Jamestown (CSi) Stutsman County Sheriff, Chad Kaiser, Wednesday afternoon said that 58 year old Daniel Ray Peterson of Jamestown died at the scene of the tanker truck rollover Tuesday morning.

Kaiser said that the tanker truck was northbound on Highway 20, in the 5-mile curve area, hauling 8500 gallons of diesel for Cenex Harvest States, when a tire went off the roadway.

Peterson was able to get the truck and trailer back on the road, then the trailer started fishtailing, with Peterson losing control on the next curve on the highway causing the unit to roll into the east ditch.

Kaiser says Peterson was wearing a seat belt.

Kaiser says the crash created a hole in the front section of the trailer that leaked diesel fuel into the ditch.

He says the first compartment of the tanker held 4500 gallons of diesel fuel and was punctured, causing the fuel to spill in the ditch.

The Jamestown Rural Fire Department blocked two culverts on either side of the ditch with gravel to contain the fuel spill.

The unit is owned by Cenex Harvest States and was headed to Tolna, ND when the accident occurred.

A CHS crew was dispatched from Minot to clean up off-load the remaining fuel and haul the truck/tanker away.

The Jamestown Rescue Squad and Jamestown Rural Fire Department were called to Highway 20, six miles north of Jamestown at 10:24-a.m., Tuesday, to a tanker truck rollover, which punctured the tank and was leaking diesel fuel.

Peterson’s body was taken to Bismarck for an autopsy. The highway was open to one lane until the roadway is cleaned up and the vehicle removed.

The rural fire fighters were on scene, and reports say the diesel spill was contained in a 100 foot area in the east ditch of the highway, and that Central Valley Health was being contacted concerning the hazardous waste.

The one unit cab/tanker was being up-righted for removal later Tuesday.

The spilled fuel cleanup estimated at about 100 gallons was handled by a contractor, on Tuesday.

The tanker contained about 8500 gallons of fuel.

Jamestown City Fire Department Lt. Sheldon Mohr says the rescue squad with two units and nine personnel was on the scene about an hour and ten minutes.

Also responding to the scene was the Stutsman County Sheriff’s Office, the North Dakota Highway Patrol, and Jamestown Area Ambulance Service.

Jamestown (CSi) The two men accused in the May 25, 2015 robbery of the Superpumper gas station and convenience store in Jamestown, appeared in Southeast District Court in Jamestown on Tuesday.

Superpumper employees along Highway 281 South in Jamestown called police at around 12:38 AM.

The clerk reported a man wearing a bandana and heavy jacket entered the store, pushed past them and took an undisclosed amount of cash from a safe under the counter and fled out the back door of the store.

No weapons were involved.

After reviewing surveillance camera footage with the manager authorities identified the suspect as a former employee, and analyzed the getaway vehicle.

Police went to the apartment of former employee 26 year-old Josh Lamb and his roommate and former co-worker 23 year-old Mark Shannon and found the stolen cash and clothing matching the description of the alleged robber.

Jamestown Police said it was determined Lamb went into the store and took the money and Shannon drove the car, a 2000 maroon Chevrolet Malibu.

Both were charged with Class C felonies. Lamb is charged with theft of property and criminal conspiracy to commit theft of property. Shannon is charged with criminal conspiracy to commit theft of property. Both remain in the Stutsman County Corrections Center on $1,500 cash bonds.

 

Valley City (CSi) Valley City Police report, a 28 year-old man is being charged in connection with a traffic stop, about 4-p.m., on May 22, 2015.

During the stop an officer saw a bulge around the front of the man’s waistband that the believed might be a weapon, and a pat-down revealed a firearm.

Police Chief Fred Thompson said the driver, 28 year-old Cody Williams is being charged with possession of a Firearm by a Convicted Felon, Loaded Firearm in a Vehicle.

The serial number had been removed on the weapon.

Additional charges may be pending against Williams..

 

Bismarck (CSi) – North Dakota Department of Human Services Executive Director Maggie Anderson has appointed Rosalie Etherington, Ph.D., as North Dakota State Hospital Superintendent. In this role, Etherington is responsible for oversight of business and clinical operations for the hospital.

