Jamestown (CSi) Stutsman County Sheriff, Chad Kaiser, Wednesday afternoon said that 58 year old Daniel Ray Peterson of Jamestown died at the scene of the tanker truck rollover Tuesday morning.

Kaiser said that the tanker truck was northbound on Highway 20, in the 5-mile curve area, hauling 8500 gallons of diesel for Cenex Harvest States, about 10:24 a.m., when a tire went off the roadway.

Peterson was able to get the truck and trailer back on the road, then the trailer started fishtailing, with Peterson losing control on the next curve on the highway causing the unit to roll into the east ditch.

Kaiser says Peterson was wearing a seat belt.

Kaiser says the crash created a hole in the front section of the trailer that leaked diesel fuel into the ditch.

He says the first compartment of the tanker held 4500 gallons of diesel fuel and was punctured, causing the fuel to spill in the ditch.

The Jamestown Rural Fire Department blocked two culverts on either side of the ditch with gravel to contain the fuel spill.

The unit is owned by Cenex Harvest States and was headed to Tolna, ND when the accident occurred.

A CHS crew was dispatched from Minot to clean up off-load the remaining fuel and haul the truck/tanker away.

Jamestown City Fire Department Lt. Sheldon Mohr says the rescue squad with two units and nine personnel was on the scene about an hour and ten minutes.

Also responding to the scene was the Stutsman County Sheriff’s Office, the North Dakota Highway Patrol, and Jamestown Area Ambulance Service.

 

 Valley City (CSi) The North Dakota Highway Patrol reports that at approximately 6:21 pm Wednesday, an NDHP trooper responded to a report of a reckless driver traveling westbound on I-94 from MM 338. Several additional callers reported the vehicle continuing to travel westbound on I-94 prior to NDHP contact with the vehicle.

At approximately 6:55 pm, an NDHP trooper located the suspect vehicle, a 2001 Mercury Grand Marquis, and attempted a traffic stop near MM 300 on I-94 westbound. The driver failed to stop and a pursuit was initiated westbound on I-94. At exit 292, the suspect vehicle exited I-94 and stopped on the off-ramp. The suspect, 42 year old Jason David Anderson, of Valley City, was taken into custody and arrested for Felony Driving Under the Influence and Resisting Arrest and Misdemeanor Fleeing Law Enforcement.

Anderson was transported to the North Dakota State Hospital after the incident and placed in the care of staff at the State Hospital.

The Barnes County Sheriff’s Office and Valley City Police Department assisted with the incident.

 

Jamestown (CSi) The two men accused in the May 25, 2015 robbery of the Superpumper gas station and convenience store in Jamestown, appeared in Southeast District Court in Jamestown on Tuesday.

Superpumper employees along Highway 281 South in Jamestown called police at around 12:38 AM.

The clerk reported a man wearing a bandana and heavy jacket entered the store, pushed past them and took an undisclosed amount of cash from a safe under the counter and fled out the back door of the store.

No weapons were involved.

After reviewing surveillance camera footage with the manager authorities identified the suspect as a former employee, and analyzed the getaway vehicle.

Police went to the apartment of former employee 26 year-old Josh Lamb and his roommate and former co-worker 23 year-old Mark Shannon and found the stolen cash and clothing matching the description of the alleged robber.

Jamestown Police said it was determined Lamb went into the store and took the money and Shannon drove the car, a 2000 maroon Chevrolet Malibu.

Both were charged with Class C felonies. Lamb is charged with theft of property and criminal conspiracy to commit theft of property. Shannon is charged with criminal conspiracy to commit theft of property. Both remain in the Stutsman County Corrections Center on $1,500 cash bonds.

 

Valley City (CSi) Valley City Police report, a 28 year-old man is being charged in connection with a traffic stop, about 4-p.m., on May 22, 2015.

During the stop an officer saw a bulge around the front of the man’s waistband that the believed might be a weapon, and a pat-down revealed a firearm.

Police Chief Fred Thompson said the driver, 28 year-old Cody Williams is being charged with possession of a Firearm by a Convicted Felon, Loaded Firearm in a Vehicle.

The serial number had been removed on the weapon.

Additional charges may be pending against Williams..

 

Bismarck (CSi) – North Dakota Department of Human Services Executive Director Maggie Anderson has appointed Rosalie Etherington, Ph.D., as North Dakota State Hospital Superintendent. In this role, Etherington is responsible for oversight of business and clinical operations for the hospital.

Etherington brings 22 years of experience in quality management, program development, and expertise in operationalizing regulations and requirements in a behavioral health setting. She is currently the Clinical Director for Inpatient Services at the North Dakota State Hospital.

Anderson says, “Dr. Etherington’s experience will ensure the State Hospital, as part of the state’s public behavioral health system, continues to partner with stakeholders to improve access to mental health and substance use disorder treatment.”

