Valley City CSi The Valley City Commission met in Regular Session Tuesday evening at City Hall. All members were present.

Mayor Werkhoven swore in  a police officer, Eric Triebold.

APPROVAL OF CONSENT AGENDA ITEMS INCLUDED:

Approving Monthly Reports from the Fire Chief, Building Inspector, Auditor, Municipal Judge and Public Works Accountant, Monthly Bills for the City and Public Works in the Amount of $ 2,888,047.50.

Also approved was a Bingo Permit for Barnes County Senior Citizens council, Inc., a Tree Trimming Permit for David Singleton, a Parade application and Blocking off Street application for VCHS Homecoming Parade on October 2, 4 p.m. and a new Plumbing License for TNT Plumbing.

ORDINANCES …

City Commissioners approved the first reading of an Ordinance rezoning property from I-2 to R-1,described as:

Section 1. That Section 2A of Ordinance No. 572 be amended to change the zoning of the following described real property, set forth below, from I-2, Heavy Industrial, to R-1, Single Family, legally described as a tract of land situated in Auditor’s Lot 1 in the Southeast Quarter of Section 30, in Township 140 North, Range 58 West of the 5th Principal Meridian, Barnes County, North Dakota, more particularly described as follows:

 

Commencing at the Southeast corner of said Southeast Quarter; thence N89º02’11″W along the south line of Southeast quarter a distance of 1076.31 feet to the southwesterly corner of said Auditor’s Lot 1, the point of beginning; thence N42º20’44″W along the westerly boundary of said Auditor’s Lot 1 a distance of 225.68 feet; thence S89º02’11″E parallel with said south line of Southeast Quarter a distance of 370.69 feet; thence S00º57’49″W a distance of 164.17 feet to said south line of the Southeast Quarter and Auditor’s Lot 1; thence N89º02’11″W along said south line a distance of 215.93 feet to the point of beginning.

City Attorney Myhre said planning and zoning has approved and recommends approval by the City Commission. The property is located southwest of Valley City, owned by Adam Paul, who plans to build a house on the property.

 

The City Commission approved the first reading of an Ordinance amending and reenacting Section 26-51.10of Article II, Chapter 26 of the revised ordinances of Valley City, ND, 1963 relating to Dedication of Tax Proceeds.

NEW BUSINESS

The City Commission approved awarding bid for a bucket truck for the electric department to Terex Hi-Ranger in the amount of $126,958. It’s a nine percent higher bid than the only other bid.

Administrator Schelkoph said the unit is better suited for its application. He said the cost is $45,000 under the projected cost.

Commissioners approved the updated Employee Policy and Procedure Manual.

The City Commission discussed a section of the Valley City Vehicular Driving Codes. Police Chief Thompson, asked that patrol vehicles use sirens along with emergency lights at all times.

Commissioners indicated a limited use of sirens, during times when traffic is light, such as between midnight and 6-a.m.

City Attorney Myhre said he favors minimizing liability to the city.

The Commission voted 4-1 to follow the North Dakota Century Code,  allowing sirens in the early morning hours,with Commissioner Luke voting in opposition.

 

City Commissioners approved deeding the Water Treatment Plant lime pit to the Park District.

CITY ADMINISTRATORS REPORT

With the Energy Efficient Campaign the city has purchased energy efficient LED light bulbs. The city in October will establish an educational campaign for residents to use energy efficient LED lights.

He said the plan by Barnes County Rural Water for modifications concerning lines is not opposed by the city.

CITY UPDATE & COMMISSION REPORTS

KLJ updated project reports, noting that VCSU students and staff have shown understanding in changes in the parking lot, and additional walking required with the construction of the permanent flood control walls in that area.

Jamestown (CSi) Jamestown Tourism Director, Searle Swedlund says, the arts has a significant economic impact on Jamestown and the area.

On Tuesday’s Wayne Byers Show on CSi Cable 2, he pointed out that the tourism Grant/Executive Board recent approved a request by the Jamestown Arts Center, to help fund a study on how the Art Center, impacts the area,in the amount of $2,750, or half the amount, for a study of the economic impact of the arts and culture on Jamestown.

The balance of the funds will come from the Americans for the Arts program.

