the fourth quarter to shock New Orleans 123-119 in overtime to take a 3-0 lead in that first round NBA playoff series. Steph Curry hit a desperation 3-pointer to force overtime and finished with 40 points and nine assists as the Warriors mounted the third-largest fourth quarter comeback in NBA playoff history.
 
     BOSTON (AP) – The Cleveland Cavaliers are one victory away from sweeping the Boston Celtics out of the NBA playoffs. LeBron James scored 31 and the Cavaliers beat the Celtics 103-95 to take a commanding 3-0 series lead as they go for the sweep Sunday in Boston.
 

 MILWAUKEE (AP) – Derrick Rose scored 34 points as the Chicago Bulls beat the Milwaukee Bucks 113-106 in double overtime last night to take a 3-0 lead in their Eastern Conference playoff series. Milwaukee went scoreless for more than 6 minutes between the first and second overtimes. Game 4 is tomorrow at Milwaukee.

  WASHINGTON (AP)- The Washington Capitals posted their third straight victory over the New York Islanders, 4-1, to take a 3-2 series lead in that NHL playoff series. Evgeni Kuznetsof (kooz-NEHT’-zawf) scored a pair of goals for the Caps, who can advance with a Game 6 victory on Long Island Saturday.

UNDATED (AP)- The Tampa Bay Lightning fought back from a two-goal deficit in the final five and a-half minutes of regulation to beat Detroit 3-2 in overtime and even that first-round NHL playoff series at two games apiece. Tyler Johnson scored the game-winner 2:25 into OT.

Nashville beat Chicago 5-2 to cut the Blackhawks lead in that series to 3-2.

 Daniel Sedin (suh-DEEN’) scored the tiebreaking goal early in the third period and the Vancouver Canucks avoided elimination with a 2-1 victory over the Calgary Flames. The Canucks still trail the series 3-2 and Game 6 of that Western Conference quarterfinal series is Saturday in Calgary.
  

NBA-DEFENSIVE PLAYER OF THE YEAR
  
     NEW YORK (AP) – Kawhi (kuh-WHY’) Leonard of the San Antonio Spurs has been named the winner of the NBA’s Defensive Player of the Year Award. He’s only the sixth forward to lead the NBA in steals since the league starting keeping track of the statistic 42 years ago. Leonard is the first Spurs player to win the award since David Robinson in 1991.
 
     Golden State’s Draymond Green was second in the media voting.

 

MLB…

 DETROIT (AP) – Tigers closer and former Twin  Joe Nathan will miss the rest of the season with a torn ligament in his pitching elbow. Nathan suffered the injury while pitching on a minor-league rehabilitation assignment with Triple-A Toledo on Wednesday.
 
     The 40-year-old is a six-time All-Star, but is coming off one of the worst seasons of his career as he had a 4.84 earned run average in 2014 and blew seven saves.

 NEW YORK (AP) – Baseball commissioner Rob Manfred says Pete Rose will be allowed to participate in activities surrounding this summer’s All-Star Game in his hometown of Cincinnati.
 
     This isn’t the first time the disgraced former star has been allowed to attend a top Major League event.  MLB permitted Rose to take part in the All-Century team announcement at Atlanta’s Turner Field during the 1999 World Series and a Reds ceremony in 2013 honoring their 1975 and ’76 championship teams.
 
     Rose is baseball’s career hits leader and a former Reds star player and manager. He agreed to a lifetime ban from the sport in 1989 after a Major League Baseball investigation concluded he bet on his team to win while he was managing the club.

     DALY CITY, Calif. (AP) – Lydia Ko settled for a tap-in birdie on the par-5 14th after her eagle chip deflected off the pin and the defending champion shot a 5-under 67 to take the first-round lead in the Swinging Skirts LPGA Classic.
 
     The top-ranked Ko holds a one-stroke lead over three others, including 54-year-old Juli Inkster. Stacy Lewis, last year’s runner-up to Ko at Lake Merced (mur-SEHD’) Golf Club, was two strokes back at 3 under.

MILAN (AP) – An Italian prosecutor says Islamic extremists suspected in a bomb attack in a Pakistani market that killed more than 100 people had also planned an attack on the Vatican in 2010. The prosecutor says wiretaps indicated the suspected terrorists were planning a bomb attack at the Vatican and that a suicide bomber had arrived in Rome. He says the attack plans never went further and that the suicide bomber left Italy, though it isn’t clear why.
 
     ROME (AP) – Italy says it wants more information from the United States about how an Italian aid worker was killed in a U.S. drone strike on the Afghan-Pakistan border. President Barack Obama revealed yesterday that the Italian and American Warren Weinstein (WYN’-steen), both held hostage by al-Qaida, were accidentally killed during the drone strikes in January. Foreign Minister Paolo Gentiloni says Italy takes note of Obama’s “maximum transparency” in assuming responsibility for the deaths, but he says Italy wants more information about what happened.          
 
     LONDON (AP) – The United Nations’ human rights chief is accusing Britain’s tabloid newspapers of hate speech against immigrants. The U.N. high commissioner for human rights says an April 17 article written by The Sun columnist Katie Hopkins compares migrants to cockroaches, language he says is similar to that used by the instigators of Rwanda’s 1994 genocide. Hopkins wrote that gunboats should be used against migrant boats in the Mediterranean, and called immigrants “feral humans.”
 
     VALDOSTA, Ga. (AP) – A south Georgia university has canceled classes today in a flap over a flag protest. WALB-TV reports that a week ago, student demonstrators at Valdosta State University walked on an American flag to protest racism. Safety concerns grew after police say they found a gun inside a protester’s backpack. A rally this afternoon to support the American flag is expected to draw crowds. The university has posted a message on its website saying today’s classes are canceled “in the interest of the safety of our students, faculty, and staff.”
 
     ATLANTA (AP) – A teenager is in a medically-induced coma in Atlanta after two other teens attacked him with a pot of boiling rice as he slept. WSB-TV reports that 19-year-old Quintavious Barber and 18-year-old Malik Morton are charged with aggravated assault, cruelty to a child and other offenses. The victim’s relatives say Barber and Morton had accused the 17-year-old of stealing a PlayStation3. Neighbors say all three teens had been friends.