Etherington has worked for the department for 20 years serving in multiple clinical and administrative roles. She has a doctorate in clinical psychology from the California School of Professional Psychology with a concentration in program development. She is a native of Center, N.D.

Alex C. Schweitzer, who has been the superintendent of the North Dakota State Hospital since 1995 and the statewide human service center director overseeing the eight regional centers since December 2011, is retiring May 31, 2015.

The 304-bed North Dakota State Hospital provides short-term acute inpatient psychiatric and substance abuse treatment, intermediate psycho-social rehabilitation services, forensic services, and safety net services for adults. The hospital also provides residential addiction treatment services for adults referred to the Tompkins Rehabilitation and Corrections Center (TRCC) by the Department of Corrections and Rehabilitation (DOCR). The hospital has a secure services unit that provides inpatient evaluation and treatment services for sexually dangerous individuals.

 

Jamestown (CSi) The U.S. Army Corps of Engineers, Tuesday, May 26, 2015, increased the release from Jamestown Dam from 125 cubic feet per second to 250 cfs.

The Corps Bob Martin, in Jamestown says, the new release is to lower the reservoir water level about 8 inches to the bottom of the flood storage pool by June 2, 2015.

At that time the Jamestown Dam release will be gradually reduced, while releases from Pipestem Dam start.

There have been no releases from Pipestem Dam since March 23. Releases from Pipestem Dam will continue until the lake behind the dam has been lowered about 8 feet by September or October this year.

 

Jamestown (CSi) A swimming “Last Splash,” is planned at the pool at James River Family Fitness in Jamestown with the pool party on June 26, 2015, from 6-p.m., to 10-p.m.

The pool will close at the end of June as the area will be then used as the wrestling facility for the University of Jamestown.

On Wednesday’s Wayne Byers Show on CSi Cable 2 JRFF Executive Director, Frank Conlon said, summer swimming sessions start June 1-4 with a stroke clinic, followed by swimming lesson for all levels June 8-18, then June 22-25 level one, and levels 2-6 will be held, to be completed before the pool closes.

This summer JRFF offers Youth Summer Camps, including T-Ball, a Superhero Camp, “Wet & Wild,” and more.

Adult classes continue to be offered, and coming soon will be the outdoor total body classes, including the Outdoor Boot Camp.

Also offered is Yoga classes and water aerobics.

James River Family Fitness’ summer hours are now in effect….Monday-Friday 5-a.m., to 10-p.m., Saturday 6-a.m., to 10-p.m., closed Sundays.

Conlon added that he James River Family Fitness Center will continue to offer the same programs, classes and uses of the Larson Center facility until the University of Jamestown eventually takes over JRFF’s occupied space for its own needs.

University offiicals have said it will keep JRFF informed of what the timeline is for renovations in the Larson Center,and that the learning center would be the last space that would be modified by the university.

 

GRAND FORKS, N.D. (AP) – Memorial services have been scheduled for a Grand Forks man killed when another man walked into a Wal-Mart store and started shooting.
 
     Dahl Funeral Home says visitation and a prayer service for 70-year-old Gregory Weiland is Friday night at St. Michael’s Catholic Church in Grand Forks, and Weiland’s funeral is 10:30 a.m. Saturday at the church.
 
     Weiland will be buried at St. Bernard’s Catholic Cemetery in Thief River Falls, Minnesota.
 
     Authorities say 21-year-old Marcell Willis walked into the Wal-Mart store early Tuesday and shot and killed Weiland, an overnight cashier. Willis then shot and wounded 47-year-old overnight grocery general manager Lisa Braun, who’s recovering in a hospital. Willis then killed himself.
 
     Willis’ motive isn’t known. He was a senior airman stationed at Grand Forks Air Force Base.

 

 BISMARCK, N.D. (AP) – Sentencing for a convicted con man accused of trying to impersonate as an FBI agent in the North Dakota oil patch has been postponed.
 
     Steven Goldmann was scheduled to be sentenced this week in Bismarck, but a judge granted a request filed by his lawyer to delay the proceedings until September because Goldmann has not received a revised presentence investigation report.
 
     Goldmann has pleaded guilty to an illegal weapons charge. Prosecutors have agreed to drop four counts of impersonating an officer.
 
     Investigators say Goldmann regularly displayed a gun, holster, mace and badge, and showed up one day at a Williston coffee shop with a passenger who was handcuffed.
 
     Goldmann had pleaded guilty to theft of services in Tennessee in 2013. Authorities say he conned several businesses out of money.

 

 BISMARCK, N.D. (AP) – BNSF Railway Company says it’s planning employee furloughs due to slipping freight shipping demand across its rail network.
 