Arts Center Director Cyndi Wish has said the North Dakota Council on the Arts is working with Americans for the Arts to do an economic Impact Study for North Dakota, which Jamestown’s will be a part of, separately. She said the Jamestown Arts Center will be cooperating with the organizations on the Jamestown Study.

Materials she supplied to tourism, said the study will assist the Jamestown Arts Center, with accurate data when making a case to local and state legislators in understanding how the arts drive tourism, support economic development, help attract and retain new residents, and provide jobs.

She added that understanding the impact of the arts in Jamestown could be very helpful in lobbying to get the Jamestown Arts Center’s City budget allocation increased, allowing for expanded programming which will continue to support Jamestown’s tourism.

Americans for the Arts will facilitate an evaluation process for the study.

The last study was done in 2007, and she said is outdated

Swedlund also pointed out the importance concerning tourism of the changes at the Jamestown Arts Park, downtown.

He said three groups last week visited Jamestown including an architect, artists and agencies, concerning proposals for the stage to be built at the Arts Park.

He indicated that community input on the new elements is important as the work at Arts Park goes on.

 

Jamestown (CSi) The Jamestown Area Chamber of Commerce, Jamestown Tourism, the University of Jamestown, and Tellwell will present sessions concerning using social media, web sites, and using tricks and tools.

Session One on September 30th, 2015 is about how to get started on social media, presented by Max, from Tellwell.

Session Two on October 7h is Website 101, presented by Margot from Tellwell.

Session Three on October 14th deals with pro tips, tricks and tools, with walk-throughs including Mailchimp, Canva, and Buffer.

All three session run from 10-a.m., to noon at locations at the University of Jamestown.

The cost is $30 for all three sessions and is open to everyone.

Valley City (CSi) Valley City State University is setting activities and events in recognition of the 125th Anniversary.

Highlights include VCSU President, Dr. Tisa Mason’s inauguration on Thursday, October 1, 2015 to coincide with the Homecoming festivities on October 2nd & 3rd.

The 125th celebration will be held October 13th to be held on the VCSU campus.

This coming fall, the inauguration of Tisa A. Mason, Ed.D., as Valley City

Homecoming weekend, which will include an all-Greek reunion and a Viking Hall of Fame reunion.

The weekend will also include the dedication of the Don Mugan Career and Technical Education Leadership Center, along with the traditional Homecoming parade, football game, and alumni social and dance.

The 125th celebration will culminate with a Founders Day Celebration on Oct. 13.

FARGO, N.D. (AP) – The North Dakota Supreme Court says a judge was wrong to order a state criminal investigator to pay a man for a payloader the agent confiscated and gave away because it was stolen.

Bureau of Criminal Investigation agent Arnie Rummel took possession of the loader in May 2014 from Forbes resident Darrell Schrum after an investigation determined the equipment was stolen. Schrum told authorities he didn’t know about the theft and bought the loader in good faith.

Southeast District Judge Daniel Narum declared Rummel to be in contempt of court for failing to meet a deadline to return the loader, and later ordered Rummel to pay Schrum nearly $54,000.

 The Supreme Court says the judge’s order did not comply with requirements for claims against the state.

 

 FARGO, N.D. (AP) – Fire caused an estimated $20,000 in damage to a Fargo business.
 
     Fire officials say the blaze at AutoZone started in a sign attached to the building, shortly before 8 a.m. Tuesday. Flames spread to the building’s roof, and firefighters had to remove part of the roof and a wall to make sure the blaze was completely extinguished.
 
     One firefighter suffered what officials said was a minor heat-related injury.
 
     The cause of the fire was not immediately determined.

 

  MINOT, N.D. (AP) – Police in Minot are investigating a shooting in which a 42-year-old woman was injured in the abdomen. Cpt. John Klug says authorities were called to the emergency room of Trinity Hospital Monday after the woman was brought in with a single gunshot wound. Klug says the woman was treated for non-life threatening injuries, but details of the shooting are unclear at this time.

 

 WILLISTON, N.D. (AP) – The Highway Patrol says a man operating a compacting machine in a construction zone on a Williams County road died in a mishap.
 
     Authorities say the 63-year-old man drove the vehicle too close to the edge of the roadway, and it slid into the ditch and rolled.
 
     The man died at the scene about 15 miles northwest of Williston, shortly after 6:30 p.m. Tuesday. He was not immediately identified.