Etherington brings 22 years of experience in quality management, program development, and expertise in operationalizing regulations and requirements in a behavioral health setting. She is currently the Clinical Director for Inpatient Services at the North Dakota State Hospital.

Anderson says, “Dr. Etherington’s experience will ensure the State Hospital, as part of the state’s public behavioral health system, continues to partner with stakeholders to improve access to mental health and substance use disorder treatment.”

Etherington has worked for the department for 20 years serving in multiple clinical and administrative roles. She has a doctorate in clinical psychology from the California School of Professional Psychology with a concentration in program development. She is a native of Center, N.D.

Alex C. Schweitzer, who has been the superintendent of the North Dakota State Hospital since 1995 and the statewide human service center director overseeing the eight regional centers since December 2011, is retiring May 31, 2015.

The 304-bed North Dakota State Hospital provides short-term acute inpatient psychiatric and substance abuse treatment, intermediate psycho-social rehabilitation services, forensic services, and safety net services for adults. The hospital also provides residential addiction treatment services for adults referred to the Tompkins Rehabilitation and Corrections Center (TRCC) by the Department of Corrections and Rehabilitation (DOCR). The hospital has a secure services unit that provides inpatient evaluation and treatment services for sexually dangerous individuals.

 

Jamestown (CSi) The U.S. Army Corps of Engineers, Tuesday, May 26, 2015, increased the release from Jamestown Dam from 125 cubic feet per second to 250 cfs.

The Corps Bob Martin, in Jamestown says, the new release is to lower the reservoir water level about 8 inches to the bottom of the flood storage pool by June 2, 2015.

At that time the Jamestown Dam release will be gradually reduced, while releases from Pipestem Dam start.

There have been no releases from Pipestem Dam since March 23. Releases from Pipestem Dam will continue until the lake behind the dam has been lowered about 8 feet by September or October this year.

 

Jamestown (CSi) A swimming “Last Splash,” is planned at the pool at James River Family Fitness in Jamestown with the pool party on June 26, 2015, from 6-p.m., to 10-p.m.

The pool will close at the end of June as the area will be then used as the wrestling facility for the University of Jamestown.

On Wednesday’s Wayne Byers Show on CSi Cable 2 JRFF Executive Director, Frank Conlon said, summer swimming sessions start June 1-4 with a stroke clinic, followed by swimming lesson for all levels June 8-18, then June 22-25 level one, and levels 2-6 will be held, to be completed before the pool closes.

This summer JRFF offers Youth Summer Camps, including T-Ball, a Superhero Camp, “Wet & Wild,” and more.

Adult classes continue to be offered, and coming soon will be the outdoor total body classes, including the Outdoor Boot Camp.

Also offered is Yoga classes and water aerobics.

James River Family Fitness’ summer hours are now in effect….Monday-Friday 5-a.m., to 10-p.m., Saturday 6-a.m., to 10-p.m., closed Sundays.

 

 GRAND FORKS, N.D. (AP) – Police have identified the man who was killed and the woman who was injured when a U.S. airman walked into a North Dakota Wal-Mart Supercenter and opened fire before turning the gun on himself.
 
     Seventy-year-old Gregory Weiland was killed and 47-year-old Lisa Braun was injured in the shooting shortly after 1 a.m. Tuesday at the store in Grand Forks.
 
     Altru Hospital says Braun is in satisfactory condition.
 

Her father Larry Friesz , says his daughter expects to be hospitalized for up to four days.
     Authorities say 21-year-old Marcell Willis walked into the store, shot Weiland and Braun and fired but missed at a third employee before killing himself. Lt. Derik Zimmel says police aren’t identifying the third worker.
 
     Zimmel says the shooting appears to have been random.
 
     Willis was stationed at Grand Forks Air Force Base west of the city.
 
     The store remained closed early Wednesday.

Police say an autopsy will determine if Willis who fatally shot one worker and injured a second before killing himself at a North Dakota Wal-Mart, had drugs or alcohol in his system.