     The company said Wednesday in a statement that it hopes to call back employees “as soon as business needs change.”
 
     The railroad would not say how many employees were being furloughed but that they are “at different locations across our network.”
 
     BNSF is based in Fort Worth, Texas and is part of Warren Buffett’s Berkshire Hathaway Incorporated based in Omaha, Nebraska.
 
     The railroad is the biggest player in North Dakota’s oil patch, hauling most of the more than 1.1 million barrels that moves out of the region daily. The railroad also is the biggest hauler of freight in the Upper Great Plains.

 

 MANDAN, N.D. (AP) – The state Public Service Commission is holding a public hearing on a proposed 1,100-mile pipeline from western North Dakota to Illinois.
 
     The public hearing is slated for Thursday in Mandan. That’s the first of three public hearings in North Dakota on the proposed $3.8 billion oil pipeline. Officials say it’s the largest-capacity pipeline for the state’s crude to date.
 
     Dallas-based Energy Transfer Partners LP announced the Dakota Access project last year.
 
     The company says it would move 450,000 barrels of North Dakota crude daily to an existing pipeline in Patoka, Illinois, where shippers can access Midwest and Gulf Coast markets.
 
     The company has said it hopes to place the pipeline in service late next year.
 

 

 BISMARCK, N.D. (AP) – A federal complaint charges a North Dakota-based oilfield service company subjected an employee to a hostile work environment based on his race and national origin.
 
     The Equal Employment Opportunity Commission filed a complaint Wednesday in U.S. District Court in Bismarck against American Casing and Equipment Inc. The lawsuit also charges the company fired the employee for complaining about the hostile workplace.
 
     Federal authorities say Matthew Clark, who is Filipino, worked for American Casing in Williston from November 2012 to January 2014 installing steel pipes. They say a white manager used racial slurs in referring to Clark, and one time, urinated on Clark’s legs.
 
     Authorities say Clark complained to a safety manager about the harassment and was terminated in retaliation.
 
     The company didn’t immediately return a call seeking comment on the lawsuit.

 

  BISMARCK, N.D. (AP) – North Dakota lawmakers have picked the subjects they will study as they prepare for the next session of the Legislature.
 
     The topics include agriculture, education, energy, election and human services issues.
 
     A total of 44 studies will be assigned to interim committees. The number and membership of the Legislature’s interim committees will be decided next month.
 
     The Legislative Management Committee chose the subjects during a meeting Wednesday. The council is a 17-member committee of lawmakers. Its chairman is Republican Sen. Raymon Holmberg of Grand Forks.

Jamestown  (CSi)  The James River Family Fitness Golf Tournament is set for this Saturday, May 30, 2015, at Jamestown Country Club.

JRFF Executive Director, Frank Conlon says the tourmament starts at 9-a.m.,  and will offer divisions for play,  and will have three divisions.  The entry fee is $50 per person.

Registration is in advance or the morning of the tournament.

R.M. Stoudt is offering a car for the golfer that has a hole-in-one, on the 4th hole.

 

MINNEAPOLIS (AP) – A city council member hopes renderings of a new Minneapolis city park in front of the Minnesota Vikings stadium will help jumpstart fundraising. 
 
   The  park will include a reflecting pool, gardens, a large green space, a cafe and children’s play areas. Landscape architects unveiled the first detailed renderings of their plan Wednesday.
 
     City Council Member Jacob Frey says it’s difficult to raise money before people can see what they are donating toward.
 
     A private nonprofit organization is leading the fundraising effort. It aims to raise about $20 million to build the park and support its operation.

 

EDEN PRAIRIE, Minn. (AP) – Minnesota Vikings coach Mike Zimmer says Adrian Peterson can either play for the Vikings or cannot play at all. The star running back has missed the first two days of optional team practices and is not expected to attend any of the optional workouts this summer. He has been upset with the team for a perceived lack of support while he faced a child abuse charge last season.

  OAKLAND, Calif. (AP) – The Golden State Warriors have reached the NBA Finals for the first time since 1975 by beating the Houston Rockets 104-90 last night. Stephen (STEH’-fehn) Curry overcame a poor shooting night to register 26 points, eight rebounds and six assists, while teammate Harrison Barnes scored 13 of his 24 points in the final period. James Harden had a terrible night for the Rockets, setting an NBA playoff record with 13 turnovers and scoring 14 points on just 2 of 11 shooting.

 CHICAGO (AP) – The Chicago Blackhawks beat the Ducks 5-2 last night to force a seventh game  in the NHL’s Western Conference finals Saturday at Anaheim. Andrew Shaw scored twice, Duncan Keith had three assists and Corey Crawford handled 30 shots as the Hawks staved off elimination. Brandon Saad (sahd), Marian Hossa (HOH’-sah) and Patrick Kane scored during a 3:45 span of the second period to put the Hawks ahead 3-0.
 The Ducks,  host the deciding game on Saturday.
 