 

 MINOT, N.D. (AP) – A California man has pleaded guilty to a murder conspiracy charge in a July 2013 shooting in Minot that authorities said involved members of a California gang.
 
     James Robinson agreed to plead guilty Tuesday in exchange for a nine-year prison sentence. Prosecutors dropped an attempted murder charge as part of the deal.
 
     Robinson and three other men were accused of traveling to Minot from Dickinson with plans to kill another man. Two of the other suspects are scheduled to be in court next week on conspiracy charges. The fourth pleaded guilty to a lesser charge.
 
     Investigators say the man who was shot was apparently not the intended target because the suspects had received an incorrect address. Christopher Docher was shot twice in the neck but survived.
 

  MINOT, N.D. (AP) – A man accused in a homicide in Minot a year ago is scheduled to stand trial in January.
 
     Court documents show that a nine-day trial beginning Jan. 11 has been scheduled for 38-year-old Anthony Campbell.
 
     He’s accused of killing 25-year-old Shannon Brunelle, who was found dead in a garage at an apartment building on Sept. 15, 2014. Campbell was arrested in Philadelphia on a murder warrant and an unrelated burglary warrant after a nine-week search.
 
     Campbell has pleaded not guilty to a murder charge that carries a maximum punishment of life in prison without parole.

 

 BISMARCK, N.D. (AP) – North Dakota’s Republican Lt. Gov. Drew Wrigley says he had an extramarital affair in the past and he is still considering running for the governor’s office.
 
     Wrigley spoke to The Associated Press on Tuesday with his wife at his side. It came hours after a left-leaning blog alluded to a “messy personal situation” involving Wrigley. But the Wrigleys said their decision to reveal the affair was their own.
 
     Wrigley has been weighing a bid to run for governor since Gov. Jack Dalrymple announced he wouldn’t seek another term. He told AP he’s still “actively considering” it.
 
     Wrigley said the affair is over and he had told Dalrymple about it shortly after he told his wife several months ago. Dalrymple’s spokesman said the governor continues to have faith in Wrigley.

 

 GRAND FORKS, N.D. (AP) – An official at the University of North Dakota has been placed on paid administrative leave following his arrest during a prostitution sting in Minnesota. Randall Bohlman is the university’s associate director of sustainability. He faces a misdemeanor charge of engaging in prostitution in Pope County, Minnesota.
 

 WILLISTON, N.D. (AP) – A Williston man is scheduled to enter pleas next month to numerous charges after a couple say they found him naked, drunk and sleeping in a laundry basket in their home.
 
     Forty-one-year Justin Halverson faces a felony count of burglary and four misdemeanors including assault. He could face more than 13 years in prison if convicted. Court documents do not list an attorney for him, and a home telephone listing could not be found.
 
     The  couple said they found Halverson in their home the night of Aug. 22. He allegedly punched the man who lives in the house before fleeing.
 
     Police say they found clothing and a cellphone belonging to Halverson in the home.

 

 MINOT, N.D. (AP) – The city of Minot this week is starting work on a two-year project to protect its water treatment plant from future floods. A ground-breaking ceremony is scheduled Thursday for the $25 million project. Most of the construction is being paid for with federal money. The plant is the only source of drinkable water for the city, Minot Air Force Base and many rural residents in the area.
 

 GRAND FORKS, N.D. (AP) – The head of a major unmanned aircraft systems company is making his second trip to North Dakota to tour area colleges and other facilities associated with drone development.
 
     Linden P. Blue is the CEO of General Atomics Aeronautical Systems, Inc., which has tentatively selected Grand Forks as a site to conduct unmanned aircraft pilot training.
 
     Blue’s visit on Wednesday is scheduled to include tours of the University of North Dakota, Lake Region State College, Northland Community and Technical College, Northern Plains UAS Test Site, Grand Forks Air Force Base and Grand Sky business park. Blue first came to the state in July.
 
     General Atomics is a leading manufacturer of unmanned aircraft, tactical reconnaissance radars and surveillance systems.
 
     Rep. Kevin Cramer of North Dakota is leading the tour.

 GRAND FORKS, N.D. (AP) – The University of North Dakota Student Senate wants “North Dakota” to be an option when people affiliated with the university vote on a new nickname for the school.
 