Zimmel said Wednesday that he doesn’t know when the results will be available but called the autopsy “the next significant step in this case.”

 

 BISMARCK, N.D. (AP) – BNSF Railway Co. says it’s planning employee furloughs due to slipping freight shipping demand across its rail network.
 
     The company says in a statement that it hopes to call back employees “as soon as business needs change.”
 
     The railroad would not say how many employees were being furloughed. But it says the affected employees are “at different locations across our network.”
 
     BNSF is based in Fort Worth, Texas, but is part of Warren Buffett’s Berkshire Hathaway Inc., based in Omaha, Nebraska.
 
     The railroad is the biggest player in North Dakota’s oil patch, hauling most of the the more than 1.1 million barrels that moves out of the region daily.
 
     The railroad also is the biggest hauler of freight in the Upper Great Plains.
 

 

BISMARCK, N.D. (AP) – North Dakota lawmakers have picked the subjects they will study as they prepare for the next session of the Legislature.
 
     The topics include agriculture, education, energy, election and human services issues.
 
     A total of 44 studies will be assigned to interim committees. The number and membership of the Legislature’s interim committees will be decided next month.
 
     The Legislative Management Committee chose the subjects during a meeting Wednesday. The council is a 17-member committee of lawmakers. Its chairman is Republican Sen. Raymon Holmberg of Grand Forks.

 GRAND FORKS, N.D. (AP) – Grand Forks Mayor Michael Brown says he’ll continue his mayoral duties as he recovers from open-heart surgery, though he’s taken a leave of absence from his duties as a doctor with Altru Health.
 
     Brown on Wednesday issued a statement saying he underwent the triple-bypass surgery on May 14. He said he is scheduled for cardiac rehabilitation and expects to make a full recovery.
 
     Brown said he expects to resume his work as a doctor in 4-6 weeks.

ZURICH (AP) – The international soccer federation FIFA (FEE’-fuh) is suspending 11 people — including two of its vice presidents — from all soccer-related activities. The move follows a U.S. criminal investigation into corruption in world soccer. The two vice presidents are among seven people who were arrested in Zurich early today after being indicted in the United States.
 
     CENTENNIAL, Colo. (AP) – The notebook that was kept by Colorado movie theater gunman James Holmes has been made public, a day after it was introduced as evidence at his trial. It’s full of scrawled writings and stick-figure drawings. Holmes mailed the notebook to a psychiatrist who was treating him before the rampage. It was found a few days later, undelivered in a mailroom. It included detailed maps and drawings of auditoriums in the movie theater, and the merits of each one as the scene of mass murder. Prosecutors are hoping the notebook will weaken the claim by Holmes’ lawyers that he was legally insane.
 
     MAYPORT NAVAL STATION, Fla. (AP) – A second Navy submarine crew member has pleaded guilty to charges of sharing videos of female officers undressing for a shower. It’s a case that a prosecutor calls a “black eye” for the Navy’s effort to integrate women into the nation’s sub fleet. Electronics technician Joseph Bradley was sentenced to 30 days confinement and a reduction in rank.
 
     NEW YORK (AP) – A lawyer who is hoping to free two chimpanzees from a state university has told a judge in New York that their confinement for research purposes is similar to slavery and imprisonment, and to the involuntary detention of mentally ill people. The lawyer, representing the Nonhuman Rights Project, said Hercules and Leo are “essentially in solitary confinement” — the treatment given to “the worst human criminal.” The eight-year-old chimps are used for locomotion studies at Stony Brook University. A lawyer for the state said granting personhood to chimps would lead to other battles over the rights of other animals.
 
     MEMPHIS, Tenn. (AP) – The city of Memphis has been saying farewell Wednesday to blues legend B.B. King with a tribute and processional down Beale Street. Afterward, King’s body will be taken to Indianola, Mississippi, which King considered his hometown, for his funeral on Saturday. Early in his career, King was nicknamed “Beale Street Blues Boy,” and the name was soon shortened to “B.B.” King died May 14 in hospice care at home in Las Vegas at age 89.