     The New York Rangers will host the Tampa Bay Lightning in Game 7 of the Eastern Conference finals on Friday.

 LOS ANGELES (AP) – The Los Angeles Dodgers and Atlanta Braves have finally pulled off a trade that was initially nixed when infielder Alberto Callaspo (ky-AS’-poh) exercised a provision in the collective bargaining agreement. The Dodgers get Callaspo, lefty Eric Stults, southpaw Ian Thomas and right-hander Juan Jaime from the Braves for third baseman Juan Uribe (yoo-REE’-bay) and pitcher Chris Withrow. Callaspo finally agreed to the deal after rejecting it under a clause that allows a player to veto any trade on or before June 15th if he signed a free-agent contract the previous offseason.

 ZURICH (AP) – Law enforcement officials pulled FIFA (FEE’-fuh) executives from a luxury Swiss hotel yesterday to face racketeering charges, while regional offices in Miami were raided. Swiss officials also invaded FIFA headquarters, seizing records and computers to investigate whether the decisions to award World Cups to Russia and Qatar were rigged. The raids and charges are part of an attack spearheaded by the U.S. government, which accuses FIFA of deep-seated and brazen corruption in soccer’s global governing body.

 

FRENCH OPEN…

Two-time Wimbledon champion Petra Kvitova is through to the French Open third round.
 
     The fourth seed beat Silvia Soler-Espinosa, 6-7 (4), 6-4, 6-2.
 
     Kvitova was a semifinalist at the French in 2012.
 
     The 17th-seeded woman, Sara Errani, also advanced against Carina Witthoeft, winning 6-3, 4-6, 6-2.  Errani was a finalist at the French in 2012. 
 
 
     Thanks to his next opponent’s withdrawal, Japan’s Kei Nishikori is the first player to advance to the second week of the French Open – and he gets plenty of extra time for rest and preparation.
 
     The fifth-seeded Nishikori was supposed to play Benjamin Becker in the third round on Friday, but Becker pulled out of the tournament Thursday because of a muscle tear in his right shoulder.

 The French Open loses its fifth-seeded woman, with Caroline Wozniacki losing 6-4, 7-6 (4) in the second round.
 
     Her opponent, Julia Goerges, overcame the sniffles, frequently pulling out a tissue to wipe her red nose.

 In a matchup of past French Open champions on Court 1, Svetlana Kuznetsova has taken the first set from Francesca Schiavone in an epic tiebreaker than ended 13-11.

 HOUSTON (AP) – The waters of the San Jacinto (juh-SIN’-toh) River are expected to cover streets in suburban Houston today. Officials say residents who have not evacuated in subdivisions along the west fork of the river could be stranded for several days. Although Houston got a break from rains yesterday, officials are still warning about possible flooding. Residents in some 300 homes on the west side of Wharton also were asked to evacuate because of a rising Colorado River.  
 
     MOSCOW (AP) – Russian President Vladimir Putin says the United States is meddling in the affairs of soccer’s governing body FIFA (FEE’-fuh) in an attempt to take the 2018 World Cup away from his country. Putin says it’s “odd” that the corruption probe was launched at the request of U.S. officials for crimes which do not involve its citizens and did not happen in the United States.”    
 
     ATHENS, Greece (AP) – Greece says it hopes by Sunday to clinch a deal with creditors to get $8 billion more in rescue loans. A government spokesman says, “we are going into these negotiations with the aim to have a deal by Sunday.” Reports from Greece yesterday that a deal was near caused a market rally, but the optimism proved short-lived as key creditor states, like Germany, quickly warned that a final agreement remained elusive.       
 
     WARSAW, Poland (AP) – Polish authorities say they’re searching for a man who tangled with a bear at Warsaw’s zoo and escaped, leaving traces of his blood behind. Some blood was found Sunday outside the enclosure but it appears the man was not badly hurt and no local hospitals have reported treating him. The head of the animals of prey section at the Warsaw zoo says the stunt was “very dangerous” and “could have ended much worse.” A witness posted photos on the Internet showing the man in shorts and with bare feet hitting the animal. 
 
     NEW YORK (AP) – Amazon is offering free same-day delivery service in some cities to its Prime loyalty club members. Starting today, more than 1 million items including books, electronics and vacation gear will be eligible for same-day delivery in 14 metro areas including New York, Los Angeles, the San Francisco Bay Area, Philadelphia, Phoenix and Atlanta. Orders of more than $35 are eligible for the free service. They need to be placed by noon and will be delivered by 9 p.m. Orders under $35 will cost $5.99 for same-day delivery.