The student group passed a resolution over the weekend in favor of the option, despite university President Robert Kelley saying last week that it would not be included in the vote.
 
     Kelley says “North Dakota” is an identity that already exists – not a nickname. The five nickname options that will be voted on next month are Roughriders, North Stars, Fighting Hawks, Nodaks and Sundogs.
 
     Student Sen. Chase Johnson says “North Dakota” appears to be a popular candidate and should be considered.
 
     UND’s former nickname, “Fighting Sioux,” was deemed offensive by the NCAA and was dropped three years ago.

 

  BISMARCK, N.D. (AP) – North Dakota’s Game and Fish Department is asking grouse hunters to help with future bird management by sending in wing envelopes this fall.
 
     Instructions for submitting wing feathers are printed on envelopes that are available from Game and Fish and the agency’s district offices.
 
     Wing data allows biologists to monitor production, reconcile bird counts and get a better understanding of the harvest ratio of males to females, and juveniles to adults. Upland game biologist Aaron Robinson says, “the more we have, the better the data.”
 
     The grouse season opens Sept. 12.

 MINNEAPOLIS (AP) – The Minnesota Twins have added five players from Triple-A Rochester. Shortstop Danny Santana, first baseman Kennys Vargas, catcher Eric Fryer and right-handed relievers A.J. Achter and Michael Tonkin were added Tuesday. It was the first day teams could expand their active rosters past the 25-man limit.

 UNDATED (AP) – Kansas City Royals All-Star pitcher Kelvin Herrera and right fielder Alex Rios have been diagnosed with chickenpox and will likely miss a couple of weeks. Both players were sent home from Tampa Bay after experiencing symptoms over the weekend. The Royals have reached out to players, coaches and their families to determine whether anyone else has had chickenpox or may be at risk.

     EDEN PRAIRIE, Minn. (AP) – The Minnesota Vikings have waived quarterback Mike Kafka. Kafka was a fourth-round draft pick out of Northwestern by Philadelphia in 2010. He played in four games there in 2011 and spent last season with Tampa Bay.

 

NEW YORK (AP) – A New York judge had to deflate a rumor.  Judge Richard Berman reiterated Tuesday that he’ll rule by Friday whether New England Patriots quarterback Tom Brady must serve a four-game suspension. His order came out after an apparently new and bogus Twitter account with his photograph claimed he would rule Tuesday afternoon.
Berman will determine whether the NFL properly followed its collective bargaining agreement with players when it suspended Brady for his role in using underinflated footballs in the AFC championship game.

FOX LAKE, Ill. (AP) – Helicopters are helping in the search for three men wanted in the shooting death of a northern Illinois police officer. Fox Lake Police Lt. Charles Joseph Gliniewicz (GLIHN’-uh-wihtz) told dispatchers he was chasing three men on foot Tuesday morning. That’s the last he was heard from. Backup officers found him shot.
 
     BALTIMORE (AP) – A court hearing in the death of Freddie Gray will be held today in Baltimore. Prosecutors and defense attorneys for the six city police officers criminally charged will present arguments on three issues – whether State’s Attorney Marilyn Mosby should recuse herself, whether the officers should be tried together or separately, and whether the charges should be dismissed.      BUDAPEST, Hungary (AP) – Migrants, mostly from Syria, continue to arrive outside the main international train station in Budapest, Hungary. And some are protesting as police block them for a second day from boarding the trains to seek asylum in Germany and other wealthy countries in the European Union. Meanwhile, the Greek coast guard says it’s rescued more than 1,000 migrants in the Aegean Sea over the past 24 hours.
 
     NEW ORLEANS (AP) – Attorneys in Louisiana will ask federal appeals court today to block the release of longtime state inmate Albert Woodfox and allow prosecutors to try him a third time in the 1972 death of a prison guard. Woodfox is the last member of the group dubbed the “Angola Three” who’s still behind bars. A judge ordered Woodfox’s “immediate” release in June and barred a third trial for the 68-year-old.
 
     RALEIGH, N.C. (AP) – North Carolina officials will hold a hearing today on compensation for two brothers who were wrongfully imprisoned for three decades in the killing of an 11-year-old girl. Henry McCollum and Leon Brown were pardoned in June, and they’re qualified to each receive $750,000 from the state. The hearing is one of several steps that are largely considered formalities before the money can be paid.
